Images of prison: Managing institutional complexity in the Austrian penal system

Prisons are a specific type of organization with distinct challenges for their management. Most importantly, prisons - as well as understandings of how to 'successfully' manage them - are embedded in a pluralistic environment that consists of a variety of stakeholders with different ideas and expectations with regard to role and governance of prisons. This study addresses the question of which different understandings of 'good' prison management can be found in the Austrian discourse and how the expected complexity constituted by contradictory expectations is manifested in the shared narratives of prison managers. I draw on an institutional theory perspective in order to reconstruct the distinct constellation of institutional logics at the field level as well as at the individual level. Empirically, the study has four central elements: First, I identify the institutional logics at the field level as well as the relevant actors in the field. Second, I reconstruct the prevalent institutional logics as well as the metaphors in use at the individual level. Third, I compare field level and individual level. Finally, I am particularly interested in whether and how metaphors are used by prison managers to enact institutional logics and establish relationships between them. To answer the questions concerning the field level, I focused on articles in five Austrian newspapers from 1970 to 2015. Regarding the individual level, I conducted eight narrative interviews with (former) Austrian prisons managers. Methodologically, I combine a variety of different analytical approaches, namely content analysis, metaphor analysis, and objective hermeneutic analyses. The findings reveal two different 'types' of logics, namely governance and purpose logics. These logics differ in their content (what they claim jurisdiction over), their structure (their relationships within and across types), and in the metaphors used (purpose logics have a more restricted set of metaphors, while governance logics have a more differentiated set). Further, the empirical analyses show that metaphors play a variety of roles with regard to logics. They may either specify individual logics, set up competing logics against each other, stress complementarities between logics, or create relationships between otherwise unrelated logics. Summing up, this dissertation contributes, first, to literature on cross-level relationships of institutional logics by linking field-level results with individual-level results. Second, it extends literature on institutional pluralism and institutional complexity by arguing that constellations of logics do not only exist at different levels but there may also be different types of logics within a constellation. Third, I contribute to rhetorical approaches in institutional theory by showing how metaphors are a way of manifesting institutional pluralism. Fourth, for the practice of prison management, the study has implications for the planning and realization of change management efforts.

Positive Administrative Control: A Construct for Assessing Managerial Influences on Rates of Misconduct in Prison

abstract: The most prominent theories for explaining the incidence and prevalence of misconduct in prison are deprivation (Clemmer, 1940; Sykes, 1958; Colvin, 1992), importation (Irwin and Cressey, 1962; Harer and Steffensmeier, 1996; Cao Zhao, and Van Dine, 1997), and administrative control (DiIulio, 1987; Useem and Kimball, 1989; Useem and Reisig, 1999). Administrative control does not supersede deprivation and importation theories, but rather adds to them by asserting quality management is essential for the maintenance of an orderly environment jeopardized by the effects of deprivation and importation. Even though research has supported administrative control, researchers have disagreed over which aspects of management are most effective for mitigating disorder, and have thus far only proven that poor management leads to administrative breakdowns in policies and practices that predicate disorder. This dissertation introduces the concept of positive administrative control, based on social exchange theory, as the mechanism prison administrators should use to induce staff to act in accordance with agency desires and avoid administrative breakdowns. The results show that when prison employees experience quality relationships with their supervisors, they are more likely engage with inmates in a similar fashion, which is associated with reductions in misconduct rates. At the same time, when prison employees are supported and rewarded for their good behavior, they are more likely to actively monitor inmates, which is associated with increases in misconduct rates. Additionally, the results support importation theory by demonstrating that the aggregated criminogenic characteristics of inmates in a prison are representative of cultural influences on prison misconduct. Based on these findings, recommendations are made to restructure leadership training to emphasize relational leadership skills that positively influence staff to act in accordance with agency desires and more closely follow policy guidelines. It is also recommended that future studies consider including aggregated demographic variables in studies of misconduct in order to capture cultural/environmental influences that may otherwise be missed, and should avoid overuse of composite variables, in particular institution security level. / Dissertation/Thesis / Doctoral Dissertation Criminology and Criminal Justice 2015

A pesquisa procura compreender a emergência desses novos atores no contexto da gestão penitenciária identificando o processo de fragmentação institucional do exercício de poder sobre a população carcerária por meio de sucessivas reformas realizadas ao longo do século XX, e o quanto esse fenômeno estimulou a emergência de novas forças que se colocaram em disputa pela primazia sobre essa população. Para isto é realizada uma caracterização dessas forças, entre as quais se tornaram mais proeminentes: administração penitenciária central, diretor, diretor de segurança, facções, juiz da execução, defensor público e mídia, e analisa as interações mantidas entre esses atores, com tensões e cooperações estabelecidas ao longo do tempo. A partir de uma análise crítica das premissas que orientam o comportamento de cada um desses atores, a tese apresenta as características da profunda crise de coordenação que define a gestão carcerária no estado de São Paulo nas últimas décadas. / This dissertation provides a critical analysis of contemporary control institutions responsible for the prison population within the state of São Paulo. More specifically, it analyzes the management conflict that characterizes its modus operandi. By focusing on the prison wardens, the research endeavors to understand how the behavior of these actors is influenced by a number of other powers, such as judges, inmates, and the bureaucracy in the state correctional department, to which wardens are subordinate. The research shows that the emergence of these other influences has led to institutional fragmentation in the exercise of power over the prison population. To this end, the research carries out a detailed characterization of these powers and subsequently analyzes the interactions between these actors including their tensions and cooperations over the years. The prominent actors included in analysis are the prison central administration, the warden deputy, the security warden, prison gangs, judges, public defenders and the media. By conducting a critical analysis of the principles that guide the behavior of these actors, the dissertation is able to identify the characteristics of the profound crisis that defines prison administration in São Paulo in the last decades.

Unit management in prisons

Research into unit management in prisons was necessitated by a need to change the way in which South Africa deals with prisoners. The lack of respect for human dignity, poor control in prisons before and after demilitarisation and the need to reduce crime in South Africa are some of the reasons why the study became important. Topics addressed include the role of architecture in corrections, direct supervision to enhance active custody, renewed emphasis on individuals by means of case management and decentralised delivery of development and treatment programmes. Apart from the aspects mentioned above, the philosophy of unit management is spelled out. Imprisonment in countries such as Australia, Canada, Germany, Japan, South Africa and the United States of America is discussed against the background of the unit management philosophy. During any process of incarceration, documentation forms an integral part of the process. In this study, the researcher discussed those documents that could play an important role in unit management. The importance of unit management in prisons cannot be overemphasised. The investigation contributes largely to scientific knowledge in that the importance of sentence planning for each individual within the Criminal Justice System is emphasised.
