Resumé Community Law Against Unfair Competition The purpose of my thesis is to analyze the European legislation on unfair competition, its application by Court of Justice of the European Union (hereinafter referred to as "CJ EU") and its implementation into Czech law. The thesis is composed of six chapters. Chapter One is dedicated to the general explanation and description of the unfair competition and its subjects. Chapter Two examines the background and evolution of the harmonization process on unfair competition on European level and summarizes present applicable directives. It also provides a brief note on respective Czech regulation in which these European directives were implemented. Chapter Three is dedicated to the subject of misleading advertising as defined by the Directive 2006/114/EC. The first part of this chapter provides a description of misleading advertising, second part illustrates the approach of CJ EU in its decisions. Third part is concerned with the Czech regulation of misleading advertising while it can be concluded that Czech regulation is sufficient according to required European standard without further need of implementation. The Comparative Advertising - development of regulation in the Czech legal order Resumé My thesis analyzes the legal regulation of the comparative advertising in the Czech Republic. It deals not only with the current legislation, but it looks at the historical development and future perspectives too. The goal of my thesis is to provide a thorough guide to the development of its legal regulation within the particular eras of the Czech history, describe different approaches of legislators, judges and professionals, and eventually, I try to evaluate the current situation and draw conclusions. At the very beginning after my introduction I put a short chapter containing a few words about the term "comparative advertising" itself and about the different types of comparative advertising. Then, in the following chapter I chronologically address the issues of legal legislation in the history of the Czech Republic: the first part is dedicated to the time period of so called "First Republic" and its Law on protection against unfair competition and its vast judicature. European Law Against Unfair Competition Resumé This diploma thesis deals with the European (EU) law against unfair competition, or more specifically with the legal regulation of two directives of European Union, which are the ones for the european law against unfair competition most significant, Misleading and Comparative Advertising Directive and Unfair Commercial Practices Directive. The purpose of this thesis is to provide comprehensive and understandable overview of the legal regulation of both above mentioned directives, to analyze selected judicature of the Court of Justice of the European Union related to these directives, to briefly outline interpretation problems arising from the transposition of both directives to the Czech legal order, which were identified by professional literature. De fato, ele confere à empresa seu maior diferencial competitivo no mercado globalizado: a inovação, ou seja, a capacidade de, continuamente, gerar novos produtos, processos e serviços ou aperfeiçoar os existentes. A organização da empresa em sociedade empresária possibilita a criação de conhecimento coletivo oriundo do trabalho profissional dos seus sócios, administradores e empregados, fato que originou a expressão capital intelectual, cunhada no âmbito econômico para designar o patrimônio empresarial de natureza intangível resultante de contribuições intelectuais. Como o Direito é precedido da evolução das sociedades e da Economia, nota-se a importância de sempre se buscarem soluções jurídicas às novas realidades socioeconômicas que surgem ao longo da história. Nesąžiningos konkurencijos pagrindai buvo įtvirtinti 1883 m. Paryžiaus konvencijoje dėl pramoninės nuosavybės apsaugos. Šia konvencija apsaugos nuo nesąžiningos konkurencijos institutas ne tik, kad buvo priskirtas prie pramoninės nuosavybės objektų, bet taip ir joje numatyti pavyzdiniai nesąžiningos konkurencijos veiksmai buvo glaudžiai susiję su intelektinės nuosavybės teise. Siekiant užtikrinti plačią apsaugą intelektinės nuosavybės objektų, pavyzdžiui, prekių ženklų, dizaino, geografinių nuorodų, išradimų, savininkams teisiniu reglamentavimu yra suteikiamos plačios teisės. Dėl to galimybės pasinaudoti intelektinės nuosavybės teisės suteikiama apsauga tam tikra dalimi sutampa su ta, kuri yra suteikiama nesąžiningos konkurencijos teisės, pavyzdžiui, prekių ženklams su reputacija suteikiama apsauga. The latter not only includes protection against unfair competition under industrial property rights, but also provides the examples of three cases of unfair competition which closely relates to the intellectual property law. In order to ensure the broad protection to the owners of the objects of intellectual property, e.g. trade marks, design, geographical indications, inventions, a variety of rights are provided by the legal regulation. Therefore the protection granted by intellectual property law, especially the trademark law, overlaps with the protection against unfair competition. However, taking into account the different goals, pursued by intellectual property law and unfair competition law, respectively the protection of property and the guarantee of the protection for the subjects acting in the situation of competition againt unfair acts of the others, it has to be stated that intellectual property law and unfair competition law are not identical. The objective of this study is to measure the level of the European Union's (EU) Common Agricultural Policy (CAP) price support system (PSS) applied to producers in the EU-15 and in Turkey. The producer subsidy estimate (PSE) method has been used to determine protection levels for selected cereal products from the beginning of the application of the PSE method in 1986 to date. In addition, this study attempts to examine the empirical findings of the PSE in the light of CAP reforms and EU enlargements during the period 1986- 2003. The expected contribution of this study is to determine which support instruments, such as countervailing levies or direct payments (based on limited or unlimited area) against export subsidies, voluntary or compulsory set-aside measures and price interventions, are more appropriate for the CAP in reducing destabilizing effects on trade with selected products between the EU and Turkey with respect to distribution effects (how income is distributed between different groups involved in the production operation process). Does the current PSS of the CAP have positive effects on agricultural producers in Turkey as a non-member country? The major finding of this dissertation is the evaluation of benefits and costs of common agricultural policies of the EU on fair trade. The assessment of the PSE of the EU's CAP will be used to determine the impact of current support measures of the CAP reforms on fair trade and consumer welfare, and how the CAP measures can be reformed for the improvement of producer gain in accordance with fair trade. The Law of Supression of Unfair Competition, approved by Legislative Decree 1044, tries to avoid confusions about what is protected as a trade secret and what cases of misappropriation should be sanctioned.In this article, the author questions the interpretation and application that has beenconsistently employed, in many cases, to some of the terms contained in the aforementioned law.For that purpose, the author explains the meaning of the trade secret and other related terms, such as prohibited competition and concurrent purposes. He then proceeds to elaborate an analysis about the economic function of protecting trade secrets and what should be the correct application of the Law of Supression of Unfair Competition. / La Ley de Represión de la Competencia Desleal, aprobada por el Decreto Legislativo 1044, trata de evitar confusiones acerca de qué se protege comosecreto empresarial y qué supuestos de apropiación indebida deberían sancionarse.En el presente artículo, el autor cuestiona la interpretación y aplicación que se le ha venido dando, en muchos casos, a algunos de los términos contenidos en dicha ley. Para ello, explica el significado del secreto empresarial, y de otros términosrelacionados como la competencia prohibida y la finalidad concurrencial. The following chapters are concerned with the European Unfair Practises Directive and legal means of protection against unfair competition.
