The evolution of data protection and privacy in the public security context : an institutional analysis of three EU data retention and access regimes

Since nearly two decades threats to public security through events such as 9/11, the Madrid (2004) and London (2005) bombings and more recently the Paris attacks (2015) resulted in the adoption of a plethora of national and EU measures aiming at fighting terrorism and serious crime. In addition, the Snowden revelations brought the privacy and data protection implications of these public security measures into the spotlight. In this highly contentious context, three EU data retention and access measures have been introduced for the purpose of fighting serious crime and terrorism: The Data Retention Directive (DRD), the EU-US PNR Agreement and the EU-US SWIFT Agreement. All three regimes went through several revisions (SWIFT, PNR) or have been annulled (DRD) exemplifying the difficulty of determining how privacy and data protection ought to be protected in the context of public security. The trigger for this research is to understand the underlying causes of these difficulties by examining the problem from different angles. The thesis applies the theory of 'New Institutionalism' (NI) which allows both a political and legal analysis of privacy and data protection in the public security context. According to NI, 'institutions' are defined as the operational framework in which actors interact and they steer the behaviours of the latter in the policy-making cycle. By focusing on the three data retention and access regimes, the aim of this thesis is to examine how the EU 'institutional framework' shapes data protection and privacy in regard to data retention and access measures in the public security context. Answering this research question the thesis puts forward three main hypotheses: (i) privacy and data protection in the Area of Freedom, Security and Justice (AFSJ) is an institutional framework in transition where historic and new features determine how Articles 7 and 8 of the Charter of Fundamental Rights of the European Union (CFREU) are shaped; (ii) policy outcomes on Articles 7 and 8 CFREU are influenced by actors' strategic preferences pursued in the legislation-making process; and (iii) privacy and data protection are framed by the evolution of the Court of Justice of the European Union (CJEU) from a 'legal basis arbiter' to a political actor in its own right as a result of the constitutional changes brought by the Lisbon Treaty.

This thesis aims to discuss the legal nature of public safety, to elucidate the constitutional parameters of action of bodies responsible for promoting public safety, said the democratic conception of its policies, to discuss the systems perspective model of the Brazilian constitutional public safety and public safety design as essential public service. States the recognition mechanisms for promoting the right to public safety, particularly through the jurisdictional control of their departments and public policies, the implementation of the Code of Consumer and employment of public civil action as a means of ensuring the right to security public, recognizing them as mechanisms of citizenship and the furtherance of human dignity. Party to both the caput of art. 5 of the Federal Constitution which gives the right to security as a fundamental right, as well as art. 144 of the same Constitution, which states, textual and specifically, the constitutional system of public security in Brazil / A Constituição de 1988 trata em disposição específica da segurança pública, delineando o sistema constitucional de segurança pública, o qual abrange os órgãos públicos responsáveis por sua realização. A presente tese tem por finalidade discorrer sobre a natureza jurídica do direito à segurança pública, elucidar os parâmetros constitucionais de atuação dos órgãos responsáveis pela promoção da segurança pública, afirmar a concepção democrática de suas políticas, discorrer sobre a perspectiva sistêmica do modelo constitucional brasileiro de segurança pública, bem como conceber a segurança pública como serviço público essencial. Afirma-se o reconhecimento dos mecanismos de promoção do direito à segurança pública, especialmente através do controle jurisdicional dos respectivos serviços e políticas públicas, da aplicação do Código de Defesa do Consumidor e do emprego da ação civil pública como instrumento de efetivação do direito à segurança pública, reconhecendo-os como mecanismos concretizadores da cidadania e a da dignidade da pessoa humana. Parte-se para tanto do caput do art. 5° da Constituição Federal, o qual apresenta o direito à segurança como direito fundamental, bem como do art. 144 da mesma Carta Magna, o qual prevê, textual e expressamente, o sistema constitucional de segurança pública brasileiro

To put this theme in a wider panorama was performed a bibliographic research on crime and violence seeking to steer the study under the sociological point of view. It is presented an approach of the national public security system, in view of the constitutional principles, with the objective of facilitate the understanding of the role of each organ of that system in the State. To better situate the work it is designed a social profile of the city with the presentation of social indicators directly related to the public safety. It was made a detailed description of the operations of each of the members responsible for public security of the city, including police, prosecutors, judiciary system and penitentiary system, focusing in their systematic aspects. Through the presentation of historical series of data about police occurrences recorded in the city, it was made an analysis of the rates of homicide and crimes against property plotting the growth of these rates with the action of each of the organs of the security system. / Este trabalho analisa as atividades dos órgãos integrantes do sistema de persecução criminal e as taxas de homicídios e de crimes contra o patrimônio na cidade de João Pessoa em 2009. Com a finalidade de contextualizar esse tema num panorama mais amplo foi efetuada uma pesquisa bibliográfica sobre a criminalidade e a violência, buscando-se pautar o estudo sob o ponto de vista sociológico. É apresentada uma abordagem do sistema nacional de segurança pública, tendo em vista os preceitos constitucionais, com o objetivo de facilitar o entendimento do papel de cada órgão desse sistema no âmbito estadual. Para melhor situar o tema central do trabalho, se traça um perfil social da cidade com a apresentação de indicadores sociais diretamente relacionados com a segurança pública. Foi feita uma discrição detalhada da forma de atuação de cada um dos órgãos responsáveis pela segurança pública da cidade, incluindo as policiais, o Ministério Público, o Poder Judiciário e o sistema penitenciário, enfocando-se os seus aspectos sistemáticos. Através de apresentação de séries históricas de dados sobre as ocorrências policiais registradas na cidade, foi feita uma análise das taxas de homicídios e de crimes contra o patrimônio, correlacionando o crescimento dessas taxas com a atuação de cada órgão do sistema de segurança.

De porto a porto : a segurança pública como forma de controle social

A tese analisa a atuação dos secretários de segurança e sua capacidade de gerar mudanças nas instituições de segurança e sobre os índices de criminalidade e violência. O objeto de investigação circunscreve-se ao âmbito do estado do Rio Grande do Sul, na cidade de Porto Alegre, nas gestões da segurança pública do período entre 2001 a 2015. O enfoque é a política de segurança proposta pelos secretários de segurança e os dados criminais da cidade de Porto Alegre, que possibilitam um diálogo com a política criminal portuguesa e programas especiais de segurança pública, executados pela Polícia de Segurança Pública. Para esse cenário, a tese busca apresentar o contexto histórico, social e econômico que favorece a criminalidade em Porto Alegre e na cidade do Porto, fazendo um debate com elementos como planos de segurança, modelos de policiamento, índices criminais, a política criminal portuguesa, a lei que descriminaliza o consumo de drogas em Portugal e os programas especiais da Polícia de Segurança Pública do Porto. Em termos metodológicos, foram realizadas análises de documentos; foram levantados dados sobre criminalidade, reaparelhamento das instituições de segurança, investimento em formação, novas tecnologias e participação social; e foram realizadas entrevistas. O referencial teórico foi constituído por abordagens sobre segurança pública e dilemas da violência e da criminalidade – Benevides (1985), Soares (2003), Adorno (1996), Velho (2000), Silva (1999); “governance” - Wood & Dupont, 2006, Oliveira (2006), Merrien (1998), Johnston & Shearing (2003), Agra (1997), Oliveira (2006), Zedner (2009), Lemieux (2000), Webber (2004) e Jones (2012); e cidadania - Villagómez (1997), Elster (1993), Martin & Ceballos (2004), Sen (2003), Dagnino (2004) e Carvalho (2001). Para desenvolver esta análise, vinculamos o contexto da segurança pública a temas fundamentais como a “governance”, que nos possibilita tomar contato com a gestão a partir de um debate específico e a cidadania, como elemento que imprime um novo ponto de partida para a segurança pública. Pudemos constatar que a segurança pública no Brasil chega de maneira diferente aos estratos sociais. De modo geral, utilizando recursos diversos, os secretários de segurança buscaram dar respostas que definiam um determinado tipo de controle sobre a criminalidade e a violência, os resultados são expostos nos índices de criminalidade. Os enfoques para confrontar a insegurança vão do combate à criminalidade até o enfrentamento da causalidade do crime. A visão sobre o criminoso tem grande diferença, alguns secretários evitam esse ângulo, alguns compreendem que são cidadãos que deveriam ter oportunidades e outros entendem como pessoas irremediavelmente desviantes. Assim, os secretários dividemse entre mais voltados para uma abordagem social-crítica do contexto de criminalidade, os que ficam num estágio intermediário, conservador, buscando ações preventivas e aqueles que se concentram numa perspectiva punitivista e tradicional do combate ao crime. Quanto à Portugal, vem para essa tese para confirmar as possibilidades de uma convivência social pacífica, a despeito da existência de problemas socioeconômicos, destacando elementos culturais importantes na construção de ambientes seguros. Por fim, a Polícia de Segurança Pública demonstra a importância de programas especiais de segurança perenes e bem definidos, voltados a públicos mais vulneráveis. / The thesis analyzes the performance of the secretaries of security and their capacity to generate changes in the security institutions and on the rates of crime and violence. The object of investigation is limited to the scope of the state of Rio Grande do Sul, in the city of Porto Alegre, in the public security administrations of the period between 2001 and 2015. The focus is the security policy proposed by the secretaries of security and the data criminal cases of the city of Porto Alegre, that allow a dialogue with the Portuguese criminal policy and special programs of public security, executed by the Public Security Police. For this scenario, the thesis seeks to present the historical, social and economic context that favors criminality in Porto Alegre and in the city of Porto, by discussing elements such as security plans, policing models, criminal indexes, Portuguese criminal policy, law that decriminalizes drug use in Portugal and the special programs of the Porto Public Security Police. In methodological terms, document analyzes were carried out; data were collected on crime, re-organization of security institutions, investment in training, new technologies and social participation; and interviews were conducted. The theoretical framework was constituted by approaches on public security and dilemmas of violence and crime - Benevides (1985), Soares (2003), Adorno (1996), Velho (2000), Silva (1999); (1998), Johnston & Shearing (2003), Agra (1997), Oliveira (2006), Zedner (2009), Lemieux (2000), Webber (2004) and Jones (2012); and citizenship - Villagómez (1997), Elster (1993), Martin & Ceballos (2004), Sen (2003), Dagnino (2004) and Carvalho (2001) In order to develop this analysis, we link the public security context to fundamental issues such as "governance", which enables us to make contact with management through a specific debate and citizenship as an element that sets a new starting point for security public. The view of the criminal has a big difference, some secretaries avoid this angle, some understand that they are citizens who should have opportunities and others understand them as hopelessly deviant people. Thus, the secretaries are divided among more focused on a social-critical approach to the context of crime, those who are in an intermediate stage, conservative, seeking preventive actions and those who focus on a punitive and traditional perspective of the fight against crime. As for Portugal, he comes to this thesis to confirm the possibilities of a peaceful social coexistence, in spite of the existence of socioeconomic problems, highlighting important cultural elements in the construction of safe environments. Finally, the Public Security Police demonstrates the importance of special, perennial, well-defined security programs aimed at more vulnerable groups.

A presente dissertação analisa as mudanças implementadas na agenda da segurança pública na pós-transição democrática e os motivos pelos quais o modelo de segurança pública no Brasil é tão resistente a reformas. O cenário democrático testemunhou a entrada de novos atores na comunidade da política, e, a partir de então, novas e velhas visões acerca do tema passaram a coexistir. Apesar da crise da segurança pública, explicitada nas décadas de 1980-1990, nenhuma das propostas de reforma estrutural do modelo da política obteve êxito até o momento, o que pode ser explicado pela ausência de uma ampla coalizão em torno de uma agenda mínima de reformas e pelo padrão de dependência da trajetória da política. As mudanças possíveis nesse contexto, embora sejam insuficientes para conformar um novo modelo de política, têm provocado deslocamentos em algumas das características históricas do sistema de segurança pública, promovendo pequenas alterações na sua dinâmica federativa. / This dissertation analyzes the changes to the agenda of public security in Brazil after its democratic transition. It also addresses the reasons why the Brazilian policy model of public security might be so resistant to reforms. The new democratic scenario witnessed new actors entering the policy community and brought together old and new views on the subject. In spite of the crisis in the public security, which was brought to light in the 1980´s and 1990´s, none of the proposals for structural reform of the policy model have hitherto been successful. Such a failure might be explained by the absence of a broad coalition around a minimum agenda of reforms and also by the path dependence of the public security policy. The possible changes in this context, despite being insufficient to forge a new policy model, have led to shifts in some of the historical features of the system of public security, promoting small changes in its federative dynamics.

Percorre o trajeto das políticas de segurança pública até a hodierna configuração de uma política pública de segurança. Investiga o reconhecimento do direito fundamental à segurança pública. Discute o PRONASCI como uma política que alia estratégias preventivas e repressivas no enfrentamento às violências. Metodologicamente, utiliza de revisão de literatura por meio de levantamento bibliográfico, análise de documentos e dados referentes ao Programa e às atividades desenvolvidas para a concretização da segurança pública. Os Conselhos Comunitários de Segurança são uma das várias instituições participativas que apareceram no país desde a década de 1980. Já foram objetos de grande entusiasmo e de igual decepção. Esse trabalho busca compreender os Consegs da cidade de São Paulo de uma forma transversal, com método quantitativo buscando entender seu funcionamento e prática nos diferentes contextos de renda, escolaridade e crime. Dessa forma serão testados os diagnósticos mais pessimistas de que os Consegs são espaços propícios para a reprodução de representações preconceituosas e estigmatizadoras de certos grupos sociais. E também aqueles mais otimistas de que os Consegs produzirão, pela prática do diálogo, comportamentos cívicos e racionais. Além disso, informações históricas serão mobilizadas para propor uma explicação sobre a situação atual dessas instituições. / The Community Councils of Public Security are one instance among others of participative institutions that flourished in Brazil since 1980. They have been considered sometimes with great hope and enthusiasm and other times with exaggerated criticism. This research sought describe and understand how this institutions work throughout the various contexts of the city of São Paulo regarding differences in income, education and crime rates. The intention is to test previous diagnoses: first, those that are more pessimistic and believe that these spaces tend to worsen prejudice and segregation against certain social groups of people. Also will be challenged those diagnoses that are more optimistic and believe that the dialog and reason will produce civic learning. Also, historic information are retrieved in order to propose an explanation for the present situation of these institutions.

Em um recorte histórico mais detalhado, centra-se nos protestos protagonizados por jovens nos dez primeiros anos do século XXI, nas ruas de Salvador-Bahia. A tese defendida é que a repressão de ações coletivas de protestos por parte da policia militar não pode ser explicada exclusivamente pelo passado ditatorial (ainda com impactos na atuação das forças de segurança pública no país) como expressão de uma política de controle social, mas também como expressão de uma noção de ordem (e desordem) decorrente de julgamentos ideológicos pautados em estereótipos e preconceitos sobre a conduta (in)desejada de determinados indivíduos - julgamentos estes, constituídos pelo intercruzamento de variáveis relacionadas aos valores quanto às questões raciais/étnicas, geracionais, de classe e gênero. Valores socioculturais também expressos quando do uso do poder discricionário do policial para definição de quem, quando e como se provoca a des(ordem), na margem deixada pela Constituição Brasileira. Aqui, não se trata de desonerar (ou desculpabilizar) a estrutura ou uma instituição nela inserida para onerar indivíduos por “atos mal feitos”, antes, a questão é alcançar as variáveis e seus intercruzamentos nos momentos de ações e assim contribuir para reflexão sobre uso e abuso da força, ampliando a compreensão do fenômeno. Assim, a investigação enfrenta uma permanente tensão entre estrutura e situação, entre explicação de ordem estrutural e explicação de ordem situacional - de um lado, está o campo da segurança pública que expressa a própria estrutura com uma dinâmica mais resistente às mudanças sociais e, por outro lado, está o campo dos movimentos sociais, que expressa na maioria das vezes o questionamento das estruturas e organizações sociais e por isso são inovadores, indicadores de mudanças sociais e pulsadores da sociedade. Como tema que ainda carece de um campo próprio constituído, tomam-se como fluídas as fronteiras das disciplinais (ciência política, sociologia, antropologia, história, direito) e recorre-se às teorias e teóricos agregados em quatro grandes grupos não unanimes nas abordagens e visões, mas que orientaram a investigação, a saber: teorização sobre estado democrático de direito; teorização sobre o sistema cidadão de segurança pública no estado democrático de direito; teorização sobre a criminalização das ações coletivas de protestos em espaços públicos no estado democrático de direito e, por fim, a teorização sobre os ciclos de protestos. A pesquisa empírica adotou a abordagem metodológica qualitativa, analisando representações sociais, cujo acesso se deu através da captura de discursos oficiais apreendidos via documentos; discursos mediáticos e discursos dos próprios agentes policiais militares. This paper discusses public security of the democratic state in Brazil. Our studies focus on the senses and meanings of actions for the maintenance of law and order during protests in public spaces. At a certain historic moment, it focuses on the protests led by young people in the first years of the 21st century on the streets of Salvador-Bahia. We argue that the suppression of protests by the military police cannot be explained only by the dictatorial past (it still presents impacts on the actions of the public security of our country) as expression of a policy of social control, but also as expression of a notion of order (or disorder) that results from ideological judgments based on stereotypes and prejudices about (not) desired conduct of some individuals – judgments that are based on the mixing of variables related to values of racial/ethnic, generational, class and gender. Sociocultural values are also expressed by the use of arbitrary power by the police for definition of who, when and how to provoke (dis)order, according to the margin left by the Brazilian Constitution. It is not a about exonerating (or excusing) the structure or an institution to be a burden on individuals for “bad behaviors”. The question is to achieve the variables and their interbreeding in times of action, contributing to the reflection on use and misuse of force in a way we can understand the phenomenon. Thus, the investigation faces a permanent tension between the structure and the situation, between the explanation of the structural order and the explanation of the situational order – on one hand there is the public security, which expresses its own structure according to a more resistant dynamics to social changes, and on the other hand there are the social movements, which usually expresses the questioning of structures and social organizations, and therefore they are innovative, indicators of social changes and motivators of society. Being a theme which needs a proper field, it is possible to see the shared borders among disciplines like political science, sociology, anthropology, history, law, and we use theories and authors from four large groups which do not share the same approaches and visions, but which are the base of our investigation: theorization of the democratic state; theorization of the citizen system of public security in the democratic state; theorization of criminalization of collective actions of protests in public spaces in the democratic state; and theorization of the protests cycles. Our empirical search is based on a qualitative methodology, and we analyze social representations through the capture of official discourses from documents, media discourses and military discourses.
