Locus of identity : public infrastructure that forms loci for cultural identity

This dissertation investigates the role of architecture in the emergence of community identity with specific reference to the spontaneous surfacing and expansion of informal settlements within the South African context and the need for fundamental public service infrastructure provision. The aim is to understand and illustrate the significance of contextual infrastructure provision as catalyst in the emergence of social and cultural networks. In analysing the current innovative survival strategies induced by the community themselves, a theoretical premise will be established regarding the implications of an "African urbanist" approach to infrastructure and means of applying it in design. The current rate of urbanization within the South African context has resulted in several human settlements expanding organically, attempting to meet the increasing housing demands whilst neglecting the provision of platforms for various interwoven layers of urban fabric and public services. These platforms are integral in the shaping of cultural and community identity. The intent of the proposal is to provide an interface between the public and the built fabric that serves the needs of, as well as enhances the quotidian praxis within the Eastern Mamelodi precinct. The proposal intends to disclose an existing cultural language and identity by establishing physical loci that host and exhibit quotidian social practices unique to Mamelodi. The nexus among disasters, social vulnerability, subsidiarity assistance, and government finance in the U.S.

Numerous studies have examined the effect of natural disasters and social vulnerability indicators on broad factors using different theoretical frameworks; however, no study synthesizes a framework of theories to comprehensively examine the nexus among natural disasters, social vulnerability, subsidiarity principle, and government finance in the U.S. The dissertation utilizes a broad framework of theories to address two objectives of the dissertation namely the determinants of (1) infrastructure investment and (2) public assistance programs. Using panel data from 50 U.S states over a 17-time period (2000 – 2017), the first objective of the study investigates the determinants of infrastructure investment using a synthesis of theories. The study maintains that state infrastructure investment is not necessarily because of disaster punctuations but economic prosperity. The findings paint a picture of a proactive government that is perhaps prepared and does not act necessarily because of disaster events. The objective of the second study investigates the determinants of public assistance receipt assessed in 4 ways. The study maintains that subsidiarity assistance is influenced by both disasters and social vulnerabilities. However, disaggregating subsidiarity assistance into its sub-components (total public assistance, emergency work funds, permanent work funds, and intergovernmental transfers) provide a nuanced understanding of public assistance receipt. Federally declared disasters are strongly associated with disaster-relief forms of assistance, but not a significant determinant of intergovernmental transfers. Social vulnerability indicators, more especially – poverty, inequality (Gini), political influence, income, and infrastructure investment positively influence the receipt of federal intergovernmental transfers. The findings demonstrate that federal allocation of subsidiarity assistance follows a formula in terms of addressing wicked problems related to disasters and social vulnerabilities. In addition, the dissertation finds that disaster impact and social vulnerability theory additively explains the subsidiarity principle of U.S. federal government assistance programs to subnational governments. The dissertation contributes to theory, policy and management practices, and enlightens scholars and policymakers on the vital factors that stimulate state infrastructure investment and federal assistance receipt for best policy practice. Policymakers must constantly modify funding policies and effectively utilize tax-payer dollars following a formula to respond to jurisdictional vulnerabilities and public service needs

Public-private partnership in the provision of secondary education in the Gaborone city area of Botswana

Public sector organisations are established in order to promote the quality of citizen's lives through the provision of public services. However, the demands for public services often outstrip the limited resources at the disposal of the public sector for the delivery of such services. Public-private partnerships (PPPs) are emerging as an important tool of public policy to deliver public infrastructure and the attendant services. The main aim of this study is to establish the extent to which PPPs can be used to improve the quality of the delivery of secondary education in the Gaborone City area in Botswana. The study includes a conceptual analysis of the nature of the public services in general, and in particular, the nature and the provision of secondary education in Botswana with specific reference to the Gaborone City area. The study also includes a conceptual analysis of PPPs as gleaned from published literature. Various dimensions of PPPs are analysed and these include but are not limited to definitions, benefits, models and the antecedents for the successful implementation of PPPs. Among the various models that are analysed in the study, the design, build, operate and finance (DBOF) model is preferred for improving the quality of the delivery of secondary education in the Gaborone City area in Botswana. In addition to the conceptual analysis, an empirical research study is undertaken in which the secondary school heads are the respondents to a structured questionnaire. The results of the empirical research support the conceptual analysis to the extent that in both cases, it is possible to improve the quality of the delivery of secondary education through PPPs. More secondary schools can be built and more facilities be made available to schools. Through the use of PPPs, most if not all learners can receive the entire secondary education programme, from junior to senior secondary education. Existing secondary schools can be modernised through PPPs. Ancillary services can be delivered by the organisations that have the necessary expertise. Certain antecedents for the successful implementation of PPPs are necessary. 隨著知識經濟的崛起以及許多社會現象與研究文獻的證實,人力資本對一國的經濟成長而言,已是不可或缺的動力;因此,本文沿用Barro (1990)模型,將人力資本要素引進生產函數,並設定政府部門對私部門的人力資本投資有特定比例的補貼,據此探討加入人力資本要素後,Barro (1990)模型是否有不同的結果?而人力資本與其補貼對於經濟成長的影響又為何? 本文分析的結果發現,租稅政策對經濟體系的影響大致與Barro (1990)模型的結論相同,分別為:一、所得稅率的變動,為經濟成長率帶來的影響仍是不確定的;二、在給定特定的人力資本補貼率,如果政府所課徵的所得稅率能夠達成經濟成長率的極大,就能夠使社會福利水準達到極大。但與Barro (1990)不同的是,因為本模型的體系中存在著人力資本的補貼,因此在極大化經濟成長率的水準下,所得稅率會較Barro (1990)模型下的所得稅率大。 此外,由於人力資本與補貼的加入,使得本文有所突破之處:一、和一般認知不同的是,政府對於人力資本投資的補貼增加,在其他條件不變下,使得對於經濟成長率的影響並非正向,而是不確定的。二、給定特定的所得稅率,當政府決定的人力資本補貼率能使經濟成長達極大時,亦會使社會福利水準達到極大。

依據我國促進民間參與公共建設法,民間機構參與公共建設之主要方式有六種,其中又以BOT模式最具代表性,最常為世界各國所採行。 BOT專案融資之償還責任,由傳統的政府機關移轉到民間企業集團承擔,而民間企業集團除有限的自有資金部位之外,大部分資金仍需仰賴金融機構融通,亦即,政府機關移出之風險,到頭來還是會轉嫁到融資機構。因此,融資機構除了審慎評估專案融資風險或尋求其他有效方法轉嫁風險如保險或共同承貸等之外,另需透過契約妥適規範風險分攤,才能有效控制風險承受程度。 鑒於「專案融資」為BOT專案計畫最重要關鍵變數之一,本研究除了深入探討BOT專案計畫之定義、適用之先決條件、法源依據、基本契約架構、民間參與公共建設涉及政府出資樣態,並述及可行性評估、先期規劃、招商作業、甄審及評決、議約及簽約、興建、營運及移轉等作業流程,再就攸關BOT專案計畫成敗之「專案融資」起源、意義、計畫、類型、優缺點、與傳統融資之差異、當事人法律關係、法令規範、風險管理、政府提供融資協助機制等進一步研析;最後援引並評析臺北縣政府刻正辦理之重大BOT「徵求民間參與淡水鎮漁人碼頭休閒專用區觀光旅館暨藝術大街計畫案」,俾結合專案融資理論與實務。 綜上研究,歸納提出5項結論併相關建議,備供學界及實務界人士參考。 一、BOT專案成功關鍵繫於當事人間之風險認知與有效溝通協調。 二、政府融資協助機制相對保守。 三、現行BOT計畫之融資管道仍以間接金融為主。 四、實務上,融資機構評估意見之甄審評分權重比率並不高。 五、促參案件爭訟之實務判決案例仍然不多。 / According to our Act for promotion of private participation in infrastructure projects, the private institution may participate in an infrastructure project by six means but BOT is the typical model that usually be adopted in the world. The responsibilities of the debt of BOT project finance have transferred to private institution from the authority in charge of government. Nevertheless, except limited private capital, lots of capital for BOT still needs to depend on the financing institution. That is, the risk of the debt of BOT project finance will transfer to the financing institution finally. Therefore, besides evaluating the risk of project finance deliberately or looking for the effective methods to transfer the risk by insurance or consortium loan, the financing institution needs to plan the appropriate risk distribution via the contract for controlling the risk that can be accepted. Because project finance is one of the most important key factors of BOT, besides fundamental characteristics, suitable conditions, law bases, contract frame, the investment types of government and the process of feasibility study, preliminary plan, announcement by a public notice, evaluation and selection, negotiation and signing of concession agreement, construction, operation and transfer, this research will further study BOT project finance, relevant risk management, law relation between the persons involved, the financing assistance by government . Then, proceeded with the representative case study domestically and laid the special emphasis on both of principal plan terms and important financing conditions. According to the research as above, summarized five conclusions combined with suggestions as following for reference. 1. The key factors of success about BOT depend on the risk understanding and effective communication between the participators. 2. The regulation of financing assistance by government is conservative relatively. 3. Indirect finance is the principle channel for BOT at present. 4. The weight of opinion of financing institution evaluating BOT is not enough. 5. There are still a few cases with regard to the law suit about promotion of private participation in infrastructure projects.

In this report, the main Income Tax aspects related to the concessions of public infrastructure and of public services regulated by Supreme Decrete N° 059-96-PCM are analyzed. Hence, the applicable rules for investments made by the concessionaires and the treatment of self- sustained and co-financed concessions will be examined. To conclude this report, legislative changes that, in opinion of the authors would help provide greater security to the current regime on benefit of the Peruvian State and the investors, are suggested. / En este artículo se analiza el tratamiento para fines del Impuesto a la Renta de las concesiones de obras públicas de infraestructura y de servicios públicos regulados por el Decreto Supremo N° 059-96-PCM, que rige la entrega de las referidas concesiones. Así, se examina el régimen aplicable a las inversiones realizadas por los concesionarios, el tratamiento de las concesiones auto-sostenibles y las concesiones cofinanciadas. Para culminar este artículo, se proponen cambios legislativos que, en opinión de los autores, ayudarían a dotar de mayor seguridad al régimen actual en beneficio del Estado peruano y de los inversionistas.

Public assets financing in Nigeria : the imperatives for legal reforms to unlock domestic financial resources and foreign capital for infrastructure development

Infrastructure is one of the main parameters of economic growth and a country‘s competitiveness depends on the provision and maintenance of efficient and productive infrastructure assets. However, Nigeria, like most countries in Sub-Saharan Africa has the lowest quantity and poorest quality of stocks of infrastructure assets in the world and this phenomenally poor infrastructure has remained an impediment to development in the country. Decades of sub-optimal investment, poor maintenance culture and the fact that the required infrastructure investments could not be accommodated within the available fiscal space as a result of budgetary constraints have all contributed to the Nigeria‘s infrastructure deficit. The immediate outcome of this however is that the available infrastructure assets across the Nigerian landscape are in decrepit state and absurdly inadequate. Besides, the present demand for basic infrastructure services has grown astronomically out-stripping the supply capacity of the existing ones. Closing the infrastructure financing gap will however require increased investment by private investors through creative financing in an enabling legal and financial environment. Outside the budgetary constraints, the absence of efficient maintenance and management of infrastructure assets and quality service delivery by the public sector are some of the reasons why procurement of public infrastructure stocks by government through the traditional approach is no longer plausible and hence, the general appeal of the public-private partnership framework. However, despite all the potentials, the public private partnership technique in Nigeria has not made an appreciable impact in closing the infrastructure gaps due to lack of access to long-term financing. It is against this back-drop that this study has sought to investigate how reforms of the legal and financial infrastructure could widen access to financing through innovative financial resource mobilization in scaling-up infrastructure development and service delivery to the teeming Nigeria population. Therefore, the central thesis of this study is that the inadequacy of appropriate laws and inefficient financial system are partly responsible for the huge financing gaps in the Nigeria‘s infrastructure market and with the legal and financial reforms, an enabling legal and financial environment that would open up space for resource mobilization through innovative financing techniques and sources will be created thereby widening access to long-term financing and increasing the appetite for private investment in the nation‘s public infrastructure assets and services. So, the overarching objective of this thesis is to explore how legal and financial system reforms can facilitate the development of financial models and instruments that can help mobilize financial resources to fund infrastructure and bridge the huge infrastructure financing gaps in Nigeria in a sustainable fashion. Given the infrastructure poverty that constrains economic growth and development in Nigeria, the outcomes of this proposed study would help inform the need for the legal and financial system reforms to unlock resources in addressing the problems of financing gaps in infrastructure projects development in Nigeria. Besides, such outcomes based on the Nigerian experience in infrastructure financing and development may be turned into valuable knowledge for policy –making and further research in Nigeria. Ceux-ci, ayant fait l’objet deplusieurs réformes en 2008 et en 2009, sont, tour à tour, loués, critiqués ou décriés en ce qu’ilsnourrissent ou affectent les mécanismes de droit commun de la commande publique en droitinterne tout en exploitant des interprétations ambiguës quant à leur capacité d’assurer desmissions de service public.Le caractère tant innovant du contrat de partenariat, par ses spécificités relatives au partagedes risques associé à des objectifs de performance, que dérogatoire par une possibilitéd’utilisation conditionnée, plusieurs fois réaffirmé par le Conseil constitutionnel, font de cenouveau mode contractuel un contrat public singulier.A défaut d’existence de toute définition juridique des partenariats public-privé, cette recherche apour objet d’une part, d’analyser en quoi le partage des risques, pilier de cette singularité, estun vecteur de développement du contrat de partenariat et d’autre part, à s’interroger en quoi cedernier est susceptible de constituer un outil de réforme de l’Etat en ses mécanismes decontractualisation. / Private public partnership has noticeably been introduced in the French public law ofgovernment contract by the Act of 17 June of 2004 relative to Partnership contract. Largelyinspired from the Anglo-Saxon system and approved unanimously by the EuropeanCommission, it is noteworthy that prior to the Act private public partnership techniques wereofficiously already in used through different type of complex contractual settings. Subject toseveral reforms in 2008 and 2009, they were successively praised and criticized. Indeed, PPPhas been decried as affecting the national public procurement law and particularly because itsimplementation has been facilitated by different ambiguous construction regarding its capacityto fulfill public service missions.PPP innovates both by its contractual specificity with regards to the sharing of risk arising duringthe performance of contractual obligations and by its derogatory character due to the rule, whichhas frequently been reaffirmed by the Constitutional Court, that the use of PPP is subject tostrict conditions. The two aforementioned distinguishing features made this new contractualengineering a particular public contract law.Notwithstanding the lack of any legal definition of PPP, this research aims firstly to ascertainhow risk sharing, which is the pillar of this instrument, is the driving force behind thedevelopment of partnership contract. This research also aims to determine how PPP, throughits contractual technicalities, can be a tool in the reform of the State.

Projekt Partnerství veřejného a soukromého sektoru / Project of Public Private Partnership

This thesis is about the problems of PPP projects. These are the projects, whose realization is based on the partnership of the private and public sector. This way brings new possibilities how is building and management of public infrastructure more effective. In theoretical part the basic information concerning the problems of PPP projects is described, its advantages and disadvantages, basic characters and principles. In this thesis is described actual state of PPP projects in the Czech Republic. In practical part the thesis is about specific concession project, whose realization is considered. It is the project of construction and operation of cableway to Spilberk Castle. Within this part at first the entrance data for financial models have been found, after that the financial models have been count and the analysis of sensitivity has been finished. In conclusion the evaluation of project has been done and there was the recommendation how to realize the project.
