Om betalningen stannar / When the payment system stops

Betalsystemet är en av de viktigaste delarna vi har i den finansiella infrastrukturen, störningar i systemet skulle snabbt kunna leda till allvarliga konsekvenser för både individen, företagen och samhället i stort. Syftet med studien är att ge inblick i hur beredskapen ser ut idag, att hantera dessa störningar. Vidare syftar studien till att reda i vilka åtgärder som behövs för att säkerställa betalsystemets funktion vid en allvarlig störning, där digitala betalmetoder inte är fungerande. För att utföra studien har en kvalitativ metod använts, underlaget för studien har varit intervjuer med sju sakkunniga personer från Finansinspektionen, Riksbanken, Swedbank, Bankomat AB, Regeringskansliet, MSB och Bankgirot. Detta i kombination med relevant teori. Av resultatet kan vi se att genom att skapa en starkare motståndskraft och bättre förmåga för systemen att återhämta sig, blir samhället mer förberett på hanteringen av en framtida kris. Vidare framgår det att samhället inte skulle klara av ett längre avbrott i betalsystemet i dagsläget. Det blir också tydligt att bristande rutiner och en oklar fördelning av ansvaret leder till ett instabilt betalsystem i ett krisläge. Det är oklart vem som står för kostnaderna, om aktörer och myndigheter behöver rusta upp sina system, men detta förväntas bli tydligare i samband med ny kommande lagstiftning. För att säkerställa ett fungerande betalsystem både i ett krisläge och i ett normalläge, behövs ett mer robust system, med tydligare rutiner och ansvarsfördelning. / The payment system is one of the most important functions in our society’s financial infrastructure. Disruptions in the system would rapidly lead to serious consequences for individuals, businesses, and society as a whole. The purpose of the thesis is to provide a better understanding of what the emergency preparedness process looks like in dealing with mentioned disruptions, what actions are needed, and how the different actors address the issue and what risks society faces in the event of prolonged interruptions in the payment system. The study was conducted using a qualitative method, with interviews with seven experts from Finansinspektionen, Riksbanken, Swedbank, Bankomat AB, Government Offices of Sweden, The Swedish Civil Contingencies Agency and Bankgirot as the primary foundation and combining this with the relevant theory. Conclusions that can be drawn are that by strengthening the resilience and preparing society we give our systems a better ability to recover from a future crisis in our payment systems. Furthermore, that the society would not manage to retain control of the payment system in case of extensive disruption. It also became clear that insufficient routines and an indistinct division of responsibilities, lead to an unstable payment system in the event of a crisis. At this time, it is not clear who would pay the costs, if actors and authorities need to enhance their payment systems, but this uncertainty is intended to diminish with forthcoming new legislation. To ensure a functioning payment system in both a crisis and a normal situation, a sturdier system is required, with adequate routines and a division of responsibilities.

Title of the Diploma Thesis Bank account Abstract The first part of the thesis deals with the account from the perspective of legal theory. It is examined the nature, characteristic elements and brief historical development. Following an analysis of the account as an object of property rights. In the chapter Legislation of the account under the Civil Code the thesis provides an analysis of provisions that affect the obligations of the account agreement. A part of this chapter is dedicated to a division of accounts under the existing scheme of the Civil Code. Regulation of other than a payment account and bankbook will be mentioned only in passing. Furthermore, the work deals with the analysis of rights and obligations being performed in relation to the provision of payment services, comprehensively regulated by the Payment System Act. Due to the fact, that the form of the Payment System Act has been significantly influenced by the european legislation, the thesis reflects, in appropriate cases, to the wording of the so-called Payment Services Directive. The final part describes fundamental changes in the provision of payment services going in connection with the adoption of the Directive 2014/92/EU of the European Parliament and of the Council of 23 July 2014 on the comparability of fees related to payment...

Cizojazyčné resumé The thesis is dedicated to the matter of a bank account. The bank account is considered to be a financial product that serves for depositing of temporarilly free financial funds and primarily for realizing cashless payment system. The aim of this thesis is to provide an analysis of current applicable and effective legislation considering the bank account in Civil Code, where newly contained the bank account legislation as a result of recodification of private law. In some sections of the thesis the analysis of the legislation is accomplished in the context of the antecedent legislation in former Commercial Code. The thesis is divided into seven chapters. The first chapter is dedicated to analyse the basis of the bank account from the point of view of legal doctrine. The second chapter provides fundamental legal charakteristic of bank account contract. This chapter describes the bank account contract as banking contract and focuses on the bank account contract from the point of view of consumer law. This chapter also provides analysis of parties of the bank account agreement. The end of the chapter discusses the general charakterization of banking terms and conditions. Nos últimos anos, tem-se observado um aumento significativo no volume de transações financeiras realizadas pela Internet. Esse crescimento no volume financeiro, associado à fragilidade inerente à ausência de verificações básicas, possíveis somente em transações do mundo físico, tem atraído a atenção de pessoas com o objetivo de obter vantagens financeiras de forma ilícita. Devido aos prejuízos causados pelas fraudes, surgiram empresas de pagamento online com o objetivo de tornar as transações de compra e venda na Internet mais seguras. Essas empresas atuam como um intermediário das transações e assumem os riscos associados, mostrando-se ser esse um negócio de alto risco. Dado o alto volume de transações com as quais essas empresas precisam lidar, torna-se clara a necessidade de métodos computacionais para detecção de transações fraudulentas, visto que a utilização estrita de verificações manuais é inviável para lidar com tal volume de transações. Essa tarefa de análise e identificação de transações fraudulentas pode ser vista como um problema computacional de classificação, sendo então aplicáveis técnicas de classificação, aprendizado computacional e mineração de dados. Porém, dada a complexidade do problema, a aplicação de técnicas computacionais só é possível após um profundo entendimento do problema e a definição de uma modelagem eficiente associada a um processo consistente e abrangente, capaz de lidar com todas as etapas necessárias para a análise eficiente de uma transação. Face a isso, o presente trabalho propõe uma abordagem abrangente para tratar o problema da fraude nesse novo mercado de intermediação de pagamentos online utilizando como base um processo já muito bem estabelecido na indústria. Abordaremos mais especificamente uma das fases desse processo, que se refere justamente a utilização de ferramentas computacionais para a detecção das fraudes, e apresentaremos um sub-processo que envolve a utilização de várias ferramentas para o tratamento do ponto de vista computacional do problema de detecção de fraudes. Para a validação dos resultados da proposta, utilizaremos uma enorme quantidade de dados reais disponibilizados por uma grande empresa do setor de intermediação de pagamentos online que colaborou com nossa pesquisa. / In recent years, there has been a significant increase in the volume of electronic transactions in the Web. This growth in trading volume, associated with the risks caused by the absence of basic checks, possible only in transactions of the physical world, has attracted the attention of people with the intention of taking advantage to obtain illicit financial benefits. Due to the injuries caused by fraud, online payment service companies emerged, with the goal of making Web transactions safer. These companies act as an intermediary between buyers and sellers, assuming all the risks, and so it is clear that it is a high-risk business. Given the high volume of transactions with which these companies must deal, it is clear the need for computational methods for detecting fraudulent transactions, as the strict use of manual checks is infeasible to handle such a volume. The task of analysis and identification of fraudulent transactions can be seen as a classification problem, and so classification, data mining and machine learning techniques can be applied to it. However, given the complexity of the problem, the application of computational techniques is only possible after a thorough understanding of the problem and the definition of an efficient model, associated with a consistent and comprehensive process which would be able to handle all the steps needed to analyze a transaction in an efficient way. Given this scenario, this work proposes a comprehensive approach to address the problem of fraud in this new business of online payment intermediation, using as basis a process already established in the industry. We will discuss more specifically one of the phases of this process, which refers to the use of computational tools to detect frauds, and we will present a sub-process using several tools to deal with the problem from a computational point of view. The above specified aim should be reached by closer investigation of both contracts and analysis of their purpose, characteristic and applicable legislation. Since these contracts play an important role within today's society and became very common, this topic should be interesting and current. Blockchain at the European Level Abstract The objective of this master thesis is to provide a basic overview of the blockchain technology, its features and its potential utilization, including an overview of European legal regulations that might be applicable to the technology, under certain conditions. In the first chapter, the master's thesis sets forth the legal framework of the EU primary law that establishes or can establish the EU's competence to act in the matters of blockchain technology, depending on its legal qualification (especially in the context of the internal market - namely the free movement of services and capital). The second and third chapters provide essential description of features of blockchain and cryptocurrency and related services. A more detailed description is provided in Annexes I-IV of this thesis. Further, the legal status and applicable regulation of cryptocurrencies are assessed at the European and national levels and in terms of other global jurisdictions. I takt med att Internethandeln ökar och fler och fler använder smartphones, introduceras alternativa betallösningar på marknaden. En betalmetod som redan är etablerad är SMS-betalning. Med tanke på detta borde inte steget till att använda mobilbetalningstjänster i fysisk butik vara så stort. Syftet med denna uppsats är att undersöka de huvudfaktorer som påverkar användandet av mobilbetalningstjänster i fysiska butiker. Det huvudsakliga perspektivet ligger på användarna av tjänsterna, snarare än de butiker som erbjuder dem. Både kvalitativa och kvantitativa metoder har användt. Resultaten är baserade på data från en enkätundersökning, intervjuer och användartester. En intressant upptäckt från enkätundersökningen var att även fast människor har erfarenhet av SMS-betalning så verkar det som att få har vetskap om att mobilbetalningstjänster i fysisk butik existerar och därför inte börjat använda dem. I denna studie presenteras någa förslag på faktorer som kan tas i beaktande för att öka kunskapen och användarfrekvensen. De viktigaste faktorerna tycks vara uppfattad nytta, ekonomiska fördelar, uppfattade risker, standardisering och förenlighet med mäniskors existerande beteendemönser. / As Internet shopping increases and more and more people use smartphones, alternative payment solutions are introduced to the market. One payment method that is already established is SMS payment. Given these developments, mobile payment services in physical stores ought not be far from being adopted. The purpose of this essay is to examine the key factors that influence the use of mobile payment services in physical stores. The main focus is the perspective of the users of the services rather than the stores offering them. Both qualitative and quantitative methods have been applied. The results are based on data from a survey, interviews and usability tests. One interesting survey finding was that even though people have first-hand experience of SMS payment it seems that few people have knowledge of mobile payment services in physical stores, and therefore not adopted them. To increase the knowledge and adopting rate a suggestion of factors that can be taken into consideration is introduced in the study. The most important factors seem to be perceived usefulness, economic advantage, perceived risks, standardization and reconcilability with existing behavioural patterns.
