Esta dissertação pretende explicar o processo de implementação da Diretoria de Pessoal (DIPE) na Superintendência Regional de Ensino de Ubá (SRE/Ubá) que conforme a nova estrutura orgânica da Secretaria de Estado de Educação de Minas Gerais (SEE/MG) passou a vigorar a partir de 27/01/2011, mediante o Decreto nº 45.536, em todas as SREs. A pesquisa visa a contribuir para o entendimento da seguinte questão: A nova estrutura organizacional implementada na SRE/Ubá proporciona qualidade na prestação de serviço ao público em geral? Desse modo, o objetivo geral é analisar se esta nova estrutura está promovendo trabalhos alinhados às demandas do público que procura a SRE/Ubá. Os específicos focam em investigar se tal mudança proporciona cooperação estratégica governamental, a partir de melhor organização das funções, ao orientar os setores na busca de soluções eficazes para o alcance das metas pactuadas. Justifica-se o tema, uma vez que a DIPE caminha para superar dificuldades, apoiar e qualificar os servidores que atuam nesta área, tendo como foco a melhoria da qualidade dos serviços ofertados. A metodologia envolveu um Estudo de Caso cuja pesquisa de campo foi exploratória, descritiva e de cunho qualitativo, tendo como técnicas os seguintes instrumentos utilizados: questionário, entrevista com roteiro semiestruturado e análise documental tais como: leis, decretos e notas técnicas, além dos conceitos de alguns teóricos, a saber: Chiavenato, Bergue, Tachizawa, Paradela e Mello. A partir de alguns resultados apresentados, a DIPE proporcionou maior eficiência na execução dos trabalhos, bem como na assistência ao público, promovendo maior diálogo entre SRE-Escola, com consequente descentralização das tarefas e facilidade de comunicação, tornando assim, o serviço mais qualificado e ágil. / The proposal that contemporary public institutions crave is that Brazilian states to transform and build within them, work environments more collaborative, integrated, and daring technicians. This dissertation aims to explain the implementation process of the Directorate of Personnel (DIPE) in the Regional Superintendent of Education of Uba (SRE / Uba) that according to the new organizational structure of the State Department of Education of Minas Gerais (SEE / MG) became effective from 27/01/2011, by Decree No. 45,536, in all SREs. The research aims to contribute to understanding the following question: The new organizational structure implemented in SRE / Uba provides quality in providing service to the general public? Thus, the general objective is to analyze whether this new structure is promoting work aligned to the demands of the public who seeks SRE / Uba. The specific focus on investigating whether such a change provides strategic government cooperation, from better organization of functions, to guide the sector in seeking effective solutions to achieve the agreed targets. Justified the theme, since the DIPE walks to overcome difficulties, support and qualify the servers who work in this area, focusing on improving the quality of services offered. The methodology involved a case study whose field research was exploratory, descriptive and qualitative nature, with the techniques used the following instruments: questionnaire, semistructured interview and document analysis such as laws, decrees and technical notes, beyond concepts some theorists, namely: Chiavenato, Bergue, Tachizawa, Paradela and Mello. From some results presented in DIPE provided greater efficiency in the execution of the works, as well as assistance to the public, promoting greater dialogue between SRE-School, with consequent decentralization of tasks and ease of communication, thus making the most qualified service and agile.

The aim of this thesis is to analyze the forms of ownership of the water supply infrastructure in terms of its operation, the number of operators and the impact assessment on the drinking water price for end customers. All this with a view to assessing whether it is appropriate to ensure the operation with private entities or to have municipalities operate the water management infrastructure separately. The analysis unambiguously confirms that the current number of owners and operators exceeding 9 thousand companies is unnecessarily harmful to the effective management of this area. Quantitative research shows that only 52 companies provide a full 97% of the volume of invoiced water. At the same time, economic analysis proves that the efficiency of the economy is not determined by ownership but by effective management. The result of this work is the confirmation that the water price is primarily influenced by the place of drinking water supply, long-term sustainable development of the water supply infrastructure area and effective management of an adequate number of companies.

Profese daňového poradce ve vybraných zemích EU / Profession of the tax advisor in selected countries of the EU

The goal of this diploma thesis is provide a basic overview about conditions which has to be met for providing of tax advisory in selected countries of the European Union. The first part contains information about legislation of European Union which has significant influence on the tax advisory. The European legislation is followed by a description of the regulation of the profession of tax advisor and tax advisory in the Czech Republic, including a description of the Chamber of Tax Advisers of the Czech Republic. The last part of the diploma thesis, based on the questionnaire survey, is the comparison of the situation and regulation of the tax adviser profession in selected countries of the European Union. After comparing the situation in individual member states, the principles of regulation in selected European Union countries are described and a description of the facts and conditions that must be accepted when a foreign entity decides to provide tax advisory in that member country.

互聯網保險保險人說明義務研究兼論第三方平台責任 / The research on the duty of representation of Internet insurer and the responsibility of the third-party platform

進入二十一世紀的第二個十年以來,科技進步推動中國大陸互聯網經濟快速發展,也使得「互聯網+保險」這一商業模式逐漸進入人們的生活。然而在實際運行過程中,中國大陸保險法第17條規定之保險人說明義務並未能在互聯網平台得到很好的實施。實務中,無論是保險公司自營平台或第三方平台,其說明義務履行均未達到保險法、司法解釋以及相關行政法規之要求。 說明義務之立法目的在於糾正保險人與要保人之間的信息偏在,但實際履行中成本過高。而互聯網保險,尤其是其中的O2O保險碎片化、快捷化、小額化之特點,使得該制度的缺點進一步被放大。所以立法應當廢止現行說明義務規範,參酌其他國家或地區立法,代之以信息提供義務。 其中台灣雖然規定有信息提供義務類似規範,但義務違反之責任仍有缺陷。相較之下,本文建議參考德國保險法與歐盟相關指令進行立法,除信息提供義務之外,增訂承保範圍不一致警示義務、要保人撤銷權與商品資訊書相關規範。 中國大陸有大量保險於第三方平台上銷售,相較於保險公司自營平台,第三方平台對於說明義務履行狀況更加令人堪憂,然而卻極少有平台因此而對保險消費者承擔責任。本文認為,在消費領域雖然第三方平台註冊身份有保險代理人與保險經紀人之分,但考量實務運行情況,現階段宜將其統一認定為保險人之代理人。第三方平台作為保險代理人在義務履行有過錯時,仍應因其侵犯保險消費者資訊權之行為,向保險消費者承擔侵權責任。 / From 2010s, scientific and technological evolution promotes the rapid development of Internet economy in Mainland China, and makes the "Internet + insurance" business model become reality. However, the representation duty clause from Article 17 of Insurance Law, does not operate well especially on the Internet. In practice, the explanation on neither the insurance company's own platform nor third-party platform could meet the requests of the insurance law, judicial interpretation and the relevant administrative regulations. The purpose of the representation duty is to correct the information asymmetry between the insurer and the insured, but actually the cost is too high. And the features of internet insurance, especially those O2O insurance, such as, fragmentation, small amount and quickness, make the situation even worse. Therefore, the legislation should abolish the existing obligation of representation duty, and imitate the legislation of advanced countries, to replace it with duty of providing pre-contractual information. Among those countries or districts, although Taiwan has similar regulations to those in Germany and European Union, it is a pity that it has shortcomings in terms of responsibility. Thus, China should follow the German Insurance Law and European directives to amend the law, add the duty of warning about inconsistencies in the cover clause, withdraw right clause and information sheet clause, in addition to duty of providing pre-contractual information clause. In Mainland China , there is a large number of insurance products sold on third-party platforms. Compared to insurance companies’ own platforms, the situation on third-party platforms is even more worrying. However it is disappointing that few third-party platforms take their responsibility towards their consumers. As far as I am concerned, although third-party platforms can be registered as insurance agents or insurance brokers, for now they should be identified as insurers’ agents considering the actual situation when the insured is a consumer. When a third-party platform makes a mistake at work as an insurance agent, it can not be exempted from its identity. On the contrary, the third party platform shall bear the tort liability to the consumer for its behavior of violating consumers’ information rights.

Aim of this diploma thesis is to develop a referential catalogue of public administration services, which should provide its users with summary of services provided by public administration. Theoretical part of thesis at first defines notions and presents problems connected with providing public administration services in context of development in period after Velvet revolution in Czech Republic. After that, work follows with global situation in European Union and concentrates on one country (Austria) and its services. During design of the catalogue was used actual knowledge and research about service providing, which reflects customer oriented approach and access through single point of contact. The necessity of splitting the whole process of service providing into two parts, service access and service execution part, is emphasized. Within design of catalogue are presented two main models – domain model describing the structure of catalogue itself and service model, describing services. Based on analysis of possible uses and its integration potential with existing systems are defined its main benefits and is devised integrating principles designed in catalogue into „Portal veřejné správy“.

The theoretic section describes people with mental disorder and summarises problems of personal assistance comprehensively. This part also gives an overview of contemporary services and trends in care for people with mental infliction in the Czech Republic. The experimental section consists of two parts. The first part focuses on mapping and basic characteristics of organization offering personal assistance to people with mental disorderb in Královéhradecký region and Prague. The data found out in both regions are comapared to each other. The aim of the second part of the research is to learn information and attitude of users' parents to service provided in chosen regions. Transmitted data logging in routers is the main point of this semestral project. The suggestion of a system for data flows logging in routers and selection of suitable technology, that is used by implementation of the system within this thesis, is based on this analysis. In the thesis, a law responsibility of router administrator for transmitting data is analysed. In the next part, a general introduction to issue of data logging in computer networks including basic description of protocols and fundamentals of standard communication models is presented. Analysis of real enviroment is following. Suggestion and implementation of the system is described too. In the last part a reached results of this thesis are revealed.

Reconnecting The City With The Riverfront, To Revitalize The Socio-Economic Conditions Of Springfield, Ma.

The City of Springfield, Massachusetts is one of the largest cities in western Massachusetts, and was established on the Connecticut River for trading and as a fur-collecting post. In 18th and early 19th century, it experienced an industrial boom and became a regional financial center. Springfield became a major railroad center and grew to become the regional center for banking, finance, and courts. However, in mid-19th century Springfield suffered due to the flooding of the Connecticut River and the disinvestment in industry. These resulted in an urban sprawl as people started moving away from heart of the city. Now, once again, the city is trying to revitalize its downtown and neighboring areas to attract people by improving different types of social and cultural amenities. In this thesis, the author studies the relation of the city with its natural asset ‘The Connecticut Riverfront’ which can be a great place to attract people towards the heart of the city. The author has also researched the various reasons causing this natural asset to be underutilized for several years. In addition, the author also explores the possibilities of connecting the Springfield downtown to the riverfront, providing safe and undisturbed access mainly to pedestrians, physically challenged people, and bike riders. Research shows that the existing transportation paths are the major barriers discouraging people from reaching the riverfront. In order to overcome this problem, a design solution is proposed including a safe, pedestrian-friendly link from the downtown area to the riverfront mitigating all the transportation paths such as highway, high speed traffic roads, and railway tracks. The proposed link will give encouragement to local artist and will also aim to boost local businesses by providing sites for museums, exhibitions, art galleries, food courts, and retail shops. This structure will not only improve the accessibility but it will also provide public open spaces where people can gather for various activities and can also enjoy the scenic view of the riverfront. In Addition, local people can also enjoy the water viewing restaurant and bar overlooking Connecticut River. Lastly, this connecting link lays the foundation for further development of the riverfront area due to increased accessibility to this asset.

本研究は,視聴する映像を学習者自身で選択させることによる運動学習効果を検討する事が目的であった.本研究の結果,学習者自身が映像を選択する事で,実験者によって選ばれた映像を視聴した場合と比較して,映像と学習者の運動イメージとの認知的な一致度を高めた.さらに,観察角度や選択の方法の違いが運動学習の向上に寄与する事を明らかにした.これらの知見は,運動指導や体育授業における映像の視聴方法や選び方といった提供方法の提案に繋がるだろう. / This study aimed to examine the motor learning effects of allowing learners to choose their own footage to watch. As a result, this study showed that the learner's chosen footage enhanced the cognitive consistency between the video and the learner's motor imagery, compared to the case in which the experimenter chosen video was shown. Furthermore, we found that differences in observational angle and the method of choice contributed to the improvement of motor learning.
