« La représentation et l’assistance du plaideur en justice » constitue un sujet classique, mais plus que jamais contemporain. Face à la crise de la justice civile, mais aussi devant son évolution rapide, les choix de politique législative actuels font preuve d’une volonté de renforcer la représentation obligatoire par avocat. Bien que la représentation et l’assistance du plaideur en justice soient utilisées quotidiennement, leur définition et leur finalité en procédure civile restent obscures. Qu’est-ce que « la représentation et l’assistance du plaideur en justice » ? À quoi sert « la représentation et l’assistance du plaideur en justice » ? Notre étude tend à la résolution de ce double problème. À cette fin, nous examinons la nature et la fonction de la représentation et de l’assistance du plaideur en justice. Quant à leur nature, il convient d’analyser leurs composantes conventionnelle et institutionnelle comportant leurs réalités intérieures et extérieures qui les définissent en droit. Quant à leur fonction, il faut approfondir leurs finalités d’intérêt privé et d’intérêt général visant respectivement la protection des droits fondamentaux du plaideur et la bonne administration de la justice. Cette étude permet d’apporter une définition de la représentation et de l’assistance du plaideur en justice, de leur restituer toute leur valeur en procédure civile au regard de leur finalité, de fournir des réponses aux problématiques rencontrées dans la pratique juridictionnelle et d’enrichir la réflexion sur l’avenir de la procédure civile. Elle aboutit à des propositions sur une réforme de la procédure civile fondée sur la représentation à l’instance par avocat. / "Legal representation and legal assistance of litigant" is a classic topic, more than ever contemporary, though. In front of civil justice crisis and its rapid evolution, current legislative choices show a willingness to strenghten legal representation by lawyer. Despite the use of legal representation and legal assistance of litigant on a daily basis, their definition and finality remain obscure. What is "legal representation and legal assistance of litigant" ? Which is the purpose of "legal representation and legal assistance of litigant" ? This study tends to solve this double question by examining the nature and the function of legal representation and legal assistance of litigant. As for their nature, it is their conventional and institutional components including their internal and external realities that contibute to their legal definition, that must be analysed. As for their function, it is necessary to delve into their private and general interest aims that respectively tend to protect the fundamental rights of the litigant and the proper administration of justice. This study permits a definition of legal representation and legal assistance of litigant, restores their value in civil procedure with regard to their purpose, provides answers to the judicial practice problems and permits to enrich the reflection on civil procedure’s futur. It leads to proposals for a reform of the civil procedure based on legal representation by lawyer.

Thesis (M.A. Information Studies (Electronic Records Management)) -- University of Limpopo, 2021 / There is a strong argument for a direct link between records management and delivery of justice to citizens in that to an extent that a country is ready to embrace information and communication technology (ICT), the lower the level of corruption in that country. This study investigated the role of electronic records management for effective delivery of justice in Limpopo Province police stations (LPPS) with the adoption of the exploratory survey research design based on quantitative and qualitative research approaches. The study adopted a pragmatic worldview to sample 100 police detective officers and 6 records managers with a 65% response rate in Lebowakgomo and Mankweng clusters of Limpopo province with the use of questionnaire and interview as data collection instruments. The study analysed quantitative data through SPSS for Windows while adopting Thematic Analysis for qualitative data.
This study found that the LPPS had inadequate human resource and ICT infrastructure capacity for effective electronic records management and delivery of justice to citizens; that e-docket system had a positive impact in enhancing electronic records management, specifically with 24hour access and timely sharing of records; that poor internet connection emerged as the most prominent challenge faced when managing records; and that monitoring of the e-docket system and increased human resource and ICT infrastructure capacity could improve electronic records management. The study made the following recommendations in order to enable effective delivery of justice to citizens through electronic records management in LPPS: that there be minimum training requirements for those working with records in order to cultivate a culture of appreciating proper records management; that police stations be provided with enough computers with adequate network capacity; that a qualified records manager be appointed to administrate the management of records; and that offsite backup be implemented to ensure system recovery in case of disaster. / National Research Foundation (NRF)

The crime of obstructing the course of justice : is legislative intervention an imperative?Mnisi, Eric 06 1900 (has links)
In this thesis, the common law crime of obstructing or defeating the course of justice as currently applied in South African law, is considered critically. The purpose of the study is to determine whether the ambit of the crime should be extended to target all conduct which undermines the proper administration of justice in South Africa. The interests protected by the crime are investigated, and those important constitutional values which underpin the crime, are identified. These values are: (i) constitutional supremacy (ii) the rule of law (iii) the doctrine of separation of powers, and (iv) the independence of the courts. In a post-constitutional era, the question raised is whether the crime as developed in the common law adequately protects these important democratic values. The historical background and development of the offence are discussed. This is followed by a comparative legal study which considers the existence and ambit of the offence in certain foreign jurisdictions. The foreign legal systems considered are England, Australia, Canada and the United States of America. The study reveals that the crime has been codified in most of these jurisdictions. Codification was driven by the need for legal certainty and compliance with constitutional imperatives. The study concludes that similar reform is necessary in South African criminal law. It is recommended that the common law offence of obstructing or defeating the course of justice be repealed and replaced with a comprehensive statutory offence which criminalises all manifestations of conduct which are intended to defeat or obstruct the proper administration of justice. The proposals are based upon the identified constitutional imperatives which underpin the crime. It is argued that the legislature is the proper institution to initiate reform in this regard. Justice of the First Czechoslowak Republic follows on from the justice of Austor-Hungarian Empire. The theoretical part of the presented thesis illustrates how the criminal law has changed and what the system of a judiciary organization was. The second part of the thesis, based on the research of archival sources, focuses on district court and cases which falling within their jurisdiction on the example of the town Lišov in South Bohemia in the years 1918-1939. Attention is payed on a local municipal police, as well as the persons of judges and notaries.

Autonomous aboriginal criminal justice and the Charter of RightsJohnston, William Wayne 05 1900 (has links)
The imminent recognition of an inherent Aboriginal right to selfgovernment
signals the beginning of the reversal of a colonization process
which threatened the cultural survival of a people. The Report of the Aboriginal
Justice Inquiry of Manitoba , hereinafter referred to as the Inquiry, advocates an
autonomous Aboriginal criminal justice system as a significant component of
this cultural revitalization. This Aboriginal criminal justice system would differ
markedly from the conventional system in giving priority to collective rights over
conflicting individual rights. The Inquiry rejects the Charter as alien to Aboriginal
values and advocates a “tailor-made” Aboriginal charter that would incorporate
“only those fundamental freedoms and civil liberties that do not violate the
beliefs and paramount collective rights of the Aboriginal peoples.”
The conventional justice system’s paramount concern for individual
rights is premised on the potential of punishment. The Inquiry’s starkly
contrasting paramount emphasis on collective rights is premised on an
Aboriginal view of justice which this thesis refers to as the “harmony ethos”:
The underlying philosophy in Aboriginal societies in
dealing with crime was the resolution of disputes, the
healing of wounds and the restoration of social
harmony… Atonement and restoration of harmony
were the goals - not punishment.
The tension between individual and collective rights apparent in the
proposal of the Inquiry is the specific focus of this thesis. The colonization
process may justify a separate Aboriginal justice system. However, the harmony
ethos premise, while appropriate to the mediation-reconciliation communitarian
model of justice advocated by the Inquiry, blinds the Inquiry to the additional,
and crucially different, adjudicative-rights imperatives of the contemporary
Aboriginal society.
Actually existing Indianism reveals conflict-generating fault lines in the
harmony premise which challenge the sufficiency of the Inquiry’s group-based justice paradigm and indicate a need and desire for an adjudication justice
component and concomitant Charter values.
This adjudication hiatus in the Inquiry position is a reflection of a similar
void in historical Aboriginal justice which challenges the asserted rationale of
cultural survival for the paramountcy of collective rights in the contemporary
Aboriginal justice system. This historical adjudication hiatus does not preclude
a separate Aboriginal justice system, but favours the inclusion of Charter values
to strengthen an adjudication cultural foundation which is frail relative to its
reconciliation-mediation strength.
This thesis is a modest attempt to address the interface between two
systems; one mature, but in need of change, the other, fledging and in need of
assistance. The Charter provides a ready and flexible framework to join the
Aboriginal community both to the larger society and to the unlanded Aboriginal
diaspora by principled standards of justice. These fundamental indicia of
fairness, recognized by all civilized self-governing units, constitute no significant
threat to the cultural survival of the Aboriginal mediation justice heritage, while
buttressing its inherent adjudication frailty.

Todavia, o acesso à justiça encontra uma série de óbices à sua concretização, de ordem econômica, social, cultural e legal. Ao remoção dessas barreiras e também a nova demanda social por acesso à justiça reclamam a revisão deste conceito. Editlca-se, então, um novo conceito de acesso à justiça, onde o Estado e a Sociedade, em parceria, comprometem-se a resolver cont1itos por meio de diversos mecanismos de resolução de cont1itos e não exclusivamente pela via dos tribunais. O acesso à justiça passa a ser entendido como um conjunto de meios colocados à disposição da sociedade para a solução de litígios, que devem ser escolhidos por critérios de adequação, reservando-se a jurisdição à condição de ultima ratio desse sistema. Os meios alternativos de resolução de cont1itos, em especial os autocompositivos- conciliação e mediação-, além de ampliarem o acesso à justiça, levando à população a possibilidade de resolução de conflitos de modo rápido, desburocratizado, seguro e com baixo custo, podem revelar-se como o método mais indicado na solução de determinados conflitos. Deve-se disseminar e incentivar sua utilização. Recomenda-se, assim, o desenvolvimento de uma política pública que ofereça informação à população sobre esses temas e também possibilite a resolução de conflitos por meios autocompositivos, colocandose os tribunais em posição de retaguarda. / The old concept of access to Justice is as old as access to the courts. Nevertheless, access to Justice has many economic, social, cultural and legal obstacles to itself realization. Removing these obstacles, so the new social demand lor access to justice cal! for a review of the concept. Then built up a new concept o f access to Justice, where lhe State and Society, in partnership, undertake to resolve conllicts through various resolution mechanisms, and not exclusively through thc courts. Access to Justice is beginning to be understood as a set of ways for society to solve disputes, which must be chosen by criteria o f adequacy, reserving to Jurisdiction the condition of ultima ratio of that system. Alternative ways of resolving conflicts, especially the mutual agreement - conciliation and mediation - increase access to Justice, enabling people to resolve conllicts quickly, simple, safe and cheap, also may prove as best method to solve some contlicts. This use should be spread and encourage. lt is recommended, therefore, the development of a public policy that provides information to people about these issues and also enable the resolution of conllicts through mutual agreement, leaving the courts as a last alternative.

Procédant dʼune volonté de modernisation et de rationalisation de lʼinstitution judiciaire, la présence des nouvelles technologies dans l’administration de la justice pénale est croissante. Ces outils esquissent un changement sans précédent, dans une institution pourtant marquée par un certain traditionalisme. Touchant aux aspects juridiques, symboliques, humains, et gestionnaires de lʼintervention judiciaire, cette émergence du numérique pose les jalons de la justice pénale du XXIe siècle. Inexorablement, le formalisme qui caractérise lʼinstant de justice, procédural ou ritualisé, subit de profondes modifications, parfois dans le sens dʼune altération ; le fond culturel fondamental de la justice pénal est alors mis à lʼépreuve. Entre influence néfaste et renouveau bénéfique, les apports de ces instruments du travail judiciaire sont marqués par lʼambivalence. La résistance obstinée semble inadaptée, et le modernisme irréfléchi au nom d’une optimisation des moyens de l’institution, à proscrire. Seule la régulation de lʼusage dʼoutils qui sʼimmiscent jusque dans le contenu de la décision de justice peut être gage dʼune évolution harmonieuse. Nowadays, those tools of communication, information, and management represent essential ways of evolution of justice, at the heart of its performance. They imply an unprecedented change for an institution marked by a certain traditionalism. Related to judicial, symbolic, human and managerial aspects of the legal intervention, the emergence of digital is paving the way of (characterizing) the criminal justice in the XXI century. Inexorably, the formalism characterizing the justice moment, procedural or ritualized, is going through deep changes. Sometimes those changes are distorting the cultural founding of criminal justice. Between bad influence and beneficial renewal, the inputs of these judicial work tools are characterized by ambivalence. The obstinate opposition is inadequate. As the thoughtless modernism to optimize the institution tools, is to proscribe. The regulation of the tools’ practice, which is even involved in the content of the justice decision, is a necessity to ensure a smooth evolution. In order to avoid a denaturation of the legal intervention, a real integration processs of new technologies should be established, mixing ethical, legal and institutional considerations. In that way, this technological transition will be helping to legitimate the criminal justice, still affected by a functional and trust crisis
