Previous issue date: 2005-06-03 / nenhum / In the beginning it was necessary to delimit what one can understand as psychoanalysis as, even in Foucault s book, it may be seen under diverse approaches. Therefore an investigation has been carried out going over all of Foucault s pathway to check the different ways this author approches psychoanalysis in its diverse theoretical moments. Three distinct approuches can be clearly made out all over Foucault s work; at first psychoanalysis is seem as closely related to discourse, then the discussion turns to Freud as author and finally in Story of Sexuality: An Introduction psychoanalysis is seen as a dispositive. The concept of psychoanalysis to wich Foucault refers to in this book is the one related to practice, to exercise, undesrtood as an instituition of knowledge.
In order to contextualize historically the different discussions throughout Foucault s work a brief study has been carried out concerning his relationship to the structuralism which was emerging in France as he was publishing his studies.
In a second moment-the chosen work already being analyzed-the concepts which support biopolitics have been studied regarding their relationship to discipline and the government of populations-two points which provide a basis to this concept.
After being analyzed the questions on biopolitics were related to the point of view presented by Foucault in Story of Sexuality: An Introduction about psychoanalysis and it has been attenpted to examine which consequences this relationship brings to psychoanalysis as well to biopolitics.
Finally resuming the questions reised above and connecting them to each other it has been attempted to point out which aspects of psychoanalysis are linked to biopolitics and wich are not / Este estudo busca compreender através da leitura rigorosa da obra História da Sexualiade-V.I-A Vontade de Saber de Michel Foucault se a psicanálise se relaciona ou não com a Biopolítica, ou melhor, em quais aspectos há relação e em quais não.
De inicio foi necessário delimitar o que se entende por psicanálise já que, mesmo nas obras de Foucault, ela ganha diversos enfoques. Para tanto fez-se uma investigação percorrendo todo o percurso de Foucault para verificar o modo que esse autor aborda a psicanálise em seus diferentes momentos teóricos.
Percebeu-se que houve três abordagens distintas durante toda a sua obra; em um primeiro momento a psicanálise é vista como Discursividade depois a discussão recai sobre Freud como autor e finalmente em História da Sexualiade-V.I-A Vontade de Saber a psicanálise é vista como dispositivo. Nesta obra a psicanálise a qual Foucault se refere é a do exercício, da prática, entendida como uma instituição do saber.
A fim de contextualizar historicamente as diversas discussões no decorrer da obra de Foucault, estudou-se rapidamente qual a sua relação com o estruturalismo que emergia na França no momento em que ele produzia seus estudos.
Em um segundo momento já analisando a obra escolhida estudou-se os conceitos que sustentam a biopoltica até chegar a sua relação com a disciplina e o governo das populações que são dois pontos que embasam este conceito.
Depois de analisadas, as questões sobre biopolítica, foram relacionadas com a visão apresentada por Foucault em História da Sexualidade-V. I sobre a psicanálise e tentou-se verificar quais as conseqüências desta relação tanto para a psicanálise quanto para a biopolítica.
Finalmente, retomando as questões levantadas e articulando-as entre si, buscou-se verificar em quais aspectos a psicanálise se liga à biopolítica e em quais não

Esta tese analisa as normas processuais aplicáveis à arbitragem. O reconhecimento da prevalência da autonomia da vontade das partes e, subsidiariamente, dos árbitros para estabelecer regras para condução do procedimento arbitral, afastou a aplicação das regras processuais do local da realização da arbitragem. A ausência de uma lei processual de regência ou da aplicação mandatória das regras processuais da lex fori possibilitou, por um lado, a harmonização da prática processual arbitral e, por outro lado, embates recorrentes sobre a forma adequada para a condução do procedimento. A ausência de uma lei de regência não significa que o processo arbitral possa ser discricionário. Existe uma pluralidade de fontes normativas que influenciam a tomada de decisão processual nas arbitragens. Propõe-se a análise destas fontes normativas à luz do direito transnacional. O método transnacional adotado inclui normas nacionais e internacionais, bem como outras fontes normativas que não se enquadram tipicamente em uma categoria tradicional, admitindo que o quadro regulatório do processo arbitral seja formado por uma confluência de fontes que operam em ordens jurídicas e planos normativos diversos. Diante dessa pluralidade de fontes normativas, defende-se a necessidade de maior normatização in concreto, incentivando que as partes e os árbitros realizem uma conferência preliminar para definir a melhor forma de conduzir o procedimento em cada arbitragem. / This thesis analyzes the procedural rules that apply to arbitration. The recognition that the parties and, subsidiarily, the arbitrators are free to establish the rules for conducting the arbitral proceedings has prevented the procedural rules of the place where the arbitration is held from being applied. The absence of a governing procedural law or the mandatory application of the procedural rules of the lex fori has, on the one hand, made the harmonization of arbitration procedure possible and, on the other, led to recurrent conflicts regarding the appropriate way to conduct an arbitration. The absence of a governing law does not mean that the arbitration procedure could be discretionary. The existence of a plurality of normative sources that influence procedural decision-making in arbitration is verified. The analysis of these normative sources in light of transnational law is proposed. The transnational method adopted includes domestic and international rules, as well as other normative sources that do not typically fit in a traditional category, allowing the regulatory framework of an arbitration proceeding to be formed by a confluence of sources that operate in different legal systems and on various normative planes. In light of this plurality of normative sources, the need for more active case management and rule-making is defended, encouraging the parties and the arbitrators to hold a preliminary conference to determine the best method for conducting the arbitration in each arbitration proceeding.

Characterisations of YHWH in the song of the vineyard : a multitextural interpretation of Isaiah 5:1-7Miller, David Jay 06 1900 (has links)
The Song of the Vineyard, Isaiah 5:1-7, portrays YHWH as a vinedresser who has carefully prepared land and planted a choice vine, a symbol of the people whom the deity has chosen. When the reasonable expectation that the vine produce good fruit is thwarted, the vinedresser destroys the vineyard. YHWH, the vinedresser, may seem to be characterised by these actions as a demanding god who will swiftly and harshly recompense any failure to meet expectations. This thesis poses the hypothesis that although this brief song may at first seemingly present a monochromatic characterisation of YHWH, it may actually present a spectrum of characterisations when viewed through multiple interpretive lenses.
Socio-rhetorical criticism is the methodology used to examine this hypothesis. This methodology, developed by Vernon K. Robbins, encompasses diverse interpretive approaches, examining five aspects, or “textures,” of the text to obtain a broad interpretive spectrum. In this thesis, three of the textures, innertexture, intertexture, and socio-cultural texture, are considered in separate chapters. The chapter on innertexture examines the world of the text itself, in particular its progressive nature and emotive content. The next chapter examines the intertextural relationship between this Isaian song and two other ancient songs (The Song of the Reed Sea and the Song of Moses), associative references to Sodom, and parallels with the Song of Solomon. The chapter on the socio-cultural texture examines the portrayal of YHWH in light of the socio-economics and socio-cultural values of the world of the story, eighth century B.C.E. Judah. Through this interpretive lense, YHWH is seen as a patron or benefactor who has been dishonoured by his people.
In socio-rhetorical criticism, ideology is often presented as a separate texture; in this thesis, it is considered as part of the act of interpretation of all textures, since readers’ ideologies interact with the text. The sacred texture, the last of Robbins’ proposed textures, is presented as the conclusion, with a summary of the spectrum of characterisations of YHWH that the multi-lensed interpretive approach uncovers. My research provides a historical and archaeological context for this thesis, in which I argue the JB-2 missile is historically significant as a unique example of the rapid duplication of enemy technology for both physical and psychological retaliation, as a crucial link in the chain of development for America’s cruise missile program, and for its role in early Cold War deterrence. Jet Bomb model number 2 (JB-2), America’s first operationally successful, mass produced cruise missile, developed as a direct copy of the German V-1, with slight variation in manufacture due to differences between German and American components, machinery and tooling. Continuing modifications of the JB-2 during its service life led to improvements in performance, control, and accuracy. From 1944 to 1953, the JB-2 transitioned from a weapon quickly prepared for wartime deployment to an essential test vehicle for the United States Army, Air Force and Navy while supporting the U.S. policy of containment during the early Cold War.
