Even at authoritarian times, social rights have been formally recognized, given that the Federal Constitution of 1988 gave them enormous attention. However, realization of social rights requires, beyond the state action, the commitment of workers and their unions, occupying Article 8., III CF/88 position of prominence in this particular, by allowing the union, as a procedural substitute, to file lawsuits in defense of collective rights (especially of a certain workers class) and homogeneous individual rights of its members. This ensures isonomic access to justice to the members of the class (especially professional), and also decrease the excessive amount of individual claims and increase the number of workers protected. Finally, the most frequent activities of the union as a procedural substitute for workers, beyond strengthening the ties between them, will reduce the low rate of spontaneous compliance of the constitutional and legal norms which enshrine social rights by employers, also reducing, as a result, judicial cases and relieving the Labor Courts. / No Brasil, através dos direitos sociais, foram consagrados, de forma paralela, os direitos civis e políticos. Mesmo em períodos autoritários, os direitos sociais foram reconhecidos formalmente, sendo certo que a Constituição Federal de 1988 deu a eles enorme destaque. Contudo, a concretização dos direitos sociais, além de prestações do próprio Estado, requer o empenho dos trabalhadores e de seus sindicatos, ocupando o artigo 8º., III da CF/88, neste particular, posição de destaque, ao possibilitar que o sindicato, na condição de substituto processual, ajuíze ações em defesa dos direitos coletivos (da categoria profissional, enquanto tal) e dos direitos individuais homogêneos de seus membros. Isso garante aos integrantes da categoria (notadamente profissional) isonomia no acesso à justiça, além de diminuir a quantidade excessiva de reclamações individuais e aumentar o número de trabalhadores tutelados. Por fim, a atuação mais freqüente do sindicato como substituto processual dos trabalhadores, além de fortalecer os laços entre eles, aumentará o baixo índice de cumprimento espontâneo pelos empregadores das normas constitucionais e legais que consagram os direitos sociais, reduzindo também, via de conseqüência, os processos judiciais e desafogando a Justiça do Trabalho.

A partir do levantamento e análise de documentos oficiais foi possível trabalhar o quadro de indefinições vivenciado pelas comunidades quilombolas no Brasil e, especificamente, na região do Vale do Ribeira Paulista. O processo de regularização dos territórios quilombolas para ser analisado foi dividido em três etapas: 1) Identificação e Demarcação dos Limites; 2) Reconhecimento Oficial; 3) Outorga do Título e Registro no Cartório de Imóveis. Desta forma, foi possível delinear como os embaraços e lacunas do jogo político, que envolve a questão, se refletem no trabalho de regularização dos territórios de quilombo que essas instituições promovem / Abstract: The land regularization process occupied by communities of "quilombo? triggered by Article 68 of the Constitutional Act of the Transitional Provisions - ADCT from the Constitution of 1988 stipulated that "the ownership to the remnants of Quilombo communities who are occupying their land are recognized as definitive, and shall the state issuing them their titles. " From the survey and analysis of official documents with the government and interviews we could work the situations experienced by lack of "quilombos? laws in Brazil and specifically in the state of São Paulo. Thesis title: Right to health and legitimate expectations in perspective of the standards and above-standards in Czech health care system This diploma thesis deals with the legal regulation of the right to health as a social right. In the first chapter, the genesis of the social rights, their specific characteristics and the social rights' role in relation to civil and political rights are analysed for the purpose of interpretation of the right to health. The actual problematics of legitimation crisis based on the states' inability to fulfil the obligations and expectations rising from social rights are later discussed. In relation to the socio-legal context, the international legislation as well as some specific national legislation of the right to health are analysed in detail within subsequent chapter. With this regard, the practice of the courts as well as the practice of the quasi-judicial bodies is considered in the following chapter, especially with respect to the right to health and its relation to some civil and political rights. The standardization process of right to health within this decision-making practice is also examined. Moreover, the right to health is explored in perspective of the Czech legislation. Social assistance : legal reforms to improve coverage and quality of life for the poor people in South Africa

The South African Constitution in section 27(1)(c) obligates the state to develop a comprehensive social security system. It affirms the universal right to access to social security, including appropriate social assistance for those unable to support themselves and their dependants. It orders the state to take reasonable legislative and other measures, within its available resources, to achieve the progressive realisation of these rights. The underlying normative commitment of social security is the improvement of the quality of life of the population by promoting economic or material equality. Social security ensures that all citizens have a stake in society and that each individual has an incentive to contribute to the development of the commonwealth. It plays a crucial role in the lives of communities and families viewed in the context of social transfers which provide broader development objectives and tackles income poverty transfers. The objectives of this study are threefold. Firstly, it examines the extension of social assistance coverage to the indigents in South Africa. Secondly, it looks at the legal mechanisms employed by courts and government in order to improve the social security rights of the poor in South Africa. Thirdly, the research investigates the possible reform and trends in India and Brazil with the aim of improving South Africa’s system of social security.
