Holmes and Laski on natural law

Thesis (Ph.D.)--Boston University. / Using the two volumes of the Helmes-Laski Correspondence, published by Harvard and edited by Mark DeWolfe Howe, as one of its principal sources, this dissertation examines the circumstances leading up to the publication of Justice Oliver Wendell Holmes' essay, Natural Law in the Harvard Law Review in November, 1918, when Harold J. Laski was its editor. From this focus several lines of inquiry expand, developing from the two major questions of the dissertation: 1) What is Natural Law? and 2) How significant, profound and pertinent were Holmes' and Laski's contribution to the theory of Natural Law, the validity of which they denied? A last chapter examines the co-fusions in Laski's connecting together the plural sovereignty with the personality of associations theories -- ideas he apparently gathered from Otto Gierke. Gierke's position is analyzed directly from his writings, with the conclusion that he was unclear in his own formulations, and that Laski was even more unclear in what he thought Gierke said. Reasons for the vitiation of Laski's work are analyzed, and in summary his frustrations are stressed, while Holmes' great accomplishment within the framework of his own creative inconsistencies is forcefully stated. The conclusion of the whole is that no matter what they said they believed both Holmes and Laski lived and worked as though they believed in Natural Law.

Orientador: Ricardo Monteagudo / Banca: Jacira de Freiras / Banca: Cláudio Araújo Reis / Resumo: O objetivo da pesquisa é compreender o conceito de Lei Natural e Lei Civil na obra de Rousseau e analisar a possibilidade de uma relação entre estes dois conceitos e formação de uma concepção única de Lei. Porém, constatou-se que existe uma interseção e uma interdependência entre conceitos de Lei Natural e Lei Civil construído dentro de uma linearidade que se inicia no plano hipotético do Segundo Discurso e se concretiza no plano histórico do Contrato Social, mas não há possibilidade de formar um único conceito de Lei. Ou seja, a Lei Natural emerge no estado de natureza e pode ser definida como conjunto de princípios naturais compartilhados entre o homem e a natureza, dentre eles: amor de si, piedade e princípios naturais que distinguem os humanos e dos outros seres, a saber: liberdade e perfectibilidade. Tais princípios impulsionaram o homem, naturalmente solitário e sem noções de moralidade, a perfazer modificações em sua relação com a natureza no sentido de melhorar as condições de sobrevivência e gradativamente intensificar suas interações sociais, situação que, apesar de ter trazido ampliação consciência de si e do outro e o amadurecimento moral, acentuou a progressão da desigualdade que culminou num "estado de guerra" que é finalizado com o pacto social ou pacto dos ricos. Este institui "justiça" e o "direito", através de uma proposta de uma igualdade jurídica, que pode ser considerada uma expressão de maturação dos cidadãos no que se refere à concepção Lei. Porque esta, que até então, era um conjunto principiológico sem exigibilidade, passa, a partir do estabelecimento do contrato a ter força coercitiva que dará, diferentemente do pacto que é ato primitivo de natureza contratual, movimento e vontade ao corpo político. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The research is aimed to understand the concept of Natural Law and Civil Law in the work of Rousseau and to examine the possibility of a relationship between these two concepts and the formation of a single conception of Law. However, it was found that there is an intersection and interdependence between the concepts of Natural Law and Civil Law built inside a linearity that begins in the hypothetical plan of the Second Discourse and that is realized on the historical level of the Social Contract, but there is no possibility of forming a single concept of Law. That is, the Natural Law emerges in the state of nature and it can be defined as a set of natural principles shared between man and nature, among them: love of self, compassion and natural principles that distinguish humans and other beings, namely: freedom and perfectibility. Such principles drove the man, naturally lonely and without notions of morality, to make changes in his relationship with nature to improve the living conditions and gradually intensify his social interactions, a situation that, despite having brought expansion of his own conscience and self-awareness the other and moral maturity, highlighted the progression of inequality that culminated in a "state of war" that ends with the social pact or pact of the rich. It establishes "justice" and "right", through a proposal for a legal equality, which can be considered as an expression of citizen maturation regarding the Law conception. Until then, this was a logical principle set without enforceability and from the establishment of the contract it begins to have coercive force that, unlike the pact that is a primitive act of contractual nature, is going to give movement and will to the political body. Os estudos da obra de Hugo Grotius apontam a sua importância para a constituição de um conceito moderno de direito natural. A análise do conteúdo de suas principais obras políticas, De Jure Praedae Commentarius e De Jure Belli ac Pacis, permitiu a identificação de noções inspiradas no estoicismo e no ecletismo romano, principalmente de Sêneca e Cícero, sobretudo no que diz respeito ao direito natural. Além disso, a abordagem jusnaturalista do autor serve de base para fundamentar seus argumentos em defesa da possibilidade de se empreender uma guerra justa. Deste modo, uma análise do direito natural grociano requer a reflexão sobre estes dois aspectos. Com vistas a compreender a origem dos conceitos de lei natural e direito natural e as consequências que Grotius retira deles, a presente dissertação investigou a possível influência estoica e eclética na concepção de direito natural formulada por Groitus e o vínculo existente entre esta formulação e a teoria grociana da guerra e da pena. / Studies of Hugo Grotius\'s work suggest its relevance for the constitution of a modern concept of natural law. The analysis of the content of his main political works, De Jure Praedae Commentarius and De Jure Belli ac Pacis, opened space for the identification of concepts inspired by the Roman stoicism and eclecticism, specially from Seneca and Cicero, mainly regarding the natural law. Moreover, the author\'s jusnaturalistic approach serves as a base to support his arguments in defence of the possibility to wage a just war. Therefore, an analysis of the Grotian natural law requires a reflection upon these two aspects. Aiming at comprehending the origin of the concepts of natural law and natural rights and the consequences Grotius retrieves from them, the present dissertation investigates a possible stoic and eclectic infuence on the conception of natural rights formulated by Grotius and the link between this formulation and the Grotian\'s theory of war and punishment.

In this period of intellectual discussions about the New World, many theologians and jurists sought to establish guidelines about the indigenous people and the way of governing the Castilian crown. In the case of Vitoria, leader and master professor of the Salamanca University, solutions to the Indias problem were thought their colonization thomist theses, based on the practice of good government that administer justice to the common well of the “heathens” in order to ensure them in Spanish christian “civilization” and insert them into the corpora of the universal hierarchy morally ordered by eternal, divine, natural and positive human laws, which the natural laws are mediators of all justice and right of good government.

A crescente complexidade das relações intersubjetivas faz com que a criação e a forma de aplicação à norma jurídica evoluam superando a esfera da legalidade. Como parâmetro supralegal, destaca-se a formulação do direito natural em Aristóteles e Tomás de Aquino por fornecer características muito importantes para o panorama atual ao tratar da phronesis/prudentia e da mutabilidade da natureza humana. Tal formulação busca uma atitude pensada e adaptável às conjunturas sem descuidar dos princípios básicos atemporais e dos requisitos da razoabilidade prática definidos por Finnis. Nesse ínterim, a ideia de pré-compreensão em Gadamer, que afirma existir uma compreensão prévia funcionando como pressuposto subjetivo hermenêutico presidindo toda a compreensão, caso for adaptada ao direito, constata que, no processo de tomada da decisão jurídica, a ação interpretativa parte de um conjunto de conceitos e conhecimentos prévios, os quais, de certa forma sedimentados, possibilitam alcançar suas conclusões com um mínimo de previsibilidade. In the meantime, the idea of pre-understanding in Gadamer, who says there is a prior understanding working as hermeneutic subjective assumption presiding over all understanding, in case is adapted to the law, appear that, in making the legal decision to the interpretive action as a part of a set concepts and prior knowledge, which somehow sedimented, reaching its conclusions with a minimum of predictability. The thought of Finnis about natural law, based on practical reasonableness and the construction of a philosophical hermeneutics as Gadamer, lead us to believe in the possibility of an ethical foundation for hermeneutics and to the right, without forgetting the contingent and temporary nature of their understanding and application of structures.
