Among the proposed principles and instruments, the shared responsibility for the products life cycle and the reverse logistic are inducers of a new management model and a great challenge as well. To assist in its operationalization, the NPSW institutes the Sectoral Agreements (SA) and, in São Paulo State, the SA were established by the Commitment Terms of Reverse Logistics (CTRL). Seeking to bring this scenario to light, the current research proposes to present and analyze the implementation of CTRL in São Paulo State. For this, it is presented the historical of the 12.305/2010 law approval process and the waste management scenario post-NPSW. The data and information collection occurred through bibliographic and documentary review, and the CTRL case study was developed with an application of questionnaires and interviews. The State of São Paulo presents 10 signed CTRL, with 08 sectors participating in this research. Inconsistencies were identified regarding the definition of targets and the results obtained by the sectors, which adopted, in most, different metrics. The Secretariat for the Environment of São Paulo State played a fundamental role in stimulating and directing the terms, being the main responsible for establishing them juridically in a legal instrument, acting also in the definition of targets. The participation of different actors in the realization of shared responsibility is still deficient, with a greater accountability to manufacturers. The involvement of cooperatives and public authorities is not a reality yet, which have importance and role beyond the perception of CRTL subscribers. Most of the sectors use support tools (software and GIS) and affirm to have reached the established targets, having as the main difficulty the low interest and participation of the others chain members. It is concluded that the NPSW, despite the slow evolution, should stimulate new and necessary solid waste management practices in Brazil, having the sectoral agreements as a pillar for the reverse logistics and shared responsibility effectiveness. / A Política Nacional de Resíduos Sólidos (PNRS), instituída pela Lei federal nº 12.305/2010, estabelece os princípios norteadores, instrumentos legais e objetivos para ordenar as ações e práticas de gestão de resíduos no Brasil. Dentre os princípios e instrumentos propostos, a responsabilidade compartilhada pelo ciclo de vida dos produtos e a logística reversa apresentam-se como indutores de um novo modelo de gestão, e também um grande desafio. Para auxiliar sua operacionalização, a PNRS institui os acordos setoriais (AS) e, no Estado de São Paulo, os AS foram estabelecidos por Termos de Compromisso de Logística Reversa (TCLR). Buscando trazer à luz esse cenário, a presente pesquisa se propõe a apresentar e analisar a implantação dos TCLR no Estado de São Paulo. Para tanto, é apresentado o histórico do processo de aprovação da Lei 12.305/2010 e o cenário da gestão de resíduos pós-PNRS. A coleta de dados e informações ocorreu por meio de revisão bibliográfica e documental, e o estudo de caso dos TCLR se desenvolveu com a aplicação de questionários e entrevistas. O Estado de São Paulo apresenta 10 TCLR firmados, sendo que 08 setores participaram desta pesquisa. Foram identificadas inconsistências referentes ao estabelecimento de metas e os resultados obtidos pelos setores, os quais adotam, em sua maioria, métricas diferentes. A Secretaria do Meio Ambiente teve papel fundamental no estimulo e condução dos termos, sendo o principal responsável por estabelecê-los juridicamente em um instrumento legal, além de atuar na definição de metas. A participação de diferentes atores na efetivação da responsabilidade compartilhada é deficiente, havendo maior responsabilização aos fabricantes. O envolvimento de cooperativas e do poder público ainda é insuficiente, os quais têm importância e papel que vão além daqueles percebidos pelos signatários de TCLR. A maioria dos setores faz uso de ferramentas de suporte (softwares e SIGs) e afirma ter alcançado as metas estabelecidas, tendo como principal dificuldade o baixo interesse e participação dos demais membros da cadeia. Conclui-se que a PNRS, apesar da lenta evolução, deve estimular novas e necessárias práticas de gestão de resíduos sólidos no Brasil, tendo os acordos setoriais como pilar para efetivação da logística reversa e responsabilidade compartilhada.

The subject of this work is a long-term debate about the collective responsibility which occurs between two opposite opinions on social phenomenon above all. The methodical individualists interpret the social phenomenons with reference to individuals, whereas the methodical holists assert that these cannot be reduced to phenomenons of individuals without any rest. Methodical individualists lean on the classic conception of the moral responsibility which is based on the intended agency in causal connection with the moral wrong. This conception is connected with human beings in its nature, but there is countless of thinkers who bring arguments in favour of the collective moral responsibility which is thought to bring about more good in the world. We will try to introduce this debate in its complexity and its most interesting and important arguments. Within the frame of debate about moral responsibility of collectives, we can meet with the notion of shared responsibility, distributive collective responsibility, non-distributive collective responsibility connected with the organized collectives, the responsibility for historic injusticies and with the conception of moral taint. O objetivo do presente trabalho consistiu na análise jurídica da responsabilidade compartilhada pelo ciclo de vida do produto (RCCVP) e suas principais implicações na cadeia de resíduos eletroeletrônicos, no contexto brasileiro da Política Nacional de Resíduos Sólidos, instituída pela Lei Federal n. 12.305/2010 (PNRS). A análise desenvolvida compreendeu os principais deveres relacionados à prevenção de resíduos e à logística reversa, com um enfoque especial na gestão integrada de resíduos eletroeletrônicos. Baseada nos princípios do poluidor-pagador, da cooperação, da prevenção e da precaução, a RCCVP impõe à cadeia de suprimentos a priorização de medidas de prevenção e redução de resíduos por meio de uma concepção ecológica (ecodesign) para produtos e embalagens, bem como pelo reaproveitamento de materiais residuais como insumos, seja em seu próprio ciclo, seja em outros ciclos produtivos, inclusive mediante sistemas de logística reversa e coleta seletiva, estendendo a responsabilidade do berço ao berço e flertando com um modelo econômico circular. Com vistas a desestimular a estratégia da obsolescência planejada de qualidade, a relevante informação sobre o tempo de vida útil de cada produto durável, em especial a dos eletroeletrônicos, deverá ser ampla e obrigatoriamente prestada pela cadeia produtiva, para que os consumidores, uma vez informados e esclarecidos sobre a sua durabilidade objetivamente aferida, tenham condições reais de exercer, na prática, o seu direito e ao mesmo tempo dever de efetuar escolhas de consumo (ou desconsumo), da maneira mais consciente possível, inclusive sob a perspectiva ecológica. No momento, encontra-se em andamento no país o processo de construção de acordo setorial de abrangência nacional para implementação da logística reversa de eletroeletrônicos de uso doméstico, inclusive os provenientes do setor de telefonia móvel. / The aim of this work was the legal analysis of product lifecycle shared responsibility and its implications in the supply chain of waste electrical and electronic equipment (WEEE), within the scope of the Brazilian National Solid Waste Policy, established by Federal Law 12,305/2010. The analysis encompassed the main duties related to waste prevention and reverse logistics, with a particular focus on the WEEE integrated management. Based on the principles of polluter pays, cooperation, prevention and precaution, the product lifecycle shared responsibility requires the supply chain to prioritize waste prevention and reduction measures through an eco-design approach for products and packaging, as well as the reuse of waste materials as inputs, either in its own cycle, or in other production cycles, including through reverse logistics systems and selective collection, extending responsibility \"cradle to cradle\" and flirting with a circular economic model. In order to discourage the planned obsolescence strategy, the relevant information about the lifetime of each durable product, especially of electronics, should be comprehensive and mandatorily provided by the production chain, so that consumers, once informed and enlightened about its durability objectively measured, have actual ability to exercise in practice their right and duty at the same time to make consumer choices (or non-consumption), the most sensible way possible, even from the ecological point of view. Procedure for implementation of consumer WEEE take-back systems with a national scope, through preparation of Sector Agreement, is currently in progress in Brazil, including those from mobile industry.

Understanding Perspectives of Risk Awareness

Research in risk awareness has been relatively neglected in the health informatics literature, which tends largely to examine project managers’ perspectives of risk awareness; very few studies explicitly address the perspectives held by senior executives such as directors. Another limitation evident in the current risk literature is that studies are often based on American data and/or they are restricted to American culture. Both factors highlight the need to examine how senior executives (i.e., directors) who oversee or direct eHealth projects in Canada perceive risk awareness. This research explores and discusses the perspectives of risk awareness (i.e., identification, analysis, and prioritization) held by directors and project managers who implement Canadian eHealth projects. Semi-structured interviews with nine directors and project managers uncovered six key distinctions in these two groups’ awareness of risk. First, all project managers valued transparency over anonymity, whereas directors believed that an anonymous reporting system for communicating risks had merit. Secondly, most directors emphasized the importance of evidence-based planning and decision making when balancing risks and opportunities, an aspect none of the project managers voiced. Thirdly, while project managers noted that the level of risk tolerance may evolve from being risk-averse to risk-neutral, directors believed that risk tolerance evolved toward risk-seeking. Directors also noted the importance of employing risk officers, a view that was not shared by project managers. Directors also believed the risk of too little end-user engagement and change management was the most important risk, whereas project managers ranked it as the least important. Finally, when directors and project managers were asked to identify and define the root cause(s) of eHealth risks, directors identified the complexity of health care industry, while project managers attributed it to political pressure and a lack of resources where eHealth projects are concerned. This research proposes that the varied perspectives of risk awareness held by directors and project managers must be considered and integrated to properly align expectations and build partnerships for successful eHealth project outcomes.
