Le chaos régulé : une approche épistémique de l’intervention humanitaire

L’objectif de cette recherche est de comparer deux modes d’intervention internationale (étatique et non-étatique) qui ont une optique de maintien ou de rétablissement de l’ordre et de la paix, de développement économique et social, pour des raisons humanitaires. De fait, la frontière est aujourd’hui floue entre les interventions étatiques et non-étatiques. Pour éviter une confusion conceptuelle, l’objet de l’étude est la comparaison de trois moments historiques d’intervention américaine en Haïti. L’étude se déroule en deux temps. D’abord elle servira à comprendre la logique d’action de l’État américain lors des interventions passées et présente afin de relever les objectifs implicites et explicites de ces interventions. Dans un deuxième temps elle se concentrera sur la biopolitique dans l’intervention humanitaire et l’application de la théorie de régulation du chaos. Celle-ci impliquant des conditions variées, elle propose un modèle théorique qui vise à comprendre l’intervention contemporaine en tant que nouveau cadre épistémique d’action politique, celle du ‘chaos régulé’ (‘Regulated Chaos’: McFalls, Pandolfi, Nguyen). Cette recherche transpose donc l’emphase sur la nécessité effective de l’intervention vers les propriétés de l’intervention. Elle est une tentative de comprendre les expériences sociales de pouvoir dans une zone humanitaire comme Port-au-Prince. / The main goal of this study is to compare two modes of international interventions (state and non-state) that have the objective of maintaining or restoring order and peace, economical and social development, for humanitarian reasons. In fact, the limit between state and non-state interventions is blurry. To avoid such conceptual confusion, the object of study is an ensemble of three historical moments of American intervention in Haiti. The study is divided in two points. First, it will help comprehend the logic of action of the American state during past interventions in Haiti, and define the implicit and explicit goals of these interventions. Secondly this study focuses on biopolitics in humanitarian intervention and the application of the theory of regulated chaos. Because this theory implies various conditions, it proposes a theoretical model that wishes to explain contemporary intervention as a new epistemic framework of political action, one of the « regulated chaos » (McFalls; Pandolfi; Nguyen). This study shifts the emphasis on the effective necessity of the humanitarian intervention to its properties. It is therefore a tentative to understand social experiences of power in a humanitarian zone such as Port-au-Prince.

Le pouvoir communal et l'émancipation urbaine au XVe siècle : le cas de la ville de Liège (1400-1455)

La ville de Liège, à la fin du Moyen Âge, fut le théâtre de l’affirmation de ses bourgeois par l’entremise des corporations de métier et des institutions communales. Le XIVe siècle fut en effet marqué par des gains communaux importants au détriment, d’une part, du patriciat urbain, d’autre part, du prince-évêque de Liège. À partir de 1384, le Conseil liégeois, entièrement entre les mains des artisans, possédait des prérogatives étendues dans l’administration et la gestion de la ville. Toutefois, la progression du pouvoir bourgeois se trouva brusquement stoppée, pour une dizaine d’années, lors de la défaite liégeoise d’Othée, en 1408. Ce mémoire porte sur l’évolution du pouvoir communal liégeois dans la première moitié du XVe siècle, moins bien connue des historiens. L’étude de la chronique de Jean de Stavelot permet de mettre en lumière cette période trouble. La défaite d’Othée de même que les réformes imposées par les princes-évêques causèrent notamment de grands bouleversements. Des partis politiques entrèrent aussi en scène et la présence voisine du puissant duc de Bourgogne influença la vie des Liégeois. Ces particularités issues du contexte politique et social sont autant d’éléments qui influèrent sur la volonté d’affirmation des bourgeois et l’exercice du pouvoir communal à Liège. / The city of Liege, in the late Middle Ages, witnessed the assertions of its bourgeois through their guilds and municipal institutions. The fourteenth century was indeed marked by significant gains for the municipal power at the expense of the urban patriciate on one hand and of the prince-bishop of Liege on the other hand. From 1384, the Council of Liege, entirely in the hands of the craftsmen, possessed extensive powers in the administration and management of the city. However, the growth of the power of these bourgeois was suddenly stopped for a decade after their defeat in Othee in 1408. This thesis discusses the evolution of communal power in Liege during the first half of the fifteenth century, less well known by historians. The study of the chronicle of Jean de Stavelot can highlight this troubled period. The defeat of Othee, as well as reforms imposed by prince-bishops, caused notably dramatic changes. Political parties also entered the scene and the neighboring presence of the powerful Duke of Burgundy influenced the lives of the bourgeois of Liege. These features of the political and social context are factors which influenced the willingness of the bourgeois’ assertion and the exercise of communal power in Liege.

The landscape of the boreal forest in north-central Canada is characterised by mosaics of broad-leaved deciduous trees (aspen, Populus; birch, Betula), evergreen conifers (black spruce, Picea mariana; jack pine, Pinus banksiana; and larch, Larix), fens and lakes. The forest has been cited as the possible location of a global carbon sink, and its likely response in the event of global climate change remains unclear. To improve our current understanding of the links between the boreal forest ecosystem and the lower atmosphere, the Boreal Ecosystem-Atmosphere Study (BOREAS) was executed in a series of field experiments in 1994 and 1996. This thesis documents the efforts made to characterise and map temporal and spatial distributions of the fluxes of heat, water vapour and CO2 over two 16 km x 16 km heterogeneous sites at the BOREAS study sites. / Most of the data in this thesis were obtained from the airborne observations by the Canadian Twin Otter Aircraft, operated by the Institute for Aerospace Research of the Canadian National Research Council, at the BOREAS Northern Study Area (NSA), and Southern Study Area (SSA). The research aircraft was flown at a fixed altitude of about 30 m agl. The data acquired in 1994 were primarily used to develop an objective deterending scheme in eddy-correlation flux estimates, that took into consideration the physical nature of turbulent transport during convective daytime conditions, and to map the spatial distribution of sensible heat, latent heat and CO2 fluxes over three intensive field campaigns. Maps of spatial patterns of the surface characteristics, such as the surface temperature excess over air temperature (Ts-T a) and Greenness index (GI), were also constructed. The mapping procedure involved generation of an array of grid points by block averaging the parameter of interests along the flight lines, spaced 2 km apart, over 2 km windows, with 1 km overlap between adjacent windows. The (Ts-Ta) maps showed, not surprisingly, that surface temperatures were relatively cooler over the mature forests than over the disturbed, regenerating and burn areas. However, they also showed a decoupling between sensible heat flux and T s-Ta not seen in less complex terrain. By contrast, close correspondence was observed between maps of CO2 flux and greenness, suggesting that the potential to infer CO2 exchange from remote sensing observations of the surface is higher than that for energy exchange. La présente thèse a pour objet de démontrer que la conception du droit de Jean Domat (1625-1696) constitue une issue au positivisme juridique dominant aujourd'hui. Ce dernier fait obstacle à toute interrogation philosophique, n'a pas pu s'opposer à des débordements totalitaristes et contribue à une prolifération des textes qui mène à l'éclatement du lien social. Une pensée sur le droit aujourd'hui doit être facile à concevoir, toujours présente ; il faut qu'elle puisse se sentir dans l'action. Elle doit aussi animer tout le droit, privé comme public et permettre un contrôle complet des règles venant du pouvoir par les membres et responsables de la société, et être partageable par tous, de quelques croyances, religions et opinions qu'ils soient, pour éviter les critiques communautariennes. Il lui faut enfin être issue de l'examen du droit lui-même plutôt qu'être déduite d'une doctrine imposée, être capable de faire obstacle aux déviances politiques et enfin être logique dans ses développements pour être acceptée. Jean Domat découvre que le droit est animé par deux principes :"Nous ne devons pas faire à autrui ce que nous n'aimerions pas qu'autrui nous fasse ; nous devons faire à autrui ce que nous aimerions qu'autrui nous fasse". Ces principes répondent à ces critères. Il reconstruit et présente le droit privé d'une part, et le droit public d'autre part, en montrant comment ils s'organisent selon ces deux principes. Il démontre par une présentation réussie de tout le droit privé que les relations de droit entre particuliers peuvent dans le détail être toutes régies par ces deux principes. Il fait voir également comment l'action politique du Prince peut et doit être conduite par eux. Le Prince est soumis comme quiconque à ces exigences et ne dispose pas de prérogative particulière. Enfin, Jean Domat pose que le sujet n'a pas à obéir à une loi qui ne serait pas conforme à ces principes. Nous montrons que sa pensée, qui a été oubliée, présente une profonde nouveauté tant à son époque que dans le débat contemporain et permet de redonner sens au droit. / This doctoral thesis aims to demonstrate that the conception of the law developed by Jean Domat (1625-1696) constitutes an alternative to legal positivism, which is the dominant approach today. Legal positivism impedes any philosophical interrogation; it was unable to oppose totalitarian excesses, and it contributes to the multiplication of texts, which disrupts social cohesion. A theory of the law today should be pervasive and easy to conceptualize. This theory needs to be action-oriented. It needs to inspire all spheres of the Law, be it private law or public law, and should be designed to place all rules imposed by the government under the complete control of the members and leaders of society. This thought should be shareable by everyone, regardless of creed, religion and opinion, hence avoiding communautarian criticism. Moreover, this theory needs to be the result of an examination of the Law itself rather than being deducted from an imposed doctrine. It needs to be able to stand in the way of political abuses and be logical in its developments to be accepted. Jean Domat discovered that the Law is inspired by two principles: “we shall not do to others what we would not like others do to us; we shall do to others what we would like others do to us”. Both principles are in line with the above-mentioned criteria. Jean Domat reconstructs and presents both private law and public law, and shows that they are organized according to these two principles. He presents the whole of private law and demonstrates that the details of the legal relationships between private individuals are all be governed by these two principles. He also shows that they can and should inspire the political action of the Prince. The Prince does not have any particular status: he is subjected to these requirements, as everybody else. Finally, Jean Domat postulates that a subject does not have to obey a law that is not in conformity with these principles. In this doctoral thesis, I show that his thought, that has been forgotten, is highly original for his time. La restauration de la République conduite par Octavien vit renaître l’activité législative, « florissante » selon les mots d’Ovide (Met., 2.141) « sous la conduite du très juste » Auguste (Met., 5.833). L’association entre Auguste et son oeuvre législative fut telle que parmi les honneurs funèbres, il fut proposé que le nom de chacune des lois figure sur des écriteaux du cortège funéraire. La lex accompagnait Auguste au tombeau. Ses successeurs abandonnèrent progressivement le recours à la lex et quelques décennies après la disparition d’Auguste, la loi recevait comme seule fonction de sanctionner les pouvoirs et honneurs décidés par le Sénat et conférés à l’empereur à chaque début de principat. Cette loi était la dernière traduction formelle de la volonté du populus Romanus : parce qu’elle émanait du peuple et qu’elle établissait un fondement entre le prince et son statut, ses pouvoirs et les activités auxquelles elle donnait lieu, elle retint particulièrement l’attention des Prudents. S’ils constatèrent le bouleversement général des sources du droit que l’enracinement du prince dans l’édifice constitutionnel républicain et le développement de ses interventions normatives avaient entraînés, seule la partie des Prudents que le prince avait associée à l’exercice de sa justice et de sa production normative, amplifia la normativité des formes qu’empruntait la volonté impériale. La formulation de l’identité de la constitution impériale à la lex marqua l’avènement d’un ordre juridique dont la cohérence reposait sur le consensus, non plus des divers organes de la République mais de l’empereur et des Prudents. Le recours à l’autorité de la loi pour caractériser les constitutions impériales leur assurait, au-delà des mutations dont ils surent prendre la mesure, la continuité d’une activité qui s’originait dans les premiers temps de la civitas. / The restoration of the Republic led by Octavian marked a new start of legislative activity, said to be "flourishing" by Ovid (Met.,2.141), "under the leadership of the righteous" Augustus (Met.,2.141). As part of his funeral honours, Augustus being so closely related to his legislative work was made clear when it was suggested that the name of each law were to be inscribed on the banners for the funeral procession. The lex accompanied Augustus to his tomb. Little by little his successors no longer resorted to the lex and a few decades after Augustus decease, the unique function of the law was to acknowledge the powers and honours decided by the Senate and conferred to the Emperor at the beginning of his reign. That law was the last formal expression of the will of the populus Romanus: because it originated from the people and established the basis between the Prince and his status, his power and the activities that rose from it, it particularly caught the attention of the Prudentes. Though they may have noted the general disruption of the sources of the Law, resulting from the normative interventions of the emperor, it was only the part of jurisprudence that the prince had associated with his justice and therefore the production of norms,, that enhanced the normativity of the forms expressing the imperial will. The identity of the imperial constitution formed on the lex was the beginning of a new legal order, coherently based upon the consensus between the emperor and the Prudentes rather than upon the various organs of the Republic. Their resorting to the authority of the Law to characterize the imperial constitutions and their ability to assess change, ensured that an activity that started at the beginning of the civitas could continue.

Genre et musique populaire en Haïti : vers une compréhension sociologique de la réception du rabòday par des femmes

Le présent mémoire porte sur la réception du rabòday, un style musical populaire reconnu pour ses propos obscènes et sexistes, par des femmes haïtiennes. À partir d’un cadre théorique combinant les approches des Cultural Studies et du féminisme intersectionnel, l’analyse fait ressortir les façons par lesquelles le genre et la classe sociale interviennent dans la réception de ce style musical par des femmes qui en sont fans. En suivant la démarche développée par Janice Radway (2000 [1984]), le mémoire présente, d’une part, une analyse de contenu de dix chansons rabòday et, d’autre part, une analyse de discours réalisée à partir d’une série d’entretiens semi-dirigés et de focus groups menés auprès de 21 femmes provenant des quartiers populaires de Port-au-Prince. Les résultats montrent que les stéréotypes, la violence et les inégalités de genre sont au cœur du rabòday. En revanche, le rabòday décrit une réalité sociale à laquelle s’identifient les jeunes femmes des classes défavorisées. Bien qu’elles soient conscientes de son caractère sexiste, voire misogyne, les participantes à l’étude estiment que le rabòday donne de la visibilité aux personnes qui, comme elles, vivent dans des conditions marquées par la précarité et l’insécurité. La réception du rabòday se comprend ainsi comme une « lecture négociée » (Hall, 1994 [1973]) chez ces femmes. / This master’s thesis deals with the reception of rabòday music - a popular musical style known for its obscenity and sexism - by Haitian women. Drawing from a theoretical framework combining Cultural Studies and intersectional feminism, the analysis highlights the ways in which gender and social class shape the reception of this musical style by its female fans. Following Janice Radway’s (2000 [1984]) method, the thesis presents, on the one hand, a content analysis of ten rabòday songs and, on the other hand, a discourse analysis carried out from a series of semi-structured interviews and focus groups with 21 women from the lower working-class neighborhoods of Port-au-Prince. The results show that stereotypes, violence and gender inequalities are at the heart of rabòday music. However, rabòday music describes a social reality to which young women from lower social classes identify. Although they are aware of the sexist and even misogynistic character of rabòday music, the participants in the study believe that rabòday gives visibility to people who, like them, live in precarious conditions. The reception of rabòday music by these Haitian women is thus understood as a “negotiated position” (Hall, 1994 [1973]).

Tobacco Culture and Environmental Consciousness: Ecological Change, Race, and Gender, Prince Edward County, Virginia, 1850--1870

The purpose of this thesis is to examine through the lenses of an environmental historian the myths and the realities of soil exhaustion as this ecological process relates to the developing environmental ethics of tobacco farmers of Prince Edward County, Virginia, from 1850 to 1880. During the nineteenth century the tobacco farms of Southside Virginia experienced three phases in a century long process of ecological change that both influenced and were influenced by events that occurred in human history. The first phase coincides with the agricultural reform movements led by the planters of the late antebellum period. The second phase spans the Civil War years. The third phase begins with emancipation and Reconstruction and lasts until the end of the century when the cause of scientific agriculture was taken up by the agricultural reformers of the Progressive era. With each phase of ecological transition in conjunction with the transition from slave labor to wage labor, the relationship of white men and women and African American men and women to the rural landscape changed, thus creating a diverse, dynamic environmental ethic among the tobacco farmers of Prince Edward County, Virginia.

The relations between the Eastern Orthodox Church and the Roman Catholic Church have long been studied over the years in academia. Much focus has been placed upon the Fourth Crusade as the final act that brought the schism of 1054 into full development between the two churches. However, it was during the First Crusade that the Roman Catholic Church made its first concrete efforts to repair relations with the Eastern Orthodox Church. Yet such efforts were eventually twisted to suit the purposes of some of the crusading lords, and thus becoming arguably the largest blow to church reunification because it lead to the permanent formation of an anti-Greek attitude in Latin Europe.
