Selected issues of inheritance proceedings This diploma thesis deals with selected issues of inheritance proceedings which play an important role in inheritance proceedings. These selected issues are the assets and liabilities of the estate, their detection, an importance of the common property of spouses and its settlement as a result of the death of one of the spouses and the role of the international element in the inheritance proceedings. Except for the introduction and conclusion, the thesis is composed of two main chapters which are further divided into individual subchapters. The first chapter deals with the assets and liabilities of the estate and it is divided into three large subchapters. The first subchapter deals in general with the assets and liabilities that create the estate, defines them and focuses on the means from which information is obtained about them and also contains legislation about estate without assets and estate with assets of no or insignificant value. Ons is dikwels onbewus van hoe hierdie verwagtinge, rolle en eise wat aan ons gestel word, deur verskillende diskoerse en stories tot stand gekom het. Die spesifieke lewenstorie en omstandlghede van die indiwidu(e) word meestal in die proses geignoreer, byvoorbeeld die saamleef met 'n huweliksmaat wat "gediagnoseer" is as iemand met 'n "bipolêre gemoedsversteuring", bring noodwendig omstandighede mee wat vir die meeste mense onuithoudbaar mag wees. Hierdie studie vertel die storie van 'n persoon wie daarin kon slaag om ten spyte van hierdie "omstandighede", sy storie so te kon herskryf dat hy steeds met hierdie persoon suksesvol binne die huwelik kan saamleef. The aim of this thesis is to put an interpretation on the institution of discharge with regard to an approval of the Act No. 294/2013 Coll., which changes the Act No. 182/2006 Coll., on decline and its solution strategies (Insolvency Act) and the Act No. 312/2006 Coll., on insolvency administrators (hereinafter referred to as "revising amendment"), to compare the amendment before and after its taking effect, with a main focus on discharge for entrepreneurs and individuals whose debts come from entrepreneurship, and on discharge for spouses. The thesis is divided into five chapters. The first chapter sums up the development of insolvency proceedings and insolvency law from Roman times to the present day. Thanks to this overview, the reader can see that insolvency proceedings and insolvency law are not only contemporary issues and owing to this, we are also able to map the development which led to the Insolvency Act as it stands. The main topic of the second chapter is decline and its solution strategies. As to the decline, I describe its two basic alternatives, insolvency and over-indebtedness. Residential lease with special focus on joint residential lease Summary The subject of my diploma thesis will be the residential lease focusing on joint residential lease. I decided to choose this particular topic since it has been an issue of ultimate interest for me during all the years of my studies at Law Faculty. In addition to property legal title it concerns above all the contract of lease on the grounds of which one of the most fundamental human needs, housing, is satisfied. The objective of the submitted thesis is to provide the most comprehensive presentation related to residential lease as possible. The thesis aims to include all particularities ensuing from joint residential lease. As a basic source of the corresponding legal regulation the Civil Code was used and an extensive judicature was considered to have an equally irreplaceable importance. Summary: Ownership interest in the joint property of spouses A thesis target represents above all the clarification of conditions, under which an ownership interest becomes a part of the joint property of spouses, as well as in what manner it can be realized. The accent is also put on questions relating to the treatment of ownership interest, being still part of the joint property of spouses. The position of another partner, not associated in a business partnership, doesn't escape notice, being for example closely connected with the institute of the so-called usual property administration (or administration in a legal context according to the terminology of the new Civil Code) etc. The chosen thesis topic encroaches on both the branch of business law and civil law; consequently both the sources of the two branches are used. In my considered opinion even afterwards, when the new legal regulations will enter into force, the most used jurisdiction and specialized literature stay relevant in light of explanation. However, new regulations also include some provisions, not known by current legal forms, this could unfortunately cause the exclusion of some conclusions of the expert public, having been accepted up to date. The studies try, once knowing the key variables involved in the adjustment process, to make the companies get higher levels of success in expatriations. The trailing spouses, as they are known, deeply feel the expatriation demands on their careers and on their couple relations. The present study look at the many challenges and problems faced, by these individuals, that leave their families, friends and normally, even their careers. The three case studies show that the personal resources specially the personality traits, the social abilities, and the will and determination are the strongest predictors of a good adjustment. The analysis of the relates shows that the marital resources, as free communication between the members of the couple, the concern about the other s feelings and the good time spent together are also strong indicators of a good adjustment, especially in distant cultures / O número de executivos expatriados com seus cônjuges ou famílias vem crescendo anualmente com a globalização. Os cônjuges que acompanham os executivos expatriados, conhecidos como trailing spouses, vivenciam fortemente as demandas que a transferência internacional apresenta às suas carreiras e às suas relações conjugais. O presente estudo qualitativo, foca nos diversos desafios e problemas enfrentados, e nas formas e estratégias de enfrentamento, por esses indivíduos, que deixam seus familiares, seus amigos, e normalmente, até sua carreira. São três estudos de caso, escolhidos entre algumas entrevistas, que mostraram que os recursos individuais, como as características de personalidade, as habilidades sociais e a determinação são as principais condições de um bom ajustamento. A análise dos relatos também mostra que os recursos conjugais como comunicação livre entre os membros do casal, preocupação com os sentimentos do outro e apreciar o tempo passados juntos também são fortes indicadores de ajustamento, especialmente em culturas mais distantes

Stroke är den tredje vanligaste dödsorsaken i Sverige och risken för att insjukna ökar med stigande ålder. Vid stroke har personen drabbats antingen av en infarkt eller av en blödning i hjärnan. Restsymtomen efter en stroke kan uttrycka sig på olika vis. Vanligaste symtomen är domningar eller förlamningar i ansikte, armar och ben. Rehabilitering efter en stroke kan ta lång tid och efter sjukhusvistelsen är det ofta närstående som tar det största ansvaret för omvårdnaden av personen som drabbats av stroke. Syfte med studien var att undersöka närståendes upplevelser och erfarenheter av att vårda en person som drabbats av stroke. Litteraturöversikten genomfördes genom kritisk granskning och analys av kvalitativa och kvantitativa vårdvetenskapliga artiklar, enligt analysmodellen av Friberg (2006). Litteratursökningen gjordes i databaserna Cinahl och Pubmed. I resultatet framträdde två huvudteman : Förändrad livsvärld och Upplevelser och erfarenhet med hälso- och sjukvårdspersonal. Resultatet visade att närstående upplevde en stor livsförändring där rutiner och livsmönster ändrades och anpassades efter personen som drabbats av stroke. Det gjorde att närstående upplevde att det inte fanns tid för egna intressen. Närstående upplevde både psykisk- och fysisk ohälsa som stress, depression, ångest, högt blodtryck, magsmärtor och sömnsvårigheter. Många närstående upplevde att informationen från hälso- och sjukvårdspersonalen var otillräcklig. Det medförde att närstående kände sig osäkra på att vårda den som drabbats av stroke. Sjuksköterskor har möjlighet att påverka närståendes upplevelser genom att bemöta dem på ett respektfullt och lyhört sätt. Det handlar också om att de kan identifiera informationsbehovet för att ge adekvat information som kan stilla närståendes oro. / Program: Sjuksköterskeutbildning

The aim of this thesis is the interpretation of current legislation of community property in the context of business activities of one or both spouses. After the review of current legislation, the theoretical part of this thesis focuses on the community property - its definition, creation, modification and termination. The theoretical part also focuses on the prenuptial agreement - its definition, requirements, conditions for entering into and its current popularity. The practical part of this thesis then introduces two real model situations illustrating issues concerning prenuptial agreements, where one or both newlyweds are entrepreneurs.

Syfte: Att öka förståelsen för anhörigas levda erfarenheter av aktivitetsbalans när sammanboende partner drabbats av stroke. Metod: Individuella kvalitativa intervjuer med sju personer (alla kvinnor, ålder 63 - 87år) sammanboende med manlig partner som drabbats av stroke (strokeinsjuknandet 6 - 24 månader sedan). Fenomenologisk hermeneutisk metod användes för dataanalys. Resultat: Deltagarna beskriver den essentiella meningen av aktivitetsbalans som en känsla av frihet och kontroll. Det är en strävan för deltagarna att uppnå en känsla av balans i alla dimensioner av fenomenet aktivitetsbalans. Faktorer i omgivningen och hos personen kan möjliggöra eller hindra anpassningen till den nya livssituationen och till den nya rollen som informell vårdgivare. Vid aktivitetsobalans beskriver deltagarna tecken på ohälsa. Konklusion: Deltagarnas nya roll som informell vårdgivare påverkar upplevelsen av aktivitetsbalans. Studien belyser vikten att som arbetsterapeut inkludera den anhörige i rehabiliteringsprocessen, ge den anhörige möjlighet att utforska den nya rollen och utveckla egen känsla av kompetens då detta påverkar upplevelsen av aktivitetsbalans. Fokus mot de anhörigas aktivitetsbalans och aktivitetsmönster är av betydelse i syfte att förebygga ohälsa. / Aim: To develop an understanding of relatives´ lived experiences of occupational balance when cohabiting partner suffers from stroke. Material and method: Individual qualitative interviews with seven informants (all female, aged 63-87) living together with a male partner that suffered from stroke in the past 6-24 months. The interviews were analyzed using phenomenological hermeneutical method. Result: The informants describe the essential meaning of occupational balance as a sense of having control and freedom. The informants are striving to achieve a feeling of balance in every dimension of the phenomena. Personal and environmental factors can enable or inhibit the adaptation in the new life situation and the new role as an informal caregiver. In case of occupational imbalance, the informants express experience of physical, cognitive and psychological health issues. Conclusion: The informants´ new role as an informal caregiver affects the experience of occupational balance. This study illustrates the importance of including the closest relatives in the process of rehabilitation, to let them explore the new role as a caregiver and to achieve a feeling of competence and confidence. The concern of the closest relatives´ occupational balance and activity pattern is relevant to prevent illness.

It was unclear what the actual role of the Family Readiness Group (FRG) was in helping the spouses of U.S. Navy submariners (SMSs) in learning to live the submariner-family lifestyle. Submarines deploy in regular cycles regardless of world conflict. Submariners and their spouses are isolated from each other during deployments, communities of submariner spouses are smaller than other Navy communities, and spouses must acquire unique social capital to manage unique challenges. The purpose of this study was to explore how SMSs experience or perceive the FRG role in their social construction and adaptation to the SMS lifestyle. The examination was guided by Ingram, Schneider, and DeLeon's social construction and policy design theory. Data were collected using an open-ended survey distributed to 83 SMSs through an online survey platform. Data were coded for themes and subthemes using an iterative process including values and process coding. Key results were that SMSs construct themselves differently than how they are constructed by policy principals. Among SMSs, benefits and burdens perceived to be distributed by the FRG program are different than the distribution of actual benefits and burdens. These differences influenced participants' engagement with the FRG program. More research is needed to define this influence and to explore the origins of relationships that increase lifestyle capital. The implication for social change is that a better understanding of the nature of SMS lifestyles can contribute to better policy decisions and improved program design, leading to better outcomes for military spouses.
