The sub judice rule is a media law practice that is currently often in the
spotlight. Editors and journalists are constantly furiously speaking out against
this rule that limits their freedom of expression in an attempt to assure the
accused's fair and proper trial. Practitioners of the law, on the other side, say
the sub judice rule is indispensable to the proper administration of justice.
The rule, which much prevents the media from interfering with a
pending case, causes confusion under journalists, as it is not consistently
applied. Judges often warn the media against the violation of the rule during a
high profile case, but those who do break the rule are not charged with
contempt of the court.
The aim of this study is to determine how Beeld, the Afrikaans daily
newspaper, applies the sub judice rule in his reporting. The way in which this
leading paper handles the rule is of importance to other journalists as well as
the readers. The origin, development and function of the rule are also
examined.
It was established that Beeld did not contravene the sub judice rule as
unceremoniously as a few other newspapers. Beelds violations of the rule
were different experts' nuanced interpretations thereof. These violations is
more based on the perception that the court's independence and worthiness
must be upheld in the public eye than on the rule's actual function to guard

The topic of the dissertation is a reconstruction of organisation structure and personnel overview of the Superior Land Court in Bohemia between 1541-1620. The thesis is divided into two parts of the research. In the first part, the court is examined from perspective of administration history and history of justice. The aim is to reconstruct the structure of courts as an independent institution within the organisation of the provincial administration in Bohemia prior to the Battle of White Mountain. Position of court within the structure of noble courts before 1620, as well as the subject of location, time frame and the process of judicial hearing, the topic of casting and seating arrangements or subject of the occupation and release of judicial posts is being dealt with in its sub-chapters. This part is based on normative sources of the central authorities and sources of assessor's personal nature. Judges - as a group of individual assessors within the court are examined in the other part. The aim is to find and identify all personnel appointed for the function within the Court associate justice (the Chief Clerk; Juror without the Superior Land Court). of the accused against those of the community. The main goal of this assessment is to find a
balance between said interests. While an application for bail is made at a stage where guilt
has not been proven, it is of extreme importance that the court must not infringe on the
fundamental rights of the accused which include the right to personal freedom and the
presumption of innocence.
In order to protect the rights of the bail applicant within the proper functioning of the
legal system, it is important to determine the nature of bail proceedings. As shown in this
thesis, bail proceedings are sui gelleris in nature, which means that a separate set of rules of
the law of evidence is applicable to these proceedings. The object of this thesis is to identify
the rules of law of evidence applicable to bail proceedings as well as to clarify the deviation
from the normal rules of evidence which apply to the trial of the accused.
In chapter one the purpose and nature of bail proceedings as well as the characteristics
of accusatorial and inquisitorial systems, are discussed. Problem areas within the South
African legal system with regards to bail applications are also highlighted in this chapter.
In chapter two the application of the primary rules of the law of evidence with regards
to bail proceedings are investigated as well as the admissibility of evidence pertaining to prior
convictions of the applicant, opinion evidence and character evidence. In chapter three the
admissibility of hearsay evidence at bail proceedings is discussed. The constitutionality of
the privilege pertaining to the police docket is dealt with in chapter four. Chapter five deals
with the infom1er's privilege. The requirements that have to be met in order to qualify for
protection under the said privilege, are examined.
Chapter six focuses on the privilege against self-incrimination and the manner In
which it is applied in bail proceedings. The provisions of s 60(11B)(c) of the Criminal
Procedure Act and the role of the presiding officer are also discussed in this chapter.
Chapter seven focuses on the burden of proof in bail applications. Chapter eight
contains a summary and recommendations. / AFRIKAANSE OPSOMMING: By die beoordeling van 'n borgaansoek moet die hof die be lange van die beskuldigde
en die belange van die samelewing teen mekaar opweeg. Die doel van die betrokke
verrigtinge is om 'n balans tussen hierdie belange te vind. Omdat borgtog ter sprake kom op
'n tydstip waar daar nog geen skuldigbevinding is nie, is dit van kardinale belang dat die hof
ten aile tye moet waak teen die onregverdige inbreukmaking op die beskuldigde se
fundamentele regte wat onder andere die reg op individuele vryheid en die vem10ede van
onskuld insluit.
Ten einde die regte van die borgaansoeker na behore te beskem1 sonder om die
behoorlike funksionering van die regstelsel te belemmer, is dit belangrik om vas te stel wat
die aard van borgverrigtinge is. Soos in hierdie tesis aangetoon word, is borgverrigtinge sui
generis van aard. Dit het tot gevolg dat daar 'n aparte stel reels van die bewysreg bestaan wat
op hierdie verrigtinge van toepassing is. In hierdie tesis word daar gepoog om die reels van
die bewysreg wat op borgverrigtinge van toepassing is, te identifiseer en om die afwykings
van die gewone bewysregreels wat op die verhoor van toepassing is, te verklaar.
In hoofstuk een word die doel en aard van borgverrigtinge bespreek en word die
kenmerke van die akkusatoriale en inkwisitoriale stelsels teen mekaar gestel. Die
onduidelikhede oor die aard van borgverrigtinge in die Suid-Afrikaanse reg word ook
aangeraak. In hoofstuk twee word die toepassing van die relevantheidsgrondreel by
borgverrigtinge ondersoek, asook die toelaatbaarheid van getuienis oor die vorige
veroordelings van die beskuldigde, opiniegetuienis en karaktergetuienis.
Hoofstuk drie het betrekking op die toelaatbaarheid van hoorsegetuienis by
borgverrigtinge. In hoofstuk vier word kwessies rakende dossierprivilegie behandel en die
grondwetlikheid van sodanige privilegie, asook die toepassing daarvan, word van naderby
beskou. In hoofstuk vyf word daar gefokus op die aanbrengersprivilegie. Die aard en
toepassing van die privilegie asook die vereistes waaraan voldoen moet word alvorens daar

Thesis (MPA)--Stellenbosch University, 2012. / ENGLISH ABSTRACT: Paraguayan Justice has been going through a period of deep transformation. The Justice has many challenges to face. Those challenges should be regarded as opportunities for transformation and not as threats.
It is a fact that information and communication technology (ICT) per se cannot solve all current challenges; however, it can offer solutions to the many problems that confront the judiciary. In that sense, ICT development becomes the best ally of Justice.
The Information, Technology, Processes, Objectives and values, Staff and skills, Management systems and structures, and Other resources (ITPOSMO) dimensions described by Heeks (2006) are applied as the basis for evaluating ICT in the judicial sphere. This research validates the opinion of the users with regard to ICT projects. Judges, court and administrative officials, managers and lawyers constitute the unit of analysis of this study. These stakeholders were interviewed and requested to complete a survey.
The study reveals the high level of relevance that ICT holds for the judiciary, in the sense of providing information and tools for interacting with different users. The objective of ICT is to act as support for improving court and administrative performance through the different ICT systems.
Nonetheless, this research has also uncovered limitations and flaws in the current information systems. These flaws tend to turn the benefits that ICT systems can bring into constraints.
This study makes various suggestions on how to overcome those flaws. The most important suggestion is the development of a holistic approach when ICT projects are conceived. Likewise, the early involvement of stakeholders who will be influenced by any ICT initiative should be encouraged. / AFRIKAANSE OPSOMMING: Paraquay se Justisie het deur ‘n moeilike transformasie tydperk gegaan. Die Justisie het met baie uitdagings te doen gekry. Hierdie uitdagings moet beskou word as geleenthede vir transformasie en nie as bedreiginge nie.
Dit is ‘n feit dat inligting en kommunikasie tegnologie (IKT) op sigself nie alle huidige uitdagings kan oplos nie, alhoewel dit oplossings kan verskaf vir baie van die probleme wat die regbank ondervind. In hierdie opsig is IKT ontwikkeling die beste roete vir Justisie.
Die Inligting, Tegnologie, Prosesse, Doelwitte en waardes, Personeel en vaardighede, Bestuurstelsels en –strukture, en Ander hulpbronne (ITPDPBA) dimensies wat deur Heeks (2006) beskryf word, is gebruik as basis vir die evaluering van IKT in die regterlike omgewing. Hierdie navorsing staaf die opinie van die gebruikers wat betref IKT projekte. Regters, regs- en administratiewe beamptes, bestuurders en regsgeleerders vorm die eenheid van analise in hierdie studie. Die studie het die hoë vlak van toepaslikheid wat IKT vir die regbank bied deur die voorsiening van inligting en hulpmiddels vir interaksie met verskillende gebruikers, onthul. Die doel van IKT is om as ondersteuning te dien om howe en die administrasie se werkverrigting te verbeter met behulp van verskillende IKT stelsels.
Nogtans het hierdie navorsing ook beperkinge en foute in die huidige inligtingstelsels bloot gelê. Hierdie foute neig om die voordele wat IKT stelsels kan bring, in beperkinge om te skakel.
Hierdie studie maak verskeie voorstelle oor hoe om daardie foute te oorkom. Die belangrikste voorstel is die ontwikkeling van ‘n holistiese benadering wanneer IKT projekte bedink word. Terseldertyd moet die vroeë betrokkenheid van rolspelers wat deur enige IKT inisiatief beïnvloed sal word, aangemoedig word.

An Analysis of Oregon Youth Authority Populations: Who Receives Treatment and What Factors Influence Allocation of Treatment Resources?Yazzie, Rebecca Arredondo 05 June 2017 (has links)
Service provision in both adult and juvenile correctional settings is an understudied phenomenon. Research has evaluated the use of evidence-based practices (EBP) in the treatment of mental health and substance abuse among adults and juveniles. Young, Farrell, Henderson and Taxman (2009) highlight the role of organizational factors including climate and culture, opportunities for staff training, resources, administrator attitudes and interagency collaboration in the application of EBP in correctional settings. The Oregon Youth Authority (OYA) aims to provide services to youth under the guise of EBP. Literature in the field of juvenile justice is limited in scope in areas of organizational factors, which are likely to influence the allocation of mental health treatment to youth. This study addressed this gap in existing research by using thematic analysis of focus group data with 28 OYA employees representing seven facilities. Data on 594 youth is offered to illustrate the variability of youth characteristics in OYA facilities. Facility data reflective of youth management and operations is presented to suggest context for staff observations and perceptions of how youth are identified for treatment. Results indicate staff knowledge about treatment and consistency in training along with frequency of organizational change affect climates in which treatment recommendations are made. Findings from this study will be beneficial to OYA as they attempt to meet the growing needs of mental health populations and address ongoing changes to agency staff, culture and climate. Implications from this study will contribute to literature on treatment service provision in juvenile correctional settings.

A partir d'une analyse quantitative et qualitative, cette étude explore la façon dont l'autonomie de juges est conditionnée par le processus qu'ils suivent pour être élus. Pour conclure, cette thèse se penche aussi sur l'état actuel du bilan entre l'indépendance des juges et leur responsabilité vis-à-vis de leur fonction. / This researching work intends to provide theoretical and practical elements to enrich the debate about the causes and consequences of the politicization of two high tribunals in Colombia. In fact, this doctoral project analyses the way the election of the high judges is carried out and the respective consequences of these selection processes. Throughout a quantitative and qualitative analysis, we explore the way the autonomy of the judges is conditioned by their election process. Finally, the current state of the assessment between independence and responsibility of the judges is also tackled.

L’éclatement sans logique du contentieux des actes des autorités indépendantes de régulation économique ( AAI et API) entre le juge judiciaire et le Conseil d’État rend compte d’une instrumentalisation de l’exigence de bonne administration de la justice censée pourtant fonder un tel partage. L’absence d’unité procédurale comme d’unité jurisprudentielle traduit le caractère inopportun de cette répartition des compétences. L’objectif d’une bonne administration de la justice exige de prendre acte de la spécificité et de l’unité de la mission de régulation confiée par l’État à ces autorités pour unifier le contentieux de leurs actes au profit du Conseil d’État. / The illogical partition of the litigation of the acts of the independent authorities in charge with the economic regulation between the ordinary courts and the Council of State displays an instrumentalisation of the requirement of a proper administration of justice, a requirement that was at first presented as the reason for such a sharing. The absence of procedural and jurisprudential unity reflects the inappropriate nature of thisdivision of powers. The principle of proper administration of justice requires taking into account the specificity and the unity of the regulatory mission entrusted by the State to these authorities and therefore unifying the litigation of their acts in favour of the Council of State.

Previous issue date: 2018-05-04 / The objective of this research was to investigate cultural policies related to the debate on the reform of Brazilian Audit Courts (TCs). The study focused on analyzing how accounts of legitimacy and framing strategies conducted by different categories of legal and non-legal actors manifested themselves in the debate on the reform of Brazilian TCs in the period from 2000 to 2017. In this sense, the debate on reform was understood as a field of dialogue and discussion that, between 2000 and 2017, allowed the shaping of the legitimacy of TCs, law enforcement organizations responsible for controlling public resources. With regard to the development of the research, first, the mobilization process on the reform was described. Second, the central arguments used by different categories of actors were analyzed. Third, through legitimacy accounts of the reform, the emerging legitimacy factors and the frameworks of the mobilization process were identified. Documentary data were used, such as parliamentary speeches, public hearings, debates and news. Interviews were also conducted with representatives of the various categories of actors, including professional corporations, media, academia, judiciary, and organized civil society. The data were analyzed using the content analysis technique with the support of NVivo software. The results showed (i) the centrality of professional corporations acting both in the mediation and the translation of the debate, and in the design of intervention strategies in the legal field; (ii) the identification of legitimacy factors emerging from the debate that signal a
multidimensionality of the legitimacy of TCs; and (iii) evidence of the framework of the mobilization process on TC reform in three ways — as a legal process associated with the construction of legal meaning, as a normative process associated with behavior change at the interorganizational level, and as a responsive process integration between political and legal groups. / O objetivo desta pesquisa foi investigar políticas culturais relacionadas ao debate em torno da reforma dos Tribunais de Contas Brasileiros (TCs). A pesquisa centrou-se em analisar como accounts de legitimidade e estratégias de enquadramento conduzidas por diferentes categorias de
atores legais e não legais se manifestaram no debate acerca da reforma dos TCs brasileiros no período de 2000 a 2017. Nesse sentido, o debate sobre a reforma foi entendido como um campo de diálogo e discussão que, entre 2000 e 2017, permitiu a moldagem da legitimidade dos TCs, organizações de aplicação da lei responsáveis pelo controle de recursos públicos. No tocante ao desenvolvimento da pesquisa, em primeiro lugar, descreveu-se o processo de mobilização em torno da reforma. Em segundo lugar, analisou-se os argumentos centrais usados por diferentes categorias de atores. Em terceiro lugar, identificou-se, por meio dos accounts de legitimidade da reforma, os fatores de legitimidade emergentes e os enquadramentos do processo de mobilização. Foram utilizados dados documentais, como discursos parlamentares, audiências públicas, debates e notícias. Também foram utilizadas entrevistas com representantes das várias categorias de atores, incluindo corporações profissionais, mídia, academia, judiciário e sociedade civil organizada. Os dados foram analisados a partir da técnica de análise de conteúdo com o apoio do software NVivo. Os resultados mostraram (i) uma centralidade de atuação das corporações profissionais tanto na mediação e tradução do debate, como no desenho de estratégicas de intervenção no campo legal; (ii) a identificação de fatores de legitimidade emergentes do debate que sinalizam para uma multidimensionalidade da legitimidade organizacional dos TCs; e (iii) a evidenciação de enquadramento do processo de mobilização em torno da reforma dos TCs sob três formas: como um processo legal associado à construção do significado legal, como um processo normativo associado à mudança de comportamento no nível interorganizacional e como um processo responsivo associado à integração entre grupos das esferas política e jurídica.
