La performativité du langage constitutionnel / The performativity of constitutional language

Depuis Austin et ses travaux sur les énoncés performatifs, il est d’acception commune que le langage ne sert plus seulement à décrire une réalité mais aussi à agir, à créer sa propre réalité. Si le droit est d’abord un langage avant d’être une norme, cette dernière dépendrait, tant dans sa nature que dans sa force, d'une faculté spécifique de son énonciation. Tel est le point de départ de l’étude sur la performativité du langage constitutionnel, une performativité qui en ferait un langage spécifique, pour un droit singulier. Sa particularité viendrait ainsi d’un acte de langage qui serait propre au dire constituant, un dire créateur d’un état de chose qui ne tiendrait son existence que de lui. Cette capacité créatrice du langage fait apparaître le langage constitutionnel comme un langage qui constitue un monde, un ordre juridique, plutôt qu’il le régulerait. La norme constitutionnelle se présente comme une norme qui n’est pas comme les autres, chargée d’une normativité atypique. C’est ici l’apport de la distinction searlienne entre les règles constitutive et normative. La règle constitutionnelle se singularise donc in fine vis-à-vis de la règle inférieure par sa dimension constitutive, indépassable, intransgressable, que le juge constitutionnel accepte et entretient à travers sa jurisprudence. / Since Austin and his work on performative sentences, it has been commonly accepted that language is no longer used only to describe a real fact, but also to act and create one’s own reality. If law is first and foremost a language before being a norm, the latter is likely to depend, both in its nature and its force, upon specific speech production. Such is the starting point of the research on the performativity of the constitutional language, a kind of performativity which can be regarded as language-specific for a particular type of law. Thus, its specificity may come from a speech act proper to constitutional statements and creating a situation which may only exist by it. This creative capacity of language shows the constitutional language as a language which constitutes a world, not simply to control it, but rather to order it legally. The constitutional norm appears to be a different one, full of atypical normativeness. This appertains to Searle’s distinction between constitutive and normative rules. In fine, the constitutional rule, therefore, calls attention to the inferior rule by its constitutive, impassable, and unbreakable dimension which the constitutional judge accepts and maintains through his jurisprudence.

The aim of this study is to describe how sex eduacation, as an area of expertise, is made visible and constructed in dance teachers education in Swedish higher secondary school. The queer theory describes dance teachers’ work from a perspective of body, sexuality, gender and normativity. Using qualitative methods, leaving space for reflection and subjective experiences, four higher secondary school working dance teachers were interviewed. The findings include that sexual education as an area of expertise exists both consciously and unconsciously in dance education and the subject of dance. Furthermore, the informants do not understand sexuality as something important in teaching dance, in spite of that sexuality as a subject is present in the discussions. The result of the study proved that norms about sexuality, body and gender cooperate with the dance education and the dance teachers daily encounters with their students. The most important conclusion in the study was that dance teachers should have an understanding of how sexual education as an area of expertise can be expressed through dance teaching to be able to encounter students with an including education.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / Esta pesquisa tematiza o conceito saúde na perspectiva dos modelos médicos vitalistas, situando-se no eixo da dimensão doutrina médica das Racionalidades Médicas, e tem como objeto de estudo os vitalismos de Hahnemann e Nietzsche. A partir do levantamento e análise bibliográfica de textos e da abordagem disciplinar histórica e filosófica, teve como objetivos analisar os conceitos de vida, saúde, doença e cura presentes nos pensamentos desses autores, traçar correspondências e explicitar as diferenças dos pensamentos envolvidos. Como apoios teóricos os trabalhos de Canguilhem, Luz e Foucault. Partindo da ênfase na atitude vital do sujeito em seu processo de saúde-doença-convalescença-cura, que ambos pensadores destacam, buscou-se avaliar as hipóteses de o vitalismo hahnemanniano se assemelhar ao nietzscheano e se seria possível afirmar que a busca da grande saúde equivaleria à meta do tratamento homeopático ao contemplar a liberdade do espírito na conquista da ampliação da normatividade vital. Concluiu-se que os vitalismos de Hahnemann e Nietzsche são semelhantes na medida em que as bases de seus pensamentos ressaltam a vida enquanto um jogo de forças e luta, onde enfatizam a irredutibilidade dos fenômenos dos vivos às propriedades físico-químicas; a concepção dos seres humanos como totalidades únicas e singulares nas quais há um jogo de forças atuantes, promovendo diferentes saúdes no mesmo indivíduo, de acordo com as variadas fases da vida; e as hierarquias existentes entre as forças, resultando em análises diagnósticas, possibilidades de intervenção terapêutica e acompanhamento do processo saúde-doença. Correspondem a formas de olhar a vida humana de modo dinâmico, valorizando todos os aspectos físicos, mentais, emocionais e as interações/relações com o meio em que vive. From the survey and literature review of texts and the historical and philosophical disciplinary approach, it aimed at analyzing the concepts of life, health, disease and cure in the thoughts of these authors, drawing connections and explaining the differences of thoughts involved. The theoretical support were the works of Canguilhem, Luz and Foucault. Starting from the emphasis on the vital attitude of the subject in the health-disease-convalescence-healing process, that both thinkers emphasize, we sought to assess the idea that Hahnemanns vitalism resembles Nietzsches, and whether it is possible to say that the pursuit of big health would the goal of homeopathic treatment to address the freedom of spirit in achieving the expansion of the vital normativeness. It was concluded that Hahnemanns and Nietzsches vitalisms are similar in that the foundations of their thoughts emphasize life as a game of power and control, which emphasize the irreducibility of the phenomena of living beings to physical and chemical properties; the design of human beings as unique and singular wholes in which there is a set of interacting forces, promoting different types of health in the same individual, according to the varied stages of life and the hierarchies between the forces resulting in diagnostic tests, opportunities for therapeutic intervention and monitoring of the health-disease process. They correspond to ways of looking at life in a dynamic manner, valuing all physical, mental, emotional aspects and interactions/relations with the environment in which they live. The great health to a spirit that becomes what it is it expands the ideal of homeopathic cure by helping reframe the concept of health as expanding the normativity of life and life as value creation, promoting shifts in individual and collective perspectives, to conquer a living and happier life and affirming the free spirit. Both thoughts can promote significant revaluation of the concept of life and health in contemporary society and medicine, focusing on values statistically determined, generalizing and standardization of individuals of the paradigm normal/pathologic

Shari'a Commercial Law : "old wine in new bottles?"

Suite à la crise financière globale de 2008, ainsi qu’aux différents facteurs qui y ont mené, il est étonnant qu’une alternative éthique et juste pour une finance lucrative et stable n’existe toujours pas (ou du moins, demeure oubliée). Ayant décidé de contribuer au domaine pluri-centenaire du Droit Commercial de la Chari’a, nous avons été surpris par la découverte d’une problématique à l’origine de cette thèse. En France, nous avons suivi des débats doctrinaux intéressants dont les conclusions se rapprochent de la perception générale Occidentale quand à la nature de la finance Islamique, que ce soit au niveau de la finance basée sur le Droit de la Chari’a ou encore les exigences de sa pleine introduction dans le système juridique français de l’époque. Cet intérêt initial dans la finance islamique a ensuite mené à un intérêt dans la question des avantages d’éthique et de justice du Droit Commercial de la Chari’a dans son ensemble, qui est au coeur de cette thèse. Dans le monde moderne du commerce et de la finance d’aujourd’hui, les transactions sont marquées par une prise de risque excessive et un esprit de spéculation qui s’apparente aux jeux de hasard, et menant à des pertes colossales. Pire encore, ces pertes sont ensuite transférées à la collectivité. Par conséquent, y at-il des préceptes, des principes ou des règles éthiques et juridiques qui peuvent fournir une certaine forme de sécurité et de protection dans les marchés financiers d'aujourd'hui? Est-ce réalisable? Cette thèse soutient que la richesse de la jurisprudence islamique ainsi que ses règles dont les avantages n’ont pas encore été pleinement saisis et régénérés en réponse aux nouveaux défis d’aujourd'hui, peuvent encore fournir continuellement des solutions, et réformer des produits financiers de façon à refléter des principes de justice et d'équité. Dans ce processus, un éclairage nouveau sera apporté à certains sujets déjà connus dans le cadre de la contribution prévue de cette thèse, mais ne sera pas le principal objectif de la thèse. / Following the 2008 global financial meltdown and the various reasons that lead to it, it seemed inconceivable that no ethical and justice-driven alternative for highly lucrative and stable financing existed, or at the very least forgotten about. Deciding to contribute to the already centuries old and continuously developing domain of Shari’a Commercial law, we were first caught by surprise when we discovered one particular problem that sparked the start of this thesis. In France, we encountered interesting debates and doctrinal findings resembling a general and common western perception of the legal nature of Islamic Finance, being Shari’a Commercial law based financing, and the requirements for its full introduction into the French legal system at the time. This initial interest in Islamic Finance then evoked an interest in the ethical and justice driven gems of Shari’a Commercial law as a whole, and as the subject of this thesis. In today’s modern and global commercial and financial world, transactions are shrouded by excessive risk-taking and speculation akin to gambling, rendering at times colossal damages. To make matters worse, those damages are dislodged onto the public. Therefore, are there any ethical and legal precepts, principles and rules that may provide some form of a safety and social net in today’s financial markets? Is this achievable? This thesis argues that the richness of Islamic jurisprudence and its rules that have not had their benefits fully reaped and regenerated in response to new challenges till today, may still continuously provide solutions, as well as provide reforms to financial products, which exemplify justice and fairness. Within the process, new light will be shed on certain already known topics as part of the intended contribution of this thesis, but will not be the main objective of the thesis.
