Orientador: Maria Teresa Miceli Kerbauy / Banca: Maria Cristina Gobbi / Banca: Sebastião Geraldo / Resumo: Esta pesquisa tem como objetivo traçar o perfil de um grupo de TVs universitárias do Brasil e da TV Unaerp de Ribeirão Preto e analisar os modelos de gestão adotados por elas, já que a maior parte veicula a programação por meio da TV por assinatura via cabo. As características que delineiam as TVs universitárias ainda estão sendo formadas no país, portanto, necessita-se identificar os modelos de negócio e as leis que regulamentaram o setor e, desta maneira, verificar de que forma afetam o desenvolvimento e a manutenção dessas emissoras. Para alimentar as argumentações o estudo se apoia nas políticas públicas de comunicação e na legislação em vigor que dão suporte ao entendimento sobre a evolução da televisão universitária no país. A partir de levantamento bibliográfico e pesquisa de campo composta por aplicação de questionário e entrevistas, buscamos abranger o maior número de informações para a realização de um trabalho de pesquisa capaz de produzir conteúdo de referência e reflexão. A TV universitária tem pela frente grandes desafios como o ser reconhecida pela comunidade acadêmica e pela sociedade, promover a sustentabilidade e garantir sua manutenção, consolidar-se no campo público a ter acesso ao Sistema Brasileiro de Televisão Digital Terrestre / Abstract: This research has as its aim make the profile and analyze the models managing of a University Television group in Brazil and from Unaerp TV in Ribeirão Preto, most of them being exhibited via cable TV. The outlining characteristics from University TVs are still being formed in the country, therefore, identifying the business and sectors rules is needed, this manner, verify in which way they affect the development and maintenance of these channels. To arise argumentation the study is based in communication public politics and in the running legislation, which support the understanding about the evolution of University television in the country. Whereof bibliographic studies and camp research made of questionnaire and interview, we tried to embody the highest number of information to promote a research work capable of producing reference and reflection context. In 1988, The Canada and the United States of America signed the Free-trade Agreement of North America. They wrote in a compulsory licence of cablodistribution: cablodistributors could, without consent, intercept the broadcasting waves but would also have to give them a financial compensation. / In 1995, the WTO2 elaborated the Trade related intellectual property agreement (TRIPS). The latter grants the broadcastors a right to authorize or to prevent the communication of their waves to the public. / Is the existence of the compulsory licence compromised by this agreement? We believe not. Indeed, justifications to the compulsory licence are found in the TRIPS: the general derogation of section 13 and the insertion of the Berne Convention through section 9 allow such licence. We also establish that the national treatment and the most-favoured nation clauses do not apply to the compulsory licence. / 2World Trade Organization

This study reviews the evolution of television broadcasting in Taiwan from 1949 to 1982, with emphasis on the period from 1970 to 1982. The problem was to examine the development of the television industry in Taiwan as influenced by law and regulation, politics, and social customs. This study concludes that the development of the television industry in Taiwan was indeed greatly influenced by the above three factors. Future growth of the industry, however, may be greatly hindered unless the government relaxes its close control of the medium in the future.

This investigation deals with a change of congressional attitude concerning violence in entertainment media, from noninterference to investigation to initiation of research. The data are primarily from official government records. This study first examines a period of congressional reluctance to interfere with the violent content of movies and radio in 1929-45. Next examined is the period 1945-68, when Congress actively investigated media violence,, focusing on television. Finally, the study examines congressional activity concerning television violence in 1968-74 and the Surgeon General's report on television violence. This report concludes that, by 1955, the pattern of congressional interest in media violence had turned from reluctance to activity, -and discusses the likelihood of future control of television program content.

La thèse aborde le droit européen de la télévision sous deux aspects :les régimes administratifs d’accès des émissions télévisées aux réseaux câblés et les droits intellectuels. <p><p>En ce qui concerne l’accès des émissions aux réseaux câblés, la thèse met en avant le besoin de sauvegarder un service public de l’audiovisuel. Celui-ci est défini comme un ensemble des règles qui visent à la fois le paysage audiovisuel propre à chaque Etat membre (par exemple pluralisme) et le contenu des émissions proprement dit (émissions informatives, éducatives, épanouissement culturel etc.). Le droit communautaire primaire et dérivé, tel qu’interprété par la Cour de justice, fournit les moyens de conciliation entre, d’une part les intérêts généraux et, d’autre part, les exigences découlant de la libre prestation de services et de la libre concurrence. <p><p>En ce qui concerne l’application des droits intellectuels, la thèse aborde la problématique liée à l’épuisement ou la subsistance de ceux-ci. Dans le cas de la câblodistribution, la Cour a affirmé la subsistance du droit. Cette position est corroboré par la nouvelle directive européenne sur le droit d’auteur et les droits voisins dans la société de l’information. La thèse appuie la position de subsistance en considérant qu’elle constitue une condition essentielle pour la juste récompense des auteurs. <p><p>Enfin, la thèse aborde les questions plus spécifiques qui naissent à propos de la convergence technologique et juridique. Tout d’abord, il est avancé que le service public de l’audiovisuel n’est pas uniquement lié à des contraintes techniques, mais essentiellement à des objectifs qualitatifs (contenu des émissions). Ainsi, la thèse plaide en faveur de la pérpetuité du service public de l’audiovisuel dans l’ère du numérique. Par ailleurs, des questions plus spécifiques (comme l’accès à la boucle locale, l’interconnexion des réseaux et la numérisation des infrastructures) ont été examinées. <p><p> / Doctorat en droit / info:eu-repo/semantics/nonPublished
