Termination of the confederated tribes of the Grand Ronde community of Oregon: Politics, community, identity

Search the library catalog for the location and call number. / In 1954, one hundred years after the western Oregon Indians were removed to the Grand Ronde Reservation; the antecedent peoples were subjected to the final effort by the United States to colonize the remainder of their lands through Federal termination policy. The permanent Grand Ronde Reservation, settled in 1855 and established by presidential executive order in 1857, was terminated by Congress, and the tribal people lost their Federal recognition. The seven ratified treaties that ceded to the United States millions of acres of land, most of western Oregon, which was occupied by over 60 tribal nations, were nullified. These 60 tribes were declared by Congress to be assimilated, and termination was enacted to free them from continued government management and oppression. In western Oregon, native people appeared to cease to exist, and for 29 years the Grand Ronde descendants suffered disenfranchisement and a multitude of social problems. The reservation's tribal cultures, languages, and community were severely fractured and much was lost. Terminated tribal members were rejected by other tribes as having willingly sold out to the Federal government. During the post-termination era, despite all of the problems the tribal members faced, they found ways to survive and worked to restore the tribe. In 1983, the Grand Ronde Tribe was restored. This research gathers disparate information from political, anthropological, historical, and tribal sources to analyze and understand the termination of the Grand Ronde Reservation. Revealed are the many political issues of the 1940s and 1950s that contributed to termination. Oral histories and government correspondence and reports from the era are referenced to illuminate the reality of tribal life in the post-termination era. The research connects to historic strategies of the Federal government to colonize all aboriginal lands and to assimilate Indians. Finally, this study seeks to unveil the history of the Grand Ronde Reservation and its peoples so that the tribal people may understand and recover from the effects of the termination of the tribe. The continued effects of termination are explored, discussed, and connected to issues of tribal identity and indigenous decolonization. / Adviser: Lynn Stephen

Le tristement célèbre Ecran Bleu de la Mort de Windows introduit bien le problème traité. Ce bug est souvent causé par la non-terminaison d'un pilote matériel : le programme s'exécute infiniment, bloquant ainsi toutes les ressources qu'il s'est approprié pour effectuer ses calculs. Cette thèse développe des techniques qui permettent de décider, préalablement à l'exécution, la terminaison d'un programme donné pour l'ensemble des valeurs possibles de ses paramètres en entrée. En particulier, nous nous intéressons aux programmes qui manipulent des nombres flottants. Ces nombres sont omniprésents dans les processeurs actuels et sont utilisés par pratiquement tous les développeurs informatiques. Pourtant, ils sont souvent mal compris et, de fait, source de bugs. En effet, les calculs flottants sont entachés d'erreurs, inhérentes au fait qu'ils sont effectués avec une mémoire finie. Par exemple, bien que vraie dans les réels, l'égalité 0.2 + 0.3 = 0.5 est fausse dans les flottants. Non gérées correctement, ces erreurs peuvent amener à des évènements catastrophiques, tel l'incident du missile Patriot qui a fait 28 morts. Les théories que nous développons sont illustrées, et mises à l'épreuve par des extraits de codes issus de programmes largement répandus. Notamment, nous avons pu exhiber des bugs de terminaisons dues à des calculs flottants incorrects dans certains paquets de la distribution Ubuntu. / The infamous Blue Screen of Death of Windows appropriately introduces the problem at hand. This bug is often caused by a non-terminating device driver: the program runs infinitely, blocking in the process all the resources it allocated for its calculations. This thesis develops techniques that allow to decide, before runtime,termination of a given program for any possible value ​​of its inputs. In particular, we are interested in programs that manipulate floating-point numbers. These numbers are ubiquitous in current processors andare used by nearly all software developers. Yet, they are often misunderstood and, hence, source of bugs.Indeed, floating-point computations are tainted with errors. This is because they are performed within a finite amount of memory. For example, although true in the reals, the equality 0.2 + 0.3 = 0.5 is false in the floats. Not handled properly, these errors can lead to catastrophic events,such as the Patriot missile incident that killed 28 people. The theories we develop are illustrated, and put to the test, by code snippets taken from widely used programs. Notably, we were able to exhibit termination bugs due toincorrect floating-point computations in some packages of the Ubuntu distribution.

Réalisation de périphéries innovantes de TRIAC par thermomigration d'aluminium et insertion de silicium poreux / Realization of TRIAC's innovative peripheries via aluminum thermomigration and insertion of porous silicon

Cette thèse est dédiée à l’étude, à la réalisation et à la caractérisation de nouvelles périphéries de TRIAC. L’objet de cette recherche est de réduire l’espace occupé par la périphérie en tentant de conserver le même niveau de performances au blocage. Deux voies d’amélioration ont été poursuivies : l’une concerne la réalisation de caissons d’isolation par thermomigration d’aluminium, l’autre implique l’intégration du silicium poreux dans le caisson d’isolation. La thermomigration d’aluminium est une technique attractive permettant de remplacer les techniques de diffusion conventionnelles. Son industrialisation subit cependant quelques verrous technologiques, notamment le retrait des résidus aluminés et la formation de billes. Deux procédés de gravure ont été développés en vue d’enlever sélectivement l’ensemble de résidus. L’origine des billes a été analysée à l’aide d’observations expérimentales et de modélisations numériques. En utilisant un motif incluant des trous carrés aux intersections, des résultats encourageants ont été démontrés malgré une uniformité thermique encore optimisable. La deuxième voie d’innovation consiste à profiter des propriétés diélectriques du silicium poreux. Un procédé de masquage par fluoropolymère a été développé pour la localisation du silicium poreux. Les conditions d’anodisation adéquates ont été déterminées. La caractérisation de prototypes a montré des tenues au blocage largement améliorées par rapport à l’étude précédente. Bien que les tenues en tension nécessaires n’aient pas été atteintes, des courants de fuite inférieures à 10 μA ont été constatés jusqu’à plusieurs centaines de volts. / This thesis is dedicated to the study, the realization and the testing of “Planar” type TRIAC with novel peripheries. The aim of this research is to shrink the device periphery while maintaining the same level of blocking performances. Two paths of innovation have been pursued: one concerning Al-Si thermomigration for the production of through-wafer isolation walls, and the other involving porous silicon and its integration in the isolation walls. Al-Si thermomigration is an attractive mean allowing to replace conventional diffusion technologies. However, several remaining issues, such as the removal of the unintentional residues and the ball formation phenomenon, block its commercial application. Two different etching procedures have been developed in order to selectively remove all residues. The origin of the ball phenomenon has been analyzed using experimental observations and numerical modeling. By using a new pattern including square holes at intersections, encouraging results have been demonstrated in spite of an optimizable thermal uniformity. The second way of innovation is to take advantage of the dielectric properties of the porous silicon. A fluoropolymer masking process has been developed for local porous silicon formation. The appropriate anodization conditions have been determined. The characterization results showed improved blocking performances compared to the previous study. Although the necessary voltage requirements are not met, leakage currents of less than 10 μA have been observed up to several hundred volts.

Aditivos orgânicos para bovinos confinados com dietas de alto concentrado / Organic additives for cattle fed high concentrate diets

As restrições impostas a utilização de antibióticos como aditivos alimentares para bovinos têm estimulado a busca por tecnologias alternativas. Nesse sentido, foram conduzidos dois experimentos com o objetivo de avaliar o efeito de diferentes aditivos alimentares orgânicos e antibióticos sobre o desempenho, metabolismo ruminal, características de carcaça e qualidade da carne de bovinos Nelore confinados recebendo dietas com alta proporção de concentrado. As dietas continham 85% de concentrado e 15% de volumoso e os aditivos correspondentes aos tratamentos, sendo eles: 1) Aditivo orgânico (Fator P®) (A0), 2) Aditivo orgânico + Monensina sódica (AO+M), 3) Aditivo orgânico + enzimas amilolíticas (AO+E), 4) Monensina sódica + Virginiamicia (M+V). No experimento 1, 45 tourinhos da raça Nelore com 24 meses de idade e peso médio inicial de 373±32 kg, foram alojados em 4 baias coletivas equipadas com portões eletrônicos, para controle individual da alimentação, em um delineamento em blocos casualizados (peso inicial). Durante o confinamento foram analisadas as características de desempenho e de carcaça por ultrassonografia. Após 88 dias de confinamento os animais foram abatidos e analisadas características de carcaça, qualidade da carne e teste sensorial de aceitação pelo consumidor. No experimento 2 foram utilizados 8 novilhos da raça Nelore, com cânulas ruminais em um delineamento em quadrado latino 4 x 4 duplicado, com quatro tratamentos e 4 períodos de 21 dias, sendo realizadas análises de degradabilidade, pH ruminal e ácidos graxos de cadeia curta (AGCC). As características de desempenho, bem como as variáveis de degradabilidade ruminal não foram influenciadas pelos diferentes aditivos. O tratamento M+V apresentou maior pH ruminal (P<0,05), enquanto os tratamentos AO+M e AO+E apresentaram maiores concentrações de ácido acético e do total de AGCC (P<0,05). Maiores concentrações de ácido butírico foram encontrados nos tratamentos AO e AO+M (P<0,05). Os tratamentos não influenciaram o peso de carcaça quente, rendimento de carcaça, área de olho de lombo, pH da carcaça 24h após o abate, cor e lipídios totais. O tratamento M+V apresentou maior EGSU enquanto o tratamento AO+E apresentou menor EGPU (P<0,05) em relação aos demais. O tratamento AO apresentou menor perda por cocção em relação aos demais (P<0,05), sendo observado maiores escores de suculência para os tratamentos AO, AO+M e AO+E (P<0,05) e maiores escores de textura e qualidade global para os tratamentos AO e AO+M (P<0,05). O uso de aditivos orgânicos pode ser uma alternativa ao uso dos antibióticos tradicionais na terminação de bovinos confinados com dietas com alta proporção de concentrado, sem alterar os níveis produtivos, sugerindo possível melhora na aceitação pelo consumidor. / The restrictions applied for the use of antibiotics with feed additives for cattle have stimulated the search for alternative technologies. In this sense, two experiments were conducted to evaluate the effect of different organic food additives and antibiotics on performance, ruminal metabolism, carcass characteristics and meat quality of feedlot Nellore cattle fed high concentrate diet. The diets contained 85% of concentrate and 15% of corn silage and additives corresponding to each treatment: 1) Organic additive (AO), 2) Organic additive + Monensin sodium (AO+M), 3) Organic additive + amylolytic enzymes (AO+E), 4) Monensin sodium + Virginiamycin (M+V). In the experiment 1, 45 Nellore steers with 24 months of age and initial body weight of 373 ± 32 kg were allotted in four collective pens equipped with electronic gates for individual control of feeding in a randomized complete block design. During the feedlot, animal performance and carcass characteristics were analyzed by ultrasonography. After 88 days of feedlot, the steers were slaughtered and carcass characteristics, meat quality and sensorial acceptance test by the consumer were analyzed. In the experiment 2, eight Nellore steers with ruminal cannulas were used in a 4 x 4 duplicate Latin square design, with four treatments and four periods of 21 days. Degradability, ruminal pH and short chain fatty acids (AGCC) were evaluated. The different additives did not influence the performance characteristics, as well as, the ruminal degradability variables. The M+V treatment had higher ruminal pH (P<0.05), whereas AO+M and AO+E treatments had higher concentrations of acetic acid and total AGCC (P<0.05). Higher concentrations of butyric acid were found in AO and AO + M treatments (P<0.05). The treatments did not influence hot carcass weight, carcass yield, ribeye area, carcass pH 24h after slaughter, color nor total lipids. The M+V treatment showed higher EGSU while the AO + E treatment presented lower EGPU (P <0.05) when compared with others. The AO treatment presented lower cooking loss (P<0.05), with higher succulence scores for AO, AO+M and AO+E treatments (P<0.05), and higher texture and quality scores for AO and AO+M treatments (P<0.05). The use of organic additives can be an alternative to the use of traditional antibiotics in finishing cattle fed high concentrate diets without affecting the production levels, suggesting possible improvement in consumer acceptance.

The aim of this thesis is to describe the current legal regulations of covenant not to compete in the Czech Republic and the USA - particularly in the states of New York and California, to refer to the advantages and disadvantages of these regulations and to think if these very different regulations could inspire each other in some areas. I decided to write half of the thesis about covenant not to compete in the USA because of my study experience in American law school where I understood more closely the common law system of law and because I did not find any Czech article which would write about this topic in the USA and I wanted to fill in this blank space. This thesis is devided into three parts. The first chapter is dedicated to the current wording of covenant not to compete in the Czech Republic. In the particular subchapters there are described the constitutional roots of covenant not to compete, which activities can be banned by the covenant not to compete, which information the employee must have acquired, with what types of employess the covenant can be entered into and in what area scope, what is the maximum time period during which the employee can be banned, what compensation the employer has to pay to the employee and how the covenant can be terminated. Amongst these questions the basic necessities of the lease agreement that are required by the law are described first, then the mutual rights and obligations of the contracting parties and finally the matters related to the termination of the lease.

Les gènes IMA (Inhibitor of Meristem Activity) et MIF2 (MIni zinc Finger 2) codent des protéines de la famille des « MIni zinc Finger » impliquées dans le développement et la réponse hormonale. Leur fonction est intimement liée à leur capacité d’interaction avec des protéines partenaires au travers de leur unique domaine, un doigt de zinc non-canonique. La génération et la caractérisation de plantes gain- et perte-de-fonction pour ces gènes chez Solanum lycopersicum et Arabidopsis thaliana nous a permis de mettre en évidence leur homologie fonctionnelle dans le mécanisme d’arrêt de la prolifération des cellules souches méristématiques : la terminaison florale. Au cours du développement floral précoce, leur expression est induite par le facteur de transcription à MADS-BOX AGAMOUS. Les protéines codées sont capables d’intéragir avec le facteur de transcription à doigt de zinc C2H2 KNUCKLES (KNU) et de recruter le co-facteur TOPLESS (TPL) ainsi que l’HISTONE DEACETYLASE19 (HDA19) pour former un complexe multimérique impliqué dans le remodelage de la chromatine. Ce complexe intervient ensuite afin de réprimer l’expression du régulateur majeur de la prolifération des cellules souches méristématiques WUSCHEL. Les travaux qui ont suivi ont permis de montrer qu’au-delà de leur intervention dans ce processus, les protéines IMA et MIF2 sont impliquées d’une manière plus générale dans le développement floral et l’organogenèse. Leur fonction de protéine adaptatrice est sans doute permise par le désordre intrinsèque qui les caractérise et qui leur permettrait une spécificité d’interaction avec divers partenaires protéiques. / IMA (Inhibitor of Meristem Activity) and MIF2 (MIni zinc Finger 2) are two members of the MIni zinc Finger family (MIF) involved in the regulation of floral development and hormonal signaling pathways. Their ability to control physiological events is linked to their unique domain, a non canonical zinc finger, which confers to MIF the capacity to interact with other proteins. The characterization of gain- and loss-of-function lines for these genes in Solanum lycopersicum and Arabidopsis thaliana allowed us to unravel their functional homology in the termination of floral stem cell maintenance. During early floral development, IMA and MIF2 gene expression is induced by the MADS-Box transcription factor AGAMOUS. Then, IMA and MIF2 proteins recruit the C2H2 zinc finger KNUCKLES (KNU), in a transcriptional repressor complex together with TOPLESS (TPL) and HISTONE DEACETYLASE19 (HDA19). This complex binds to the WUSCHEL (WUS) locus leading to WUS repression via a chromatin deacetylation mechanism. Further work allowed us to demonstrate that IMA and MIF2 play a wider role in floral development and organogenesis. Their function as adaptor protein is probably linked to their intrinsic disorder leading to structural flexibility and interaction specificity with a large range of partners.

High-throughput experimental and computational studies of bacterial evolution

The work in this thesis is concerned with the study of bacterial adaptation on short and long timescales. In the first section, consisting of three chapters, I describe a recently developed high-throughput technology for probing gene function, transposon-insertion sequencing, and its application to the study of functional differences between two important human pathogens, Salmonella enterica subspecies enterica serovars Typhi and Typhimurium. In a first study, I use transposon-insertion sequencing to probe differences in gene requirements during growth on rich laboratory media, revealing differences in serovar requirements for genes involved in iron-utilization and cell-surface structure biogenesis, as well as in requirements for non-coding RNA. In a second study I more directly probe the genomic features responsible for differences in serovar pathogenicity by analyzing transposon-insertion sequencing data produced following a two hour infection of human macrophage, revealing large differences in the selective pressures felt by these two closely related serovars in the same environment. The second section, consisting of two chapters, uses statistical models of sequence variation, i.e. covariance models, to examine the evolution of intrinsic termination across the bacterial kingdom. A first collaborative study provides background and motivation in the form of a method for identifying Rho-independent terminators using covariance models built from deep alignments of experimentally-verified terminators from Escherichia coli and Bacillus subtilis. In the course of the development of this method I discovered a novel putative intrinsic terminator in Mycobacterium tuberculosis. In the final chapter, I extend this approach to de novo discovery of intrinsic termination motifs across the bacterial phylogeny. I present evidence for lineage-specific variations in canonical Rho-independent terminator composition, as well as discover seven non-canonical putative termination motifs. Using a collection of publicly available RNA-seq datasets, I provide evidence for the function of some of these elements as bona fide transcriptional attenuators.

Právní a ekonomické aspekty skončení pracovního poměru / Legal and economic aspects of termination

This thesis focuses on the institute termination of employment from the legal and economic point of view. From a legal perspective, it is mainly about the presentation of the most common ways of termination of employment, including acquainting the reader with a steady legal interpretation. From a microeconomic point of view, the termination of employment relates to the consequences for employers and employees and from a macroeconomic perspective, with consequences for the whole society. This is followed by a practical part which connects the foregoing and the current example of OKD Inc., which employs nearly 10 thousand employees and currently finds itself in serious financial difficulties, the state estimates the costs associated with the mass redundancies at different alternatives. These variants are bankruptcy or reorganization provided financial assistance to the state. At the conclusion of the two calculations are compared and outlines a list of partial measures to mitigate the effects of similar events in the future.
