Text in Afrikaans / Parralel met die snelle groei van rekenaartegnologie en die groteiwordende rol wat rekenaars in ans alledaagse lewe speel, is daar ongelukkig 'n toename in die misbruik van rekenaars. Benewens die wyses om rekenaarmisbruik by wyse van remedies in die siviele reg aan te spreek, is dit hoofsaaklik die taak van die strafreg om sodanige misbruik te kriminaliseer en deur middel van straf sulke misbruik te voorkom en oortreders af te skrik. Uit 'n ontleding van die Suid-Afrikaanse strafreg het dit geblyk dat bestaande misdrywe, beide gemeenregtelik en statuter, nie voldoende rekenaarmisbruik kan kriminaliseer en aanspreek nie. Wetgewing blyk die mees gepaste optossing te wees. Uit 'n regsvergelykende studie van die hantering van rekenaarmisbruik in jurisdiksies waar die wetgewer verskillende benaderings toegepas het, het dit geblyk dat die mees gepaste wyse om rekenaarmisbruik te kriminaliseer sal wees om ongemagtigde rekenaarbetreding as moedermisdaad te bestraf aangesien dit die fondament is waarop enige verdere misbruik van 'n rekenaar gebaseer word. Daarbenewens moet verdere meer spesifieke misbruikshandelinge wyd omskryfword as misdrywe, ten opsigte van meer emstige misbruik na betreding van 'n rekenaar / Parallel with the growth in computer technology and increasing use of computers, there has been an increase in computer misuse. In addition to addressing different methods of computer misuse in terms of civil law remedies, it is mainly the task of the criminal law to criminalise such misuse, prevent computer misuse and deter offenders by means of punishment. It was clear from a study of South African criminal law that existing offences, both statutory and in terms of the common law, do not criminalise and address computer misuse effectively. It therefore seems that legislation would be the most appropriate solution. It appeared from a comparative study of jurisdictions where legislators approach computer misuse differently, that the most effective way of criminalising computer misuse would be to criminalise una1,1thorised computer accessing as basic offence. The world reality has already transformed itself. What once in the past looked lame and took decades to change, now changes with a single click of a computer keyboard. We live nowadays a constant process of evolution of the world society where cultural and economic globalization makes its path into the virtual world of the Internet. The Internet phenomenon, called Web of webs, already impacts the human universe in unimaginable proportions through a digital convergence process where man interacts with another man, each time and more through an infinite virtual space that respects no cultural differences, geographical limits or State Sovereignties. The economic and cultural globalization of the societies also requires the globalization of the juridical thought as a whole in order to find efficient mechanisms and apply legal norms that last and endure beyond the territorial principles, especially when it concerns to Penal Law and Economic Law. In these terms, the present work intended to analyze, under the Economic Law view, the circumstances that involve the legal reparation of the victims from the crimes against the honor perpetrated on the Internet. From the law operator´s point of view the difficulties are enormous, even because Internet is a world phenomenon, homogeneous, countrywide and landless, with no spatial or geographical delimitations, and with immaterial consistency. It is a universe which has not been predicted by the traditional historic cultural reality of Law. The three-dimensional Theory that brought the fact, the value and the norm, now faces the challenge of dealing with a social reality far different from what existed decades ago. The Internet phenomenon is still little known among us, but Law has to adapt as fast as possible to this new Era of virtuality. It is from this adjustment capacity and projection of valid and efficient legal norms to the virtual universe of the Web of webs that emerges the necessary juridical safety to the national judicial systems of each country in the world. This work aims to contribute uniquely with the discussion and the possible and viable solutions of questions related to the economic consequences that come up with the practice of crimes against the honor of people through the World Wide Web. The Internet, as we know it today, represents the technology of freedom, and this is good. What brings up such discussions and what one tries to avoid is the risk of the ineffectiveness of Law towards the illicit conducts and the old and new outlaw behaviors that currently occur in its virtual space that if not hold back, cause economic and social injuries witch bring discomfort and juridical insecurity to millions of people. / A humanidade como um todo passa por um processo rápido e contínuo de mudança nas esferas social, econômica e política. A realidade mundial já se transformou. O que outrora parecia lento e perdurava décadas para mudar, hoje avança com um simples apertar de um botão de computador. Vivemos atualmente um processo evolutivo da sociedade mundial em torno da globalização cultural e econômica em que o caminho mais rápido faz-se por meio do mundo virtual da Internet. O fenômeno da Internet, rede das redes, já impacta o universo humano em proporções jamais imagináveis, através de um processo de convergência digital em que o homem cada vez mais interage com outro homem por entre um espaço virtual infinito que não respeita as diferenças culturais, geográficas ou de soberanias de Estado. A globalização da economia e das culturas das sociedades também exige a globalização do pensamento jurídico, de modo a que possamos encontrar mecanismos eficientes de aplicação de normas que vigorem além dos princípios da territorialidade, sobremaneira no tocante ao Direito Penal e ao Direito Econômico. Neste diapasão, o presente trabalho objetivou analisar, sob a ótica do Direito Econômico, as circunstâncias que envolvem a reparação às vítimas dos crimes contra a honra praticados no âmbito da Internet. Do ponto de vista do aplicador do direito, as dificuldades são enormes no sentido de que a Internet é um fenômeno mundial, homogêneo, apátrida, sem qualquer delimitação espacial ou geográfica e de consistência imaterial. É um universo que não foi previsto pela tradicional realidade histórico-cultural do direito. A teoria tridimensional que trouxe o fato, o valor e a norma, agora encara o desafio de lidar com uma realidade social bastante diferente do que se tinha até algumas décadas. O fenômeno da Internet ainda é pouco conhecido entre nós, mas o Direito tem que se adequar rapidamente a essa nova era da virtualidade. É dessa capacidade de adequação e de projeção de normas válidas e eficazes para o universo virtual da rede das redes que decorre a segurança jurídica necessária aos ordenamentos jurídicos nacionais de cada país. Este trabalho visa a contribuir singularmente com a discussão e as possíveis e viáveis soluções para o deslinde de questões que envolvem as consequências econômicas ocasionadas quando crimes contra a honra das pessoas são perpetrados por meio da rede mundial de computadores. A Internet, como até o momento sabemos, é a tecnologia da liberdade, e isso é bom. O que se tenta discutir e combater é o risco da não efetividade do Direito em abranger comportamentos e condutas ilícitas, velhas e novas, que ocorrem diariamente no âmbito da virtualidade da rede e que, se não reprimidos, geram prejuízos sociais, econômicos, desconforto e insegurança jurídica a milhões de pessoas.

Il semble aujourd'hui possible de considérer que le numérique et le cyberespace ont complètement changé les rapports de force dans notre société moderne. En se numérisant, la société permet à ses membres un accès quasi illimité et instantané à des millions de ressources et données. Par ailleurs, il facilite largement les relations personnelles et professionnelles entre les individus. Si le numérique peut être présenté comme une véritable révolution, celui-ci expose son utilisateur à de nouvelles vulnérabilités, à de nouveaux risques. Le droit pénal, en ce qu'il régit la société et choisit les valeurs sociales à protéger, s'est donc intéressé au développement du numérique et à ses conséquences. La présente étude constate un arsenal législatif étendu pour lutter le plus efficacement possible contre la délinquance numérique. Néanmoins, l'analyse observe qu'il existe de nombreux obstacles à l'application du droit pénal au cyberespace en raison des particularités liées aux réseaux. La délinquance numérique n'est, en outre, pas la seule menace générée par le numérique, puisque désormais, il est possible de parler du cyberespace comme d'un nouvel espace de confrontation. Ainsi, à la délinquance numérique s'ajoute la menace militaire puisque les États investissent les réseaux par la mise en place d'armes numériques. Il s'agit alors de s'interroger sur la pertinence de ces choix étatiques et sur les solutions permettant d'accentuer la lutte contre la délinquance numérique. / Today, it seems possible to consider that digital technology and cyberspace have completely changed the balance of power in our modern society. By digitizing, the society gives its members almost unlimited access to millions of resources and data. Digital technology also facilitates personal and professional relationships between individuals. If digital technology can be presented as a real revolution, it exposes its user to new vulnerabilities and risks. The criminal law, insofar as it governs society and chooses the social values to be protected, has therefore been concerned with the development of digital technology. The present study notes the extensive legislative arsenal for fighting in the most effective manner against digital delinquency. Nevertheless, the analysis observes that many obstacles are against the application of criminal law into the cyberspace because of networks particularities. Moreover, digital crime is not the only threat generated by digital technology, since it is now possible to consider the cyberspace as a new space for confrontation. Thus, military threat is added to digital delinquency as the States set up electronics weapons into networks. Then, the arised question is about the relevance of these state choices and the solutions to intensify the fight against digital delinquency.

Právní aspekty boje proti počítačové trestné činnosti / Legal Aspects of Fighting Cybercrime

The thesis deals with the topic of computer crime. Foremost, it demonstrates on an example of the operation of a medical image information processing system some selected aspects of this issue. It shows that it is always necessary to monitor the current state of the technical knowledge at the time, but also the need of addressing the issue within the corresponding legal limits. The thesis presents criminal law reality as a complex system. The links between different parts of the system are examined, and possible shortcomings are considered. The legal instruments and legal limits of the procedures that can be used against cybercrime are evaluated. The thesis focuses especially on the issue of obtaining evidence under the Czech Criminal Procedure Code. It presents a proposal on how to understand individual procedural legal institutes and for what purposes and how to use them. Consequently it suggests legal procedures for specific selected practical situations.

Resolving the Password Security Purgatory in the Contexts of Technology, Security and Human Factors

Yes / Passwords are the most popular and constitute the first line of defence in computer-based security systems; despite the existence of more attack-resistant authentication schemes. In order to enhance password security, it is imperative to strike a balance between having enough rules to maintain good security and not having too many rules that would compel users to take evasive actions which would, in turn, compromise security. It is noted that the human factor is the most critical element in the security system for at least three possible reasons; it is the weakest link, the only factor that exercises initiatives, as well as the factor that transcends all the other elements of the entire system. This illustrates the significance of social engineering in security designs, and the fact that security is indeed a function of both technology and human factors; bearing in mind the fact that there can be no technical hacking in vacuum. This paper examines the current divergence among security engineers as regards the rules governing best practices in the use of passwords: should they be written down or memorized; changed frequently or remain permanent? It also attempts to elucidate the facts surrounding some of the myths associated with computer security. This paper posits that destitution of requisite balance between the factors of technology and factors of humanity is responsible for the purgatory posture of password security related problems. It is thus recommended that, in the handling of password security issues, human factors should be given priority over technological factors. The paper proposes the use of the (k, n)-Threshold Scheme, such as the Shamir’s secret-sharing scheme, to enhance the security of the password repository. This presupposes an inclination towards writing down the password: after all, Diamond, Platinum, Gold and Silver are not memorised; they are stored. / Petroleum Technology Development Fund

Elle doit faire face à la cybercriminalité qui se joue du temps, de l’espace et des législations puisque les actes illicites se déroulent désormais dans le cyberespace. Mais, pour que le système de justice pénale puisse contribuer efficacement à la lutte contre la cybercriminalité, les États doivent pouvoir s’appuyer sur un ensemble de règles juridiques contre cette criminalité et des systèmes de justice pénale qui fonctionnent correctement, doivent avoir les capacités nécessaires pour démêler les affaires pénales qui peuvent être complexes et coopérer à la répression de la cybercriminalité au plan international / Nowdays, Criminal justice is confronted to digital and the development of dematerialized data, whose heritage value is still increasing, raise challenges of ideological, sociological, economical, geopolitical and of course legal nature. Time Orientation, Rational Choice and Deterrence: an Information Systems Perspective

The present study examines General Deterrence Theory (GDT) and its "parent," Rational Choice Theory (RCT), in an information security setting, assessing the behavioral intent to violate organizational policy under varying levels of certainty, severity and celerity of negative sanction. Also assessed is the individual computer user's time orientation, as measured by the Consideration of Future Consequences (CFC) instrument (Strathman et. al, 1994). How does rational consideration of violation rewards influence the impact of sanctions on individuals? How does time orientation impact intent to violate security policy? How do these operate in an IS context? These questions are examined by assessing the responses of university students (N = 443) to experimental manipulations of sanctions and rewards. Answering vignettes with the factorial survey method, intent to violate is assessed in a setting of Internet piracy of electronic textbooks while being monitored by computer security systems. Findings show that, although traditional GDT variables and reward impact intent to violate, CFC does not cause the hypothesized moderating effect on these variables. However, post-hoc analysis reveals a direct effect of time orientation on behavioral intent, as well as a weak moderating effect opposite of the hypotheses, indicating increased time orientation positively moderates, rather than negatively moderates, the impact of reward on intent to violate. Implications for theory and practice, and future research directions, are discussed.
