The co-operation regime of the international criminal court: the obligation of states to arrest and surender

Magister Legum - LLM / The study attempts to identify the concrete mechanisms inherent in the co-operation regime of the ICC in relation to the arrest and surrender of suspects. By doing so, it attempts to contribute to a better understanding of the procedural mechanisms pertinent to the question of arrest and surrender, thereby augmenting the emerging body of international literature focusing on this issue. Moreover, by examining real cases will identify practical deviations and suggests measures that need to be considered to remedy the problem. It is important that the procedures are clarified and followed properly. Otherwise, the ICC will lose credibility internationally, thus undermining the purpose of its creation, which was to combat impunity and to contribute towards achieving justice, peace and well being worldwide.

Women's erotic rape fantasies.

This study evaluated the rape fantasies of a female undergraduate sample (N = 355) using a sexual fantasy checklist, a sexual fantasy log, a rape fantasy scenario presentation, and measures of personality. Results indicated that 62% of women have had a rape fantasy. For these women, the median rape fantasy frequency was about four times per year, with 14% of participants reporting that they had rape fantasies at least once a week. Further, rape fantasies exist on a continuum between erotic and aversive, with 9% completely aversive, 45% completely erotic, and 46% both erotic and aversive. Women who are more erotophilic, open to fantasy, and higher in self-esteem tended to have more frequent and erotic rape fantasies than other women. The major theories that have been proposed to explain why women have rape fantasies were tested. Results indicated that sexual blame avoidance and ovulation theories were not supported. Openness to sexuality, sexual desirability, and sympathetic activation theories received partial support.

Surrender to God Predicts Lower Levels of Substance Use Addiction

Religiousness has been shown to have an inverse relationship with at least some types of addiction. The present study examined whether intrinsic religiousness predicts substance addiction in a sample of participants that included mostly undergraduate students from the Appalachian region, as well as some participants surveyed with the use of social media advertisements. Intrinsic religiousness has been defined as internalizing the tenets of one’s faith. Participants self-reported their religiousness using the Religious Surrender and Attendance Scale – 3 (RSAS-3), which has been shown to measure intrinsic religiousness. Substance use was measured by the TCU Drug Screen V (TCUDS). Religiousness, as measured by the RSAS-3, predicted lower levels of substance use addiction as measured by the TCUDS both continuously and dichotomized: X2 (1, N=517) =8.296, p=.004. The odds ratio for the model was 3.724 95% CI [1.305, 10.625] meaning that the odds of being addicted to a substance was 3.724 times more likely for someone who did not meet the threshold for being high in religious commitment than for someone who did. The present study extends findings regarding religiousness and addiction but further research should be done to analyze different theological traditions and their relationship with health outcomes.

European arrest warrant represents an innovative criminal procedure instrument at the European level that has significantly helped the Member states of the European Union to effectively prosecute cross-border crime. The aim of my diploma thesis is to describe and analyze the European arrest warrant as a legal basis of surrender procedure among the Member states of EU. The description of this institute is not the only thing to be presented to the reader, the thesis also proposes a critical view on using it. The thesis is divided into five chapters. The introductory chapter is an analysis of the traditional international judicial cooperation in criminal matters and its particular types, mainly the extradition, which is important for a consecutive explanation of surrender procedure. After a brief theoretical part, in the second chapter author focuses on the evolution and the process of the European judicial cooperation in criminal matters, starting with the opening of the external borders of the EU regarding the Schengen Agreement in 1985, mentioning the important Maastricht and Amsterdam Treaties and the last important change of the Treaties of the European Union brought by the Lisbon Treaty. Resumé The European Arrest Warrant The aim of my diploma thesis is to analyze the Framework Decision of 13 of June on the European Arrest Warrant and the surrender procedures between Member States (2002/584/JHA), next as "FWD", and how it has contributed to the creation of new simplified and more effective system of extradition of criminals among the Member States of the European Union. The historical development of international judicial cooperation in criminal matters and the extradition procedure will be discussed first in order to understand the need for a new solution for handling with the new forms of organised cross boarder crime in the European Union that were brought by the introduction of the principle of free movement of persons and the abolition of boarder checks after the Schengen Agreement. This will lead us to the critical analysis of fundamental principles on which the European Arrest warrant is based, its practical application by the judicial authorities in different Member States and core problematic issues that the daily practise of surrender procedure is nowadays facing. La question du rachat préoccupe les assureurs depuis longtemps notamment dans le contexte des contrats d'épargne en Assurance-Vie, pour lesquels des sommes colossales sont en jeu. L'émergence de la directive européenne Solvabilité II, qui préconise le développement de modèles internes (dont un module entier est dédié à la gestion des risques de comportement de rachat), vient renforcer la nécessité d'approfondir la connaissance et la compréhension de ce risque. C'est à ce titre que nous abordons dans cette thèse les problématiques de segmentation et de modélisation des rachats, avec pour objectif de mieux connaître et prendre en compte l'ensemble des facteurs-clefs qui jouent sur les décisions des assurés. L'hétérogénéité des comportements et leur corrélation ainsi que l'environnement auquel sont soumis les assurés sont autant de difficultés à traiter de manière spécifique afin d'effectuer des prévisions. Nous développons ainsi une méthodologie qui aboutit à des résultats très encourageants ; et qui a l'avantage d'être réplicable en l'adaptant aux spécificités de différentes lignes de produits. A travers cette modélisation, la sélection de modèle apparaît comme un point central. Nous le traitons en établissant les propriétés de convergence forte d'un nouvel estimateur, ainsi que la consistance d'un nouveau critère de sélection dans le cadre de mélanges de modèles linéaires généralisés / Insurers have been concerned about surrenders for a long time especially in Saving business, where huge sums are at stake. The emergence of the European directive Solvency II, which promotes the development of internal risk models (among which a complete unit is dedicated to surrender risk management), strengthens the necessity to deeply study and understand this risk. In this thesis we investigate the topics of segmenting and modeling surrenders in order to better know and take into account the main risk factors impacting policyholders’ decisions. We find that several complex aspects must be specifically dealt with to predict surrenders, in particular the heterogeneity of behaviours and their correlations as well as the context faced by the insured. Combining them, we develop a methodology that seems to provide good results on given business lines, and that moreover can be adapted for other products with little effort. However the model selection step suffers from a lack of parsimoniousness: we suggest to use another criteria based on a new estimator, and prove its consistant properties in the framework of mixtures of generalized linear models

Assessing Religious Commitment: The Religious Surrender and Attendance Satisfaction Scale

Survey instruments have been developed to measure whether someone claims to be religious but do not address the degree to which someone is satisfied with their religious commitment. The Religious Surrender and Attendance Satisfaction Scale (RSASS) was revised to measure both a person's level of religious commitment and satisfaction with level of religious commitment. This study was conducted to determine initial validity for the satisfaction portion of the RSASS. Construct validity measures provided initial confirmation of the utility of RSASS as a measure of satisfaction with religious commitment, that can be used by nurses in practice and research.

影響壽險解約行為因素之實證分析 / On the Factors Affecting the Surrenders Behavior of US Life Insurance Contracts

本篇論文要探討的主題為何種總體或個體因素會影響投保人在壽險上的解約行為。由於壽險保單的解約行為會讓保險公司面臨現金流、聲譽、逆選擇等風險,進而影響公司營運。因此探討影響保單解約率之因素,進而準確估計保單的解約率為十分重要的議題。此外,不論投保人主動解約或是被動使保單失效均會對保險公司造成影響,因此本篇論文也將利用不同解約率的計算方式進行實證分析,研究是否不同計算方式的解約率會影響實證結果。本文使用NAIC (National Association of Insurance Commissioners)保險資料庫之年報資料,對2004-2014年間保險公司之經營狀況進行分析,驗證解約率實證中常用的三個假說:市場利率假說、緊急資金假說以及保單替換假說,選用之變數包含失業率、利率、保單替換率、高齡比等變數,並採用固定效果模型作為縱橫資料之迴歸模型,分別對不同計算方式所得之解約率進行迴歸分析,並比較彙整其結果。最後針對結果提出未來研究之建議。 / Insurance companies’ business will be influenced by surrender activities in several aspects, such as cash flow problem and inverse selection problem. Empirical researches show that both macroeconomic variables and microeconomic variables will influence surrender behaviors. Hence, this paper seeks to which kinds of macroeconomic variables will influence surrender activities and investigates whether using different ways to calculate surrender rate will cause different empirical results. All available US insurance company data, ranging from January 2004 to December 2014, are obtained from the annual statement in NAIC (National Association of Insurance Commissioners).We found some evidence supporting Emergency Fund Hypothesis and Interest Rate Hypothesis, but using different ways to calculate surrender rate may cause a little bias in conclusion. However, the relationship between surrender activities and macroeconomic variables supports insurance companies to understand and actively manage lapse/surrender risk.

Validation for a Very Brief Measure of Religious Commitment for Use in Health Research

Religious Commitment is a construct known to be predictive of various health-related factors of importance to researchers. However, data collection efficiency and instrument brevity in healthcare settings are priorities regardless of the construct being measured. Brief, valid instruments are particularly valuable in health research and will be vital for testing mechanisms by which health may be improved or maintained. This series of studies aims to demonstrate that Religious Commitment can be validly measured with a very brief instrument, the Religious Surrender & Attendance Scale-3 (RSAS-3), which combines a 2-item measure of Surrender, a specific type of religious coping, with a 1-item measure of Attendance at religious services. Three studies are reported, two utilizing undergraduate university students (Ns = 964 and 466) and one utilizing a clinical-based pregnant population (N = 320), all in southern Appalachia. The original 12-item Surrender Scale, a 2-item subset of Surrender items, and Attendance were found to be highly positively correlated with each other and with Intrinsic Religiosity, an additional measure of Religious Commitment employed to demonstrate concurrent validity. Religiosity variables were found to be strongly negatively correlated with Anxiety and stress, which were the health outcomes of interest. Hierarchical multiple regression analysis was used to confirm the similarity of Anxiety and stress prediction using the 12-item and 2-item Surrender measures and to confirm the superior stress prediction of the 3-item instrument RSAS-3. The RSAS-3 is recommended as a measure of Religious Commitment in future health research.
