La investigación es relevante ya que la gran rapidez en la producción y el consumo de productos OVM, hace que sea necesaria la realización de un estudio adecuado sobre la inadecuada regulación de estos productos en relación al derecho a la información y a la salud del consumidor. Así entonces, la investigación busca analizar sobre todo las implicancias de los OVM en los derechos del consumidor a la información y a la salud, teniendo en cuenta que, los OVM que más se comercializan, comprenden el grupo de alimentos más utilizados por los consumidores como el maíz, la soja, el trigo y el arroz, entre otro más. De modo que, la adopción de garantías de tutela para la gran cantidad de consumidores del mercado peruano es una situación de urgente y necesaria atención. Esta característica de estos productos, es decir su carácter de constituir productos de comercio masivo, hace necesario desarrollar un trabajo mediante el cual se pueda determinar que existen deficiencias en la protección de los derechos a la información y a la salud de los consumidores respecto a los OVM. / Tesis

Design guidelines and the law: History and analysis of design guidelines in zoning ordinances

The American public has shown growing concern for the protection of aesthetic values on private and public lands. For private lands, the protection of aesthetic qualities must be coupled with use rights inherent in property ownership under American law. One of the earliest models to protect such values on private lands was the use of "police power" to regulate the appearance of new development in selected districts. This has most frequently been accomplished by including design guidelines in zoning ordinances. This study examines history, relevant law and literature, and the content of design guidelines in zoning ordinances. The content analysis was designed to investigate both design elements and trends over time existed. The findings from the content analysis suggest that the use of design guidelines are increasing for contemporary areas and communities as well as historic districts. Also, that the design guidelines are becoming increasingly specific in the design elements included.

A comparative study of technological protection measures in copyright law

Digitisation had a profound impact on the creation, reproduction, and dissemination of works protected by copyright. Works in digital format are vulnerable to infringement, and technological protection measures are accordingly applied as protection. Technological protection measures can, however, easily be circumvented, and additional legal protection against circumvention was needed. Article 11 of the WIPO Copyright Treaty (the WCT) obliges Member States to provide adequate legal protection against the circumvention of technological measures applied to works protected by copyright. Contracting parties must refine the provisions of Article 11 and provide for exceptions on the prohibition. Article 11 does not specify whether it pertains to only certain types of technological measures, nor does it prohibit the trafficking in circumvention devices. The United States implemented the provisions of Article 11 of the WCT through the Digital Millennium Copyright Act of 1998 (the DMCA). Section 1201 of the DMCA prohibits the circumvention of technological measures. It is detailed and relates to two categories of technological measures - access control and copy control. It prohibits not only the act of circumvention, but also the trafficking in circumvention devices. Article 6 of the EC Directive on the Harmonisation of Certain Aspects of Copyright and Related Rights in the Information Society of 2001 implements Article 11 of the WCT. Article 6 seeks to protect Aeffective technological measures@. It prohibits both the act of circumvention and circumvention devices. Although Article 11 of the WCT is silent on the issue of access control, it seems as if the international trend is to provide legal protection to access controls, thus indirectly creating a right to control access. South Africa has not yet implemented Article 11 of the WCT. The South African Copyright Act of 1979 does not protect technological protection measures. The Electronic Communications and Transactions Act of 2002 (the ECT Act) provides protection against the circumvention of technological protection measures applied to digital data. The definition of Adata@ is such that it could include protected works. If applied to protected works, the anti-circumvention provisions of the ECT Act would be detrimental to user privileges. The Corporate Exploitation of Fundamental Rights: A Nation of Arbitration

This thesis is an in-depth discussion and analysis of the alternative dispute resolution process of arbitration in the United States. It begins by providing a basic explanatory overview of arbitration clauses and the arbitration process. It then goes on to highlight the various benefits over traditional court litigation that arbitration has to offer. From there, the paper presents a detailed discussion of the many shortcomings of the arbitration process. It identifies the overall lack of procedural fairness that exists in arbitration today due to the fact that arbitration currently tends to favor businesses over consumers and workers during dispute settlements. The paper then identifies the various negative potential consequences that exist as a result of the unfair nature of arbitration today. This thesis concludes by presenting various ways that the arbitration process can be improved upon to make for a fairer, more neutral dispute resolution alternative.

We will begin doing an explanation of the legal regime of the financial institutions on Brazilian Constitution, the Central Bank and the Monetary Authority, as well as the possibility for self-regulation. Then we will analyze the legal protection of the consumer in Brazil, with main focus on the information right. We will study the concept of good faith in legal terms and the responsibility of financial institutions in abusive loan contracts regarding consumers. There will be a highlight on de vulnerability of the consumer and de concept of consumers that are more vulnerable than others. This paper intends to demonstrate that loan contracts sign with disregard of the information right by the financial institution to not oblige the consumer. As a consequence of this violation, the contract should be considered as not valid and the parties involved must return to the previously situation / O objetivo deste trabalho será analisar o papel do direito à informação do consumidor e do dever de educação do fornecedor e a responsabilidade jurídica que as instituições financeiras possuem nos contratos de mútuo bancário no direito brasileiro, especialmente considerando a vulnerabilidade do consumidor. Iniciaremos fazendo uma explanação do regime jurídico das instituições financeiras na Constituição Federal, no Brasil pelo Banco Central e Conselho Monetário Nacional, bem como a possibilidade de autorregulação de suas atividades. Após, trataremos da proteção jurídica do consumidor, especialmente o direito à informação. Será analisado ainda o conceito de boa-fé objetiva, bem como a responsabilidade dos fornecedores nos contratos de mútuo no que tange aos consumidores. Neste ponto, serão destacados a vulnerabilidade do consumidor e o conceito de consumidores hipervulneráveis. Este trabalho pretende demonstrar que os contratos de mútuo celebrados com desrespeito ao dever de informação por parte do fornecedor não vinculam o consumidor. Como consequência desta violação, o contrato deverá ser considerado nulo e, assim, as partes deverão voltar ao status quo anterior à celebração do contrato

Environmental regulations reconsidered : identifying incentives and barriers to environmental performance

Attention has been drawn to the observation that environmental benefits under the current regulatory approaches are diminishing with respect to increased pollution control costs. Regulators have begun to appreciate that while environmental gains can still be achieved under the current command and control system, the most significant environmental gains have already been made, and an alternative regulatory approach might be warranted for continued environmental improvement. This study found that regulatory initiatives that seek to address business incentives and disincentives may yield better environmental outcomes. Internal characteristics such as corporate environmental directives, waste audit and environmental performance tracking systems and linkage of compensation to environmental performance are evident in firms that have attempted to adapt to regulatory pressures. These characteristics, according to organizational models, are posited to improve the environmental performance of firms as environmental issues are linked to key business decisions. This study was conducted by surveying firms in the forest products industry. Certain firms were found to exhibit specific internal characteristics indicative of good environmental performance. The study attempts to identify the implication this finding has on regulators in terms of policy design and implementation. The study suggests that the optimum regulatory strategy is a hybrid of a command and control approach and a market-based approach which blends the compliance assurance of the command and control approach to address motivating firm behavior with the flexibility of the market-based approach to provide firms incentives to improve environmental performance. The study concludes that the value of such a hybrid approach which attempts to address firm incentives and disincentives related to their environmental practices will result in improved environmental performance. / Graduation date: 1998
