Uncovering complexity in everyday practice : a post modern study of community nursing assessmentBeckwith, J. S. January 2010 (has links)
Much skilled nursing practice is described by words which at face value appear low-tech and self-explanatory. Despite being acknowledged as intrinsic to practice “nursing assessment” has few operational definitions. This thesis critiques and reviews the methodological assumptions that underpin research and the frameworks commonly used to facilitate Concept Analysis (CA). Despite the apparent plethora of approaches to CA, the majority of them used (or adapted without justification or critique) the work of one author, and this was found to be simplistic and ontologically flawed. A review of the contemporary nursing literature was undertaken to identify uses of the term assessment. The subsequent Glasarian Grounded Theory Analysis revealed the Judicial as the core of seven overlapping categories. Evidence of the everyday use of the term assessment was obtained through observation and audio recording of nursing assessment practice. Following Foucault, Critical Discourse Analysis of the data recorded in the study’s field work phase was undertaken. This revealed social power and dominance facilitated through subject/object conflations and the discourses of discrimination, surveillance, repression, natural science, resistance and institutional power, and in contrast, examples of empowering practice. This thesis will argue that the process of nursing asssessment is skilled and complex, and that in order to measure and demonstrate the quality of nursing practice within an arena dominated by the hegemonic power of medicine, it requires articulation and understanding. Nurses use a matrix of approaches to build rapport and assess patients during all interactions. Their work involves integrating intuitive, predictive and logical reasoning within an empathetic and authentic communication with patients and their carers. Hierarchies of nursing practice, government policies, inter-professional agendas and dissonaces between the policy rhetoric of placing patients at the heart of assessment and actual everyday practice, produce barriers to meaningful assessments.

Anotation The aim of this thesis is to draw attention to the issue of medical drug and addictive substance abuse in the old age. It describes the bio-psycho-socio-spiritual changes and needs of the elderly which are often connected with the start of harmful use of medical drugs. It lists the substances which are most commonly abused in the old age and it demonstrates the theory by means of concrete casuistries. Overuse of and addiction to addictive substances is not investigated enough by either addictology, geriatrics or social work. The aim of this thesis is to discuss the whole problem area from the point of view of social work, which should be paying more attention to it.

This paper revisits one of the more frequented stops at the crossroads of politics and morality in contemporary ethical theory, Michael Walzer’s essay “Political Action: The Problem of Dirty Hands.” The aim is to provide a fresh assessment of Walzer’s project, and to evaluate the tenability of its core notion of “dirty hands.” In pursuit of this aim, the effort is made to reopen the paths which take Walzer to his celebrated impasse, from two directions. The first of these resituates Walzer’s analysis in the context of the debate within Anglo-American ethical theory in which it is originally expounded. The second route seeks to recapture the trail of thinkers who guide Walzer to his conclusions from more remote locations in intellectual history, in order to determine the reliability of his intriguing constellation of Machiavelli, Weber and Camus as lodestars. Writing thirty years later, one of Walzer’s friendliest interpreters, Jean Elshtain, in the midst of her enthusiasm for ‘dirty hands,’ renews doubts about his recommendation of “casuistry.” Hints from throughout Walzer’s essay, incompletely elaborated there, are parceled together into closing suggestions as to an alternative approach to so-called ‘dirty hands’ situations. / text

The theme of my diploma thesis is mentally disabled people in prison. The aim of this work is to map methods of social work and functioning of a specialized department for mentally disabled people. The theoretical part focuses on legislation regulating this area. Moreover, there is a characteristic of particular types of prisons and a description of rights and obligations of the convicted persons and disciplinary punishments. Another topic of the work is the function of the sentence, characteristic of the specialized department and brief characteristic of particular disabilities. The practical part includes an interview with workers in this department. I found out the methods of work they use and how much different the work with these convicted persons is. Fort better understanding of this topic there are also case studies of convicted persons from the specialized department.

This master's thesis is primarily concerned with the philosophical conditions of late seventeenth- and early eighteenth-century England that encouraged the emergence of periodical literature and perpetuated the birth of the novel. While most connections between periodical literature and the novel are made on how the former created the readership that ensured the latter's success, I focus on how the epistemology unique to the advent of empirical science together with the growing prominence of casuistic thought created a space in which periodical literature could emerge and the early novel could flourish. I investigate the underlying assertion of a particular philosophical amalgam that I call casuistic-empiricism. Such philosophies encouraged the Renaissance trend that devalued letter-of-the-law thinking, which led ultimately to a significant epistemological transformation in seventeenth-century England. Recognizing the immensity of this epistemological shift, I focus on the early seventeenth-century practice of casuistry as an outgrowth fueled by seventeenth-century natural philosophy. By investigating the poetry and prose of John Donne, I emphasize the pervasive threads of casuistic thought that found parallels in empirical epistemology. I proceed in a linear fashion by following the evolution and growing pervasiveness of casuistic culture into its period of culmination marked by the birth of the Athenian Gazette. Readers' prominent attraction to the periodical is shown to run on a parallel with the incipient empiricism. Indeed, the two prominent lines of thought (empiricism and casuistry) form a dynamic binary where each feeds off of and is fed by the other, culminating in a unique epistemology that aided the emergence of the early novel. Extending this discussion of periodical literature's casuistical qualities into Defoe's Robinson Crusoe, I investigate how Defoe's ties to casuistry are reflected in and perpetuated by Crusoe, illustrating how the novel becomes a medium for resolving cases of conscience. The novel as a genre is shown to be more than just a close relative of the periodical, both genres being spurred into prominence by some of the more salient features attendant to casuistic-empirical philosophy. The novel becomes finally a type of culminating product of a unique casuistic-empirical practice that accounts for the full range of experiences involved in reaching justified conclusions.

Peut-on parler d’une théorie des nullités dans la doctrine après le Code civil ? C’est à cette question que l’on a cherché à répondre dans ce travail. En effet, la réponse, habituellement, apportée à cette dernière appelle des précisions. Selon cette réponse, après le Code civil, il y a eu une théorie des nullités dans la doctrine. D’abord, il y a eu une doctrine classique qui est composée, majoritairement, d’auteurs du XIXème siècle. Ensuite, à coté de cette doctrine, il y a eu une doctrine dite moderne, composée majoritairement d’auteurs du XXème siècle. Si, pour construire une théorie générale des nullités, la doctrine classique a utilisé l’état de l’acte, la doctrine moderne elle, elle a utilisé le critère lié au but de la règle violée. Dans ce travail, on a cherché à renouveler cette réponse, d’une part en mettant en évidence les limites de l’idée d’une doctrine classique ou moderne et d’autre par en montrant l’inadéquation de ces théories générales, construites par les auteurs après le code civil, au droit positif. Ce qui nous a permis de proposer d’abandonner toute vision globale sur doctrine et sur la théorie des nullités. Aussi, on a proposé de remplacer cette vision globale par une conception diverse des nullités. Une conception diverse d’abord, en ce qui concerne la doctrine, dans la mesure où il n’y a pas d’un coté la doctrine classique et de l’autre la doctrine moderne. Mais aussi une conception diverse en ce qui concerne la théorie des nullités elle-même, dans la mesure où il n’y a pas une seule théorie pour tous les types de contrats, mais des théories diverses qui épousent les spécificités de chaque contrat. Telles sont les conclusions auxquelles nous sommes parvenus à l’issue de ce travail. / Can we speak of a theory of nullity in the doctrine after the Civil Code? This is the question we sought to answer in this work. Indeed, the answer usually given to the latter requires clarification. According to the response after the Civil Code, there was a theory of nullity in the doctrine. First, there was a classical doctrine which is composed mainly of lawyers of the nineteenth century. Then, next to this doctrine, there was a doctrine called modern, composed mainly of lawyers of the twentieth century. If, to construct a general theory of nullity, the classical doctrine has used the state of the act, the modern doctrine, she has used the criterion related to the purpose of the rule breached.In this study, we sought to renew this response, first by highlighting the limits of the idea of a classic or modern doctrine and the other by showing the inadequacy of these general theories, built by the authors after the Civil Code, the positive law. This allowed us to propose to abandon any overall vision and doctrine on the theory of nullity. Also, it was proposed to replace this global vision by various design nonentities. A diverse design first, with regard to doctrine, to the extent that there is no one side the classical doctrine and other modern doctrine. But also various design regarding the theory of nullity itself, insofar as there is no single theory for all types of contracts, but various theories that espouse the specifics of each contract.These are the conclusions we have reached the end of this work.

The Stories We Tell: Novellas, News, and the Uses of Casuistry in Early Modern EuropeBurns, Raphaelle J. January 2020 (has links)
This dissertation examines representations of legal, theological, and medical modes of case thinking and case narration in the novella collections of four early modern authors: Giovanni Boccaccio (1313-1375), Marguerite de Navarre (1492-1549), Matteo Bandello (c.1485-1562), and Miguel de Cervantes (1547-1616). It further investigates how these collections perform and problematize practices of narrating and interpreting cases while framing such practices within the context of the navigation of daily news. Indeed, keen observers of the capacity of informal and formal networks to circulate information and opinions in unpredictable ways and on scales unprecedented, these authors also used the novella genre—and the polysemy of the term “novella”—to intervene in contemporary debates on the value of novelty and on the merits of popularizing expert knowledge. I argue that the early modern novella’s role as a literary mediator between professional forms of the case and popular forms of the news report was instrumental to its durable transnational European success. Over the course of this dissertation, I show how these collections depict the art of storytelling qua case narration as an essential ethical component of professional casuistries and of everyday information exchanges. I draw attention to specific professional inflections of the case-novella-news nexus, in order to highlight how each author conceives—and makes the case for—the indispensability of storytelling to spiritual and civic life. I demonstrate that a juridical approach to cases and novelty takes precedence in Boccaccio’s Decameron. I show that, in contrast, Marguerite de Navarre’s Heptaméron relies on distinctly theological conceptions of cases and news. I proceed to compare the type of moral casuistry found in the Heptaméron to that found in Matteo Bandello’s Novelle. Finally, I investigate the consequences of Cervantes’ predilection for a medical approach to case analysis, novelty, and news in his Novelas ejemplares. The broader ambition of this investigation is twofold: first, to contribute a literary and historical perspective to contemporary methodological debates on the value of case thinking in the human sciences and in the liberal professions, and second, to pave the way for an exploration of the casuistical foundations of modern journalism at a time when its epistemological and ethical priorities are sorely in need of being reassessed.

The goal of my diploma thesis is introduce one of alternative direction {--} music therapy, to outline the sphere of specific learning and behavior disorders, and also to give a guide, how to apply components of music therapy during the work with children with these disorders. The thesis consists of two parts {--} a theoretical and practical part. The theoretical part focuses on defining key terms, such as music therapy, dyslexia, dysgraphia, dysortographia, dyscalculia, dyspinxia, dysmusia, dyspraxia. In my work I aim to clarify the question of ADHD and try to point out the relation of particular learning and behavior disorders. The practical part includes twenty activities that were made firstly according to a methodical manual written by M. Beníčková and Z. Vilímek, who use the Czech method of music therapy {--} Music of body, and secondly on the base of casuistry of two boys attending special practical school. Each activitiy should develop particular skills, comprises tools, motivation, its own description and analysis coming out of a practical accomplishment. The method of observing was used for the evaluation.

The thesis focuses on the socio-educational work methods of the probation and mediation services and of its workers in relation to their clients with imposed probation supervision and on the opportunities for development and support of their healthy social functioning. The thesis is divided into theoretical and practical part. In the theoretical part initially are defined the basic concepts and terms, then it is described the target group of conditionally released from prison clients, which currently are under supervision of a probation officer. The thesis sees the imprisonment as a difficult life situation and it deals with the influence of penitentiary environment on the personality of the convict in relation to his further development. In the second part are described the specific activities of the probation and mediation service workers in relation to clients from the target group. The thesis focuses on the socio-educational work of the probation officers, as well as social workers or other organizations for social prevention and their impact on the social stabilization of individuals, belonging to the target group. Here the concept of social stabilization is concretized and related to individual areas, which should be implemented within the probationary period. The practical part shows...
