The aim of this paper entitled "The Role of the State Prosecutor in Preparatory Criminal Proceedings" is to perform a comprehensive analysis, based on the valid legislation, of the individual actions taken by the State Prosecutor during the preparatory stage of criminal proceedings and to identify their possible shortcomings. The paper consists of five chapters followed by annexes. Chapter 1 presents a comprehensive history of the State Prosecutor's office since its inception to the present with a special emphasis on its historical development in what is now the Czech Republic. Chapter 2 discusses the essentials of public prosecution that come into play during the preparatory stage of criminal proceedings. Chapter 3 deals with the present-day legislation regulating the State Prosecutor's office. It is comprised of three parts. The first part discusses the constitutional foundations of the State Prosecutor's office in the Czech law. The second part provides specifications of the basic organizational structure of the State Prosecutor's office, whereas its responsibilities are described in the third part. This thesis on the topic of The role of the state prosecutor in the preparatory criminal proceedings is trying comprehensively discuss about activities of the state prosecutor in the preparatory criminal proceedings and possibly to point out individual legal shortcomings. Diploma thesis on the Powers of state prosecutor in preparatory criminal proceedings is trying to comprehensively discuss the individual powers of state prosecutor throughout the preparatory process. Previous issue date: 2013 / A presente pesquisa, Idosos e o Ministério Público Estadual, agentes atuantes na
comunidade rio-grandina e imprescindíveis na solidificação da educação ambiental,
se insere no campo socioambiental, com objetivo de compreender as relações entre
os idosos e o Ministério Público Estadual, buscando nos fundamentos da Educação
Ambiental o alicerce para demonstrar a eficácia, ou não, por parte desse Agente, na
resolução dos interesses dos idosos, cujo grau de solicitação e satisfação encontrase
diretamente vinculado ao exercício e construção da cidadania. Assim, a total
conexão homem-ambiente justifica o objeto de estudo e traduz a relevância do tema
abordado. Considerando que a atuação ministerial, embora de forma não explícita,
aproxima-se da perspectiva da Educação Ambiental, contribuindo com o
compromisso de despertar sentimentos de respeito e alteridade, bem como auxiliar
no processo de conscientização caracterizada pela ação com conhecimento,
capacidade de opção e compromisso social, o presente estudo direcionou-se a
investigar o contraponto dos anseios dos idosos no sentido protecionista e a atuação
do agente ministerial estadual como órgão protetor. O movimento de
conscientização se dá pela prática social, reflexiva, formativa e emancipadora,
objetivos diretos da Educação Ambiental. A investigação se desenvolveu com base
na Abordagem Bioecológica do Desenvolvimento Humano ABDH, de Urie
Bronfenbrenner, associada aos princípios básicos da Análise Textual Discursiva
(GALIAZZI; MORAES, 2007), cujas categorizações foram extraídas dos registros
obtidos junto ao Ministério Público do Estado do Rio Grande do Sul, em especial a
Promotoria dos Idosos em Rio Grande. Para tanto, analisa-se e reflete-se sobre a
relação entre Idoso, Ministério Público Estadual e Educação Ambiental, tomando
como objeto de estudo as decisões exaradas nos procedimentos internos da
Promotoria, instaurados e já arquivados, envolvendo as diferentes áreas pontuadas
pelos idosos como focos imprescindíveis de atuação. Os resultados revelam que
Direito e Educação Ambiental constituem elo efetivo no sentido formativo e
transformador da comunidade. As compreensões advindas do estudo permitem
aferir que o acompanhamento do órgão ministerial, na solução dos impasses
apontados, constitui fator reconstrutor individual e coletivo, uma vez que possibilita a
solução dos conflitos e evita a instauração de futuras controvérsias, o que implica
afirmar a construção de uma sociedade ambientalmente melhor. / This research, Seniors and the State Prosecutor, active agents in Rio Grande
community and indispensable for the consolidation of environmental education, falls
within the environmental field, in order to understand the relationship between the
seniors and the State Prosecutor, seeking in the fundamentals of Environmental
Education the foundation to demonstrate the effectiveness, or not, by this agent in
the resolution of the interests of the elderly, whose degree of stress and satisfaction
is directly linked to the exercise and construction of citizenship. Thus, the total
connection man/environment justifies the object of study and reflects the relevance of
the subject. Whereas the ministerial role, although not explicitly, approaches the
perspective of environmental education with a commitment to helping awaken
feelings of otherness and respect as well as assist in the awareness process
characterized by action with knowledge, capability and the option of social
commitment, the present study was directed to investigate the counterpoint of the
desires of the elderly towards protectionism and the role of the state ministerial agent
as protecting body. The awareness movement occurs through social, reflective,
formative and emancipatory practice, direct objectives of Environmental Education.
The development of this research was based on Urie Bronfenbrenner’s Theory of
Human Bioecological Development TBDH, associated with the basic principles of
Textual Discursive Analysis (GALIAZZI; MORAES, 2007), whose categorizations
were extracted from records obtained at the Public Ministry of the State of Rio
Grande do Sul, Brazil, particularly the Elderly Prosecutor in Rio Grande. This
research analyzes and reflects on the relationship among Elderly, State Prosecutor
and Environmental Education, taking as object of study the decisions that have been
entered in the internal procedures of prosecution, initiated and already filed, involving
different areas punctuated by seniors as essential foci for action. The results show
that Law and Environmental Education are effective link towards a formative and
transformative community. The outcomes from the study suggest that the monitoring
by the ministerial body in resolving impasses are factors of individual and collective
rebuilding, since it enables the solution of conflicts and prevent the arising of future
controversies, which comprises the construction of an environmentally better society.

This work analyzes the patterns of recruitment and selection of the lawyers publics elite
in the Brazilian State of Sergipe. Focusing initially on the relations between the legal
and political space in the institutionalization process the state attorney career in Sergipe,
in intenden to comprehend the historical and social conditions of formation that rulling
elite. Recently, the state attorney started the discussion the importance their profession,
with the resolute purpose in motion the process of professional career, passing by the
implementation of the ideology of professionalism and meritocracy imported from core
countries. Conflicts arising there from confined in the context of the need for border
demarcation between the professional and the political in a country that historically
guided the access and mobility in the legal profession by the logic of personal
relationships. From the investigation into high positions occupation rules on prosecutors
of space, the intention of the work, to discuss issues surrounding the problem of
professionalization of the State Attorney careers, is to examine the form of production
of discourses and toggle positions within the group to face the questioning of social
practices, concepts and meanings into play in the interaction of these singularly
considered individuals and groups that have formed within the common social space.
The composition´s examination of the ruling elite the institution, in different historical
periods, and recent divisions of the group revealed that the effects of social and
demographic diversification of the group, from the 1990s, became progressively mobile
conflicts in inside the field that, despite this, it kept the old logic of recruitment and
selection its ruling elite, primarily recruited from the remarkable origins holders,
endowed with social capital and political relationship needed to win the game. / Ce travail a pour objet l'étude des modes de recrutement et de sélection de l'élites
avocats publics dans la province brésilienne du Sergipe. Son point de départ a ét´l'étude
des relations entre l'espace juridique et politique dans le processus d'institutionnalisation
de l'Etat avocat carrière dans Sergipe, la recherche a porté à saisir les conditions
historiques et sociales qui prévalent dans la composition du groupe d'élite au pouvoir.
Récemment, les procureurs de l'État ont rouvert le débat sur l'importance de leur
profession, avec la ferme intention de décoller la carrière du processus de
professionnalisation, ce qui implique la mise en oeuvre de l'idéologie de la méritocratie
professionnalisme et importés de pays clés. Les conflits qui en découlent confiné dans
le contexte de la nécessité de la démarcation de la frontière entre le professionnel et le
politique dans un pays qui, historiquement, a guidé l'accès et la mobilité dans la
profession juridique par la logique des relations personnelles. De l'enquête sur les
positions élevées règles d'occupation sur les procureurs de l'espace, de l'intention du
travail, pour discuter des questions entourant le problème de la professionnalisation des
carrières State Attorney, est d'examiner la forme de production de discours et de bascule
postes au sein du groupe pour faire face à la remise en cause des pratiques sociales, des
concepts et des significations en jeu dans l'interaction de ces singulièrement considérés
comme individus et des groupes qui se sont formés dans l'espace social commun.
L'examen de la composition de l'élite dirigeante de l'institution, à différentes périodes
historiques, et des divisions récentes du groupe a révélé que les effets de la
diversification sociale et démographique du groupe, à partir des années 1990, sont
devenus progressivement des conflits mobiles dans à l'intérieur du champ qui, malgré
cela, il a gardé la vieille logique de recrutement et de sélection de son élite dirigeante,
principalement recrutés parmi les titulaires origines remarquables, doté d'un capital
social et la relation politique nécessaire pour gagner le jeu. / Este trabalho tem por objeto o estudo dos padrões de recrutamento e seleção da elite dos
advogados públicos sergipanos. Partindo do exame das relações entre o espaço jurídico
e político no processo de institucionalização da carreira de procurador de estado em
Sergipe, a pesquisa centrou-se em apreender as condicionantes históricas e sociais
preponderantes na composição da elite dirigente do grupo. Recentemente, os
procuradores de estado reabriram a discussão sobre a importância de sua profissão, com
o firme propósito de deslanchar o processo de profissionalização da carreira, que passa
pela implantação da ideologia da profissionalização e meritocracia importada de países
centrais. Os conflitos daí decorrentes circunscrevem-se no contexto da necessidade de
demarcação das fronteiras entre o profissional e o político, num país que historicamente
pautou o acesso e mobilidade nas carreiras jurídicas pela lógica das relações pessoais. A
partir da investigação sobre as regras de ocupação de altas posições no espaço dos
procuradores, a intenção do trabalho, ao discutir questões em torno do problema da
profissionalização das carreiras de procurador de Estado, é examinar a forma de
produção dos discursos e da alternância de posições dentro do grupo ao enfrentar os
questionamentos sobre práticas sociais, concepções e significados em jogo na interação
destes indivíduos singularmente considerados e dos grupos que se formaram dentro do
espaço social comum. O exame da composição da elite dirigente da instituição, em
diferentes períodos históricos, e das recentes clivagens do grupo revelou que os efeitos
da diversificação social e demográfica do grupo, a partir da década de 1990, se tornou,
progressivamente, o móvel dos conflitos no interior do campo que, a despeito disto,
manteve a antiga lógica de recrutamento e seleção de sua elite dirigente, recrutada
fundamentalmente entre os detentores de origens notáveis, dotados de capitais de
relação social e política necessários para vencer o jogo.

A Training programme for intermediaries for the child witness in South African CourtsSchoeman, Ulrike Charlotte Wanda 03 November 2006 (has links)
This study concentrates on the development, implementation and evaluation of a research based training program for intermediaries in South African courts in order to improve the intermediary’s knowledge and understanding of the role and duties of an intermediary. The motivation for this study had its origin in the fact that the adversarial nature of court proceedings is a major stumbling block for the child witness. The research problem, namely that there is no national research based training program for intermediaries in South Africa, was discussed. Intervention research was used as research methodology and a two phase research approach was undertaken. A quantitative survey research design was used during the phases. The research question formulated for the first phase was: What are the duties and role of an intermediary? 54 magistrates and 34 prosecutors who attended four workshops, completed a self-structured questionnaire. This data complemented the literature study and both were used to compile a training program for intermediaries. The quantitative approach was also used for phase two of the study. A quasi-experimental one-group pretest-posttest design was used. An assessment by means of a questionnaire was done before the training program started and was repeated again after the presentation of the training program to determine the effectiveness of the program The research hypotheses that was formulated was: If an intermediary is trained according to a research-based training program, the intermediary’s knowledge of her role in assisting the child before and during the trial in a South African court will be improved. A five-day training program was implemented. The hypothesis was confirmed after the data had been analyzed and compared to the literature. In chapter two the legal system of South Africa, in respect to the child, was discussed and in chapters three, four and five all aspects of child development were discussed with specific emphasis on the child witness that needs to testify in a separate courtroom. Cognitive development and language development in the context of the child witness were discussed. This information was used to develop a training program. In chapter six the development of a training program was discussed with specific attention being given to outcomes based education. In chapter seven all the data that was collected was quantified, analyzed and interpreted. The conclusion could be drawn that the respondents did show improvement of their skills and knowledge of an intermediary, his/her duties and theoretical knowledge. They also showed that their practical skills had improved by attending the training program. The conclusion could therefore be made that the intermediary training program was successfully implemented and complied with the requirements of an outcomes based training program. The findings obtained indicate that trainers of intermediaries throughout South Africa can successfully apply the developed training program. Conclusions and recommendations (chapter 8) of this study are put forward in accordance with the process that was followed in developing and implementing the training program for intermediaries who are to assist children when testifying in a court. / Thesis (DPhil (Social Work))--University of Pretoria, 2006. / Social Work / unrestricted
