Israel's Absentee Property Law: When is Democratic Failure Necessary?

This paper defends Israel's expropriation of property under the Absentee Property Law within the state’s pre-1967 borders on constitutional grounds, but holds that the Law’s increased use in the region of East Jerusalem is invalid under Israel's constitutional scheme. This distinction turns upon the state’s application of the Law for necessary purposes. I hold that Israel’s justification for breaching human rights explicitly protected must be based on the state’s need to preserve its foundational ideology and national purpose in times of extra-normal circumstances. Israel may act undemocratically only to the extent imperative to preserve the Jewish nation and the existence of the Jewish state for generations to come.

Reinventing Virtue: Sensibility and Sentiment in the Works of Maria Edgeworth

While literary scholars have written extensively about sensibility in the past two decades, most of the studies have treated either the history of sensibility itself or how it interacted with a particular aspect of English culture and literature, such as sexuality or politics. My project instead examines how a single author, Maria Edgeworth, used sensibility in her writing over the course of her career. I analyze the use of sensibility in three of her novels: Belinda (1801), her first full-length novel; The Absentee (1812), her influential Irish national tale, written at the height of her popularity in the middle years of her career; and Helen (1834), her last novel. This analysis illustrates the changing attitude of both Edgeworth and English society to sensibility and its representations in literature. In Belinda, Edgeworth uses sensibility to demonstrate the virtue and superiority of the characters who possess it, and also to rehabilitate the concept itself. She differentiates between mere affectation and true sensibility by creating both positive and negative examples of sensibility in Belinda – characters clearly possess true sensibility, and those who only pretend to it. In The Absentee, Edgeworth adheres much more closely to the conventions of sentimental fiction than she had in her previous society novels. In my discussion of The Absentee, I demonstrate how Edgeworth uses the conventions of sentiment both to make Irish culture accessible to her English audience and to justify the Irish estate system which put Anglo-Irish landowners in a position of authority over native Irish tenants. My final section focuses on Edgeworth's last novel, Helen, which marks a return to the genre of the society novel with which she began her career. While Edgeworth still uses sensibility as a sign of virtue in Helen, she is also much more interested than previously in the interplay between education and inborn qualities of personality – the very qualities whose existence she was so skeptical of in her education manual, Practical Education, published two years before she began her career as a fiction writer.

A melhoria das condições de vida é o objetivo principal da migração individual, mas seu resultado pode ser o oposto. Esta dissertação estuda as implicações da migração em duas distintas e importantes literaturas. A tradição do Federalismo Fiscal sugere que a migração pode levar à ampliação das disparidades regionais. Em muitos casos, a ação individualmente racional é coletivamente irracional, resultando em pior qualidade de vida para o imigrante. A Nova Geografia Econômica sugere que a migração funciona para quem migra, mas pode novamente resultar em aumento das disparidades regionais. A partir da crítica a alguns dos pressupostos destas duas teorias, é apresentado um modelo em que a migração aumenta a desigualdade na região de atração, devido à desigual propriedade da terra. / The improvement of living standards is the main objective of individual migration, but its results can be opposite. This dissertation studies the implications of migration in two distinct and important literatures. The Fiscal Federalism tradition suggests that migration can lead to severing regional and social disparities. In many cases, the individually rational decision is collectively irrational, resulting in a worse living standard for the immigrant. The New Economic Geography suggests that migration do work for the migrating people, but still can result in an increase in regional disparities. After some critiques to assumptions and hypotheses of those two theories, it is presented a model in which the migration increases inequality in the attractive community because of the land ownership.

At risk youth: the experiences of adolescent boys with absent fathers

In a patriarchal society such as South Africa, the absence of a father figure in the family place mothers in the unenviable position of having to play a double role, namely that of mother as well as the head of the family. The role of absent fathers in the at-riskness of adolescent boys is under researched in South Africa. The aim of this study was to explore and describe the perceptions and experiences of ten adolescent boys who are growing up in father absent homes. The participants were from a low socio-economic area of the Western Cape, and high school pupils who were purposively selected from Grades 8, 9 and 10. A qualitative research methodology was used and data were collected by means of semi-structured interviews, a focus group discussion and the construction of collages. The findings showed that adolescent boys face many challenges in their development when they grow up without a strong male role model. These ten adolescents seemed to struggle with discipline issues at school as well as at home. They are at a vulnerable age, and at risk of making decisions that would be devastating to their futures. / AFRIKAANSE OPSOMMING: Die enkelouer, vrou-as-hoof huishouding is ‟n globale fenomeen. Die doel van hierdie studie was om die persepsies en ervaringe van tien adolessente seuns uit huise met afwesige vaders in te verken en te beskryf. Die deelnemers was uit ‟n lae sosio-ekonomiese area van die Wes-Kaap en doelgerig uit Grade 8, 9 en 10 geselekteer. ‟n Kwalitatiewe navorsingsmetodologie is gebruik en data is deur middel van semi-gestruktureerde onderhoude, ‟n fokusgroepgesprek en die konstruksie van ‟n kollage ingesamel. Die bevindinge toon dat adolessente seuns baie uitdaging ervaar tydens hul ontwikkelingssfase wanneer hulle opgroei sonder ‟n sterk manlike rolmodel. Die tien adolessente sukkel met dissipline by die skool sowel as tuis. Hulle is ‟n brose ouderdom en loop die gevaar om besluite te neem wat hulle toekoms kan vernietig.

The purpose of this study was to develop Gestalt guidelines for mine worker fathers living in Oranjemund in order to enhance a dialogical relationship with their children in middle childhood. The researcher made use of the first four stages of the Design and Development model of intervention research. These stages include problem analysis and project planning, information gathering and synthesis, design and the early development of the guidelines. For the purpose of this study, focus groups were conducted with father participants and semi-structured interviews were conduct with children participants. The research study was based on existential dialogue with the focus on four main themes, namely; commitment to dialogue, presence, inclusion and confirmation. Existing literature from Gestalt approach, middle childhood and culture was used together with functional elements of other existing parent child relationship and family programmes or models, to develop the guidelines. / Social Work / M. Political Transnationalism and the State

ABSTRACT Jean-Michel Lafleur Title of the dissertation: Political Transnationalism and the State The first part of the thesis consists in a review of the literature and a conceptual discussion about the concept of immigrant transnationalism and immigrant political transnationalism. This discussion shows that a series of gaps currently exists in the research on the links between the emigrants and the home country. Two of such gaps are underlined in the thesis. On the one hand, it remains difficult to determine why states decide to extend political citizenship to their citizens abroad. On the other hand, the influence of the state on its emigrant community seems neglected for the benefit of a post-national vision of citizenship. These are the gaps that this thesis is trying to address. The second part of the thesis presents in three case studies the results of the empirical research conducted in Italy, Belgium and Mexico. Some elements of migration history introduce each case and is then followed by an extensive analysis of the debate on the extension of political citizenship (especially the right to vote from abroad). A special focus is put on the role of internal actors (political parties, administrations) and external actors (migrants, associations). In the third part of the thesis, the author conducts a comparative analysis of the three cases. By doing so, the reasons why states extend political citizenship to citizens residing abroad appears clearly. It also leads to reject the post-national vision of citizenship supported by some scholars. After the presentation of the four variables pushing to act as they do in the field of external political citizenship, the thesis concludes by opening up new research tracks in the field of political transnationalism. Cet exercice met en lumière une série de lacunes dans la recherche actuelle sur les liens entre les émigrés et le pays dorigine. Deux de ces lacunes sont particulièrement mises en évidence. Dune part, il a y la difficulté de dégager les raisons poussant différents états à travers le monde à étendre la citoyenneté politique à leurs citoyens établis à létranger, et cela, en raison du faible nombre de projets de recherches comparatifs. Dautre part, le rôle de lEtat semble négligé dans la littérature existante en raison de la prégnance dune vision post-nationale de la citoyenneté dans nombre détudes sur les liens entre pays dorigine et émigrés. La deuxième partie est constituée de la restitution des données empiriques collectées dans trois pays: Belgique, Italie, Mexique. Le travail de thèse conclut en soulignant lapport de la dissertation au champ de la recherche sur le transnationalisme dans les études migratoires et ouvre une série de pistes pour des recherches futures.

Exploring the experiences of young adult women growing up with non-resident fathers in North West Tlokwe Local Municipality

This study examines the experiences of young adult women raised in non-resident father households in Tlokwe Local Municipality, North West. Focus groups and face-to-face interviews were conducted with 34 young women between the ages 18-25. Five important, nuanced themes emerged, these are: a) fathers who are physically present but emotionally absent, b) fathers who are physically present but uninvolved, c) fathers who are physically absent but involved, d) fathers who are physically present and involved and e) fathers who are absent and uninvolved. Non-resident fatherhood remains a challenge in the Tlokwe Municipality, most of the participants had never met their biological fathers. The study revealed the frustration young women feel towards their mothers and maternal grandparents for caring more about maintenance than they do about a healthy father-daughter relationship. The study further revealed a deep-seated need for close proximity and an involved type of fathering among the young women. / Sociology / M.A. (Sociology)
