A presente pesquisa teve por objetivo estudar o princípio da melhoria da condição social do trabalhador, como elemento central e teleológico do direito do trabalho, a fim de verificar aspectos relevantes para a contextualização sociológica, histórica e jurídica desse ramo do direito e contribuir para a construção de uma racionalidade de justiça social. Partindo da intrínseca relação do direito do trabalho com o sistema capitalista de produção e com o conflito de classes sociais inerente ao referido sistema, questionou-se o papel desse ramo jurídico, como instrumento de emancipação da classe trabalhadora ou de preservação dos interesses do capital. A finalidade da doutrina da conciliação das classes sociais e alguns dos principais aspectos de sua implementação no Brasil foram trazidos para o conjunto analítico. Foram analisados os reflexos das transformações do Estado e, portanto, do direito, para o princípio da melhoria da condição social do trabalhador, a partir das mudanças de uma estrutura normativa liberal para a social, passando pelo impacto da ideologia neoliberal e da reestruturação produtiva das últimas décadas. A dinâmica normativa dos princípios e em especial do princípio da melhoria da condição social do trabalhador e a verificação de aspectos importantes da relação deste princípio com outros centrais do direito do trabalho foram abordadas. Foram revisitadas as principais técnicas e situações jurídicas de aplicação do princípio em estudo, a partir da perspectiva de direito social e da contribuição para o fortalecimento da classe trabalhadora. Por fim, apresentouse uma reflexão, à luz do princípio da melhoria da condição social do trabalhador, a respeito da problemática da terceirização, da rotatividade da mão de obra e do excesso de jornada de trabalho. / This research aimed to study the principle of improvement of workers social conditions, as a central and teleological element of Labor Law in order to analise relevant aspects for the sociological, historical and legal contextualization of this branch of Law and also to contribute to the development of social justice rationality. Based on the intrinsic relationship of Labor Law with the production capitalist system and also based on the class conflict which is inherent in the previously mentioned system, the role of this branch of Law was questioned as an emancipation tool for the working class or as a tool for preserving the interests of the capital. The purpose of the doctrine of reconciliation of social classes and some of the key aspects of its implementation in Brazil were scrutinized. Reflections of state transformations were analyzed and therefore the right to the principle of improvement of the workers social conditions were also analyzed, based on changes which would alter a liberal regulatory framework into a social one, through the impact of neoliberal ideology and of the restructuring of productive decades. The dynamics of normative principles and in particular the principle of improvement of workers social condition and the analysis of important aspects of its relationship with other central principles of Labor Law were addressed. The main technical and legal situations of application of the principle being studied were rewied from the perspective of Social Law and from the perspective of contribution to strengthening of the working class. Finally, a reflection, under the light of the principle of improvement of workers social condition, about the issues of outsourcing, labor turnover and excessive working hours presented.

Apontando a necessidade de problematizar os trabalhos que tendem a generalizar (e branquear) as relações escolares da escola paulista nas primeiras décadas do século XX, e partindo da hipótese que os negros, obstante às limitações, frequentaram os grupos escolares nesse período, a tese pretendeu discutir a escolarização de crianças negras na cidade de São Paulo. O período que compreende os anos de 1920-1940 marca as transformações das estruturas econômicas, sociais, políticas e ideológicas da cidade de São Paulo, e as discussões sobre a necessidade de democratizar a educação popular no sentido de alfabetizar as massas também se faziam presentes. Para realizar a análise utilizamos pesquisa bibliográfica e investigação documental. Com base nos jornais da imprensa negra paulista, que tratavam das aspirações por educação e instrução profissional, nas pesquisas etnológicas realizadas pelo Departamento de Cultura da Prefeitura Municipal de São Paulo na década de 1930, nos depoimentos de famílias negras da Coleção Memória da Escravidão em Famílias Negras de São Paulo (Universidade de São Paulo) e na documentação oficial depositada em arquivos públicos estadual e municipal, foi possível considerar a presença de crianças negras nos grupos escolares da capital. A partir dessas fontes construiu-se um perfil racial deste universo escolar, que revelou a inserção de crianças negras na ordem de, aproximadamente, 10%. A presença negra na escola paulista traz a compreensão de que os negros obtiveram oportunidades de escolarização quando da implementação da Escola Nova, especialmente pela intenção dos reformadores paulistas em disciplinar os diferentes grupos étnico-raciais que perfaziam o universo escolar, para enfim, propagar os valores republicanos e reformar a vida social paulista rumo à modernidade anunciada. / Pointing out the need to problematize the works that tend to generalize (and whiten) school relations of schools from São Paulo city in the early decades of the twentieth century, and assuming that blacks, despite the limitations, attended school groups during this period, the thesis intended to discuss the education of black children in São Paulo city. The period that covers the years 1920-1940 marks the transformation of economic structures, social, political and ideological of São Paulo city, and discussions about the need to democratize education in the sense of popular alphabetize the masses were also presented. It has used bibliographic and documentary research to conduct the analysis. Based on the journals of the black press in São Paulo, which dealt aspirations for education and professional instruction in ethnological research conducted by the Department of Culture of the municipal government of São Paulo city in the 1930s, in the testimonies of black families Collection Memory of Slavery in Black Families of São Paulo (University of São Paulo) and in the official documentation filed in state and local public records, it was possible to consider the presence of black children in school groups from São Paulo city. From these sources it has built a racial profile of this school universe, revealed that the inclusion of black children in the order of approximately 10%. The black presence in schools from São Paulo brings the understanding that blacks had opportunities of schooling when the implementation of the New School, especially the intent of reformers from São Paulo to \"discipline\" the different ethnic and racial groups that accounted for the school environment, to finally spread republican values and reform of social life of São Paulo city toward modernity announced.

Die Forschungsarbeit hat das Betriebliche Eingliederungsmanagement (im Folgenden BEM) in kleinen und mittleren Unternehmen (im Folgenden KMU) zum Gegenstand. Einerseits wird die Rechtsnorm gem. § 84 Abs. 2 SGB IX aus arbeits- und sozialpolitischer Sicht in Form und Funktion aufgearbeitet. Andererseits wird eine manuale Strategie zur Umsetzung des BEM entwickelt, mittels derer 42 BEM-Fälle in 10 KMU begleitet werden. Nach Diskussion der theoriegeleiteten Erkenntnisse und empirischen Ergebnisse folgt ein Ausblick. Es werden Anregungen zur weiterführenden Forschung gegeben, aber auch Forderungen an die Politik formuliert, die im Handlungsfeld der Präventionsnorm bestehenden und durch die Forschungsarbeit aufgedeckten Problempunkte aufzulösen und somit einen wirksamen Praxistransfer des BEM zu ermöglichen. / The research paper concentrates on Corporate Integration Management (CIM) in small and medium companies (SME). On the one hand the task consists in reviewing the form and function of the legal norm under Section 84 Subsection 2 of Book IX of the German Social Code (SGB) in terms of labour and social policies. On the other hand a manual-based strategy for implementing CIM shall be developed. Following the integration of the legally valid CIM concept with the appropriately adapted framework the manual is subjected to an empirical review. By accompanying 42 CIM cases in 10 SMEs it has been possible to show on the basis of partly standardized and open guided interviews with company experts that the introduction and implementation of CIM is markedly enhanced by means of this manual. The discussion of the theory-guided findings and the empirical results is followed by an outlook. Suggestions for further research are made while the political establishment is called upon to resolve the challenges existing within the scope of the prevention norm and revealed in the research paper thus facilitating an effective transfer of the CIM theory into the practice field.

Par les technologies de l'information et de la communication, les liens juridiques, sociaux, économiques et organisationnels entre le salarié et l'employeur se sont modifiés. L'usage des technologies a des effets sur de nombreux aspects oudimensions du travail qui sont intimement liés à la personne même du salarié. Avec l'article 8 CEDH comme fil conducteur et source principale des réflexions, la thèse réaffirme que le droit du travail et celui des droits de l'homme sont intimementliés et que l'article 8 CEDH s'applique aux relations entre travailleur et employeur. A l'aide d'une approche comparative, l’auteur analyse le droit à la vie privée du salarié en droit européen, en droit français et en droit suisse en faisant apparaître lesdifférences et les lacunes de l’un ou de l’autre droit. La première partie pose les bases du droit à la vie privée du salarié (vie familiale, domicile, correspondance, protection des données). Le difficile équilibre entre les intérêts de l'entreprise à sauvegarder sa sécurité et celui du travailleur à préserver son intimité fait l'objet de l'analyse. La deuxième partie traite de la mise en oeuvre de la protection de la vie privée du salarié en passant par l'élaboration des normes, les types de régulation etl'application qui en est faite par les autorités de surveillance nationales et par les autres acteurs internes ou externes à l'entreprise. La thèse démontre, sur la base d'une analyse comparée, qu' une meilleure protection du droit fondamental à la vie privée du salarié peut être valablement mise en oeuvre par le biais d'un règlement interne à l'entreprise, si possible discuté et négocié entre les partenaires sociaux. L'objectif est de protéger le droit à la vie privée de l'employé, non seulement en théorie, mais surtout en pratique. / As a result of information and communication technologies, ties of a legal, social economic and organisational nature between employee and employer have changed. Use of technology impacts several areas and dimensions of the working arrangement that are inextricably linked to the employee’s personal status. Using Article 8 EDHR as the leitmotiv and main source of analysis, this thesis reaffirms that employment law and human rights law are intertwined, and that Article 8 EDHR can be applied to relations between worker and employer. Using a comparative approach, the author analyses employees’ rights to privacy under European, French and Swiss law — highlighting their differences and shortcoming in relation to each other. Part one lays the foundation of employees’ rights to privacy with regard to family life, home life, correspondence and data protection. The delicate balance between the interests of the company in safeguarding its security and those of the worker in protecting his or her private life are analysed. Part two deals with the way in which privacy protection can be implemented, looking at the drafting of standards, types of regulation and the application made of the latter by national oversight bodies and by agents inside and outside the company. The research demonstrates that, on the basis of comparative analysis, improved protection of basic rights to employee privacy can legitimately be put in place through a company’s bylaws, preferably through discussions and negotiations with social partners. The goal is to shield employees’ privacy, not only in theory but most importantly in practice.

Nationella socialförsäkringssystem är inte anpassade för internationella situationer. Problem beträffande socialförsäkringstillhörighet kan därför uppstå när en person arbetar i flera länder samtidigt. EU har skapat ett samordningssystem för att nationella regler ska passa ihop i internationella situationer. Samordningssystemet uppdaterades nyligen genom införandet av förordning nr 883/2004 samt tillhörande tillämpningsförordning som ersatte förordning nr 1408/71 och dess tillämpningsförordning. Samordningssystemet innehåller lagvalsregler som pekar ut vilket stats lagstiftning som är tillämplig på en person i en gränsöverskridande situation. Endast ett lands lagstiftning kan tillämpas på en viss situation. Huvudregeln, när en person arbetar i flera medlemsstater, är att personen ska omfattas av arbetsstatens lagstiftning. I undantagsfall kan person istället omfattas av bosättningslandets lagstiftning. I förordning nr 1408/71 fanns begrepp som saknade uttryckliga definitioner vilket medförde att det var oklart vad som krävdes för att uppfylla förutsättningarna för att omfattas av undantagsregeln. Begreppsproblematiken i förordning nr 1408/71 har till viss del eliminerats i och med införandet av förordning nr 883/2004, eftersom tidigare oklara begrepp helt tagits bort. Lagstiftaren har även valt att behålla ett tidigare oklart begrepp men utvecklat begreppets innebörd. Det kan också konstateras att ny begreppsproblematik har tillkommit i och med införandet av förordning nr 883/2004. Författaren anser att trots att lagstiftaren i nuvarande lagstiftning mer utförligt förklarar begrepp som kan bli föremål för tolkningsproblem är förklaringarna inte tillräckligt utförliga. Det kvarstår väsentliga brister i förklaringarna som ger upphov till nationella tolkningar som äventyrar en konform tolkning av begreppen och tillämpning av lagvalsregeln. / National social security systems are not adapted to international situations which can cause problems when a person is working in two or more Member States. EU has therefore created a coordination system which makes the national systems fit better together in international sitautions. The coordination system has recently been updated and regulation no 1408/71 and regulation no 574/72 have been replaced by regulation no 883/2004 and regulation no 987/2009. The main rule for determining the legislation applicable provides that the legislation of the Member State in which a person is working is applicable. When a person works in several Member States problems occur when trying to determine the applicable legislation, therefore the legislation in the State och residence can be applied instead. In order for the legislation in the State of residence to be applicable several critera in regulation no 1408/71 had to be fulfilled. These criteria contained words which missed explicit defintions. The lack of clarity made it unclear what was required to meet the criteria to be subject to the exemption rule. The problems concerning the lack of clarity regarding the criteria has partly been eliminated with the introduction of the new regulation. The legislature have taken away some of the unclear words but also kept some of them. It may also be noted that some new unclear words have been added. The author finds the explantions to the vague words in the new regulation more detailed than before but is still concerned with the fact that the explanations are not detailed enough. The opinion of the author is that the explanations have significant weaknesses which give rise to national interpretations. These national interpretaions will in turn endanger a consistent interpretation of the words and application of the rules of conflict

Le droit du travail a connu au cours de ces trente dernières années des évolutions remarquables avec, d’une part, l’apparition de nouvelles technologies de l’information et de la communication au sein des entreprises et, d’autre part, l’émergence de l’exigence de justification. Alors que les employeurs sont désormais tenus d’énoncer leurs raisons d’agir et que les salariés travaillent sur des postes informatisés, se pose la question de savoir dans quelle mesure ces nouvelles caractéristiques du monde du travail ont modifié les règles de preuve applicables en la matière. Si la charge de la preuve ne paraît pas avoir été affectée par ces différentes évolutions, il en va différemment de l’objet de la preuve. En effet, l’apparition des toutes dernières technologies de l’information et de la communication participe, au-delà des apparences, à un déplacement de l’objet de la preuve, les salariés ayant désormais accès à de nouveaux éléments de preuve susceptibles d’emporter la conviction des juges. Par ailleurs, l’exigence de justification invite les juges à contrôler plus avant la décision des employeurs. Ces derniers doivent en effet désormais expliciter leurs raisons d’agir. Cela signifie concrètement qu’ils ne peuvent se contenter d’invoquer des faits objectifs, ils doivent encore convaincre les juges de la justesse de leurs décisions en détaillant les ressorts de ces dernières. Ainsi, alors que la doctrine classique avait pour habitude d’affirmer que l’offre de preuve attendue des plaideurs porte sur des faits pertinents, contestés et contestables, l’exigence de justification nous amène à ajouter des faits « contextués », c’est-à-dire des faits articulés au sein d’un discours cohérent et si nous avions pu penser dans un premier temps que l’émergence de l’exigence de justification se traduise par une part croissante de subjectivité dans les décisions de justice, force est de reconnaître au contraire que le contrôle des juges s’est renforcé / The labor law knew during these last thirty years remarkable evolutions with the appearance of new information technologies and communication in the companies and, the creation of “justification’s requirement”. In the mean time employers are now obliged to detail the motivations of their actions and the employees are working more and more on informatics work station. It’s important to understand how these new characteristics have modified the application of the rules of the proof. If the proof’s burden seems to not have been affected by these evolutions, it is not the same about the proof’s object. Indeed, beyond the appearances, the new information and communication technologies lead to a modification of the proof object by giving to the employees the access of new elements of proof susceptible to influence the judge’s conviction. Besides, the “justification’s requirement” invites the judges to better control the employer’s decision. They have now the obligation to clarify their reasons for action. Concretely it means that, to support their claims, they can’t just argue objective facts to convince the judge but they have to justify the logic of their decisions. So, while the classic doctrine had for practice to expect relevant, controversial and questionable facts as proof objects, the “justification’s requirement” brings us to add “sensible facts" (facts articulated within a coherent speech). If at the first time, we could think that the “justification’s requirement” emergence will lead to subjective decision, we are obliged to admit the reinforcement of the judge control.

Previous issue date: 2016-08-01 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES / This work refers to qualitative and social research that discusses the themes of educational policy, such as: training of basic education professionals; Working conditions offered in public schools; Perspectives of the professional career of master educators and the quality of educational institutions. Based on these thematic dimensions and the research carried out in the municipal public network of João Pessoa, we analyze the context of the current laws of Brazilian education, relating the insertion of master educators in the democratization of educational policies as a perspective of political transformation to improve the quality of institutions Education. Our main reference is based on the theory of complexity from Edgar Morin, relating the understanding of historical, political and economic phenomena that involve education as an instrument of social transformation. We analyze the field research questionnaires and the contextual comparisons, based on the content analysis made explicit by Laurence Bardin, and then emphasize the main ideas of Paulo Freire's Pedagogy that suggest a re-signification of Brazilian and local education. In the first stage of field research, we conducted a survey of information on the number of masters and doctors working in municipal schools in the Municipality of João Pessoa and the Statistical Assistant of the State Secretariat of Education of Paraíba. João Pessoa. In the second stage, we visited the municipal schools of Polo I and the space where the continuing education of the professionals of the basic education of the Municipality of João Pessoa was carried out. As a result of these steps, 32 teacher educators volunteered to answer the proposed questionnaire with 10 questions, nine of which were subjective and one objective. The systematization of the text of this thesis is organized in three chapters, they are: the complexity in the research in educational policies; Public education, political context and current challenges; And the understanding of the professional formation from the educators masters of the municipal network of João Pessoa. As a conclusion, we point to the contribution of the master educators in the democratization of the public school through the effective participation in institutional decisions, in the construction of educational policies, in the mutual learning and socialization of successful pedagogical experiences, thus enabling the requested and essential changes in the quality Of basic education. / Este trabalho refere-se a pesquisa qualitativa e social que discute os temas da política educacional, tais como: formação dos profissionais da educação básica; condições de trabalho oferecidas nas escolas públicas; perspectivas da carreira profissional de educadores mestres e qualidade das instituições de educação. A partir dessas dimensões temáticas e da pesquisa desenvolvida na rede pública municipal de João Pessoa, analisamos o contexto das leis vigentes da educação brasileira, relacionando a inserção dos educadores mestres na democratização das políticas educacionais, enquanto perspectiva de transformação política para melhoria na qualidade das instituições públicas de ensino. Nosso principal referencial está fundamentado na teoria da complexidade a partir de Edgar Morin, relacionando a compreensão dos fenômenos históricos, políticos e econômicos que envolvem à educação enquanto instrumento de transformação social. Analisamos os questionários da pesquisa de campo e as comparações contextuais, a partir da análise de conteúdo explicitada por Laurence Bardin, em seguida, enfatizamos as principais ideias da Pedagogia de Paulo Freire que sugerem ressignificação da educação brasileira e local. Na primeira etapa da pesquisa de campo, realizamos um levantamento de informações, na Secretaria de Administração do Município de João Pessoa e na Subgerência de Estatística da Secretaria de Estado da Educação da Paraíba, sobre o número de mestres e doutores que trabalham nas escolas municipais de João Pessoa. Na segunda etapa, visitamos as escolas municipais do Polo I e o espaço onde foi realizada a formação continuada dos profissionais da educação básica do Município de João Pessoa. Como resultado das referidas etapas, 32 educadores mestres se voluntariaram em responder o questionário proposto com 10 questões, sendo nove subjetivas e uma objetiva. A sistematização do texto desta tese está organizada em três capítulos, são eles: a complexidade na pesquisa em políticas educacionais; educação pública, contexto político e desafios atuais; e a compreensão da formação profissional a partir dos educadores mestres da rede municipal de João Pessoa. Como conclusão, apontamos para a contribuição dos educadores mestres na democratização da escola pública a partir da efetiva participação nas decisões institucionais, na construção das políticas educacionais, na aprendizagem mútua e socialização de experiências pedagógicas exitosas, possibilitando assim, as pleiteadas e imprescindíveis mudanças na qualidade social da educação básica.

Por fim, apresentouse uma reflexão, à luz do princípio da melhoria da condição social do trabalhador, a respeito da problemática da terceirização, da rotatividade da mão de obra e do excesso de jornada de trabalho. / This research aimed to study the principle of improvement of workers social conditions, as a central and teleological element of Labor Law in order to analise relevant aspects for the sociological, historical and legal contextualization of this branch of Law and also to contribute to the development of social justice rationality. Based on the intrinsic relationship of Labor Law with the production capitalist system and also based on the class conflict which is inherent in the previously mentioned system, the role of this branch of Law was questioned as an emancipation tool for the working class or as a tool for preserving the interests of the capital. The purpose of the doctrine of reconciliation of social classes and some of the key aspects of its implementation in Brazil were scrutinized. Reflections of state transformations were analyzed and therefore the right to the principle of improvement of the workers social conditions were also analyzed, based on changes which would alter a liberal regulatory framework into a social one, through the impact of neoliberal ideology and of the restructuring of productive decades. The dynamics of normative principles and in particular the principle of improvement of workers social condition and the analysis of important aspects of its relationship with other central principles of Labor Law were addressed. The main technical and legal situations of application of the principle being studied were rewied from the perspective of Social Law and from the perspective of contribution to strengthening of the working class. Finally, a reflection, under the light of the principle of improvement of workers social condition, about the issues of outsourcing, labor turnover and excessive working hours presented.

Apontando a necessidade de problematizar os trabalhos que tendem a generalizar (e branquear) as relações escolares da escola paulista nas primeiras décadas do século XX, e partindo da hipótese que os negros, obstante às limitações, frequentaram os grupos escolares nesse período, a tese pretendeu discutir a escolarização de crianças negras na cidade de São Paulo. O período que compreende os anos de 1920-1940 marca as transformações das estruturas econômicas, sociais, políticas e ideológicas da cidade de São Paulo, e as discussões sobre a necessidade de democratizar a educação popular no sentido de alfabetizar as massas também se faziam presentes. Para realizar a análise utilizamos pesquisa bibliográfica e investigação documental. Com base nos jornais da imprensa negra paulista, que tratavam das aspirações por educação e instrução profissional, nas pesquisas etnológicas realizadas pelo Departamento de Cultura da Prefeitura Municipal de São Paulo na década de 1930, nos depoimentos de famílias negras da Coleção Memória da Escravidão em Famílias Negras de São Paulo (Universidade de São Paulo) e na documentação oficial depositada em arquivos públicos estadual e municipal, foi possível considerar a presença de crianças negras nos grupos escolares da capital. A partir dessas fontes construiu-se um perfil racial deste universo escolar, que revelou a inserção de crianças negras na ordem de, aproximadamente, 10%. A presença negra na escola paulista traz a compreensão de que os negros obtiveram oportunidades de escolarização quando da implementação da Escola Nova, especialmente pela intenção dos reformadores paulistas em disciplinar os diferentes grupos étnico-raciais que perfaziam o universo escolar, para enfim, propagar os valores republicanos e reformar a vida social paulista rumo à modernidade anunciada. / Pointing out the need to problematize the works that tend to generalize (and whiten) school relations of schools from São Paulo city in the early decades of the twentieth century, and assuming that blacks, despite the limitations, attended school groups during this period, the thesis intended to discuss the education of black children in São Paulo city. The period that covers the years 1920-1940 marks the transformation of economic structures, social, political and ideological of São Paulo city, and discussions about the need to democratize education in the sense of popular alphabetize the masses were also presented. It has used bibliographic and documentary research to conduct the analysis. Based on the journals of the black press in São Paulo, which dealt aspirations for education and professional instruction in ethnological research conducted by the Department of Culture of the municipal government of São Paulo city in the 1930s, in the testimonies of black families Collection Memory of Slavery in Black Families of São Paulo (University of São Paulo) and in the official documentation filed in state and local public records, it was possible to consider the presence of black children in school groups from São Paulo city. From these sources it has built a racial profile of this school universe, revealed that the inclusion of black children in the order of approximately 10%. The black presence in schools from São Paulo brings the understanding that blacks had opportunities of schooling when the implementation of the New School, especially the intent of reformers from São Paulo to \"discipline\" the different ethnic and racial groups that accounted for the school environment, to finally spread republican values and reform of social life of São Paulo city toward modernity announced.
