A supremacia (in)constitucional dos poderes do Presidente da República e a teoria da separação dos poderes

No. of bitstreams: 1 JEFERSON MOREIRA DE CARVALHO.pdf: 954314 bytes, checksum: 89972efbab18ad948a174ef911411b9a (MD5) Previous issue date: 2005-11-23 / The purpose of the following thesis is to show that even the Federal Constitution had adopted the Theory of power s division, as according to the idea of Montesquieu, foreseeing the existence of the Executive, Legislative and Judiciary, independents and harmonics, although with an certain control of each other to prevent the concentration of powers in only one person or only one organ, in fact the Constitution itself by preventing the power of the President allows him that he interferes on others powers, therefore, puts him in supremacy related to the Legislative and to the Judiciary. The study in front of the history in Brazil justifies itself, where is noted the President, using the constitutionals powers that are given to him, legislates more than the Legislative name members to the Audit Court, which is Legislative´s aid organ with the function of inspect the President s accounts. What is respected to the Judiciary, the history shows the nomination of integrants of the Courts, who are derived from political parties, fact that is not accepted by the Judiciary that members have compromises with ideologies from a political party. Therefore, the creation of an organ with outer control of the Judiciary, puts him in a lower position in relation to the others powers, which not suffer this kind of control, once more recognizing the interference of the President that name the members of the outer control. Withdraw the presidential is not impose, also this form of government do not allow the absolutism presidential. Basing on Montesquieu´s theory and reading the Constitution there is the conclusion of the necessity in modifications on the Constitutional Text in order to repel the supremacy of powers from the president and locate the Three Powers of the State on the same constitutional level, considering that the experience and the history show that the real and alive forces of powers that constitutes the Brazilian State do not accept the concentration of powers in only one person or only one organism / o Presidente da República detém supremacia em relação aos poderes legislativo e judiciário, através das medidas provisórias, leis delegadas, nomeação para o Tribunal de Contas e nomeações para o Supremo Tribunal Federal e outros órgãos judiciários.

A chefia de Estado na república federativa sob a perspectiva do pensamento de Montesquieu

Este trabalho se propõe a traçar o cenário em que se desdobraram os acontecimentos que instigaram o gênio de Montesquieu a buscar um padrão cientifico para os fenômenos sociais e políticos que tão argutamente observava. Combinando as nuances doutrinárias de Montesquieu, pretende o estudo abordar as premissas conceituais básicas de federação e a ideia clássica da separação de poderes para, em seguida, examinar as atribuições da chefia de Estado numa república que adote o modelo federativo e a separação de poderes como seus nortes estruturais, no contexto de um sistema presidencialista de governo. Com base nas premissas deduzidas examina-se o alinhamento do modelo brasileiro àquelas premissas institucionais que o inspiraram. / The purpose of this research is to depict the events that unfolded within the scenario that provoked Montesquieu to search for a scientific pattern in order to explain the social and political phenomena that he carefully observed in his time. Drawing on the variations of Montesquieu’s doctrines, The work aims to explore the basic conceptual argument of federation as well as the classic idea of separation of powers. Thereafter, It intends to examine the roles of state leadership in a republic whose foundation lies upon the federative model and the separation of powers in a presidentialist system of government. Based on this, the study is going to consider the alignment of the Brazilian model to those institutional propositions that initially provoked Montesquieu’s mind.

Modos de governar e administrar : os conselhos políticos e administrativos de D. Pedro II a partir da seção de fazenda do conselho de estado (1842-1889)

O presente trabalho realizou uma análise e classificação das consultas da Seção de Fazenda do Conselho de Estado, que funcionou no Brasil Império no período de 1842 a 1889, a partir dos modelos administrativos e de governo que influenciaram o funcionamento e organização da administração e do Conselho de Estado. Buscou-se no modelo corporativo do Antigo Regime português as primeiras fontes e raízes para o modelo polissinodal e de governo por conselhos. Posteriormente novos paradigmas e idéias político-administrativas entraram em linha de conta no modelo português, como foi o caso, no século XVIII, dos paradigmas relacionados ao chamado Estado de Polícia. Essas fases da formação do Estado Moderno e paradigmas de governo e administração influenciaram o modelo político adotado no Brasil independente e constitucional e vieram a conformar a atuação do Conselho de Estado no Segundo Reinado. A partir da análise da produção da Seção de Fazenda do Conselho de Estado é possível mapear continuidades e rupturas com modelos anteriores e a adoção de novos paradigmas de governo e administração e explicar o funcionamento do Conselho de Estado sob D. Pedro II. / The present work carried out an analysis and classification of the consultations of the Finance Section of the Council of State, which operated in Empire of Brazil from 1842 to 1889, from the administrative and governmental models that influenced the functioning and organization of the administration and the Council of State. The first sources and roots for the polissynodal model and for government by councils were sought in the corporate model of the Old Portuguese Regime. Subsequently new paradigms and political-administrative ideas came into account in the Portuguese model, as was the case, in the eighteenth century, of paradigms related to the so-called Police State. These phases of the formation of the Modern State and paradigms of government and administration influenced the political model adopted in independent and constitutional Brazil and came to conform the performance of the Council of State in the Second Reign. From the analysis of the production of the Finance Section of the Council of State it is possible to map out continuities and ruptures with previous models and the adoption of new paradigms of government and administration and to explain the functioning of the Council of State under D. Pedro II.

Elas foram destacadas para desempenhar um papel relevante dentro da nossa sociedade na medida em que os serviços prestados pelo Estado foram sendo gradativamente reduzidos. Diante da redução da efetiva participação estatal nos mais diversos setores da sociedade, coube a iniciativa privada o mister de encampar as áreas de atuação produtivas que anteriormente eram exploradas pelo Estado. O Estado por sua vez, ao retirar seu protagonismo em atividades tanto na esfera econômica quanto na esfera social, atribuiu às agências reguladoras o papel de fiscalização e regulação das atividades que a partir desse momento seriam prestadas por entidades privadas. As agências então receberam diversas prerrogativas para que pudessem exercer seus desígnios de maneira mais exitosa. Dentre as prerrogativas recebidas estava a capacidade para a expedição de normas técnicas na área dos serviços prestados pelos entes privados. Tal capacidade lhes fora atribuída em razão da sua notória especialidade dentro de cada setor a ser regulado. No entanto, a atividade normativa das agências reguladoras passou a ser bastante questionada. Do mesmo modo, surgiu o debate acerca da possibilidade do controle do mérito desses atos pelo Poder Judiciário, sem que isso afetasse o princípio constitucional da separação de poderes. Para examinar o presente tema pesquisamos decisões dos Tribunais Superiores no Brasil e também da Suprema Corte dos Estados Unidos, em razão da influência que as agencies norte americanas exerceram sobre as agências reguladoras brasileiras. / The regulatory agencies are completing two decades of birth in Brazil. They were assigned to play an important role within our society to the extent that the services provided by the state were gradually reduced. Before the reduction of the effective state participation in various sectors of society, the private sector fell to the mister encompass the productive practice areas previously exploited by the state. The state in turn to withdraw their role in activities both in the economic sphere and the social sphere, attributed to regulatory agencies the role of supervision and regulation of activities that from that moment would be provided by private entities. The agencies then received various privileges so that they could exercise their designs more successful way. Among the received powers was the ability for the dispatch of technical standards in the area of services provided by private entities. Such capacity given them out because of their notorious specialty within each sector to be regulated. However, the normative activity of the regulatory agencies has become very questionable. Similarly, there was discussion about the possibility of control of the merit of these acts by the judiciary power without it affecting the constitutional principle of separation of powers. To examine this subject, decisions of the Superior Courts in Brazil and the Supreme Court of the United States were research, due to the influence that North American agencies exerted on Brazilian regulatory agencies.
