This thesis consists of an analysis of the canonical notion of the pedagogical relation, as introduced by Hermann Nohl in the 1930’s following the tradition of pedagogy and education in Germany. This notion, which has both been central in current debates on educational theory, for example in the work of Norm Friesen and Tone Sævi, has certain implications and political consequences. With an aim to expanding the notion and exploring its shortcomings, I identify certain central pillars, and focus on two of them, namely autonomy and the unified subject. The essay explores these and proposes other theoretical readings in order to contrast and broaden the landscape of thought regarding pedagogy and relations, and thereby the notion of the pedagogical relation. To this end, I first discuss the notions of relational autonomy and transindividualism, in order to put in evidence the liberal, often unnamed, roots of the (hegemonic) notion of autonomy and to open up to other ways of conceiving it. Then, I delve into a psychoanalytic reading of Jacques Lacan’s thought on education and his four discourses, through the work of Anna Pagès and Anna Herbert. In so doing, the notion of the unified subject is problematized, exploring the instability of the subject as a departure. This uncertainty, together with the notion of transindividuality, are presented as some possible ways of thinking about pedagogy, opening up to future discussions such as pedagogical relations, the philosophy of the teacher, and educational aims.

Under an interdisciplinary focus we have tried to connect various definitions relating to distinct subject-matters of the Social Sciences about the Third Sector over the world and in Brazil, and verified its undissociable relation to transindividualism. Under this context, we have analyzed the influences of the Third Sector in the Science of Law and tied it to the new citizenship consciousness, the civic bond, the democratic participation in the decisions on the goals of the nation, the protagonism in the social networks, to conclude that all the power belong to the people, therefore the people, and only the people, is the legitimate owner of its own destiny. The Third Sector, as a transindividual legal phenomenon is a social source of the Law / O presente trabalho busca investigar o advento do Terceiro Setor, fenômeno social de transformação mundial, cujo crescimento exponencial a partir da década de 70 trouxe à baila questionamentos acerca das estruturas e funções estatais, da adequação da soberania dos Estados-Nação ante à nova conformação econômica globalizada, ao redimensionamento dos espaços públicos e à relação tempo/espaço. Sob o espectro da interdisciplinaridade, buscamos concatenar conceitos vários pertinentes a objetos distintos das Ciências Sociais sobre o Terceiro Setor no mundo e no Brasil, e verificamos sua indissociável relação com o transindividualismo. Neste contexto, analisamos as influências do Terceiro Setor na Ciência do Direito e as entrelaçarmos à nova consciência cidadã, ao engajamento cívico, à participação democrática nas decisões sobre os rumos da nação, ao protagonismo nas redes sociais, para concluir que todo o poder emana do povo, sendo o povo, e só o povo, o senhor legítimo do seu destino.
