This diploma thesis deals with the defectiveness of present converb in contemporary Russian language. The first part outlines the theoretical solutions of converb in Russian language, its origin and diachronic development. The second part presents basic grammar books illustrating the codification of defectiveness of present converb during the 20th and early 21st century. The grammars of Lomonosov, Grech and Vostokov, which illustrate the state of codification in the previous period, are composed to supplement. On the basis of theoretical knowledge and data from the grammars most often forbidding forms of the converbs were chosen and then submitted to corpus analysis. The aim of the corpus analysis was to verify the actual usage of the forbidding forms of present converbs in literary texts. key words: morphology; Russian; converb; codification; use; corpus

This Diploma Thesis deals with the importance of customary law in contemporary international law. The thesis provides description of sources of international law, focused on custom as a necessary source of international law. Further the history of international law is described. Finally a brief summary of cases settled by International Court of Justice where customary international law was applied is provided. The task of the work is to provide evidence that the custom is still useful and used source of international law. As a proof of this statement a range of ICJ decisions is mentioned and the process of international law codification and progressive development is described.

Este estudo versou sobre os caminhos da formação do Direito Comercial brasileiro a partir das reformas pombalinas no século XVIII até a promulgação do Código Comercial brasileiro de 1850, procurando expor em quais pontos em se diferenciou do Direito Civil. Para tanto, no primeiro capítulo, expôs-se de que forma se deu a penetração das ideias Iluministas em Portugal, especialmente por meio da obra de LUÍS ANTÓNIO VERNEY. Em seguida, procurou-se demonstrar como essas ideias informaram as reformas levadas a efeito pelo Marquês de Pombal no século XVIII. No segundo capítulo, objetivou-se evidenciar as alterações na sociedade e na estrutra do império luso-brasileiro a partir da abertura dos portos em 1808 e de que forma estas alterações tiveram impacto na História do Direito Comercial nacional. O terceiro capítulo destinou-se a provar o influxo de ideias jusracionalistas no Direito Comercial brasileiro por meio da adoção da teoria subjetiva da causa, consagrada legislativamente no Código Civil francês de 1804. O trabalho, portanto, destinou-se a por em relevo um aspecto da História do Direito privado brasileiro que não se coaduna com a tradição jurídica luso-brasileira / This study refers to the formation of Brazilian Commercial Law from the pombalinas reforms until the promulgation of the Brazilian Code of Commerce in 1850. Throughout the work we tried to demonstrate how the Commercial Law followed a different tradition comparing with the Civil Law in Brazil. Thus, the first chapter demonstrates the Enlightenment influx in Portugal, specially through the work of LUÍS ANTÓNIO VERNEY. Then, the influence of VERNEYS ideas and the reforms that took place by the hands of the Marquês de Pombal in Portugal was showed. The second chapter demonstrates the social and political modifications that happened in the Portuguese Empire after the opening of the Brazilian ports to the trade of the world. At this point, there was also a study on the impact of the these developments in the History of the Brazilian Commercial Law. The third and last chapter attempts to prove the influx of Enlightenment demonstrating that the Code of Commerce of 1850 adopts the subjective theory of cause which is the same as in the French Code Civil of 1804. Therefore, this work demonstrated how the Brazilian Commercial Law followed different juridical tradition in comparison with the Brazilian Civil Law.

Gerador de estímulos visuais naturalísticos para pesquisar o sistema visual de moscas / Naturalistic visual stimuli generator for research in the blowflys optical system

Este trabalho descreve o desenvolvimento e a validação de um gerador de estímulos visuais naturalísticos, GEN, utilizado em experimentos com o sistema visual de moscas. Tal gerador projeta a imagem em um anteparo que abrange todo o campo visual da mosca. Um espelho acoplado a um motor linear movimenta a imagem horizontalmente de acordo com velocidades predefinidas pelo experimentador. Ao contrário dos tradicionais geradores com monitores de raios catódicos - que apresentam imagens através de uma sequencia de quadros entre 60 e 200Hz - o GEN apresenta a imagem de forma contínua. Além de eliminar o problema das altas taxas de quadros por segundo exigidas nestes experimentos, o novo sistema também gera imagens com uma maior resolução, brilho e contraste. Durante a apresentação dos estímulos visuais foram registrados os potenciais de ação do neurônio H1 da mosca Chrysomya megacephala, localizado na placa lobular e responsável pela detecção de movimentos horizontais. Os resultados deste trabalho mostram como a resposta do neurônio estudado depende de parâmetros do estímulo tais como: velocidade, luminância, campo visual estimulado e frequência espacial da imagem utilizada. A influência destes parâmetros na resposta neural demonstram a importância de possuir geradores capazes de simular em laboratório estímulos que a mosca encontra em seu habitat natural. / This work presents the development and the validation of a naturalistic visual stimuli generator, NSG, to be used in neuroscience experiment with the flys visual system. To satisfy the requirement of naturalistic stimuli, the new generator projects a slide onto a screen covering the whole visual field of the fly. A mirror controlled by a linear electrical motor moves the image horizontally according to a predefined velocity profile. In addition, the NSG shows the image continuously as opposed to usual stimuli generators with cathode ray monitors having a frame rate between 60 and 200Hz. A further advantage of the NSG is its high luminance, brightness and contrast. During the stimulus presentations, the activity of the H1 neuron of the blowfly Chrysomya megacephala was recorded, this neuron is sensitive to horizontal image displacements. The results show how the response of the studied neuron depends on stimulus parameters such as speed, luminance, visual field stimulated and the spatial frequency of the image used. The influence of these parameters on neural response demonstrates the importance of generators that reproduces in laboratory the flys natural habitat.

Reception of the French Civil Code in Francophone Switzerland, Louisiana, and Quebec : a socio-legal study

The thesis studies the influence of the French Civil Code of 1804 on the civil codes of Quebec (the Civil Code of Lower Canada of 1866), Louisiana (the Civil Code of the State of Louisiana of 1825) and Francophone Switzerland (civil codes of cantons of Vaud of 1821, Valais of 1843-1855, Neuchâtel of 1853-1855, Fribourg of 1834-1850 as well as the French Civil Code as applied in two Swiss territories: the Canton of Geneva and Bernese Jura from 1804 until 1912). The study is focused not only on the reception of the positive law of one country by the positive law of another, but also on the reception of the legal tradition of one society by another. The study focuses on the modifications that the same law undergoes under different social and political conditions that exist within different nations. As it is impossible to examine all the provisions of the codes in question the research focuses only on the reception of the second book of the French Code “Of Property, and the Different Modifications of Ownership”. The study shows that, the reception of the French Civil Code took place in societies that were at different stages of their economic development, with varying political landscape, and with divergent cultural and religious values. In all jurisdictions the reception of the French Code was a creative, well thought-out enterprise that took into account local particularities and interests as well as historical sources of local law. Codifiers were not afraid of rejecting certain provisions of the French law if they found them unsuitable for their society. Nor were they afraid of keeping institutions that were abandoned in France itself if they found them pertinent to their countries.

A KMS Success Model : Investigating a Consulting Company’s Knowledge Management System and the Influence of Personalization and Codification

Abstract Purpose – The purpose of this paper is to investigate the success of a consulting agency’s KMS, examine the relationships between the factors constituting to its success, and explore possible effects of the knowledge management strategies codification and personalization on these correlations. Design/methodology/approach – This paper is a case study researching a Swedish consulting company’s KMS success using a KMS success model by Wu & Wang (2006). The survey’s results were interpreted using standard multiple regression analysis, which helped to investigate and interpret the correlations between the dimensions constituting KMS success. Findings – The findings in this paper suggest that personalization and codification have an influence on the quality of the correlations between the KMS success dimensions leaving the overall structure intact. Additionally the influence of System Quality on Perceived KMS Benefits and User Satisfaction on System Use were not found significant. Research limitations/implications – This study ‘s main limitiation is a sample size and the case study approach, which limit the generalizability of the results to other contexts. Practical implications – The most important implication of this research is the importance of the user for KMS success. A company needs to focus on improving the benefits a user receives from a KMS, which can mainly be achieved by improving the knowledge made available through the KMS, and by providing a proper basis for the KMS, in order to ensure a minimum level of System Quality. Other factors influencing the success of a KMS are incentives, which can help to increase system use and the quality of system use. Originality/value – The paper shows that when researching KMS success one should take the structure of the company’s knowledge management strategy into consideration. It further proves the applicability of the model in different contexts and its validity for accurately measuring KMS success.

Knowledge transfer when dealing with dysfunctional behavior : A study focused on the situation where customers misbehave against each other on social media

There is a current debate in Swedish media regarding the negative aspects of Internet and social media, a debate which is also virtual in blogs and forums. This started with a post on the clothing company H&M’s Facebook page where a user was virtually attacked in an aggressive manner by other users. This kind of online behavior between customers can be seen as a new challenge for organizations, especially as social media is continuously growing.   We have investigated the area of misbehaving customers, also known as dysfunctional customer behavior, by looking into the theoretical area of knowledge transfer. Within knowledge transfer we have focused on the strategies codification, which concerns transferring knowledge from people-to-documents, and personalization, meaning transferring knowledge from people-to-people.   Previous studies within knowledge transfer has investigated this in relation to different contexts, including how different context affects the transfer, how knowledge is transferred between organizations or within specific industries or businesses. However, there is a lack of research regarding knowledge transfer in relation to customers misbehaving. Hence, the purpose of this study was to understand if and how organizations work with a codification and/or personalization strategy for transferring knowledge when handling dysfunctional customer behavior on social media. By comparing the organizations we investigated reasons and underlying factors for their way of transferring knowledge.   In order to fulfill the purpose we made a qualitative research with four companies that are active on social media. We conducted semi-structured interviews with respondents holding both managerial positions as well as with employees working practically with social media.   Our study showed that both codification and personalization are used as knowledge transfer strategies when dealing with customers that misbehave on social media. The codification strategy is pursued by the use of databases, information-systems, guidelines and documentation. These methods were used to make knowledge available for all employees and to make work more effective. The personalization strategy is followed by talking to each other in person, via telephone, email or chat. This knowledge transfer strategy was pursued to exchange ideas in order to receive input and advice from one another.   We also found that when dealing with customers behaving badly towards other customers on social media, personalization holds a higher usage than codification. Further our study showed that three underlying factors affect the usage of the codification and personalization strategy, namely, closeness, previous experience and available knowledge transfer sources.

Health care decision-makers and knowledge management in the context of a regionalized health care system

Knowledge management is considered a necessary precursor to organizational success. This view is increasingly prevalent in the case of the health care sector. Two main knowledge management strategies are recognized: codification and personalization strategies. An organizations choice of knowledge management strategy depends on its objectives and the dominant form of knowledge informing its decision-making processes.<p>Health care decision-makers have access to a wealth of knowledge with which to inform their decisions. Little is known, however, about how the various types of knowledge are managed to optimize their use in decision-making. This study examines the knowledge management strategies of health care decision-makers working in the context of a regionalized health care system. The potential of communities of practice as a conceptual means for understanding health care knowledge management is also explored.<p>Members of Regional health authorities (RHAs) in the province of Saskatchewan constitute the unit of analysis for the study, which is guided by a qualitative research design. Interviews were used as the main data collection technique. For data analysis, open and axial coding methods based on the inductive and deductive approaches were adopted.<p>The study concludes that regional health authority (RHA) members utilize more fully explicit rather than tacit forms of knowledge. One of the main knowledge management practices adopted by the RHA members is the use of professional reports. This indicates that RHA members pursue a codification strategy more strongly than a personalization strategy. Moreover, it was found that the practices and strategies associated with managing knowledge were in place, despite the absence of a stated knowledge management policy. Finally, RHAs cannot be regarded as communities of practice, even though they exhibit many of their features.<p>Recommendations include the following: (1) the need for RHAs to institutionalize a knowledge management policy to guide their knowledge management processes and strategies, and (2) the cultivation of online communities of practice to marshal the tacit knowledge of RHA members, and that of the public, as an intervention to complement the use of explicit knowledge.
