Renvoi principo problematika ir sprendimo būdai / Renvoi: problematical application and possible solutions

Iki 1990 m. Lietuvos teismai praktiškai nesusidurdavo su renvoi – situacija, kada teismo vietos valstybės kolizinės taisyklės nurodo taikyti užsienio valstybės teisę, o pastarosios tarptautinės privatinės teisės normos grąžina į lex fori (pirmojo laipsnio renvoi) arba nukreipia į trečiosios valstybės teisę (transmisija). Todėl ši problematika niekada plačiau nenagrinėta nei Lietuvos doktrinoje, nei teismų praktikoje. Vis dėlto po naujos civilinės teisės kodifikacijos grąžinimo teorijos aktualumas tapo nepaneigiamas, todėl tikslinga kitų valstybių (ypač Prancūzijos) tarptautinės privatinės teisės specialistų teiginių, pozityviosios teisės bei teismų praktikos renvoi srityje analizė. Skirtingai nei kitose tarptautinės privatinės teisės srityse, renvoi problematikos ištakos sietinos ne su doktrina, o su Prancūzijos Aukščiausiojo Teismo praktika. Nepaisant to, jog grąžinimo teorijos apraiškų būta ir Anglijos bei Vokietijos teisėje, tačiau būtent Prancūzijos Aukščiausiojo Teismo sprendimas Forgo byloje įtakojo tolesnį renvoi taikymą ir doktrininius debatus dėl galimo jo atmetimo. Doktrina renvoi klausimu buvo nevienalytė. Nors dauguma tarptautinės privatinės teisės specialistų stengėsi pagrįsti renvoi taikymą teoriniais, teisiniais bei praktiniais teiginiais – neimperatyviu teismo vietos valstybės kolizinės taisyklės pobūdžiu, užsienio teisės vientisumu, užsienio valstybės įstatymų leidėjo atsisakymu reglamentuoti tam tikrus teisinius santykius, renvoi taikymo būtinybe siekiant... C’est en effet assez curieusement la jurisprudence française, et non la doctrine, qui est à l’origine avec ce qu’il est convenu d’appeler le renvoi, de la plus fameuse des controverses qui ait agité dans le monde entier la théorie du droit international privé. Certes, ce mode de raisonnement avait des précédents en Allemagne et en Angleterre et même dans l’ancien droit français, mais c’est l’arrêt Forgo de la Cour de cassation française qui, en mettant en évidence l’existence des conflits négatifs et en les résolvant par le procédé du renvoi, a permis une véritable prise de conscience du problème. This thesis explores the human body on the basis of its anatomical disposition in connection with the functional principles which enable to develop the correct body posture, leg position en dehors, classical dance poses and coordination of movement leading to rotation and jump. In this thesis, I look upon the human body as the main dancer´s tool allowing to perform the classical dance technique and by the described functional principles, I attepmt to support the correct execution of individual parts of the classical dance technique. In conclusion of this thesis, I comment on general employing of these functional principles in classical dance lessons.

Problematika trestu odnětí svobody na doživotí / The issue of life imprisonment

The purpose of my thesis is to analyse the life imprisonment and answer basic questions related to issue of this criminal sanction. It is necessary to study the life imprisonment from the perspective of the criminal law, but in the light of psychological and social aspects that are connected with the long-term imprisonment. The thesis is composed of six main chapters, which are divided into different subchapters. Each of these chapters is dedicated to several aspects of life imprisonment and this work is trying to give a global view of the life imprisonment. The Introduction is followed by Chapter One which defines the term and purpose of the punishment. This Chapter presents the history of the evolution of the punishment. This work describes development of the concept of the punishment from retribution and frighten to the modern comprehension that respects human rights and liberties. The work is pointing out the example of the remarkable Italian scientist Cesare Beccaria, who came with the modern comprehension of the punishment in the era of the Enlightenment. Šiame darbe nagrinėjamas lyginamosios reklamos reglamentavimas Lietuvoje ir Europos Sąjungoje, tiriamos istorinės lyginamosios reklamos formavimosi prielaidos pasirinktose valstybėse, analizuojama, ar lyginamosios reklamos reglamentavimas Lietuvoje atitinka Europos Sąjungos teisėje įtvirtintas nuostatas bei identifikuojamos su tuo susijusios praktinės problemos ir pateikiamas galimas jų sprendimas. Taip pat darbe pateikiami bendrieji reklamos principai, kurie taikomi visų rūšių reklamai, bei atskleidžiami pagrindiniai lyginamosios reklamos privalumai ir trūkumai. Kadangi lyginamoji reklama yra leidžiama, jei ji atitinka teisės aktuose nustatytas sąlygas, didelis dėmesys darbe skiriamas būtent lyginamosios reklamos leistinumo sąlygų analizei bei su jų taikymu praktikoje susijusioms problemoms atskleisti. Tiek, kiek tai susiję su lyginamąja reklama, darbe įvertinamas lyginamosios reklamos poveikis vartotojų ir kitų ūkio subjektų atžvilgiu, aptariami kontrolės būdai, atsakomybė už lyginamosios reklamos pažeidimus. It also examines historical assumptions of comparative advertising in selected states and common commercial principles, applicable in all arts of comparative advertising. In addition, this article seeks to ascertain, whether the legal basis in Lithuanian and European Union is unanimous in this field. Furthermore, the appropriate problems were identified and possible solutions of recent regulation were offered. Comparative advertising is allowable only if it corresponds the conditions, noted in legal regulations. Therefore, attention was paid for analysis of these conditions and investigation of appropriate problems, which occur while their application. Insofar it is related with comparative commercial, there were also measured the impact for consumers and other economy subjects, discussed different ways of control and responsibility for violation of comparative advertising regulations. According to the increasing role of self -regulation in national and European Union field, there were also analysed institutions of self-regulation and some related problems.

The dissertation on The Cobbler (Švec,) Miller´s dance (Mlynářská) and the Plough (Ruchadlo). Motifs of work and crafts in Czech folk dances deals with the theme of folk dances pertaining to motifs of work and crafts, namely dances with movements depicting and imitating work movements. It is based on the detailed study of records and descriptions of Czech folk dances in collections, manuals of social dances and other sources.The variations of dances appearing repeatedly in the sources, were compared. The study revealed three principal ways of how the work motif is employed: in the songs' lyrics; the dancers' movements resemble a certain activity ; the work process is imitated intentionally. It became evident that there is a connection between the incidence of these dances and the social and political context of the period.

The M.A. thesis is focused on body posture which serves as a stabilization of vertical position of the body in gravitational field and which supports movement. Without body posture, any targeted movement cannot take place. The thesis mainly discusses how to attain a physiologically correct body posture in classical dance while drawing out the lower limbs en dehors. It is a basic predisposition for the realization of related movements without the risk of overburdening or injury of the movement apparatus.
