Le droit au logement en France et en Italie / The right to adequate housing in France and Italy

L’homme n’habite plus vraiment, il s’abrite. Habiter exige une « part de monde » propre à l’individu afin que se réalise l’évènement de demeurer. Le droit au logement rend compte d’une exigence démocratique qu’il convient de prendre au sérieux au sein des sociétés française et italienne. Elle se manifeste inévitablement comme l’expression d’une certaine ouverture du droit positif au présent, le droit ne pouvant rester aveugle à ce qui l’entoure. L’individu questionne constamment ses ressources lorsque ces dernières ne suffisent pas ou plus à lui assurer une existence digne et se tourne le cas échéant vers la solidarité nationale afin d’y remédier. Il convient dès lors de s’interroger sur la consistance normative du droit au logement en droit comparé au regard de la convergence de ses sources internationales et nationales. Cet enrichissement donne corps à une mise en œuvre selon le principe de subsidiarité opérée par les acteurs les plus proches de la misère sociale à qui il revient en définitive de traduire la signification du droit au logement. / Man no longer truly lives somewhere, he shelters. To live somewhere would entail a “part of the world” belonging to the individual in order for the évènement de demeurer to arise. The right to adequate housing conveys a democratic requirement that must be taken seriously. This requirement reveals itself inevitably as an expression of a certain openness of positive law to the present, the law being unable to ignore its surroundings. The individual constantly questions his resources when they are insufficient or no longer ensure a dignified existence and turns, if needs be, to national solidarity as a remedy. Consequently, it is important to analyse the normative substance of the right to adequate housing in the light of the convergence of its international and national sources. This enrichment furthers the application of these norms, by the principle of subsidiarity, by the actors closest to the social misery upon whom it bears to give meaning to the right to adequate housing.

Beyond a Roof and Walls: Gaps and Challenges in Providing Adequate Housing for Refugees in Malmö

This study attempts to analyse urban housing issues and their effects on providing adequate housing for refugees, using Malmö as a case study. The content analysis adopted here uses a combination of semi-structured interviews with relevant government officers, and reports published by government agencies and international institutions as sources of information.The dominant role of the market in Sweden’s housing sector has created housing inequalities and many issues for groups with lower socio-economic status. These issues consist of shortages in affordable dwellings, cramped housing conditions and spatial segregation within the city etc. This study illustrates that refugees in Malmö face additional issues such as lack of knowledge on the housing market, reluctance of landlords to accept refugees’ establishment allowance as an income source, discriminatory attitudes, and lack of larger apartments for their comparatively larger households. They function as barriers to refugees’ right to adequate housing as well as their right to the city, while limiting their opportunities to establish in the host country. The municipality also faces these issues when arranging housing for its ‘assigned’ refugees. Additionally, they are faced with an extended demand on the social services that are meant to support the native homeless groups. Refugees’ housing issues are associated with some gaps involved in the process of accommodating refugees. The Settlement Act introduced in 2016 does not consider availability of housing when distributing refugees to municipalities. It takes more than two years to process asylum applications, compared to UN regulations of six months. The prolonged stay in accommodation centres delays their opportunities to become self-sufficient and integrated into the host society. Refugees are not provided with information relevant to the housing market in Sweden or the municipalities they are allocated to. Although municipalities are given the full responsibility of housing refugees assigned to them, the Settlement Act does not provide any guidelines as to how it should be done. In Malmö there is no evidence that any other government agency or a civil society organisation work in collaboration with the municipality to house refugees. It is clearly evident that the self-housing (EBO) mechanism functions against the objectives of the Settlement Act, consequently major cities such as Malmö continue to be refugee hotspots. In this context, I would argue that refugee housing issues cannot be solved only through dispersal policies, but they should be backed by relevant housing policies that consider housing as a human right, rather than a market commodity. The municipalities should adopt a holistic approach in providing adequate housing for refugees, with adequate regulations on the housing market for the benefit of all.

近年來,因房價急速攀升,居住困難的問題在台灣各都會區越形嚴重,為緩解此一現象,保護人民居住的權利,只租不賣的社會住宅成為政府住宅政策的焦點之一,且受到社會大眾的廣泛討論。本文使用文獻分析法爬梳台灣歷來的住宅政策,以及主導這些政策的意識型態,發掘形塑台灣社會住宅論述的主要成因。並對房地產業從業人員、民間從事土地與住宅之社會運動者及政府相關部門公職人員進行深度訪談,以不同角度交互印證前述文獻分析的結果,同時,以台北市和新北市為例,探討台灣實際執行社會住宅政策以來,其發展的現況、面臨的困境與批評,以及可能的解決之道。研究結果顯示,台灣社會住宅論述形成的原因,是由於台灣既有的住宅持有分配不均與住宅市場失靈,造成人民居住權受到壓迫,進而產生一種新型態的住宅提供之訴求,此訴求可視為對原有自由主義市場經濟主宰住宅分配的反動。台灣目前主要推行社會住宅政策的區域為居住困難情形最嚴重的台北市與新北市,其面臨的主要批評有數量少、租金高、租期短、承租對象年齡侷限等,而在政策實施上面臨的困境則有興建經費不足、政府資源分配不均、周邊社區鄰避效應處理與營運管理維護等問題。政府必須著眼於改善現行社會住宅政策的困境與批評,方能使社會住宅政策更臻完善,並能藉此達到落實居住正義之效。 / In recent years, the dramatic increase in house price has led to difficulties for dwellings to serve their own housing needs in the metropolitan area in Taiwan. Social housing therefore becomes a vital policy, in hope of easing the stress on the difficulties of housing needs and moreover, reserving the civilian’s right of habitation. This study is composed of two major parts: literature review and interview. The literature review provides the background and framework of housing policies in the past, identifies the ideologies that formulated the policies, and concludes the main factors that develop the discourse of social housing in Taiwan. The second part of the study reinforces the attributions of the literature review based on the statement and experience of the interviewees. The group of interviewees consists of chief executive form a construction company, real estate agent, social activists with awareness on land and housing issues, and civil servants involved in social housing affairs. The different perspectives presented by the interviewees explain the development of social housing, bring up the criticism and predicament on the topic, and contribute in discovering solutions for the difficulties of housing needs. The findings of this study indicate that housing inequality and housing market failure has underlain the discourse of social housing. The exploitation on the right of habitation has raised the appeal for social housing, which can also be suggested as a counteraction to the housing distribution dominated by free market. In Taiwan, social housing policy is mainly enacted in Taipei City and New Taipei City, which suffer most from the difficulties of housing needs. However, there are drawbacks that impede the promotion of this policy: lack of fund for construction, inequality on governmental resource, NIMBY in the community, and maintenance for sustaining operation. In addition, arguments about insufficient availability, unaffordable rent, short tenure and age restrict on tenants are also powerful against the policy. To conclude, the government should try to ensure that the system is designed in the way to minimize the disadvantages, which merits achieving social housing policy aim: reserving the civilian’s right to adequate housing.

The discourses on the right to housing in Gauteng Province, 1994-2008.

The post-apartheid government of 1994 is a product of the ‘Age of Rights’. Statemaking processes and the exercise of state powers is managed by the rule of law based on a constitution. Constitutionally recognised rights, and rights protection institutions, animate a transition from a legacy of Black political exclusion and underdevelopment. Intensifying class stratification and inequality constrain Black’s formal realisation of citizenship rights, placing great pressure on creative interpretation of constitutionally legitimated claims. My thesis examines the rights discourse informing the Constitution, particularly issues about the realisation of social and economic rights. I examine the unfolding of discourses on the right to housing between 1994 to 2008, to illustrate of the complexity of the discourse. Episodic housing protests suggest significant degrees of alienation, marginalisation, and disappointment with expectations of citizenship and the non-realisation of social and economic rights. Housing rights is an issue that will affect the democratic consolidation and political stability prospects of the new political order. I examine the interface between macro-economic policies, budgets, and the realisation of housing rights, and assess the impact of an identifiable configuration of forces expected to play important roles in realising a rights culture and broadening the discourse. My study draws on a spectrum of qualitative, interpretive, and analysis of discourse approaches, using data from: published articles, annual reports and archives, speeches, court proceedings and statements, interviews with persons whose scope of activities impact the unfolding of the concerned rights, namely, representatives of government departments, private sector developers, financing institutions, and civil society formations. My main findings are that few actors in the configuration support the view that the Constitution should be changed to make explicit the state’s obligations on the realisation of social and economic rights. Nevertheless, there are isolated cases of people expressing an absolute entitlement sense of rights --- the state should deliver when demands are made. My conclusions are that considerable political unrest about non-realisation of these rights will persist, but will not cause a collapse of the post-1994 political institutions and processes. More likely, political actors, legal scholars and jurists, will persistently engage the prevailing rights discourse and the variety of institutions acting towards their realisation, without effecting drastic changes to these, but always invoking positions about how they still are suited for a post-apartheid transformation project yet need critical interrogation and improvisation.

Esta dissertação apresenta uma reflexão sobre a possibilidade de se promover melhorias nas condições de moradias em favelas urbanizadas, através de programas de melhorias habitacionais, analisando suas limitações e potencialidades. Apesar dos avanços obtidos nas favelas com as iniciativas de urbanização e com os instrumentos de garantia de posse da terra, ainda persistem nestas áreas precariedades relacionadas às unidades habitacionais, condição que tem impacto direto na saúde da população. Buscando solucionar estas questões, vêm sendo desenvolvidos, há mais de uma década, programas de melhorias habitacionais em favelas, iniciativas que têm encontrado uma série de dificuldades para sua operacionalização. Neste contexto, a pesquisa propõe um aprofundamento no universo das precariedades habitacionais das moradias em favelas, identificando os problemas mais frequentes e sua incidência. Para esta avaliação, são estudadas três favelas urbanizadas no município de Diadema (SP). Analisa-se, posteriormente, como estas situações vêm sendo enfrentadas pelos programas de melhorias habitacionais, e quais as principais dificuldades e avanços a eles relacionados. Para isso, são considerados programas realizados pelo poder público, ONGs e negócios sociais. Os resultados dos estudos apontam para altos índices de inadequação nas moradias em favelas e identificam como principais fatores que dificultam a implantação dos programas a limitação de recursos, os arranjos produtivos inadequados e o controle urbano. Ao final, são apresentadas algumas recomendações para que os programas de melhorias habitacionais atinjam maior escala e efetividade. / This dissertation presents a reflection on the possibility of promoting improvements in housing conditions in urbanized favelas (or slums?), through housing improvement programs, analyzing their limitations and potentialities. Despite the progress made in the favelas with urbanizing initiatives and land tenure guarantee instruments, still persist in these areas, precariousness related to housing units, a condition that has a direct impact on the health of the population. In order to solve these issues, housing improvement programs in favelas have been developed for more than a decade, initiatives that have encountered a series of difficulties for their operationalization. In this context, the research proposes, firstly, a deepening in the universe of housing precariousness of dwellings in favelas, identifying the most frequent problems and their incidence. For this evaluation, three favelas urbanized in the city of Diadema (SP) are studied. Then, it is analyzed how these situations are being faced by the housing improvement programs, and what are the main difficulties and advances related to them. To this end, are being considered programs performed by the public power, NGOs and social businesses. The results of the studies point to high levels of inadequacy in housing in favelas and identify as main factors that hamper the implementation of the programs the limitation of resources, inadequate productive arrangements and urban control. At the end, some recommendations are presented so that housing improvement programs achieve greater scale and effectiveness.

Agentes da política urbana que utilizam indistintamente essas noções, e embora sejam expressões equivalentes, seu abarcamento conceitual se difere. O objetivo desta pesquisa depara por elementos socioespaciais que configurassem a dimensão da dignidade na moradia, e que consideramos que vai mais além do padrão de moradia adequada; tomando o contexto colombiano por referência. Construir a abordagem histórica e institucional do conceito de \"moradia adequada\", determinar fatores socioespaciais que poderiam lesar a integridade do morador que habita em espaços inadequados, e discorrer sobre os elementos diferenciadores, relacionados à moradia adequada e à moradia digna, são os objetivos específicos. Esses elementos socioespaciais configuram fatores de observação da dimensão da dignidade na moradia, que - como proposta da tese - nomeamos como a dignidade na experiência espacial. / The genesis, evolution and content of the notions of \"adequate housing\" and \"decent housing\" were researched from ONU\'s resolutions and reports; from housing indicators and constitutions of Latin American countries; from academic production compiled in great repositories, from constitutional court writ judgments for protection of constitutional rights of Colombia. Areas of urban policy that use indistinctively these notions, and even though being equivalent, their conceptual limitation differs. The objective of this research discovers socio- spatial elements that shape the dimension of dignity in housing and that we consider goes beyond the standard of adequate housing; taking the Colombian context as reference. The specific objectives are to build the historical and institutional approach of the concept of \"adequate housing\", to determine socio-spatial factors that could undermine the inhabitant\'s dignity that dwells in inadequate spaces and to expatiate in differentiator elements related to the adequate housing and the decent housing. Several areas were explored: United Nations that dictates mandatory regulations concerning human settlements for country members establishes the indicator \"right to an adequate housing\" with the International Covenant on Economic, Social and Cultural Rights (ICESCR) of 1991. The statistics institutes of 21 countries in Latin America, which hold methodology and data concerning housing indicators, and consider that the content of adequate housing, correspond to the variables that each country applies, plus the elements of the indicator \"adequate housing\" of ICESCR. These habitation variables are also material content of the right to housing, adjectivized as adequate, dignified or decent, in the current constitutions of these nations. The academic production stating that housing must be adequate according to indicators and discussed in a rights framework. The citizen\'s legal practice and understanding of the right to a decent housing is present in the social area with the inhabitant that files a suit before a judge, in Constitutional Court judgments of Colombia, in the form of facts that violate the right to housing, and on certain occasions, dignity. For this reason, we explore judgments due to the relationship between dignity and space, in the interaction between individuals when the access to housing is being pursued; to find three objects of dignity protection introduced in the writ judgments. That is how we discover recurring socio-spatial elements in a writ judgment when the violation of the right to housing is being debated, with which we could inquiry for the protection to the integrity of people in the space, when they are looking for space resources like habitation: undermined inhabitant (claimant); undermining agent (defendant); space object disputed; claimant\'s claim over that object; undermining agent\'s conduct and elements on which he shields his conduct; consequences of violating that right, observed as harm to the person and harm to the heritage; the perception about the injury by violation of the right to housing. These socio-spatial elements shape the factors to observe the dimension of dignity in housing, which, as proposal of this thesis, we denominated as dignity in space experience.

Areas of urban policy that use indistinctively these notions, and even though being equivalent, their conceptual limitation differs. The objective of this research discovers socio- spatial elements that shape the dimension of dignity in housing and that we consider goes beyond the standard of adequate housing; taking the Colombian context as reference. The specific objectives are to build the historical and institutional approach of the concept of \"adequate housing\", to determine socio-spatial factors that could undermine the inhabitant\'s dignity that dwells in inadequate spaces and to expatiate in differentiator elements related to the adequate housing and the decent housing. Several areas were explored: United Nations that dictates mandatory regulations concerning human settlements for country members establishes the indicator \"right to an adequate housing\" with the International Covenant on Economic, Social and Cultural Rights (ICESCR) of 1991. The statistics institutes of 21 countries in Latin America, which hold methodology and data concerning housing indicators, and consider that the content of adequate housing, correspond to the variables that each country applies, plus the elements of the indicator \"adequate housing\" of ICESCR. These habitation variables are also material content of the right to housing, adjectivized as adequate, dignified or decent, in the current constitutions of these nations. The academic production stating that housing must be adequate according to indicators and discussed in a rights framework. The citizen\'s legal practice and understanding of the right to a decent housing is present in the social area with the inhabitant that files a suit before a judge, in Constitutional Court judgments of Colombia, in the form of facts that violate the right to housing, and on certain occasions, dignity. For this reason, we explore judgments due to the relationship between dignity and space, in the interaction between individuals when the access to housing is being pursued; to find three objects of dignity protection introduced in the writ judgments. That is how we discover recurring socio-spatial elements in a writ judgment when the violation of the right to housing is being debated, with which we could inquiry for the protection to the integrity of people in the space, when they are looking for space resources like habitation: undermined inhabitant (claimant); undermining agent (defendant); space object disputed; claimant\'s claim over that object; undermining agent\'s conduct and elements on which he shields his conduct; consequences of violating that right, observed as harm to the person and harm to the heritage; the perception about the injury by violation of the right to housing. These socio-spatial elements shape the factors to observe the dimension of dignity in housing, which, as proposal of this thesis, we denominated as dignity in space experience.
