Le droit au logement en France et en Italie / The right to adequate housing in France and Italy

L’homme n’habite plus vraiment, il s’abrite. Habiter exige une « part de monde » propre à l’individu afin que se réalise l’évènement de demeurer. Le droit au logement rend compte d’une exigence démocratique qu’il convient de prendre au sérieux au sein des sociétés française et italienne. Elle se manifeste inévitablement comme l’expression d’une certaine ouverture du droit positif au présent, le droit ne pouvant rester aveugle à ce qui l’entoure. L’individu questionne constamment ses ressources lorsque ces dernières ne suffisent pas ou plus à lui assurer une existence digne et se tourne le cas échéant vers la solidarité nationale afin d’y remédier. Il convient dès lors de s’interroger sur la consistance normative du droit au logement en droit comparé au regard de la convergence de ses sources internationales et nationales. Cet enrichissement donne corps à une mise en œuvre selon le principe de subsidiarité opérée par les acteurs les plus proches de la misère sociale à qui il revient en définitive de traduire la signification du droit au logement. / Man no longer truly lives somewhere, he shelters. To live somewhere would entail a “part of the world” belonging to the individual in order for the évènement de demeurer to arise. The right to adequate housing conveys a democratic requirement that must be taken seriously. This requirement reveals itself inevitably as an expression of a certain openness of positive law to the present, the law being unable to ignore its surroundings. The individual constantly questions his resources when they are insufficient or no longer ensure a dignified existence and turns, if needs be, to national solidarity as a remedy. Consequently, it is important to analyse the normative substance of the right to adequate housing in the light of the convergence of its international and national sources. This enrichment furthers the application of these norms, by the principle of subsidiarity, by the actors closest to the social misery upon whom it bears to give meaning to the right to adequate housing.

Foram analisados 83 artigos, nos quais se procurou identificar os conceitos de direito social, cidadania, participação social e lazer, no intuito de que possam fornecer subsídios para uma análise rigorosa da concepção de homem, de mundo e de sociedade que tem fundamentado a produção teórica no campo lazer. Os estudos do lazer estão inseridos em um contexto maior da produção intelectual no Brasil e no mundo, expressando os conflitos sociais, influenciando e sendo influenciado pelo conjunto de conhecimentos difundidos em uma época. Tendo em vista as características presentes nas concepções de Estado, em especial nas perspectivas neoliberal e marxista, foram identificados alguns aspectos importantes que relacionam os conceitos aqui explorados com a concepção de Estado que estes acabam fundamentando. Ficou clara, na pesquisa, a existência de uma lacuna quanto à problematização dos conceitos de cidadania e direito social, tratados como termos autoexplicativos e quase sem referência teórica. A participação social é, muitas vezes, confundida com responsabilização da sociedade civil, o que enfraquece o Estado e dá poder ao mercado. No que se refere ao lazer, a discussão ocorre de maneira descontextualizada, que não favorece sua vinculação a um projeto de emancipação social. Em conjunto, esses artigos não oferecem uma proposta alternativa ao modelo de sociedade neoliberal e, portanto, o lazer não apresenta potencial para superar a legalidade em favor de sua legitimidade como direito social / The research aimed to analyze in articles published in Congress, Seminars and Magazines about Public Policies of Leisure in Brazil from 1988 to 2009, the possible contributions that these productions brought to the consolidation of Leisure as a social law. We analyzed 83 articles, in wich we identified the concepts of social law, citizenship, social participation and leisure, to enable them to provide support for a rigorous analysis of the conception of man, world and society that are grounded in the theoretical field of leisure. We believe that studies of leisure are part of a larger context of intellectual production in Brazil and around the world, expressing social conflicts, influencing and being influenced by knowledge dissemination in a season. Considering the concepts of state, especially from the perspectives neoliberal and marxist, we identified important issues that relate these concepts to the design of state that they reinforce. We note the existence of a fault on the problematization of the concepts of citizenship and social law, treated as terms and almost self-explanatory without reference theory. Social participation is often confused with accountability of civil society, which weakens the state and gives power to the market. As for leisure, the discussion is decontextualized, which is not conducive to their connection with a project of social emancipation. Together, these articles do not offer an alternative to the neoliberal model of society and, therefore, does not reach the leisure legitimacy as a social law, restricting themselves to legality

Unga lagöverträdare - Samhällets kompromiss? : En studie av socialtjänstens yttranden

Abstract In Sweden all persons under the age of 18 are considered children. The age when it is possible to be held responsible for a criminal act, and therefor convicted in court, is 15. Society’s and, perhaps first and foremost, the authority’s attitude towards juvenile crime is that they should not be equal adults in the process within criminal law. Because children are considered essential for the society of tomorrow, it is important to pay extra attention to crimes committed by juveniles. The social services authorities are considered to have the best resources and competence to handle this group of juveniles. In the criminal law process the prosecutor requests a statement regarding the young person who is reasonably suspected of a criminal act. The statement should contain information about if the young person is in need of certain interventions from social services in order to prevent unfavorable development. The conclusion that has been drawn when the statements has been reviewed is that a borderland has been created where social law and criminal law overlap. This overlapping is in a way a collision where social aspects and principles of criminal law have to meet. However, it is not always easy to make both sides satisfied. As a way to meet the needs of both sides the borderland becomes a compromise consisting of the process regarding the juveniles. The purpose of this essay is to describe and understand the compromise that has been made where statements and young juveniles are existing. The aim of this essay is to study 23 statements from social services that prosecutor request and the 23 court records attached to them. All statements and court records are regarding persons between 15 – 17 years old. The study is limited to the period between 2010-01-01 to 2010-12-31. This essay has been from a qualitative point of view where the discourse analysis as an text analytical method has been used to understand the collected statements and court records. Central results is that the statements reviewed in this essay overall are satisfying in fulfilling the social law and criminal law aspects. However the results also point out that an uncertainty within the social services regarding the design of the statements also is to be found. Descriptions of social aspects about the young juvenile behind the statement seems to be important to emphasize.

Out and about in the welfare state : the right to transport in everyday life for people with disabilities in Swedish, Danish and Norwegian law

The aim of this thesis is to identify how a social citizenship for people with disabilities is shaped bythe normative structures in the Swedish, Danish and Norwegian law governing their right to transportin everyday life. The thesis deals with three types of transport provided by the public to private individuals: transport services, car allowances, and cash benefits for reimbursing transport costs forpeople with disabilities. For each provision, the focus of the study is directed by the followingquestions: – Is there a rights/duties relationship between the public and the individual? Who is eligible forprovision? How does public funding impact entitlement? Who is obliged to provide? What are thelegal guarantees for entitlement? Despite objectives within Nordic law and policy that people with disabilities should be compensated for their impairments, and allowed to lead independent and autonomous lives, the results from the thesis show that the various transport provisions do not fully realize this. The legal relations between the public and those with needs for transport in their everyday lives are characterized by control, scrutiny and questioning. In order to protect the public budgets from costs, the eligibility criteria in the law are so constructed as to ensure that only certain needs for transport, and only some impairments, can meet them. The national, regional and municipal governments, and the administrative courts, subject people with disabilities to intrusive inquiries regarding personal details and other circumstances in their lives, in order to be able to judge which needs for transport are to be considered legitimate and which are not. The thesis shows that the individual rights to, especially, Swedish and Norwegian transport provisions are poorly protected against political decisions to cut funding. Local and regional self-governance isan interest that always competes with individual legal rights and make them weaker, irrespective of whether these rights can be appealed in administrative courts. The conclusion in the thesis highlights how a social citizenship is shaped in the law governing the right to transport for people with disabilities, and that this social citizenship does not reinforce independence and individual autonomy for those who are dependent on the various provisions tomeet their needs for transport in their everyday lives.

La notion d'incitation est au cœur des théories économiques modernes. Elle vise à obtenir des agents concernés un certain comportement par la promesse d’une récompense, comportement qu'il n'aurait pas été rationnel pour eux d’adopter sans la présence de cet avantage. En tant que dispositif juridique, l’incitation peut être définie comme un mécanisme cherchant à orienter le comportement de ses destinataires dans un sens déterminé, par la promesse d’une contrepartie avantageuse. Ces dispositifs incitatifs se développent dans l’ensemble des matières juridiques. Il est toutefois un domaine particulier du droit dans lequel il est particulièrement intéressant à étudier : le droit social. Si le législateur laisse au destinataire de la règle le choix d’adopter ou non le comportement incité, il n’en compte pas moins sur le raisonnement rationnel de ce dernier qui devrait se laisser convaincre par la perspective de l’avantage promis. Il est donc improbable, a priori, de trouver ce type de règles dans les matières largement régies par des dispositions d’ordre public.À travers l’analyse du dispositif juridique incitatif dans un domaine aussi vaste et complexe que le droit social, c’est en définitive à une étude des transformations de la normativité juridique que nous nous livrons. Cet instrument des conduites juridiques, si particulier et pourtant si présent dans le droit, donne à voir toute la richesse que peut offrir le droit, en même temps qu’il révèle les dédales obscurs que doivent parcourir ses élaborateurs pour produire, sans effets pervers, les effets escomptés. / The concept of incentive is at the heart of modern economic theories. It aims to get involved some behavior by the promise of a reward, behavior that would not be rational for agents to adopt without the presence of this advantage. As a legal rule, the incentive can be defined as a mechanism seeking to guide the behavior of its recipients in a given direction, with the promise of a reward. These incentives are developed in all legal matters. However, it is a particular area of law in which they are particularly interested to study: social law. If the legislature let the recipient free to adopt or not the behavior encouraged, it does not count less on rational reasoning. It is unlikely to find such rules in matters largely governed by the public order.Through the analysis of the incentive legal system in an area as vast and complex as the social law, it is a study of the transformation of legal normativity that we deliver. This legal instrument gives to see the richness that can provide the law at the same time it reveals the several ways its developers have to take to produce the expected effects.

Human Rights and Sustainable Development Law : Sustainabale Development Law :The Path to Sustainable Peace

<p>This paper considers the fast changing developments and changes in relation to sustainable development law with its three pillars, and the needs of international development. The focus of the analysis is on the connection between international economic, international social and international environmental law which constitute sustainable development law at their intersection point, and will show how they can be the paths to sustainable peace. As sustainable development law is emerging as international concern, the qualitative approach of this paper will show its pillars separately and their connection under different conditions. This paper also demonstrates that this approach is gaining ground in the literature, and it contends that it is a more appropriate way of addressing the problems of economic, social and environmental. In support of this argument, the paper looks initially how sustainable development law fits to be the path to sustainable peace within the contemporary world which is full of economic, social and environmental conflicts. Secondly, it provides a theoretical framework how sustainable development law with its pillars can lead the world to sustainable peace. Thirdly, the three pillars, (-international economic law, international social law and international environmental law-), will be elaborated in relation to their intersection and sustainable development law.</p>

Traduzindo conflitos e enunciando direitos : a 1a Junta de Conciliação e Julgamento de Porto Alegre como espaço de disputa por direitos trabalhistas (1941-1943)

O trabalho aqui exposto pretende explorar a repercussão, nos anos iniciais da Justiça do Trabalho no Brasil, do processo de regulação das relações de trabalho que toma forma a partir dos anos 1930, através do exame da experiência jurídica vivida por aqueles que buscavam esse meio institucional durante o período abordado, bem como o papel da Justiça do Trabalho no desenvolvimento e disseminação dos direitos sociais já estabelecidos em lei. Mais especificamente, pretende-se demonstrar o perfil e, com o passar do tempo, as mudanças no objeto das reclamações trabalhistas realizadas à 1a Junta de Conciliação e Julgamento de Porto Alegre durante o lapso temporal compreendido entre junho de 1941 e dezembro de 1943. Para tanto, foram analisadas todas as reclamações feitas à 1a Junta de Conciliação e Julgamento de Porto Alegre durante o período indicado, tomando-se como critérios principais para a catalogação dessas: a) os fatos narrados como fundamentos dos pedidos (isto é, os fatos que eram tomados pelos reclamantes como fundamentos de pretensões legais) e b) o enquadramento legal dos direitos postulados. A partir disso, deve ser evidenciada a pouca repercussão das inovações legais que informavam o novo “direito social” em formação e, por outro lado, uma expansão (ao longo do período) dos fatos sociais tidos como fundamentos de pretensões legais e, dessa forma, verbalizados em demandas judiciais, o que é indicativo, por sua vez, de uma consolidação da Justiça do Trabalho como espaço de satisfação de interesses e como instrumento de permeabilização das relações de trabalho pelo arcabouço normativo já estabelecido na época. Atentando à prática jurisdicional cristalizada nas fontes examinadas, portanto, pretende-se contribuir para a compreensão do processo de regulamentação das relações de trabalho no Brasil, em diálogo com a produção historiográfica voltada ao tema. / The work here exposed intends to explore the repercussion, in the initial years of the Labor Justice in Brazil, caused by the regulation process of the labor relations that takes shape from the 1930’s, through the examination of the juridical experience lived by those who searched this institutional space during the period addressed, as well as the role of the Labor Justice in the development and dissemination of the social rights already established by labor legislation. More specifically, it is intended to demonstrate the profile and, in the course of time, the changes in the object of the claims made to the 1st Board of Conciliation and Judgment of Porto Alegre during the temporal lapse between June of 1941 and December of 1943. For this purpose, all the claims made to the 1st Board of Conciliation and Judgment of Porto Alegre were analyzed during the indicated period, taking as main criteria for cataloging these: a) the facts narrated as basis of the requests (that is, the facts that were taken by the claimants as base to legal pretensions) and b) the legal typification of the postulated rights. From this, must be emphasized the little impact of the legal innovations that informed the new “social law” in formation and, on the other hand, an expansion (over the period) of the social facts taken as basis to legal pretensions and, in this way, verbalized in judicial demands, which indicates a consolidation of the Labor Justice as space for the indulge of interests and as a permeabilization instrument of the labor relations by the normative framework established at the time. In view of the jurisdictional practice crystallized in the examined sources, therefore, it is intended to contribute to the understanding of the regulation process of the labor relations in Brazil, in dialogue with the historiography production directed to the theme.

Evidencia, em termos de síntese e contradição da temática, que o SINASE tende a se consolidar como o “lócus” de concentração e articulação de políticas sociais e saberes profissionais que não deixam de implicar, estrategicamente, os dois conceitos, a interdisciplinaridade e a intersetorialidade.
