LA COOPERAZIONE RAFFORZATA COME MODALITA' D'ISTITUZIONE DELLA PROCURA EUROPEA

Il Trattato di Lisbona contiene la base giuridica per l’istituzione della Procura europea, tramite regolamento da adottare con il voto unanime in seno al Consiglio. Essa avrà il compito di «individuare, perseguire e rinviare a giudizio gli autori di reati che ledono gli interessi finanziari dell'Unione» (art. 86 TFUE). Il 17 luglio 2013 la Commissione ha adottato una proposta di regolamento a riguardo. Tuttavia, i negoziati fino ad ora condotti fanno ritenere che sarà difficile adottarlo all’unanimità, motivo per cui si è deciso di indagare il tema dalla prospettiva della cooperazione rafforzata. L’obiettivo della tesi consiste nel dimostrare la concreta esistenza di un valore aggiunto dell’istituzione della Procura europea da parte di un numero ristretto di Stati rispetto all’abbandono di un tale progetto per assenza di unanimità. La tesi mira a dimostrare la sua fattibilità, costruendo un sistema capace di funzionare in un contesto d’integrazione diseguale. L’elemento di novità consiste nella riscrittura della proposta di regolamento per adattarla al diverso contenuto (non più l’istituzione della Procura europea, ma l’attuazione di una cooperazione rafforzata ai fini di una tale istituzione) e nella predisposizione di modelli degli accordi disciplinanti la cooperazione tra gli Stati membri non partecipanti e l’organo di accusa europeo. / The Treaty of Lisbon contains the legal basis for the institution - by means of a regulation to be adopted by the Council acting unanimously - of the European Public Prosecutor’s Office (EPPO), which shall be «responsible for investigating, prosecuting and bringing to judgment the perpetrators of offences against the Union's financial interests» (art. 86 TFEU). In July 2013 the Commission adopted a proposal for a regulation on this matter. However, the ongoing negotiations lead to retain that it will be difficult to reach unanimity. This is the reason why this dissertation analyses the theme from the perspective of enhanced cooperation. The purpose of this thesis consists in demonstrating the concrete existence of an added value deriving from the institution of the EPPO by only some States rather than neglecting this project. Thus, it aims at proving the feasibility of this project, by constructing a functioning system, even in a context of unequal integration. The redrafting of the regulation in order to adapt it to the new object (the implementation of the enhanced cooperation for the institution of the EPPO) and the provision of the text of the agreements between non participating States and the EPPO constitute its originality.

The study offers a historico-educational investigation of the extent to which the Teachers' Association of South Africa (TASA) satisfied the educational aspirations of the Indian coIIDllunity in South Africa. The discussion begins with a theoretical exposition of characteristic features of teachers' associations. It considers the origin, nature and purpose of teachers' associations. A brief survey of some teachers' associations in the Republic of South Africa is also made. The development and the organisation of the Teachers' Association of South Africa (TASA) is highlighted. In this regard special emphasis is placed on the role of the Association's forerunners, and the nature and functioning of the various organisational structures within the Association. An elaborate discussion is devoted to the achievements of the Association in satisfying the educational aspirations of the Indian coIIDllunity in South Africa. Gender issues in management promotions in the health services : a Malawian perspective

This study sought to explore gender issues affecting management promotions in Malawi's health care services, utilising both qualitative and quantitative techniques in data collection and analysis. Promotion patterns were compared and contrasted for male and female managers. The study was based on the assumptions that • both men and women were aware of experiences that affected their promotion opportunities • promotion patterns showed fewer variations than did cultural, social and gender factors • male prejudices were maintained which oppressed women's promotions • increased decision-making power lowered stress about professional growth and development The findings supported the first two assumptions, but not the last two. The findings suggested that males and females encountered similar experiences concerning managerial promotions in Malawi's health care services. Factors that enhanced management successes for both males and females included management orientation and mentorship. Unclear promotion policies and procedures hindered management promotions. Information derived from this research could enable policy-makers to establish an environment that increases supportive networks and interactions between male and female managers in Malawi. Furthermore, to ensure equal opportunities in the health care services management, monitoring strategies by Malawi's Ministry of Gender, the Department of Human Resources Management and Development, and the Ministry of Health and Population need to be established and implemented. / Health Studies / D.Litt. et Phil. Under de senaste åren har det blivit allt vanligare för konsumenter att använda sig av sociala medier, främst inom turismindustrin. Det är vanligt för konsumenter att idag stöta på nya destinationer och att viljan av att resa uppstår genom sociala medier. Denna studie handlar om att få en djupare förståelse av hur destinationsmarknadsföring tolkas av konsumenter. För att uppnå syfte har dessa två frågeställningar formulerats, Hur möts konsumenterna av destinationsmarknadsföring på sociala medier? och Vilket inflytande påstår konsumenterna att destinationsmarknadsföring inom sociala medier har på deras köpbeslut av destination?. Den empiriska materialinsamlingen har tagits fram genom att genomföra 20 kvalitativa intervjuer på konsumenter. Valet av att genomföra intervjuerna på konsumenter var för att få konsumenternas perspektiv av det valda forskningsområdet. För att analysera den empiriska materialinsamlingen har studien utgått ifrån fem teorier, Social media marketing, Konsumentens beslutsprocess, WOM och eWOM, Personliga egenskapers påverkan på konsumenternas köpbeteende och Push- och Pull faktorer. Studien har kommit fram till att konsumenter ofta möts av destinationsmarknadsföring i sin vardag på sociala medier. Samt att mötet även har ett stort inflytande på konsumenternas köpbeslut, då viljan av att resa uppkommer och beslutet av destination tas. / Over recent years it has become increasingly common for the general populous to use social media, especially for companies and consumers in the tourism industry. This affects the way potential consumers learn about new destinations and also influences their opinions on said places. The aim of this study is to gain a deeper understanding of how destination marketing is interpreted by consumers. In order to achieve this, two questions needed to be answered: How do consumers come across destination marketing on social media? and In what way do consumers feel destination marketing impacts their purchasing decisions? Interviews were conducted with 20 consumers to obtain qualitative data in order to gain an insight on the consumers perspective. Empirical data was analyzed using five different theories: Social Media Marketing, The Buyer Decision Process, WOM and eWOM, Personal Characteristics Affecting Consumers Behavior and Push- and Pull Factors. This study shows that consumers encounter destination marketing on social media often and also that destination marketing has a significant influence on consumers purchasing decisions as it encourages travel and allows selection of destination.

The effect of single sex schooling on girls' achievement in Physical Science

This study investigated whether girls achieve better results in Physical Science in single sex environments or in co-educational classes. Thirteen independent South African schools where children were of similar socio-economic background were considered. Grade 12 Matriculation Physical Science examination results for 1999 to 2003 were analysed using Bonferroni (Dunn) t-Tests and Scheffe's Tests. Questionnaires were completed by a small number of students in order to compare their attitudes towards Physical Science and examined qualitatively. There were significant differences found by the administration of the Bonferroni (Dunn) t-Tests and Scheffe's Tests in 2000, 2001 and 2002 to indicate that girls in single sex schools achieved better results in Science than the co-educational schools. However, in 1999 and 2003 there was no significant difference in the results achieved, and so there may be other factors that are more important predictors of achievement than whether the schools are mixed or single sex. / Educational Studies / M.Ed. Promoting reading comprehension competence among English second language high school learners in a disadvantaged community

The goal of this research study was to determine whether extensive reading, supported by the instruction and use of appropriate strategies, would a) improve learners' comprehension achievement b) increase academic achievement in English, and c) promote higher achievement in general academic performance. One hundred and twenty-one learners participated in this project. Three groups of learners: extensive readers, less extensive readers and non-extensive readers were identified and studied. The result indicated that extensive reading not only leads to improved achievement in comprehension, but that it also leads to improvement in general academic performance in all subjects across the curriculum; while lack of extensive reading has an adverse effect on both reading comprehension achievement and general academic performance as a whole. / Teacher Education / M.Ed. The changing needs of a household's demand for liabilities over the life course : focused on young adults

South Africans carry high debt levels and many deal with the threat of over-indebtedness. In particular, the debt situation of the youth is of utmost concern. This study was undertaken to gain an understanding of how the liability usage of households fluctuates over the life course. The main objective was to identify and describe how debt is accumulated by young South Africans and how household characteristics and events may be related to the uptake of household liabilities. This study conducted a comprehensive literature review culminating with the development of a heuristic model that identified variables that may affect household debt uptake. Quantitative statistical analysis techniques were employed on secondary data acquired from the South African Audience Research Foundation’s All Media and Products Survey for the years 1999 until 2013. The findings identified that household debt follows a familiar life cycle pattern. A number of independent variables were shown to affect household debt uptake. Furthermore, certain of these variables are related to the trajectories of the life course. / Taxation / M. Acc. Sci.
