National security, security certificates, the special advocate regime and secret evidence: the right to know and respond to the evidence against you

This thesis examines the use of information that is confidential, for reasons of national security, against detainees held under the security certificate provisions of the Immigration and Refugee Protection Act, SC 2001, c 27 (IRPA), without disclosure to the detainee or the detainee’s counsel. The striking down of the predecessor legislation by the Supreme Court of Canada and Parliament’s response are reviewed, as is pertinent literature in the area. Parliament’s creation of a regime providing for the appointment of a Special Advocate to receive confidential information and represent the interests of an individual detained under a security certificate at hearings where the detained individual and their counsel are excluded is considered. The Special Advocate regime is analyzed to determine its adequacy in protecting the section 7 rights of a detainee under the Canadian Charter of Rights and Freedoms. The limitations associated with the Special Advocate regime are identified, with a conclusion that the relevant provisions of IRPA, including the Special Advocate regime, are inadequate in terms of protecting the right to make full answer and defence and that, therefore, the current legislation violates the Charter.

Syfte: Syftet med uppsatsen var att förtydliga hur partnership kan utnyttjas i företags arbetemed experience marketing. Analysen kom fram till hur experience marketing kan utnyttjas påett mer fördelaktigt sätt med hjälp av partnership. Vi belyste vad som krävs för att lyckas medexperience marketing och vilka krav som ställs för att skapa ett framgångsrikt partnership. Metod: En kvalitativ forskningsansats med ett deduktivt tillvägagångssätt användes. Sexintervjuer gjordes med personer med erfarenhet ifrån arbete inom experience marketing ochpartnership. Teoretiskt perspektiv: Tidigare forskning inom experience marketing och partnershippresenterades. Efter detta redogjordes det sedan för hur de här två ämnena samverkar. Empiriskt perspektiv: Den insamlade primärdatan ifrån de sex intervjupersonernapresterades. Slutsats: Studien visade att ett företag med hjälp av partnership kan förstärka sitt arbete inomexperience marketing. Genom tydliga emotionella kopplingar till sina kunder i samverkanmed skapandet av unika kunderbjudanden blir kunderna mer än bara konsumenter, de blirbrand advocates. Oberoende av bransch eller storlek kan företag förbättra sitt arbete medexperience marketing genom att tillämpa partnerships.

My thesis summarizes the legal documents relating to eligibility and possibility of legal practice in another state than the home member state. European Union Law in this regard is binding for the Czech Republic since its accession to the EU in 2004. The work is divided into chapters giving comprehensive and coherent information. The introduction justifies my choice of the topic and outlines particular chapters. The first chapter is devoted to cross-border advocacy and the related terms of a European lawyer or Union element. The second chapter begins with the interpretation of the content of primary law in relation to advocates and their activity. The third chapter presents relevant legal documents of secondary union law - directives. The fourth chapter describes fundamental Czech legislation, namely the Law on Advocacy. The fifth chapter discusses the legislation in France. The sixth chapter contains two examples of Czech and EU case law. In the chapter of annexe there is a list of the professional designation of the home state set by Ministry of Justice, so it is a list of titles of persons authorized to provide legal services, and the second annexe is a bar chart showing the number of European lawyers established in the Czech Republic. Assessing Performance on Professional, Health Advocate and Scholar During Crisis Simulation

Abstract The objective was to assess Professional, Health Advocate and Scholar CanMEDS competencies in anesthesia residents using a Generic Integrated Objective Structured Assessment Tool (GIOSAT) during simulated scenarios. Methods Twenty one anesthesia residents participated in managing two scenarios: “do not resuscitate” and “morphine overdose”. Four trained blinded raters analyzed video recordings using the GIOSAT. Internal structure was examined using generalizability analysis. Results Results of the g-study focused on PHAS and ME components alone, participants accounted for 20% of the scores variance (G-coefficient 0.66). A D-study indicated two raters and eleven or more scenarios would be required for a G-coefficient > 0.80. Conclusion This study demonstrates construct validity for assessing PHAS competencies for low stakes assessment. Results address the gap of assessment performance for PHAS competencies, describe methodology and produce recommendations for summative assessments using simulation.

We have determined that both active listening and a good balance between inquire/advocate are key factors to increasing a group's performance by increasing its collective intelligence. The degree of a group’s active listening determines how engaged the members are by showing each other that everyone's ideas are equally valuable. Active listening helps the social processes every group goes through when tackling a problem or task. The balance between inquire/advocate is important to a group’s understanding and decision making when handling a problem or task. Inquire is used to create a shared understanding while advocate is voicing ideas. When the scale tips too much on either side the group’s performance decreases. / Vi har kommit fram till att både aktivt lyssnande och en bra balans mellan inquire/advocate är viktiga faktorer för att öka en grupps prestation genom den kollektiva intelligensen. Graden av en grupps aktiva lyssnande avgör hur engagerade medlemmarna är genom att visa varandra att allas idéer är lika värdefulla. Aktivt lyssnande hjälper de sociala processer som varje grupp går igenom när man tar itu med ett problem eller en uppgift. Balansen mellan inquire/advocate är viktig för en grupps förståelse och beslutsfattande när man hanterar ett problem eller en uppgift. Inquire används för att skapa en gemensam förståelse medan advocate uttrycker idéer. När vågen tippar för mycket på vardera sidan minskar gruppens prestation.
