L'influence des réseaux d'alliances sur l'attribution des marchés publics / The influence of alliance networks on the awarding of public contracts

Avec plus de 100.000 transactions chaque année, les marchés publics représentent près de 10 % du PIB français. Pourtant, peu de travaux en sciences de gestion ont tenté de comprendre les manoeuvres stratégiques qui facilitent l'accès des entreprises à la commande publique. En s'appuyant sur la théorie des réseaux, le but de cette thèse est, justement, d'étudier l'impact de l'environnement relationnel des entreprises. Nous proposons, ainsi, un modèle qui décrit comment les réseaux d'alliances influencent l'attribution des marchés publics. Pour réaliser ce travail de recherche, nous observons 4.242 transactions de marchés publics dans lesquelles sont impliquées des alliances stratégiques. Une analyse structurale des données nous permet, alors, de détecter les réseaux d'alliances. L'organisation de ces réseaux révèle des propriétés relationnelles non-triviales, et identiques à celles des réseaux sociaux. Ces propriétés sont testées à partir d'équations structurelles (PLS-path modeling). Les résultats montrent un effet significatif de 4 propriétés relationnelles (l'encastrement, l'attachement préférentiel, la force des liens et la transitivité) sur l'obtention des marchés publics. Nous décrivons, ensuite, la façon d'organiser, efficacement, des manoeuvres d'alliances. Nous posons, ainsi, les fondements d'un système d'intelligence économique pour former des coalitions. Ce système repose sur une cartographie des réseaux qui permet aux entreprises de comprendre et d'influencer leur environnement relationnel. / With over 100 000 exchanges per years, public procurement represent almost 10% of French GDP. Nevertheless, few scientific management studies have investigated strategies which ease accessibility to public procurement to companies. Based on network theory, my thesis purpose was to study the impact of the company relational environment. We now characterize a model that illustrates the effect of strategic networks on contract awarding. We investigated 4242 transactions in French public market with strategic alliances involvement. A structural data analysis highlighted strategic networks characterized by an organization having non trivial relational properties, which are identical to social networks. We used structural equations modeling (PLS-path modeling) to validate this observation. Indeed, we demonstrated that 4 different relational properties (embeddedness, preferential attachment, strength of ties and transitivity) influence significantly the public contract awarding. What are these model applications? This model draws a company network map, a useful tool for company to manage and understand their possible coalitions. We propose how to organize efficient strategic alliances which is one of the bases of competitive intelligence system.

Embora o objetivo primário da contratação administrativa seja a aquisição de bens e serviços nos melhores termos possíveis, os entes estatais frequentemente se utilizam de seu inquestionável poder de compra para promover questões nacionais outras, que são industriais, sociais ou ambientais em sua natureza. Todavia, essas políticas, também conhecidas como políticas secundárias, colaterais ou horizontais, legitimamente perseguidas pelos governos nacionais, podem estar em contraste com outros propósitos nacionais ou internacionais legítimos, tais como livre comércio, transparência e lealdade. Esta tese analisa a taxonomia do que denominamos função horizontal da licitação e da contratação administrativa, bem como o modo por meio do qual o regime brasileiro de compras públicas lida atualmente com essas preocupações secundárias (mas de igual importância) econômicas, sociais e ambientais e com os limites impostos à adoção de tais políticas. / Although the primary objective of procurement is the acquisition of goods or services on the best possible terms, governments have frequently used their unquestionable power of procurement to promote further national concerns, which are industrial, social and environmental in their nature. However, these public policies, also known as secondary, colateral or horizontal policies, legitimately pursued by national government, could be in contrast with other nacional and international legitimate purposes, such as free trade, transparency and fairness. This essay analyzes the taxonomy of what we name horizontal function of public procurement and the way in which brazilian regime of public purchasing is dealing nowadays with these economic, social and environmental secondary (but not less importante) concerns and the limits imposed on the adoption of such policies.

Basic Qualifying Requirements in Public Tenders The purpose of this thesis is to analyse the Basic Qualifying Requirements in the public tenders, as enacted in the Section 53 of the Act no. 137/2006 Coll., on Public Procurement, as amended. The initial reasons for my research are constantly changing legal rules in this branch of law that often do not reflect the European enactment in the Directive 2004/18/EC. The thesis is composed of an Introduction, 3 separate Chapters and a Conclusion. The Introduction outlines the aim of the thesis, its structure and arrangement of the Chapters are shown in this part as well. The Introduction is than followed by the first Chapter called Qualification, in which the topic of criteria for qualitative selection is discussed in the context of the general provisions concerning qualification in the public tenders. This Chapter is subdivided into two parts separately dealing with the requirements of the bodies governed by public law and entities operating in the water, energy, transport and postal services sectors. The theme of this research is about the perspective of the implementation of sustainable procurement, it was characterized as an instrument used by the public management, for the purpose to adopting sustainable criteria in the social, environmental and economic to your shopping process. Given its purchasing power and the impact this may have on the market, aims to promote the development as well. Even if the legal regulations this reasoning in a shopping process based on sustainability this practice only gains strength with the normative instruction 01/2010 and in sequence by Law No. 12,349 / 10, amending the text of the Law 8.666 / 93, giving the new legal purpose of promoting national development the buying public. This research was classified as analytical empirical, adopts descriptive about the objectives and has a quantitative approach. Data were collected through questionnaires during the second international seminary on sustainable public procurement held in Brasília- DF. The sample was characterized as non-probabilistic for convenience and intentional, which was made up of 77 public servants procurement agents participating in the seminary. The method of analysis was give by descriptive statistic and cluster analysis. The main results indicate that only a normative legislation is not sufficient to fulfill the application of public procurement, given that this is still little used, even among servers that have greater perception of knowledge and training on the subject. One group identified the biggest difficulties even after these having the highest scores as the realized training. One of the main delimiters indicated by the servers, in this aspect of culture, which leads to change in a process, in behavioral change. Question the effectiveness of the training carried out and needing for the expansion of the theme for all areas, since the Law 8.666 / 93 that is used by all public institutions in your shopping process. Observando este potencial, o Estado inova seu processo de compras públicas ao inserir critérios de sustentabilidade em seu processo de compras e contratações, estimando deste modo a criação de uma demanda por produtos e serviços que promovam o desenvolvimento nacional. Contudo, este processo passa pelas mãos dos agentes de contratações públicas, responsáveis pela aquisição de serviços e produtos que vizem suprir às necessidades do Estado por meio do processo licitatório. Para que a finalidade de desenvolvimento efetivamente ocorra é fundamental que os agentes de contratações públicas apliquem critérios sustentáveis a este processo. Diante do presente contexto, o objetivo geral deste estudo é analisar a percepção de servidores, responsáveis pelas contratações públicas, quanto à aplicação e à finalidade das compras públicas sustentáveis. O tema desta pesquisa está sob a ótica da aplicação das licitações sustentáveis, essa se caracteriza como um instrumento utilizado pela administração pública, com o propósito de adotar critérios sustentáveis nas dimensões social, ambiental e econômica ao seu processo de compras. Observa-se que mesmo que o arcabouço jurídico já desse fundamentação a um processo de compras pautado na sustentabilidade esta prática só ganha força com a instrução normativa 01/2010 e na sequência, pela Lei nº 12.349/10, que altera o texto da lei 8.666/93, atribuindo a nova finalidade legal de promoção do desenvolvimento nacional às compras públicas. Esta pesquisa é classificada como empírica analítica, adota caráter descritivo quanto aos objetivos e tem abordagem quantitativa. Os dados foram levantados por meio de questionários durante o segundo seminário internacional de contatações públicas sustentáveis, realizado em Brasilia- DF. A amostra se caracterizou como não probabilística, por conveniência e intencional, a qual foi composta por 77 servidores agentes de contatações públicas que participavam do seminário. O método de análise deu-se por estatística descritiva e análise de clusters. Os principais resultados indicam que apenas uma legislação normativa não é suficiente para o cumprimento da aplicação das compras públicas, tendo em vista que esta ainda é pouco aplicada, mesmo entre os servidores que possuem maior percepção de conhecimento e capacitação sobre a temática. Ainda observou-se que o grupo que indicou maiores escores de dificuldade entre as variáveis é também característico com os maiores escores quanto às capacitações realiazadas. Questiona-se portanto a eficácia das formações realizadas e a necessidade de expansão da temática para todas as esferas, uma vez que a lei 8.666/93 é utilizada por todas as instituições públicas em seu processo de compras. A pesquisa permitiu reconhecer que um dos principais delimitadores, indicados pelos servidores, está no aspecto cultura, o que remete à mudança de um processo, ou seja, mudança comportamental. Evidencia-se portanto, a necessidade de que as compras públicas sustentáveis saiam do painel teórico e assumam caráter de instrumento de promoção ao desenvolvimento nacional sustentável.

Entering into a public contract Abstract The topic of this thesis is entering into a public contract while this issue remains highly topical particularly with regard to the new complex legislation on public procurement, which brought a relatively significant change into this legal area. The main objective of this thesis is to provide a comprehensive interpretation of a process which results in a public contract as well as to analyse the admissibility of a modification of this legal act. This thesis is divided into three parts. First part is particularly concentrated on the sources of a public procurement legal framework. National and European legislation is analysed in this part, together with a minor attention to the international public law. Furthermore, the fundamental principles of a public procurement are subject to rather detailed research as they have significant impact on the entire contracting process. Due to a non- negligible shift in the terminology the basic terms of a public procurement are shortly explained in the end of the first part. The thesis provides a comprehensive analysis of the horizontal policies in public procurement with the aim to determine whether public procurement may be used as a legitimate tool in the pursuit of such policies. Horizontal or secondary policies refer to the policies not inherently connected to the functional objective of public procurement - i.e. to the purchase of goods and services. These may among other strike at social or environmental issues. For this purpose, the descriptive and analytic methodics are used. The case-law of CJEU was the primary source of the thesis along with the relevant literature and both EU and Czech legislation. The thesis is structured into two chapters. The first chapter provides essential introduction to the legislation in place in respect of the horizontal policies in public procurement. The second part of the chapter then analyses relevant case-law of CJEU. Particular attention is paid to the case law in respect of public procurement used as a tool to pursue employment policies. The second chapter named taxonomy of horizontal policies elaborates on the relationship between economic and legal aspect of the public procurement in general. Because of this, it is of great importance that the courts create a unitary interpretation of the definition; a clear definition serves as a means of exerting pressure. </p><p>The thesis is an investigation of the definition of contracting authority where the primary source of information consists of case law from the European Court of Justice. The purpose is to visualize the underlying philisophy of the regulation with a view to suggest an instrument for determining a body’s status as a contracting authority. Regarding the definition of contracting authority, the thesis discuss three different levels. The first level consists of an examination of the wording according to both the directives and the Swedish law, and then the interpretation of the wording by the European Court of Justice. At the following level, it is set out to illustrate differences between the definition on a national level and an EC level, respectively.
