Sócio, trabalhador, pessoa: negociações de entendimentos na construção cotidiana da autogestão de uma cooperativa industrial / Partner, worker, individual: bargaining in the everyday self-management of an industrial cooperative

A pesquisa visa compreender como os cooperados da UNIWIDIA – Cooperativa Industrial de Trabalhadores em Ferramentas de Metal Duro – negociam interesses e entendimentos no processo cotidiano de construção da autogestão de sua cooperativa. No trabalho de campo foi realizada observação etnográfica do cotidiano de trabalho na cooperativa, bem como realizadas entrevistas com seis cooperados. Os resultados apresentam: a cooperativa, o histórico da cooperativa, o cotidiano de trabalho, os interesses em disputa e os processos formais e informais de negociação. O estudo identifica que os cooperados formularam ao menos três importantes regras sobre seu funcionamento coletivo: “todos são iguais”; “todos são responsáveis” e “todos estão no mesmo barco”. Tais regras são utilizadas pelos cooperados para manter a simetria de poder na cooperativa, cobrar atitudes uns dos outros e manter a coesão do grupo. A cada regra enunciada corresponde uma característica psicossocial destes cooperados: eles se preocupam com a cooperativa; controlam os demais cooperados e se sentem membros da cooperativa. A pesquisa conclui que os cooperados alternam posições e interesses, ora se posicionam como sócios favoráveis “à cooperativa”, ora como trabalhadores em prol “dos cooperados” e ora como pessoas em busca “de uma vida melhor”. Entretanto, conclui também que os cooperados desejam e trabalham para que estes interesses coincidam. / This project tries to understand how the workers affiliated with UNIWIDIA - the cast and die workers cooperative - bargain in the every day process of the self-management of their cooperative. We have done the ethnographic observation of the day to day working of the cooperative and we have also interviewed six workers who were members of the cooperative. The results are: the cooperative, the work day of the members, the goals fought over and the formal and informal bargaining processes. This project concludes that the cooperative members drew up at least three important rules about their collective functioning: “everybody is equal”, “everybody is responsible”, and “everybody is in the same boat”. These rules are used by the members to maintain a certain symmetry of power in the cooperative, to demand correct attitudes from each other and to maintain group cohesion. Each one of the rules corresponds to a psychosocial characteristic of the members: they are concerned about the cooperative, they control the other members, and they feel that they belong to the cooperative. We conclude that the members of the cooperative oscillate between their positions and interests: sometimes they are members “ in favor of the cooperative”, sometimes they are workers “in favor of the members of the cooperative”, and sometimes they are “workers looking for a better life”. We conclude too that the members of the cooperative desire and strive for the coincidence of these three interests.

O encontro da política com o trabalho: história e repercussões da experiência de autogestão das cooperadas da UNIVENS / The meeting of politics and work: history and repercussions of the self-management experience in the UNIVENS cooperatives

Inserida em um contexto de ressurgimento de relações autogestionárias de trabalho, esta pesquisa tem por objetivos compreender o processo de construção da cooperativa de costureiras gaúchas Unidas Venceremos (UNIVENS) e, principalmente, identificar e discutir as principais repercussões psicossociais desta experiência na vida das sócias-trabalhadoras. Ou seja, busca compreender como a vivência de relações autogestionárias de trabalho afetaram e afetam as vidas sociais de seus sujeitos, tanto no âmbito do trabalho, quanto nos espaços da família, do bairro ou até mesmo da cidade. Trata-se de um estudo de caso que teve como escolhas metodológicas a observação etnográfica e a realização de entrevistas semi-abertas de longa duração. Como resultados, este trabalho apresenta e analisa tanto o processo histórico de construção da cooperativa, como as histórias de trabalho e as principais repercussões da experiência de autogestão apontadas por quatro cooperadas. A experiência política vivida por algumas cooperadas junto ao Orçamento Participativo local surgiu como fonte simbólica da cooperativa, tendo inspirado, inclusive, parte de seus princípios, como o caráter igualitário das relações e a gestão democrática e participativa. Neste sentido, concluiu-se que foi a experiência política que propiciou a experiência econômica, e não o contrário. O direito ao trabalho, o pertencimento ao grupo da cooperativa e o enraizamento como sujeitos nos espaços da Vila e do trabalho, representam as principais repercussões destas experiências – Orçamento Participativo e cooperativa – chamadas aqui de permanências, na medida que compõem dialeticamente um campo estável de referências para essas trabalhadoras, capaz de salvaguardar a manutenção da vida familiar e o poder de intervenção de suas ações cotidianas. Dessa forma, essas permanências possibilitam o enlace firme e perene destas pessoas em seus lugares através do tempo, uma vez que passam a conhecer e a construir a história da cooperativa e do bairro (passado), a circular por estes espaços com maior apropriação e segurança (presente) e a arquitetar para eles novas ações interventivas (futuro). As permanências também se apresentaram como condições simbólicas para a ação política, por permitir a estas trabalhadoras, ainda que momentaneamente, o afastamento das atividades voltadas para a sobrevivência e o alcance da liberdade necessária para a prática da política em espaços comuns. Ainda como conclusões, esta pesquisa apresenta a possibilidade de sonhar, projetar e realizar ações políticas em horizontes mais amplos como uma repercussão de segundo grau destas permanências e, por conseguinte, desta experiência autogestionária, para seus sujeitos. / This study is closely tied to a social context which witnessed the reappearance of self-management as a characteristic of work relations. The objectives of the study are to comprehend the process of construction of the Porto Alegre-based seamstress Cooperative Unidas Venceremos (UNIVENS) and most importantly, to identify and discuss the principle socio-psychological repercussions of that experience in the lives of the worker members of the organization. In other words, this investigation strives to understand how the experiencing of self-management work relations affected, and affect, the social lives of the subjects considered, in the work environment as well as in the family, the neighborhood, and even the city. The investigation is a case-study in which the researcher opted for a methodology based on ethnographic observation and the realization of partially structured long-duration interviews. The results present and analyze the historical process of construction of the cooperative, as well as the "work histories" and the principle repercussions of the self-management experience on four members of the cooperative. The political experience which some of the members of the cooperative underwent, influenced by the local so-called Participatory Budget, surfaced as a kind of symbolic mainspring of the cooperative, having even inspired some of its principles such as the equalitarian nature of its work relations and the democratic and participatory tendencies of its management practices. Due to the above facts, the study reached the conclusion that it was the political experience that led to the economic experience, and not vice versa. The right to work, the fact of belonging to the group constituted by the cooperative, and the character of rootedness as subjects in the spaces of neighborhood and work represent the principle repercussions of these experiences – that is, of the Participatory Budget and the cooperative – and are referred to here as permanencies since they make up a dialectically-construed stable field of references for these workers, references which safeguard the maintenance of family life and the enabling power of intervention in daily life. In this way, these permanencies make possible the firm and perennial connectedness of these persons to their spaces through time, since they are able to know and construct the history of the cooperative and the community (the past), to circulate through these spaces with more of a sense of security and belongingness (the present), and to construct for themselves new ways of intervening in these particular spaces (the future). The permanencies also appeared as symbolic conditions for political action, permitting these workers, even though momentarily, to go beyond mere survival activities and to attain the necessary freedom for political practice within communal spaces. Finally, in conclusion, this study presents the possibility of dreaming, projecting and realizing political actions on a wider scale as a secondary repercussion of the above cited permanencies and, therefore, of the self-management experience itself.

Preziumuojama, jog įmonės, verslo ar jų dalių perdavimo atveju gali pasikeisti darbuotjų teisių apimtis, todėl Bendrijos teisės aktų leidėjui tenka užduotis nustatyti perdavimo sąvoką, pateikti jos požymius, o valstybėms narėms – tinkamai perkelti Direktyvą 77/187/EEB dėl valstybių narių įstatymų, skirtų darbuotojų teisių apsaugai įmonės, įmonės dalies, verslo ar verslo dalies perdavimo atveju, suderinimo bei ją keičiančią direktyvas ir konsoliduotąjį direktyvos tekstą. Despite the fact that this economic concept can be interpreted from many perspectives, this work approaches it from a labour law point of view. In order to safeguard employees‘ rights in the transfer of undertakings situation, the Council directive 77/187/EEC was adopted. Based on the assumption that transfers of undertakings change legal status of employees, the following issues are raised and discussed in this work: how „transfer of undertakings“, „employee representatives“, „information and consultation procedures“ are defined in the Directive 77/187/EEC and case law of EU courts and whether such definitions are clear cut and properly implemented in the national laws of EU member states; theoretical and practical grounds for employees‘ representation and its‘ forms; whether EU model and models of separate EU member of information and consultation secures the continuity of rights of employee representatives in transfer of undertakings situation. It is concluded that the above mentioned definitions still raise practical problems, models of implementation differ from state to state.

Depuis l’apparition du CHSCT en 1982, la représentation élue du personnel a connu de profondes évolutions. Délégués du personnel, comités d’entreprise et CHSCT ont dû s’adapter à la considérable extension des notions de santé et de sécurité. L’intégration de l’impératif de protection de la santé mentale des travailleurs dans le Code du travail a bouleversé le champ de compétences du CHSCT. La prévention des risques psycho-sociaux s’est rapidement invitée au centre de ses préoccupations, élargissant d’autant l’obligation de consultation mise à la charge de l’employeur. Des projets et mesures qui initialement nécessitaient la seule consultation du comité d’entreprise doivent dorénavant être également soumis à l’avis du CHSCT. Dans cette procédure de double consultation l’employeur est guidé par le principe de spécialité qui transforme le comité d’entreprise en simple chambre d’enregistrement des avis de l’instance spécialisée. De l’expansion du CHSCT naissent redondances et lourdeurs. Une réforme doit être envisagée. Transformation de l’instance spécialisée en commission du comité d’entreprise ou redistribution des compétences de chacun : l’alternative offerte impose la discussion. / Since the emergence of the CHSCT (health, safety and working conditions committee) in 1982, the elected representation of employees has profoundly changed. Employee representatives, works councils and the CHSCT have had to adapt to the considerable extension of the concepts of health and safety. The integration of the requirement to protect the mental health of workers in the Labour Code has radically altered the scope of competence of the CHSCT. The prevention of psychosocial risks quickly invited itself as the centre of its concerns, thereby extending the consultation obligation borne by the employer. Projects and measures that initially only required the consultation of the works council are now also subject to the prior opinion of the CHSCT. In this procedure of double consultation the employer is guided by the principle of specialty that turns the works council in a mere rubber stamp of the opinion of the specialized committee. The expansion of the CHSCT has caused reiterations and cumbersomeness. A reform must be considered. Transformation of the specialized body in a committee of the works council or redistribution of powers of each : the alternative offered requires discussion.

En dépit de son importance dans la formation de la société contemporaine, le syndicalisme apparaît comme l’un des parents pauvres de l’historiographie en Belgique. Il y a plus de trente ans, Jean Puissant déplorait que l’historiographie syndicale était essentiellement « produite par le milieu syndical lui-même » et que sa fonction était généralement « la commémoration, la légitimation, la contestation ou encore la célébration » (Archivium, vol.XXVII, 1980). Plusieurs auteurs ont, à partir des années 1960 et surtout des années 1980, entamé une approche scientifique de l’histoire syndicale. Mais, en raison du manque cruel d’études systématiques préalables, cette production historique récente, plus riche de perspectives scientifiques, est demeurée largement monographique, ne dépassant que partiellement les clivages sectoriels, régionaux et politiques. « Des synthèses restent à faire, écrivait Antoine Prost en 1997 à propos de la France, [car] aucun de ces travaux ne réussit à lier de façon pleinement satisfaisante l’histoire du travail, celle des travailleurs et celle du mouvement ouvrier. [.] Les nouveaux paradigmes de l’histoire ouvrière continuent à se chercher » (Cahiers d’Histoire, n°66, 1997). Ce constat s’applique incontestablement à l’historiographie syndicale belge.<p><p>L’ambition de la présente thèse est de pallier l’absence d’étude d’ensemble sur le mouvement syndical belge de l’entre-deux-guerres, période essentielle dans le processus de mise en place du syndicalisme contemporain en Belgique. Cette période est en effet non seulement marquée par l’avènement d’un syndicalisme de masse, par l’intégration des syndicats dans des nouveaux systèmes de relations industrielles (reconnaissance généralisée des syndicats par le patronat et l’État comme interlocuteurs privilégiés dans la négociation du contrat de travail), par leur attribution à l’échelle nationale d’un rôle officiel dans la redistribution des secours étatiques de chômage, mais également par de profondes réformes des structures et des fonctionnements syndicaux (centralisation, concentration et rationalisation accrues). <p><p>Notre étude tente d’analyser comment et suivant quelles modalités les diverses composantes du mouvement syndical ont participé à ces transformations sociétales (y compris en ce qui concerne le nouveau rôle qu’elles y acquièrent) en même temps qu’elles se sont trouvées transformées par elles.
