Darbuotojų materialinė atsakomybė pasižymi tam tikra specifika ir ypatumais, kurie lyginamosios analizės būdų ir atskleidžiami darbe. Tiek pagal Lietuvos darbo, tiek pagal Vokietijos civilinę teisę, darbuotojui atsiranda pareiga atlyginti padarytą žalą, tačiau tarp materialinės atsakomybės darbo teisėje ir turtinės atsakomybės civilinėje teisėje yra pakankamai esminių skirtumų, nulemtų dalyko specifika bei metodais, o taip pat jų paskirties ir vaidmens. Darbuotojų materialinės atsakomybės institutas Lietuvoje nuosekliai ir išsamiai reguliuojamas darbo teisės normomis, tačiau kai kurių jų praktinis taikymas vis dar kelia nemažai problemų. Atskirai darbe analizuojamos materialinės atsakomybės atsiradimo bendrosios ir specialiosios sąlygos, kurios lemia materialinę atsakomybę pagal Lietuvos darbo teisę bei padeda specializuoti būtent darbuotojo atsakomybę pagal Vokietijos civilinės teisės normas. Aptariamos darbuotojų atsakomybės rūšys nagrinėjamų valstybių teisės aktuose ir išskiriami visiškai skirtingi atsakomybės ribojimo būdai ir metodai. According Lithuanian labour and German civil law the employee is materially liable for the damage, but between material liability under labour and civil law there are a lot of differences, determined by the methods, purposes and objects and intents of this regulation. The material liability of employees in Lithuania is systematical and properly regulated by labour law, but still is problematically to apply some rules of material liability of employees. Severally, in this work are analyzing the generals and selects conditions of material liability of employees. They determine the possibility to invoke the material liability in Lithuania and to specialize on the civil liability of employees in Germany. The work presents an analysis the types of workers liability on these countries legal regulation and points up wholly different methods on the limitation of material liability of employees. In the work are disputed the occasions of full material liability of workers in Lithuanian labour law, which are the exceptions from the basic principle on the limited material liability. This scientific research has been made on the regulation of similar institute to material liability of the employees in the national law of five old European Union member states (Belgium, United Kingdom, France, Sweden and Germany), comparing it to the regulation of material liability of the employees in Lithuania. It is very important as this is one of first more detailed researches in Lithuania made on this issue. The similarities and the differences of the regulation are being pointed out through the analysis of the main questions of material liability of the employees such as conception, sources of law, applying conditions, limitation of the liability, and the cases when unlimited liability of the employees is being applied.
