A efetividade da Constituição Federal de 1988 quanto à delimitação do poder de edição de medidas provisórias / The effectiveness of the 1988 Federal Constitution concerning the delimitation of the power on editing Provisional laws

Esta tese constitui resultado de pesquisa a respeito da seguinte questão: as fórmulas constituintes em vigor são capazes de moldar a edição de medidas provisórias? No intuito de atingir esse propósito com garantia de originalidade, a pesquisa conduziu-se por duas linhas mestras: aferição das histórias institucional e conceitual da medida provisória e análise empírica de medidas provisórias. As histórias institucional e conceitual da medida provisória estão alocadas em dois capítulos, sendo o primeiro concebido de modo a prestigiar o texto original da Constituição Federal de 1988. Os debates constituintes indicam o porto seguro para análise do surgimento institucional da medida provisória, ao passo que a evolução conceitual foi apreendida através do prisma doutrinário daquele contexto, isto é, nos momentos antecedentes à Emenda Constitucional 32. O segundo capítulo estuda a medida provisória na atual redação constitucional, decorrente da Emenda Constitucional 32. A análise dos debates parlamentares travados durante essa reforma auxilia a descoberta do que se pretendia, em termos institucionais, com a mudança das regras inerentes à edição de medidas provisórias. O apoio doutrinário, devidamente contextualizado, foi utilizado na análise da evolução conceitual da medida provisória com base nas novas regras. O terceiro capítulo, destinado à aferição do impacto da medida provisória nos âmbitos de atuação da Presidência da República, do Congresso Nacional e do Supremo Tribunal Federal, ampara informações procedentes da exploração empírica de todo o universo de medidas provisórias editadas após a Emenda Constitucional 32, componentes de conjunto homogêneo cuja validade decorre do texto constitucional em vigor. O produto estatístico tem dúplice utilidade: aferição da sintonia doutrinária com a medida provisória, tal qual vem sendo utilizada desde a Emenda Constitucional 32, bem como suporte a uma postura acadêmica crítica e inovadora. O quarto capítulo contempla posicionamentos críticos orbitando o objeto central da tese. A análise empírica gerou ambiente seguro para avaliar se a Constituição Federal de 1988, após a Emenda Constitucional 32, é eficaz quanto à limitação do poder de edição de medida provisória. O estudo elucida a existência de considerável descompasso entre a evolução conceitual da medida provisória e o perfil desse instituto em sua utilização prática. Consequentemente, a abordagem teórico-constitucional, realizada através das lentes da análise empírico-estatística, ocasiona profundas reflexões a respeito dos dilemas atuais, favorecendo a idealização do perfil institucional para a medida provisória por vir. / This study is the result of research on the question: the constituent elements in force are able to shape the issuance of provisional laws? In order to achieve this purpose with the originality assurance, two main lines conducted the research: assessment of institutional and conceptual stories of the provisional law and empirical analysis of provisional law. The institutional and conceptual stories of the provisional law are presented in two chapters; the first one intends to honor the original text of the Brazilian Constitution of 1988. The constituent debates are the safe harbor for analysis the institutional emergence of the provisional law, while the doctrinaire perspective seized the conceptual evolution, that is, the preceding moments to Constitutional Amendment 32. The second chapter studies the provisional law in the current constitutional text as a result of the Constitutional Amendment 32. The analysis of the parliamentary debates that took place during this reform assist the understanding what was intended, in institutional terms, with the change of the rules related to the edition of provisional laws. The doctrine support, properly contextualized, was used in the analysis of the conceptual evolutions of the provisional laws, in accordance with the new rules. The third chapter, which presents the impact of the provisional law in the work of the Presidency, the Congress and the Supreme Court, sustain information of empirical exploration of the all provisional law edited after the Constitutional Amendment 32, homogeneous set of components which validity derive from the Constitution in force. The statistical product has dual utility: measurement of doctrinal line with the provisional law, as it has been used since the Constitutional Amendment 32 and as support of a critical and innovative academic position. The fourth chapter includes critical positions regarding the central subject of the thesis. The empirical analysis created a safe environment to evaluate whether the Federal Constitution of 1988, after the Constitutional Amendment 32, is effective for the limitation of the power to edit a provisional law. The study enlighten that there is a considerable disparity between the conceptual evolution of the provisional law and its practical use. Therefore, the theoretical and constitutional approach, examined through empirical-statistical lens, creates profound reflections on the current dilemmas, favoring the idealizations of as institutional profile of the provisional law to come.

Le gouvernement parlementaire et la fonction présidentielle en Grèce et en Irlande / The parliamentary government and the presidential function in Greece and in Ireland

La présente recherche se propose d'analyser et de comparer les articulations juridiques et politiques réalisées entre le système du gouvernement responsable et la fonction de chef de l'état dans deux républiques européennes très peu étudiées en France, la Grèce et l’Irlande. Il s'agit de tenter d'apporter une contribution à la théorie générale et à la pratique des régimes politiques de l’Europe contemporaine, en plaçant l'attention sur une problématique constitutionnelle majeure dans les républiques parlementaires mais relativement négligée. Malgré la primauté incontestable du gouvernement majoritaire, il n'en reste pas moins qu'il laisse subsister, dans les régimes républicains, des virtualités dualistes longtemps en sommeil, mais que des évolutions récentes paraissent vouloir réveiller ou au moins remettre en question dans certains pays. En d'autres termes, la fonction présidentielle, qui semblait condamnée à une inéluctable neutralisation dans les systèmes dominés par le premier ministre, tend à (re)trouver une vocation sinon gouvernementale, du moins centrale. Par-delà leurs différences structurelles, culturelles et politiques initiales, les constitutions grecque de 1975 (révisée de façon significative en 1986) et irlandaise de 1937 offrent deux exemples permettant de tester l'hypothèse retenue. / The present thesis proposes an analysis on comparative basis of the legal and political articulations that take place between the system of the responsible government and the presidential function in these two parliamentary democracies, not thoroughly studied in France. The aim of this research is a contribution to the general theory and practice of the political systems in modern Europe, stressing out aspects of an important constitutional topic for parliamentary republics which is still relatively neglected. Although the supremacy of the majoritarian government is not put into question, it can be still claimed that within the republican political systems, certain dualist implications, that remained for long inactive, tend to be reactivated again in some countries by recent events. In other words, the presidential function that seemed to be condemned to an inescapable neutralisation within the systems dominated by the political figure of the Prime minister tends to find once again a reason of being, if not governmental, at least central. Beyond their initial structural, cultural and political differences, the Greek Constitution of 1975 (revised significantly in 1986) and the Irish Constitution of 1937 offer two fruitful examples of the constitutional dynamics that could test the above-mentioned assumption.

The broad subject of this diploma thesis would be the Czechoslovak Secret Police (StB) during the years 1945-1969; and, more narrowly, certain aspects of its organization and activities in relation to the then applicable legislation. The overriding objective, which was reflected in this legislation, was the protection of the Communist political system, the regime. This regime protection goal clearly influenced the evolution and organization of the StB and the related policies on the imprisonment of those individuals that represented a threat to the State and the State System. Similar general principles and policies have basically remained in effect into the current period. The paper begins with an Introduction and Preface, which take a look at the events and nature of the society in this post-World War II period. This material is derived from an examination of historical source materials. The remainder of the paper is divided into four additional Chapters with related subsections. The Introduction and Preface focus on the nature and state of the society in the immediate post-war period, which provided the context and background used for the development of the new legislation and the newly created institutions developed for the protection of this new social order and the punishment and incarceration...

The presented thesis gives a comprehensive overview of the development of government systems in the Czech Republic since its inception in 1993 until the elections to the Parliament of the Czech Republic in 2010. The main attention will be paid to the reasons for an occurrence of clerical governments, to the evaluation of their activities and to the causes of their popularity among the Czech public. The basis for meeting the objectives of this thesis was the study of literature, documents and publications dedicated to the issue of Czech governments. Important sources of information were electronic resources of state institutions, such as the Government of the Czech Republic, the Parliament of the Czech Republic, the Constitutional Court, the Czech Statistical Office, etc., but also data from polls conducted by reputable companies such as STEM, Ltd. or the Center for Public Opinion Research. The main research method are the semi-structured discussions with the direct players ( former ministers of the clerical government of Josef Tošovský and also of Jan Fischer ), with the Czech political scene experts and also with the present high politicians and the candidates for a president that was elected in January 2013.

Imagine a world where someone’s personal information is constantly compromised, where federal government entities AKA Big Brother always knows what anyone is Googling, who an individual is texting, and their emoticons on Twitter. Government entities have been doing this for years; they never cared if they were breaking the law or their moral compass of human dignity. Every day the Federal government blatantly siphons data with programs from the original ECHELON to the new series like PRISM and Xkeyscore so they can keep their tabs on issues that are none of their business; namely, the personal lives of millions. Our allies are taking note; some are learning our bad habits, from Government Communications Headquarters’ (GCHQ) mass shadowing sharing plan to America’s Russian inspiration, SORM. Some countries are following the United States’ poster child pose of a Brave New World like order of global events. Others like Germany are showing their resolve in their disdain for the rise of tyranny. Soon, these new found surveillance troubles will test the resolve of the American Constitution and its nation’s strong love and tradition of liberty. Courts are currently at work to resolve how current concepts of liberty and privacy apply to the current conditions facing the privacy of society. It remains to be determined how liberty will be affected as well; liberty for the United States of America, for the European Union, the Russian Federation and for the people of the World in regards to the extent of privacy in today’s blurred privacy expectations.
