Legal and ethical aspects of nursing practice in selected private hospitals in the Western Cape Metropolitan Area

Dorse, Aletta Jacomina 03 1900 (has links)
Thesis (NCur (Nursing Science))--University of Stellenbosch, 2008. / The current shortage of nurses has reached crisis proportions in South Africa and the effects of decreased numbers of health professionals are enormous. This results in far-reaching consequences for the health industry. An increased use of less-skilled personnel, in an attempt to meet the health care needs, impacts negatively on quality care. Personnel are often utilised outside their scope of practice, creating a high-risk therapeutic environment for the patients and health care workers alike. Consequently, the nursing managers and employers of nurses are currently faced with major challenges in ensuring that the nurses practise their profession within a safe and healthy environment, and within the legal and ethical framework of the nursing profession. For the purpose of this study the researcher decided to explore legal and ethical aspects influencing the clinical practice of the nurse. Specific objectives were set for the study. • Are nurses functioning outside their scope of practice? • Do nurses exercise their nursing right? • Do nurses function within ethical and legal guidelines? • Do caregivers function as nurses? • Do nurses still believe in the nursing philosophy? • Are nurses exploited in their area of work? • How much overtime do nurses work? These objectives were met through an in-depth explorative descriptive research design with a quantitative approach to explore legal and ethical aspects in the nursing practice. A stratified sample was drawn of all categories of nurses in selected private hospitals in the Western Cape Metropolitan area. Through the use of a questionnaire, data was collected personally by the researcher. Data analysis techniques that were used were based on descriptive and explorative procedures. Data was compressed in frequencies, percentages, means and standard deviations. The Chi-square test was applied. Findings include the following: • 53% of enrolled nursing assistants do not function under indirect supervision. • 40% of caregivers assist nurses with interventional nursing care. • Nurses still believe in the philosophy of the nursing profession. • The nurse’s rights are in contradiction with the patient’s rights (p = 0.08). • Nurses feel exploited in certain areas of work, depending on their qualifications. • Nurses do recommend the profession (p = 0.043). • Enrolled nursing assistants do not respect other religions (p = 0.04). • Nurses feel free to discuss the patient’s progress with the doctor depending on the nurses’ years of experience (p = 0.03). • 23% of nurses love to care for their patients. Recommendations were made based on the findings. • The patient approach should be respectful, not judgemental, accepting the patient’s right to self-autonomy. • Nurses should realise their autonomous role in addressing concerns. • A staff mix should be utilised that facilitates safe and professional nursing care. • Unfavourable or unsociable working conditions in some units such as the theatre should be addressed. • Managers should match the work load with a proper skills mix and competency. • Nursing practice should take place within the professional and statutory scope of practice of the nurse. • Nurses should keep up to date with knowledge through continuous professional development. • Caregivers should be regulated, installing the nursing philosophy and ethics into their practice.

Exploring the experiences of enrolled nurses regarding quality nursing care in general nursing units in the private healthcare setting

Haakestad, Andrea 12 1900 (has links)
Thesis (MCurr)--Stellenbosch University, 2014. / ENGLISH ABSTRACT: In South Africa, currently enrolled nurses make up the largest proportion of members of the nursing healthcare team. As in direct contact with patients it is essential that the practice environment supports patient and nursing outcomes. Studies confirm the complexity of the practice environment and the impact on both personnel and on the quality of nursing care provided. Job satisfaction is integrally linked to the quality and safety of care provided. The scarcity of registered professional nurses, particularly in the South African context, has resulted in enrolled nurses being widely used to continue to deliver acute care in quite complex situations. It is well documented that the use of suboptimal nursing personnel levels or substituting enrolled nurses for registered professional nurses is associated with an increase of adverse events such as infections, pressure ulcers and unanticipated death. The purpose of this study was to explore the experiences of enrolled nurses regarding quality nursing care in general nursing units in the private healthcare setting. The objectives being: - The exploration of the enrolled nurses understanding of the concept of quality care - The exploration of the enrolled nurses understanding of her value and contribution to quality care and - The exploration of the enrolled nurses experiences (positive and negative) of quality nursing care in private health care setting A descriptive qualitative methodology was applied. A purposive sample size of n=13 was drawn from the total population of N=387. An exploratory interview was completed. Lincoln and Guba’s criteria of credibility, transferability, dependability and confirmability were applied and ethical principles were met. Findings demonstrated that enrolled nurses experienced both positive and negative work experiences, some more negative than others. They had a very good understanding of quality care but had difficulty in reconciling the patient’s needs with what they were able to deliver, due to workload pressures and resource constraints: P6: “I miss the quality because that patient that needs just that back rub or just to hold his hand ...the thing is with quality nursing we don’t do quality nursing on the patient anymore.” Most participants experienced registered professional nurses absolving their clinical supervisory responsibility. This endangers the quality and duty of care of patients and is a legal liability. A recommendation is that registered professional nurses require professional development through utilising good role models. This exposure to positive learning experiences will enable their professional development and ethical behaviour. Registered professional nurses need to be taught the skills of how to be team players. ’n Beskrywende, kwalitatiewe metodologie is toegepas. ’n Voortoets is voltooi.

The extent to which registered nurses in the ACT state that they use physical assessment skills as a basis for nursing practice

James, Jennifer Ann, n/a January 1988 (has links)
The purpose of this research was to discover the extent to which practising registered nurses in the ACT undertake physical assessment. It was also organized to discover the perceived reasons why, in appropriate instances, it was not undertaken and the extent to which certain variables may have influenced its practice or non-practice. It was directed also at discovering the extent to which the practising registered nurse would be prepared to undertake workshops on the subject, so that, if appropriate, a core of registered nurses could be provided to act as the role-models and to create the necessary learning environment in the ACT hospitals and agencies where most of the Canberra College's graduates would find employment. Since the first undergraduate course in nursing was introduced in the tertiary sector, nurse academics have placed significant emphasis on the teaching of the nursing process. It is within the first phase of this process, the assessment phase, that the physical assessment of the patient/client is conducted. Discussions with practising registered nurses and observations, led to some uncertainty as to the extent to which physical assessment was actually being used. A review of the literature showed that no investigation of the matter had been reported in the Australian literature. It was, therefore, proposed to make good this deficiency and to resolve any uncertainty about the extent of use of physical assessment in the ACT. This study was restricted to registered nurses in the ACT where all beginning nurses are educated at the CCAE with a curriculum which includes a comprehensive study of physical assessment. Even so, it is recognized that such studies will only reach a beginning level of competency. In order to ensure that the graduates of these courses extend their competency in physical assessment they need to be able to use these skills in every day nursing practice. This research, therefore, was conducted using a questionnaire which incorporated questions about the use of 36 physical assessment skills. The survey, on a onetime participation basis, was conducted for all registered nurses rostered on a fortnightly period in April 1987. A 66.7% response rate was achieved. The responses were analyzed and the findings, results and recommendations are included in the appropriate sections of this thesis.

Cultural issues in the understanding of ethics in the nursing profession : implications for practice.

Gambu, Sibongile Qhakazile. January 2000 (has links)
The study explored moral and ethical dilemmas experienced by Black nurses in a local community clinic. In particular, it examined the influences of the concept of self or personhood in nurses' ethical and moral decision-making. Influences of culture and family on morality were also investigated. Using the interview methodology developed by Gilligan (1982), nurses were asked to tell stories involving moral dilemmas in their work. Interviews were analysed using the voicecentred relational method. This method involves reading the interview narratives a number of times, each reading focusing on a particular aspect of a respondent's narrative. Results show that nurses often find themselves caught between two opposing moral and ethical viewpoints in their practices. On the one hand are hospital procedures, which are informed by universalist approaches to the person and the moral. From these are derived ethical principles emphasizing individual autonomy and choice. On the other hand, the majority of patients subscribe to a communal view . ofpersonhood. From this perspective, to be moral entails knowing one's position and responsibilities within family and community. Dilemmas arose from nurses' identification with patients' moral perspectives while realizing that this could lead to "unethical" conduct, (given , their training and current codes of ethics). It is recommended that moral and ethical deiiberations should dialogue with alternative, marginalised, viewpoints, in order to be culturally responsive. It is further recommended that ethics be conceptualised as a practical-moral engagement, rather than a detached application of knowledge. / Thesis (M.Soc.Sc.)-University of Natal, Pietermaritzburg, 2000.

Te Arawhata o Aorua, Bridging two worlds: a grounded theory study : a thesis presented in partial fulfillment of the requirements for the degree of Masters of Philosophy in Nursing at Massey University (Albany), New Zealand

Baker, Maria January 2008 (has links)
Te Arawhata o Aorua – Bridge of two worlds is a theory about Maori mental health nurses. The aim of this study was to explore what was occurring amongst Maori mental health nurses and dual competencies. A grounded theory informed by a Maori centred research approach was adopted and conducted with three focus groups of ten Maori mental health nurses situated in one metropolitan and two provincial cities. The research design was informed by Mason Durie?s Maori centred concepts of whakapiki tangata (enablement), whakatuia (integration) mana Maori (control) and integrated with grounded theory to guide the collection and analysis of the data. Audio taping and field notes were used to collect the data and the processes of constant comparative analysis, theoretical sampling and saturation were used to generate a middle range substantive Maori centred grounded theory. One core category was identified as two worlds which describes the main issue that they are grappling with. The basic social psychological process of bridging of tension explains how the two worlds are managed through two subcategories of going beyond and practising differently. Going beyond consists of two components, being Maori and enduring constant challenge that set the philosophical foundation to practice. Practising differently describes three key components as kaitiaki of wairua, it?s about whanau and connecting each are blended into each other and fused into nursing practice. The impressions of the Maori mental health nurses have been interpreted and explained by this theory. The substantive grounded theory provides a model to guide health services appreciation of Maori mental health nurses, for professional development of Maori mental health nurses and to policy writers.

A enfermagem no espelho: suas concepções sobre a profissão, a formação, a prática profissional e as especialidades / Nursing in the mirror: his views on the profession, training, professional practice and specialties

Elaine Franco dos Santos 18 May 2010 (has links)
This study aims to reflect Nursing in the mirror, based on the concepts about Nursing specialities and the profession itself, the formation and professional practice, according to the Revista Brasileira de Enfermagem (2003). There was a first investigative phase, but field work was not satisfactory since questions were not fully answered nor explanantion on the professional performance and attributions of specialized nurses were given. Then a descriptive study was developed, a qualitative approach with a bibliographical review based on the content analysis method. So the general objective of this study is to introduce images Nursing reflects in the mirror, starting with an overview of the profession and its specilities and the scond image is based on Nursings own concepts on the profession, on the formation and on professional practice, according to the Revista Brasileira de Enfermagem (2003). The specific objectives are: to describe the main viewpoints on the professions characteristics, on the process of formation and professional practice, contextualizing the specialities scenario based on these overviews. Among the main results of the study, we point out the ellaboration of a general overview of Nursing in Brazil and its specialities, and of four analysis categories: what is the Nursing profession; professional formation; professional practice; and Nursing under construction. It seems that Nursing has two different reflections in this mirror, which do not talk to each other. The first image reflected in the mirror is Nursing trying to define professional specialities concerned with technical improvement searching for self-assertion in a more specific and selective labor market. The second image is Nursing in search of its destiny as science, so it reflects upon, examines and debates on healthcare and theories which systematize this care. The point is that one reflection is very different from the other, what creates a distorted image about the profession.

No. of bitstreams: 1 ArquivoTotalDanielle.pdf: 2339944 bytes, checksum: 6aefddd9f1aef957f495757889371da1 (MD5) Previous issue date: 2013-05-18 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / Introduction: The care is inherent to human beings since the beginning of mankind. Inserted in the complex process of providing nursing care to surgical patients, fits the role of the nurse, which requires use of a body of knowledge in search of answers to solving the phenomena, considered as health aspects relevant to nursing practice. Nurses need to worry about creating strategies to ensure that patients and their families receive adequate information about the surgery and about the care that must be performed at home. We stress the importance of building a terminological Subset that includes terms related to diagnoses / outcomes and nursing actions to promote the use of a common language and at the same time, integrate scientific knowledge with practical knowledge of the rofession. Objective: Structure a terminological subset of ICNP® for hospitalized patients undergoing prostatectomy, based on theoretical basic human needs identified by Horta. Methodology: This is a methodological research, which ere adopted in some of the steps recommended by the International Council of Nurses. Before its completion, the research project was registered on the Platform Brazil's Ministry of Health and approved by the Research Ethics Committee, receiving the assent under CAAE 00866812.1.0000.5188. The research was conducted in the Surgical Clinic of the University Lauro Wanderley / UFPB, located in the city of João Pessoa / PB. The study population was comprised of nurses and faculty in the Department of Clinical Nursing (DENC), Technical School of Nursing and UFPB HULW / UFPB, working in the area of Surgery. The research was conducted in three stages: 1) Mapping of affirmative diagnoses / outcomes and nursing interventions with the concepts pre-combined diagnostics / outcomes and nursing interventions contained in the ICNP® Version 2011, 2) Validation of affirmative diagnostic / outcomes and nursing interventions developed for hospitalized patients undergoing prostatectomy and mapped with the ICNP®2011, and 3) Structuring the terminological subset of ICNP ® prostatectomy for customers, based on theoretical basic human needs of Horta. Results: We obtained 39 statements in mapping diagnostics / results nursing developed for customers who underwent prostatectomy, which when crossed with the concepts of the ICNP ® 2011, 20 were classified as affirmative equal to ICNP®; 12 as similar to ICNP®; 2 as the most comprehensive classification, 2 narrower and 3 as there is no agreement. Of the 158 claims of nursing interventions categorized and mapped with the ICNP®2011, were obtained: 61 equal interventions, 20 Similar to the statements of ICNP®, 55 more comprehensive interventions, 19 affirmative stricter and 3 interventions there were no agreement with the ICNP®. In the process of validating the content of the 39 nursing diagnoses, 25 diagnoses (64.1%) had a CI greater than or equal to 0.80, 4 (10.26%) with CI 1.00, 5 (12.82 %) 0.93 HF and 16 (41.02%) HF between 0.80 and 0.86, and 14 diagnoses (35.9%) reached the IC equal to or smaller than 0.79. The structuring of terminological subset contained significance for Nursing, the theoretical model used, based on human needs of Horta, and the relationship of the statements of 33 diagnoses / outcomes of nursing and 206 nursing interventions distributed, according to the theoretical model. Final Thoughts:This terminological subset of ICNP ® for clients undergoing prostatectomy aims to contribute to improving professional practice, providing safe care and quality, and contribute to the development of a standardized language.

Pozice sestry - mentorky v kolektivu sester, spolupráce se směnnými sestrami / The mentor position within in the nursing team, and her the cooperation with the shift nurses.

MAŘÍKOVÁ, Václava January 2010 (has links)
Abstract This diploma thesis deals with the position of nursing mentor and her cooperation with shift nurses. The theoretical part of the thesis is divided into seven chapters, and focuses on the current nursing profession that is also interconnected with education and legislature. The work is further dealing with the role of the nursing mentor and her cooperation with the nursing team. Last but not least, the theoretical part is devoted to the important role of ethics and morality in the nursing profession that is undoubtedly of central importance. We are also addressing the Certified Course for Mentors that we regard as rather positive as one of the forms of lifelong education. The nurses completing the course will acquire new skills and knowledge, but also knowledge in the field of psychology, law, didactics and other fields. The role of a nurse-mentor is rather important as she can pass the acquired knowledge further and positively influence the students in this way over the course of professional training facilitating their adaptation when they start their professional career. It was the main objective of this work to map the current position of a nurse? mentor, what her experience is with cooperation with other shift nurses as part of practical education in the workplace, and whether the nurses direct and sufficiently motivate the students to become interested in the profession of general nurses or midwifes. The section on research employed two methods. The first method consisted in quantitative research in the form of questionnaires. We employed two questionnaires, one targeted the nurses-non-mentors, while the second was intended for nurses-mentors. As a second method, qualitative research was carried out using semi-structured interview conducted with selected head and ward (charge) nurses. Using the qualitative survey approach, we tested the following working hypotheses. H1: the general nurses know what the role of a nurse-mentor is in the health-care team, H2: the nurses-mentors motivate their students to raise their interest in the profession of general nurse, H3: the nurses-mentors are not always occupying leading positions, H4: the nurses-mentors are perceived positively by the shift nurses,
