Implementation of laws regulating mining industry transformation in South Africa

Thesis (M. Dev. (Development and Management Law)) -- University of Limpopo, 2017 / This mini-dissertation deals with the implementation of laws regulating mining industries transformation in South Africa. This mini-dissertation finds that the pace of transformation is very low and the challenges faced in the mining industries which are slowing the process are evaluated. Such challenges include: lack of skills, unqualified candidates and lack of experience. It finds that the Broad-based socio-economic empowerment (BBSEE) introduced 15% target by 2011 where only 8.9% was reached in respect of transformation and that by 2014, 26% must be met where only 17.4% at the top management is achieved. The call for nationalisation of mines as a solution to speed up transformation have also been evaluated and the Mining Qualification Authority category of providing scholarships to maths and science learners to the exclusion of other streams as transformational aspect was also evaluated. The question as to whether 26% of the historically disadvantaged South Africans occupying managerial position is enough to rectify the injustices of the apartheid ills is also looked at. A comparative study was done between South Africa, Canada and Australia to see whether lessons could be learnt. The phenomenology of same-race prejudice

This thesis is not structured as a conventional empirical study (theoretical background, method, results, discussion), but instead consists of an iterative series of attempts at making sense of same-race prejudice – hopefully systematically homing in on a richer and more acute understanding of the phenomenon. The chapters are grouped together in pairs or triplets – each grouping addressing different but related perspectives on the problem. Chapters 1 and 2 are contextual, setting the scene historically and conceptually. Chapters 3, 4 and 5 introduce three different perspectives on using phenomenology as a means of approaching the issue of same-race prejudice. Chapters 6 and 7 are dedicated to looking at the themes of same-race prejudice, a critical interrogation of the themes from the interview discussions, the literature and how same-race prejudice is experienced, played out and sustained. Chapter 8 links back to Chapter 1 by casting another look at sensitivity and responsiveness to same-race prejudice by organisations whose work is supposedly on prejudice eradication. The chapter further links with both Chapters 3 and 4 by calling upon a phenomenological understanding to humanity as what can bring a liveable change to humanity regarding same-race prejudice. Chapter 9 serves as a summary of all the chapters, what each individually and collectively hoped to achieve, and the general findings and statements about same-race prejudice from the chapters’ theoretical discussions, research interviews, and critical interrogation of both the mundane and theoretical understanding. / Psychology / D. The conversion of South Africans to Buddhism

This thesis is an examination of why South Africans have converted to Buddhism, how this conversion has come about and what the meaning of the conversion has been in their lives. Chapter one is a literature review which revealed very little literature available on conversion to Buddhism and less on the conversion of South Africans to Buddhism. L.R. Rambo's Theory of Conversion is used in this thesis to see if these conversions to Buddhism can be understood within this theory. In Chapter two Rambo's theory, which is a holistic model for conversion, is analyzed in detail. He proposes seven stages within his model: crisis, quest, encounter, interaction, commitment and consequences. Context is Rambo's first stage and in Chapter three the socio-historic and religious background of these converts is examined. In order to understand how and why these conversions have come about there needs to be an understanding of the background from which these converts come. Taking Refuge (or the Gohonzon Ceremony) was used for the purpose of this thesis to be the turning point from non-Buddhist to Buddhists. In Chapter four the meaning and importance of Taking Refuge is discussed. The empirical aspect of this thesis was to interview twenty South Africans who had converted to Buddhism. Chapter five is a detailed analysis of these interviews and Appendix two gives the questionnaire used. The aim of this analysis was firstly, to investigate whether these conversions to Buddhism can be understood in the context of Rambo's theory, secondly, to see whether Taking Refuge is the correct choice of the turning point from non-Buddhist to Buddhist. In the conclusion it was found that Rambo's theory did not fully account for the conversion of the interviewees to Buddhism, and that Taking Refuge was not necessarily a good focal point in the conversion process. In the light of this a Developmental theory of becoming a Buddhist was proposed which has the following steps: Context, exposure, interest invoked, practical application, commitment and consequences. From the analysis of the people interviewed their conversion to Buddhism was a developmental process rather than a conversion as such. Hence their conversion fitted more closely with a Developmental theory than with Rambo's theory of conversion. This ties in with the discovery amongst the interviewees that none of them experienced one focal point at which they became Buddhist. Adjustment of South African expatriates in Dubai : a gestalt approach for family and child therapy

The literature, for example, Black and Stephens (1989), as well as Marchetti-Mercer (2009), emphasise that mental health professionals may be increasingly faced with the challenges linked to migration and expatriate life. There is also a paucity of information regarding expatriate adjustment in South African psychological literature, and to this end, the aim of this study was to examine how South African expatriate families adjust to a foreign environment like the Middle Eastern city of Dubai. In Dubai, many South African expatriates are employed in sectors such as hospitality, medicine, construction, education, including financial services and it is estimated that the number of South Africans living in Dubai are between 40 000 and 100 000 (The Homecoming Revolution, 2008:1). Expatriate families face the challenges of adjusting to different laws, climates, cultures, religions and social systems. They may experience lack of emotional support, grief, feelings of isolation and loneliness. Unfamiliar living conditions and a change of lifestyle may present as a crisis for certain families, manifesting in family conflict and financial hardship. Given the number of South African families living in Dubai, this study aimed to explore how these families adjusted to the living conditions of this region. A second aim of the study was to use the findings yielded from the data to formulate Gestalt therapeutic techniques, enabling family therapists to assist expatriate families with adjustment difficulties. A phenomenological system of enquiry was employed to study the experiences of six South African families and fifteen members of a focus group. Family members of the six family case studies were interviewed, their experiences audio-recorded, and then transcribed verbatim. Three children elected to provide drawings of their experiences. The focus group discussion was also audio-recorded and then transcribed verbatim. Upon analysis, six common themes emerged, namely, social support, personality factors, environmental conditions, acculturation, grief and disillusion. The findings of the study assisted the researcher in formulating five therapeutic Gestalt techniques that would facilitate and optimise communication amongst expatriate family members. Three of the therapeutic techniques were designed by the researcher, and two were adapted from existing Gestalt techniques. It is hoped that the findings in the present study will assist in amplifying the existing knowledge base regarding Gestalt therapy techniques for families and children, including the current research on expatriate adjustment and the psychological ramifications related to this phenomenon. / Social Work / D. Citizenship and belonging: An analysis of the Zimbabwean diaspora

Thesis (MA (Political Science))--University of Stellenbosch, 2010. / ENGLISH ABSTRACT: Immigrant societies are in the midst of heated debates about citizenship and what it means to belong to their nation-states. The main purpose of this study is to conduct exploratory and descriptive research into the concept of belonging to a host country, in order to advance an understanding of this under-conceptualised, yet topical issue. The project was based on an extensive review of literature from the fields of psychology, sociology and political science, as well as on the responses from an empirical, quantitative survey of Zimbabweans living in South Africa, the United Kingdom and the United States of America. The findings reveal that Zimbabwean respondents are frustrated with perceived attempts to exclude them from becoming full and equal members of host societies. Zimbabweans who feel that they will never truly belong or be fully accepted by host countries have subsequently developed a heightened sense of attachment to Zimbabwe, as a way of differentiating themselves from the dominant population. The main conclusion that can be drawn is that belonging, inclusion and identification with a host country is a complex process that involves three separate stakeholders namely the host country, members of the dominant group, and the immigrants themselves. This research thus argues that the problem of immigrant integration should be viewed through multiple lenses, by including the influence of various stakeholders. Doing so would lead to a more nuanced understanding of the forces influencing belonging, and could potentially lead to the formulation of more comprehensive and more targeted policies. / AFRIKAANSE OPSOMMING: Immigrante samelewings is in die midde van hewige debatte oor burgerskap en wat dit beteken om te behoort tot hul nasie-state. Die hoofdoel van hierdie studie is om in verkennende en beskrywende ondersoek van die konsep “gasheer land intergrasie”, ten einde 'n begrip van hierdie vooraf onder-gekonseptualiseerde maar tog hedendaags belangrike konsep, te formuleer. Die projek is op 'n omvattende oorsig van die literatuur gebaseer uit die gebied van sielkunde, sosiologie en politieke wetenskap, sowel as op die antwoorde van' ʼn empiriese, kwantitatiewe opname van Zimbabwiërs wat in Suid-Afrika, die Verenigde Koninkryk en die Verenigde State van Amerika gehuisves is. Die bevinding van die studie toon dat die Zimbabwiese proefpersone gefrustreerd is met die waargenome pogings van uitsluiting deur lede van die gasheer lande ten opsigte van volle gelykstelling met bogenoemde lede. Zimbabwiërs wat voel dat hulle sal nooit werklik behoort, of nie ten volle aanvaar sal word in gasheer-lande nie, het 'n verhoogde gevoel van verbinding ontwikkel met hul tuisland Zimbabwe, as ʼn manier van onderskeiding tussen hulself en die dominante bevolking. Die belangrikste gevolgtrekking wat gemaak kan word, is dat groep behoorting, insluiting en identifikasie met 'n gasheer land 'n komplekse proses is wat drie afsonderlike belanghebbendes naamlik die gasheer land, die lede van die dominante groep en die immigrante hulself behels. A legal and ethical analysis of the South African government’s response toward Zimbabwean immigrants

Thesis (MA (Political Science))--University of Stellenbosch, 2010. / ENGLISH ABSTRACT: This thesis is a study of the South African government‘s response toward Zimbabwean immigration, focusing on the period from 2000 to July 2009. The aim is to shed light on why the government has acted in the manner that it has, using a human security framework. South Africa‘s legal obligations under international, regional, and domestic law are investigated and the ethical debate concerning issues of entrance and borders is explored. Concepts of morality, universality, and human dignity are central to this discussion. Against this backdrop, the Zimbabwean migration is briefly analysed in terms of push and pull factors and numbers; and the legal debate concerning the classification of Zimbabweans is explored. The challenges Zimbabweans face in South Africa and how the government has dealt with the Zimbabwean immigration is covered. Key actors from civil society and government are interviewed in an attempt to engage opinions about the government‘s response. The main opinions as to why the government has responded in the manner it has are then discussed and other factors are considered. Issues of solidarity, land reform, and South Africa‘s involvement in the Zimbabwean mediation process are some of the factors considered. The conclusion of this study is that the South African government has not succeeded in meeting its legal obligations nor acted ethically concerning Zimbabwean immigrants. The particular sentiments of ex-president Thabo Mbeki, the solidarity amongst national liberation movements, regional considerations, and the capitalist interests of some South Africans are factors that carry the most weight in explaining the South African government‘s response to the Zimbabwean crisis and its subsequent migrants. / AFRIKAANSE OPSOMMING: Hierdie tesis is 'n studie van die Suid-Afrikaanse regering se reaksie op die immigrasie van Zimbabwiërs na Suid-Afrika, met die klem op die tydperk tussen 2000 en Julie 2009. Die doel is om lig te werp op die regering se optrede in dié tydperk aan die hand van 'n menslike veiligheidsnetwerk. Suid-Afrika se regsverpligtinge onder internasionale, streek- en plaaslike reg, sowel as die etiese debat rakende kwessies soos die binnekoms van immigrante en grense, word ondersoek. Konsepte van moraliteit, universaliteit en menslike waardigheid , staan sentraal tot hierdie bespreking. Teen hierdie agtergrond word die Zimbabwiese migrasie kortliks ontleed in terme van die stukrag-en-trefkrag faktore en getalle; en word die regsdebat oor die klassifisering van Zimbabwiërs onder die loep geneem. The objectives of this study were to evaluate the viability and sustainability of preferential procurement in the metals and engineering sector. Preferential procurement is one of the seven elements of Broad–Based–Black Economic Empowerment (BBBEE) and seeks to encourage companies to procure goods and services from black empowered suppliers. The Broad–Based–Black Economic Empowerment Act was legislated in 2004 as an improvement on the previous Black Economic Empowerment (BEE). The objective of these legislations was to increase participation of previously disadvantaged groups in the mainstream economy. BEE was deemed to be narrow because it focused exclusively on ownership and management control. BBBEE was enacted to broaden the number of beneficiaries and included five other elements, namely: Employment Equity, Skills Development, Preferential Procurement, Enterprise Development and Socio–economic Development. The two companies that engage in preferential procurement should benefit from the relationship and value should be created in the process. Companies should not procure from black suppliers for accumulating points on the generic scorecard. Black–owned suppliers should provide service and products of the highest quality standards that meet customer requirements. The questionnaire that reflects on the objectives of this study was drafted and circulated to black–owned suppliers for completion. The suppliers were asked to comment on statements that reflect on capacity, profitability, working relationship and continuity. The results show that the SMMEs have capacity to perform according to specification of customers. The area of concern was the difficulty for SMMEs to maintain the current preferential status. Language errors in the use of English by two different dialect groups of Afrikaans first language-speakers employed by Nedbank : an analysis and possible remedy

Thesis (MPhil (General Linguistics))--University of Stellenbosch, 2009. / ENGLISH ABSTRACT: The financial sector of South Africa is increasingly under pressure to ensure that the language used in all communication is aligned with international best practice and, furthermore, that the correct business terminology is applied. Standards of language proficiency and usage have, however, deteriorated over the past few years. This appears to be due mainly to lack of good language education at school level. In Nedbank, specifically, the language used by employees in written external communication is not always on par as is evident from the documentation that Nedbank Editorial and Language Services (Nels), the “language custodian” of the bank, has to edit and translate. Nels decided six years ago that, instead of rewriting all these documents, which is not timeor cost-efficient, to rather give business-writing training across the bank to enable Nedbank employees to increase their general writing proficiency of English. This study aims to establish whether there are discrepancies in the type of error made in English as used by Coloured Afrikaans mother tongue speakers and White Afrikaans mother tongue speakers in order to determine how to customise the business-writing training materials to the benefit of each cultural grouping in Nedbank. / AFRIKAANSE OPSOMMING: Die finansiële sektor in Suid-Afrika is toenemend onder druk om te verseker dat die taal wat in alle kommunikasie gebruik word in ooreenstemming is met internasionale “beste praktyk”, en verder dat die korrekte besigheidsterminologie gebruik word. Taalvaardigheids- en taalgebruiksvlakke het egter oor die afgelope aantal jare verswak, waarskynlik a.g.v. onvoldoende taalonderrig op skool. In Nedbank is die taalgebruik van werknemers in geskrewe eksterne kommunikasie nie altyd van ’n aanvaarbare standaard nie, soos duidelik blyk uit die dokumentasie wat Nedbank Editorial and Language Services (Nels), die bank se “taalbewaarder”, moet redigeer en vertaal. Nels het ses jaar gelede besluit om besigheidskryfkursusse vir die hele groep aan te bied, eerder as om al die eksterne kommunikasie oor te skryf, wat nie tyd- en koste-effektief is nie. Sodoende kan werknemers hulle algemene skryfvaardighede in Engels verbeter. Hierdie studie probeer vasstel of daar moontlike verskille is in die soort foute wat in Engels deur gekleurde Afrikaans-moedertaalsprekers en wit Afrikaans-moedertaalsprekers gemaak word, in ‘n poging om doeltreffende opleidingsmateriaal te ontwikkel vir elke kulturele groepering in Nedbank.

Expatriation as a career experience

Thesis (MComm (Industrial Psychology))--University of Stellenbosch, 2009. / This investigation explored the unique experiences of expatriates who have taken the proverbial first step into the novel and unknown. The main purpose of this study was to bring to the fore the importance of these experiences in a human resources management context. Through the application of the qualitative research methodology based on grounded theory, these experiences were unearthed, analysed and discussed. Various personal and contextual factors that contributed to the experience of success were identified and further elucidated. This study ultimately illustrated the need for organisations to develop adjustment programmes that would assist the expatriation process to provide insights and skills that could empower the individual to achieve true personal fulfilment in pursuit of career success.
