Race, class and inequality: an exploration of the scholarship of Professor Bernard Magubane

This thesis begins with the assumption that the theory of academic dependency provides an adequate framework within which the relationship between social science communities in the North and South can be understood. Present problems of social scientists in the South have very often been attributed to this dependence and it has been concluded that academic dependence has resulted in an uncritical and imitative approach to ideas and concepts from the West (Alatas, 2000). This dependence has also resulted in the general regression among social scientists based in the South and in a marginalisation of their works within the social science community no matter how significant and original they may be. The problematic invisibility of the works of prominent South African scholars is a dimension of a wider crisis of academic dependence, if unchecked this current trend will also reinforce academic dependence. From the nature of the problems generated by academic dependence, it is obvious that there is a need for an intellectual emancipation movement. This movement may take different forms that may range from but are not limited to a commitment to endogeneity which involves among other things, knowledge production that takes South African local conditions seriously enough to be the basis for the development of distinct conceptual ideas and theories. This requires transcending the tendency to use ‘the local’ primarily as a tool for data collection and theoretical framing done from the global north. Secondly, there is a need to take the local, indigenous, ontological narratives seriously enough to serve as source codes for works of distinct epistemological value and exemplary ideas within the global project of knowledge production. Endogeneity in the context of African knowledge production should also involve an intellectual standpoint derived from a rootedness in the African conditions; a centring of African ontological discourses and experiences as the basis of intellectual work (Adesina, 2008: 135). In this study, it is suggested that the recommendations highlighted above can only succeed if scholars make an effort to actually engage with locally produced knowledge. There is therefore a need to make greater efforts to know each other’s work on Africa. This demand is not to appease individual egos but it is essential for progress in scientific work. African communities will benefit from drawing with greater catholicity from the well–spring of knowledge about Africa generated by Africans. In the South African context, transcending academic dependence in the new generation of young academics requires engagement with the work of our local scholars who have devoted their lives to knowledge production. This thesis explores the scholarship of Professor Bernard Magubane by engaging with his works on race, class and inequality by locating his works within the wider debates on race, class and inequality in South Africa. The specific contributions of Professor Magubane to the enterprise of knowledge production are identified and discussed in relation to his critique of Western social science in its application to Africa. The making of Professor Magubane’s life, his career, scholarship and biography details are analysed with the intention of showing their influence on Magubane as a Scholar. The examination of Professor Magubane’s intellectual and biographical accounts help to explain the details, contexts and implications of his theoretical paradigm shifts. This helps prove that Professor Magubane’s experiences and theoretical positions were socially and historically constituted. The research from which this thesis derives is part of an NRF-funded project, on Endogeneity and Modern Sociology in South Africa, under the direction of Professor Jimi Adesina.

As women in South Africa, it is important for us to understand the nature of our oppression, for it is only after understanding it, can we identify the target of our attack and plan the appropriate strategy and tactics for our struggle. Black women in South Africa suffer three types of oppression. 1. Political oppression, which is common to all blacks in South Africa, ie. the denial of rights to vote for or choose the type of government we want, and the denial of rights as a people in South Africa. 2. Economic oppression as black workers in South Africa. Black women workers are even more exploited than men workers. They are paid lower wages for the same job, are treated as temporary staff and can be fired at anytime especially if they fall pregnant. 3. Social oppression which stems from the idea that women are born inferior to men and therefore have to play an inferior role in society. The socialization process starts at birth and women and men are geared towards certain roles in society. Men most often towards leadership positions and professional jobs and women towards household duties and secretarial jobs. This socialization process continues throughout ones life such that most people accept it as a natural phenomenon and a way of life. Having understood the forms of oppression, we can see that the struggle is not between men and women, where men are seen as the source of our oppression. Nor is it a struggle for mechanical equality between men and women ie. being paid the same wages as men, and having equal status as men in society, because this will mean equality within the present status quo. Our struggle is a struggle between womenand the existing social order. It is a struggle of the oppressed against oppression. Our main weapons in the struggle for liberation are UNITY and ORGANISATION. Unity is realised through common effort, links are forged through collective work and study, through criticism and self-critcism and through action against opression. Organization can be achieved through women's groups and organization. A women's group's first demand should be the clarification of our ideas, to get rid of miscosepts and erroneous ideas concerning the role and liberation of women. A women's group usually tackles the question of social oppresion, but more important, it must be seen as a stepping stone towards involvement in the broader struggle can we destroy the foundations of exploitative society and rebuild society on new foundations. Foundations built on the demands of the FREEDOM CHARTER. “The fundamental struggle is for national liberation of the oppressed people of South Africa, and any women's organization that stands outside this struggle must stand apart from the mass of women. What was realised by the Federation of South African Women was that it would be impossible for women to achieve their rights as women in a society in which so many fundamental rights are denied to both men and women by virtue of their colour and their class. Therefore just as there can be no revolution without the liberation of women, the struggle for women's emancipation cannot succeed without the victory of the revolution".

Steve Biko returns : the persistence of black consciousness in Azania (South Africa).

Steve Biko returns and continues to illuminate the postapartheid social order. His contestation by various claimants for different reasons shows his continuing and lasting legacy. However he finds a special niche among a disenfranchised and frustrated township youth who are trapped in township struggles where they attempt to derive a meaning. More important is why these youth who neither saw nor participated in the struggle against apartheid are turning to an age old idea like Black Consciousness in a context of the pervasive influence of non-racialism, rainbowism and triumphalism of neo-liberalism. The realisation is that a human-centred society with a human face which Black Consciousness practitioners advocated and strove for is yet to be realised. This shows the anomalies and maladies of a postcolonial dispensation where ideals, principles and teleology of the liberation struggle are yet to be consummated. Thus Black Consciousness as a node in a long thread of black political thought in the country; and as a spirit, will always be both an emotion, and a motion that finds a new meaning with each generation.

Achieving sustainable peace in post conflict societies : an evaluation of South Africa's Truth and Reconciliation Commission

In particular, the truth commission is investigated as a mechanism of transitional justice. The South African Truth and Reconciliation Commission (TRC) was selected as a case study to investigate the relationship between sustainable peace and transitional justice. This thesis analyses whether the TRC Commission followed its mandate, and whether there are any specific definitions, conclusions or recommendations that the TRC through its Final Report undertakes in order to fulfill a specific part of the mandate, namely “to ensure that there would be no repetition of the past” (TRC vol. 5, chap. 8, paragraph 14). This is done through a textual analysis of the Final Report of the South African TRC, where inherent weaknesses of the Final Report in its aim of achieving sustainable peace are read critically and deconstructively. It is further analysed through linking the issue of sustainable peace to the field of transitional justice and the study of political development on how future TRCs can deal with the issue of sustainable peace. This thesis comes to the conclusion that the South African TRC failed to contribute to a significant analysis of how to prevent the repetition of the past. It is argued that this is based on a lack of a coherent theoretical framework, as the Final Report mixes two different truth finding mechanisms: micro-truth finding and macro-truth finding, together with the just war theory. By analysing the TRC’s theoretical framework through textual analysis, it becomes clear that micro- and macro-truth finding is difficult to combine in one report, and that in the South African case the micro-truth finding part is prioritised. However, the macro-truth finding mechanism would have provided a more in depth analysis towards sustainable peace – which in this thesis is read as Galtung’s positive peace and Lederach’s structural peace – and is a necessary prerequisite in order to achieve sustainable peace. Die tesis kom tot die gevolgtrekking dat die Suid-Afrikaanse WVK nie ! bydrae gelewer het tot ! sinvolle ontleding van presies hoe om ! herhaling van die verlede te voorkom nie. Daar word aangevoer dat dít te wyte is aan die gebrek aan ! samehangende teoretiese raamwerk, aangesien die finale verslag twee verskillende waarheidsoekende meganismes vermeng – die mikrowaarheidsoeke en die makrowaarheidsoeke – en ook van die geregverdigde-oorlog-teorie gebruik maak. Deur die tekstuele ontleding van die teoretiese raamwerk van die WVKverslag word dit duidelik dat ! mikro- en makrowaarheidsoeke moeilik in een verslag te kombineer is, en dat, in die Suid-Afrikaanse geval, die mikrowaarheidsoeke voorkeur geniet. Tog sou die makrowaarheidsoeke ! grondiger ontleding bied vir die suksesvolle verwesenliking van volhoubare vrede, wat in hierdie tesis as Galtung se ‘positiewe vrede’ en Lederach se ‘strukturele vrede’ 5 verstaan word. Trouens, die makrowaarheidsoeke is ! voorvereiste om volhoubare vrede te bereik. ! Tradisionele lesing van die geregverdigde-oorlogteorie dra ook by tot ! individualisering van die waarheidsoekende proses, en bied nie voldoende ondersteuning vir die makrowaarhede nie. Laastens word daar deur die dekonstruksie van die uitdrukking nooit weer nie getoon dat hierdie benadering nie in WVK’s of op die groter gebied van oorgangsgeregtigheid tuishoort nie.

Tenure security in urban rental housing

Thesis (LLD (Public Law))--University of Stellenbosch, 2010. / Bibliography / ABSTRACT ENGLISH: The dissertation considers the tenure rights of urban residential tenants in the post-1994 constitutional dispensation. The 1996 Constitution mandates tenure reform in two instances. Firstly, section 25(6) (read with section 25(9)) mandates the legislature to enact legislation that would provide legally secure tenure rights for a person or community whose tenure of land is insecure as a result of past racially discriminatory laws or practices. This form of tenure reform is race-based. Secondly, section 26(3) mandates the courts to consider all relevant circumstances during eviction proceedings. In terms of this provision the court can refuse to grant the eviction order on the basis of the occupier's socio-economic weakness, which is a more general form of class-related tenure reform. The Constitution also ensures the right to have access to adequate housing, while the legislature must introduce measures that would give effect to this right (sections 26(1) and 26(2)). To determine whether the current landlord-tenant regime in South Africa is able to provide tenants with secure occupation rights and access to rental housing, it is compared to landlord-tenant regimes in pre-1994 South Africa, the United Kingdom, New York State and Germany. The landlord-tenant regimes are considered in light of changing socio-economic circumstances where the state had to assist households during housing shortages. The dissertation assesses the efficiency of landlord-tenant law, combined with regulatory measures that ensure substantive tenure rights and rent restrictions, as a form of tenure that could help alleviate housing shortages and initiate a new landlord-tenant regime for South Africa that would give effect to the Constitution. The dissertation concludes that the current substantive tenure rights of urban residential tenants are largely based on the common law, which is associated with weak tenure security. The landlord-tenant laws, namely the Rental Housing Act 50 of 1999 and the Social Housing Act 16 of 2008, fail to provide urban residential tenants with substantive tenure rights. The legislature has failed to enact a law that gives effect to section 25(6) in the landlord-tenant framework. The legislature did enact the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998 (PIE) in order to give effect to section 26(3). Recently the courts interpreted PIE to provide marginalized tenants with substantive tenure protection during eviction proceedings. However, to give effect to section 25(6) legislation should grant residential tenants substantive tenure rights that are legally secure prior to eviction. The legislature enacted the Rental Housing Act and the Social Housing Act to give effect to the right to housing (section 26 of the Constitution) in the landlord-tenant framework. These laws fail to promote access to rental housing as a form of tenure that could help alleviate housing shortages. / AFRIKAANSE OPSOMMING: Die proefskrif oorweeg die okkupasieregte van stedelike residensiële huurders in die post-1994 konstitusionele bedeling. Die 1996 Grondwet bepaal dat okkupasieregte in twee gevalle hervorm moet word. Eerstens gee artikel 25(6) (gelees met artikel 25(9)) opdrag aan die wetgewer om wetgewing te verorden wat okkupasieregte met verblyfsekerheid aan 'n person of gemeenskap sal verleen indien so 'n person of gemeenskap tans grond okkupeer met okkupasieregte wat onseker is as gevolg van vorige rasgebaseerde wetgewing. Hierdie tipe hervorming is rasgebaseer. Tweedens gee artikel 26(3) opdrag aan die howe om alle relevante faktore te oorweeg as deel van enige uitsettingsprosedure. In terme van hierdie bepaling is die howe gemagtig om 'n uitsettingsbevel te weier op die basis van die okkupeerder se sosio-ekonomiese kwesbaarheid. Hierdie tipe hervorming is 'n meer algemene klasgebaseerde hervorming. Artikel 26(1) (gelees met artikel 26(2)) van die Grondwet bepaal dat elkeen die reg op toegang tot geskikte behuising het, terwyl die staat redelike wetgewende en ander maatreëls moet tref om hierdie reg te verwesenlik. Ten einde te bepaal of die huidige huurbehuisingstelsel in Suid-Afrika voldoende is, met inagneming van die stelsel se vermoë om huurders te voorsien van okkupasieregte met verblyfsekerheid en van toegang tot huurbehuising, word dit vergelyk met die huurbehuisingstelsels in Suid Afrika voor 1994, die Verenigde Koninkryk, New York Staat en Duitsland. Hierdie huurbehuisingstelsels word bespreek met inagneming van veranderinge in die sosio-ekonomiese omstandighede waartydens die staat gedurende behuisingstekorte huishoudings moes ondersteun. Die doeltreffendheid van huurbehuising word beoordeel met verwysing na regulasies wat substantiewe okkupasieregte verseker en beperkings plaas op huurpryse om 'n vorm van verblyfreg daar te stel wat die behuisingstekort kan verminder ten einde 'n nuwe huurbehuisingstelsel vir Suid-Afrika te inisieër wat gevolg aan die Grondwet sal gee. Die proefskrif lei tot die gevolgtrekking dat die huidige substantiewe okkupasieregte van stedelike residensiële huurders grotendeels op die gemenereg gebaseer is. Die gemenereg maak nie voorsiening vir sterk substantiewe okkupasieregte nie. Die huidige huurbehuisingswetgewing, naamlik die Wet op Huurbehuising 50 van 1999 en die Wet op Maatskaplike Behuising 16 van 2008, slaag nie daarin om substantiewe okkupasieregte vir stedelike residensiële huurders te voorsien nie. Die wetgewer het nie daarin geslaag om 'n wet te promulgeer wat in die huurbehuisingsraamwerk aan artikel 25(6) effek gee nie. Die wetgewer het wel die Wet op die Voorkoming van Onwettige Uitsetting en Onregmatige Besetting van Grond 19 van 1998 verorden om effek te gee aan artikel 26(3) van die Grondwet. Hierdie Wet is onlangs so deur die howe geïnterpreteer dat dit kwesbare huurders tydens uitsettingsprosedures met substantiewe okkupasieregte beskerm. Om aan artikel 25(6) te voldoen moet wetgewing egter substantiewe okkupasieregte met verblyfsekerheid aan residensiële huurders verskaf voordat hulle uitgesit word. Die wetgewer het die Wet op Huurbehuising en die Wet op Maatskaplike Behuising verorden ten einde effek aan die reg op behuising (artikel 26 van die Grondwet) in die gebied van huurbehuising te gee. Geeneen van hierdie wette slaag daarin om toegang tot behuising, en veral huurbehuising as 'n vorm van okkupasie, te bevorder ten einde die behuisingtekort te verminder nie.

Wits University, Johannesburg, 2015 / This report interrogates the representation of blackness in post-1994 black-centred films in South Africa. With a particular focus on Khalo Matabane’s films, I analyse Conversations on a Sunday Afternoon (2005), When We Were Black (2007) and State of Violence (2011) across a spectrum of themes. I also interrogate and introduce several critical concepts such as ‘blackness’, ‘the image of blackness’, ‘black identity’, ‘masculinity’, ‘femininity’, ‘the Gaze’ and ‘Otherness’. These concepts are interlinked in ways that bring about an understanding of the concept of black-centred films, which is central to the research report. Amidst the different interpretations of black-centred films, the vantage point from which the concept is used is interested in black-centred films as films that are made by a black filmmaker, whose content addresses issues of blackness and is targeted at a black audience. However, these three factors need not always resonate in a single film in order for it to be considered and analysed as a black-centred film. The lens through which Matabane holds the camera questions his representation of the black image and whether it is from an insider or outsider’s perspective. The view from which Matabane holds the camera is important in establishing whether he has purported to represent historically stereotypical images of blackness, or whether his endeavours in filmmaking are occupied by the relentless pursuit to present new images of blackness.

Regimes and rights on the Orange River: possessing and dispossessing Griqua Philippolis and Afrikaner Orania

Submitted as requirement of the degree of Master of Arts History, Faculty of Humanities University of the Witwatersrand, January 2012 / Griqua Philippolis (1824-1862) and Afrikaner Orania (1990-present) are explored in this thesis, according to a legal-history framework that allows for a comparative appraisal of their foundations. As I argue, property – specifically, property in land – helps us to understand sovereignty and the question of rights in the South Africa. As this thesis explores, both settlements were formerly home to prior inhabitants (the San in Philippolis; Coloured squatters in Orania), and these inhabitants had to be transferred away. Both communities emerged out of contested and dynamic political contexts – situations that would determine how they saw themselves and others. Land regulations were devised within these respective contexts, in direct response to specific external pressures and the demands of the market. Internally, both polities were tightly governed. Externally, to various institutions and individuals, both argued for their ‘rights’ – mainly rights to land and to special treatment – all the time. Indeed, in a way, this study is an historical exploration of the effective deployment of ‘rights talk’, and to that end, my argument carries across two centuries right up to the present day using Orania and Philippolis to do this. This thesis, then, is a study about land rights, and the different regimes that create and erase them, that acknowledge and ignore them; it is a local history of settler colonialism past and present, using two case studies to explore the continuities of South Africa’s ever-pertinent land question. / XL2018
