Lease and ownership of non-residential premises Resumé The objective of my thesis is to describe in detail the current lease (sublease), and ownership of non-residential premises as well as their expected changes in the new Civil Code. Within my thesis I branch out into several chapters in which I try to provide a comprehensive view on the legal legislation of the concepts of a lease, sublease and ownership. I have analysed these terms and referred to the current as well as previous judgments where the legislation appears to be ambiguous, notably judgments delivered by the Supreme Court. Chapter One is introductory and defines basic terminology used in the thesis, non- residential premises. Chapter Two is subdivided into parts which I dedicated to lease of non residential premises. This part of my work is devoted to a brief historical overview and current legislation of lease of non-residential premises most notably in view of selected parts of the Act No. 116/1990 Coll, and Act No. 40/1964 Coll. It provides an outline about creation of lease, particulars of the contract, rights and obligations of the lease and termination of lease. The subject of this thesis is the lease and sublease of non-residential premises amended by Czech law. The thesis clarifies the term "non-residential premises" in general as well as particular meaning. Hereafter is the thesis focused on the creation of the lease of non- residential premises, the essential elements of the lease agreement of non-residential premises, rights and obligations of landlords and tenants, especially the issue of handover of non- residential premises, maintenance and repair of non-residential premises, revisal of the premises by the landlord and securing and providing the services by the landlord. The thesis deals in detail with possibilities and conditions for termination of the lease. In order to assure better orientation of the reader the creation, content and termination of sublease are handled separately from the lease of non-residential premises in detached chapter. In addition the thesis aims to outline the conceivable contractual arrangements of presentive institutes appearing in the lease agreement. Unannounced on site inspections in competition The purpose of my thesis is to analyse unannounced on site inspections in the competition law with regards to the Czech and European Union legal system. The thesis is composed of six chapters. Chapter one is introductory and defines the aims of the thesis. Chapter Two briefly discusses the basic legal framework of this area of law. Chapter Three is subdivided into six subchapters and sets out the competence of competition authorities including the cooperation within the European Competition Network. Chapter Four consists of two parts and concentrates on problems resulting from specific administrative proceedings before the Office for the Protection of Competition. Syftet med arbetet är att kartlägga hur en organisation arbetar med tillgänglighet för anställda med ett funktionshinder, samt vilka eventuella hinder organisationen stöter på i förbättringen av tillgängligheten inom organisationen. Studien är en kvalitativ undersökning där vi gjorde sju enskilda intervjuer med olika personer inom organisationen. Vi intervjuade personer inom organisationen som var chefer och arbetar med arbetsmiljö och tillgänglighet samt även medarbetare. Vi fick även möjlighet till att intervjua ett par personer med funktionshinder. Resultatet visade att tillgängligheten är mycket god inom organisationen. Däremot finns det områden i byggnaden som behövs förbättras och som inte är tillgänglig för alla funktionshindrade. Cheferna inom organisationen jobbar med att uppdatera sig själva angående tillgänglighet genom informationsmöten, tidsskrifter, mail och så vidare men framförallt genom eget ansvar. Däremot noterade vi att kommunikationen mellan chefer och medarbetare ibland inte är tillräcklig för att arbetet med att förbättra tillgängligheten på arbetsplatsen ska kunna utvecklas. Resultatet visar också att delaktigheten ibland har sina brister då medarbetarna inte lämnar information om förbättringar som organisationen skulle kunna göra. / The purpose of this work is to identify how the organization works to improve accessibility for its employees who have a disability, as well as any obstacles the organization may encounter in the improvement of accessibility within their organization. This work is a qualitative study where seven different individuals within the organization were interviewed. Some of those interviewed are in managerial positions who manage work accessibility issues, and some of the employees had disabilities. The results showed that accessibility is very good within the organization. However, there are areas within the building where improvments are needed, for example, not all areas are accessible for those with a disability. The heads of the organization are working to update themselves regarding accessibility through information meetings, magazines and email, but above all by their own responsibility. However, we noted that communication between managers and employees are sometimes not sufficient enough to improve accessibility in the workplace. Employee participation could also improve, for example, faster results could be achieved if employees ‘spoke out’ more reguarlarly in regards to accessibility issues.

The aim of this thesis is to describe and analyse the inviolability of diplomatic mission premises, as it is one of the basic principles of diplomatic law. The thesis examines the contents of this term, deals with its historical development and contemplates the unsolved questions related to the inviolability of mission premises. It presents a range of cases of violation or abuse of the inviolability of mission premises in the past as well as at the present time and at the end it tries to find out to what extent the current regulation of this institution in international law corresponds to the actual state practice. The thesis is based on international law regulations, theoretical approaches and description of the past experience of individual countries.

Service delivery costan alysis of IoT platforms

Internet of things (IoT) which was once a vision is now reality in many sectors. Platform in the IoT ecosystem plays an important role in service provisioning journey by creating business value for the actors and enabling data management for the user. Service provisioning on IoT platform are application centric and is more focused on vertical development. Amalgamation of services, applications in IoT platform is the key in bringing data and society together. Interoperability and scalability is posing as hindrance for this hypothesis. On high level, identifying the cost drivers in these IoT platforms can be key for an actor to bring this hypothesis to reality. This work is one such attempt in providing cost breakdown and identifying cost drivers in IoT platform. A generic framework is proposed which dimensions the platform hardware and software to apprehend the design, development and operation cost of services considered. The framework is designed to proffer three deployment cloud strategies, On-premises, Infrastructure as a Service (IaaS) and Platform as a Service (PaaS). Three business use cases are tested on this framework to arrive at the cost structure, which in turn states the cost drivers. The results suggest storage, hardware replacement and software development are major chunk of cost in the structure driven by devices/sensors in the platform and message transmission rate from those devices. Additionally, a suggestion of deployment strategies are made on each use cases to avail cost efficient services. / Internet of Things (IoT) som en gång var en vision är nu verklighet i många sektorer. Plattformen i IoT-ekosystemet spelar en viktig roll i researrangemanget genom att skapa affärsvärde för aktörerna och möjliggöra datahantering för användaren. Tjänsteleverantörer på IoT-plattformen är applikationscentriska och är mer fokuserade på vertikal utveckling. Sammanslagning av tjänster, applikationer i IoT-plattformen är nyckeln till att föra data och samhället samman. Interoperabilitet och skalbarhet utgör hinder för denna hypotes. På hög nivå kan identifiering av kostnadsdrivarna i dessa IoT-plattformar vara nyckeln för en aktör för att få denna hypotes till verklighet. Detta arbete är ett sådant försök att tillhandahålla kostnadsfördelning och identifiera kostnadsdrivare i IoT-plattformen. Ett generiskt ramverk föreslås som dimensionerar plattformshårdvaran och programvaran för att fånga konstruktions-, utvecklingsoch driftkostnaderna för betraktade tjänster. Ramverket är utformat för att erbjuda tre implementeringsmolnstrategier, lokala, infrastruktur som en tjänst (IaaS) och plattform som en tjänst (PaaS). Tre fall för affärsanvändning testas enligt denna ram för att komma fram till kostnadsstrukturen, vilket i sin tur anger kostnadsdrivarna. Resultaten tyder på att lagring, hårdvarutbyte och mjukvaruutveckling är en stor del av kostnaden i strukturen som drivs av enheter / sensorer i plattformen och överföringshastighet för meddelanden från dessa enheter. Dessutom görs ett förslag om distributionsstrategier för varje användningsfall för att utnyttja kostnadseffektiva tjänster.

BECOMING EFFECTIVE Summary: The purpose of my thesis is to analyse the legal consequence of the Act. No. 89/2012 Coll., the Civil Code, as amended (the "Civil Code"), coming into effectiveness in the Czech Republic on 1 January 2014, with regards to lease agreements on lease of non-residential premises (re-defined by the Civil Code as premises for business purposes). The reason for this analysis is the fact that, as a result of the Civil Code becoming effective, all the lease relationships, including lease relationships under lease agreement concluded prior to 1 January 2014 shall be governed by the Civil Code. Given that the introduction of the Civil Code represents full recodification of the civil law in the Czech Republic, the related changes concerning the lease agreements on lease of premises for business purposes are of significant character. Accordingly, the thesis is mainly addressed to the parties to the existing lease agreements on premises for business purposes concluded on 31 December 2013 or earlier, even though it may be found of use for other addressees as well. Multicultural diversity and OBE practices : a case study of the Harrismith region / Lawrence Laudonn Nyamane

The crucial issue in the new democratic South Africa was to change the type of education system that was based on social discrimination to one which is non- discriminatory, unbiased and accessible to all South Africans. However, to teach in a multicultural society and being faced with the challenge of teaching multicultural diverse classes, within an OBE paradigm, demands special knowledge, skills and attributes of teachers. Therefore, this study intended to investigate teachers’ OBE practices in multicultural classrooms in order to determine the strengths and weaknesses that could be useful for the improvement of teaching and learning within multicultural contexts. The study was approached from a socio-reconstructivist point of view and focused specifically on schools in the Harrismith region. The purpose of this study was thus to explore and come to a better understanding of how teachers’ OBE practices accommodate multicultural diverse learners in the Harrismith region. In order to direct the study towards the intended purpose, a literature study was undertaken to define multicultural diversity and to conceptualize OBE practices in order to operationalize the concept within the context of the study. The empirical research was done by following a qualitative research design in the form of a case study. Semi-structured, individual interviews and observations were used as data collection instruments. Interviews were conducted with teachers teaching Grade 8 and 9 learners as well as learners from the same grades, of five purposefully selected schools in the Harrismith region. By using maximal variation sampling, ten teachers and ten learners from the selected schools eventually participated in the research. Observations were recorded by means of anecdotal notes which were used to verify and supplement data obtained through the interviews. According to the findings of the empirical research, it appears that the research participants’ understanding of multiculturalism lack substance. The findings also revealed that multiculturalism is mainly accommodated by implementing the following OBE practices: working together with others, showing respect, cultural sensitivity, acknowledgement of individual learner differences, and by creating positive classroom climates. It was also evident that teachers act as change agents by discrediting discrimination and prejudice. Teaching in multicultural classrooms also poses some challenges. These included language problems, acceptance of different cultural practices, racial differences and “inherent” segregation. Though the findings revealed that teachers’ OBE practices still need to be refined in order to successfully accommodate multicultural diversity, positive attitudes were reflected in terms of improving their competence with regard to teaching in a multicultural diverse environment. / MEd, Learning and Teaching, North-West University, Vaal Triangle Campus, 2012
