The latter considered as a punitive and mainly preventive measure in order to fight malicious disposal of marital estates. First, however, this study presents a brief analysis of the evolution of the family, the concept of heritage and the principles bound to property rights of family relationships. This will enable a better understanding of some rules of conduct that are, in most cases, overlooked by participants of these relations and will also stress the need for better protection of the dignity of the spouses at the time of the breakup of romantic relationships. Finally, this investigation points out the kinds of property regimes and the rules allotted to each one by the legal system, the procedures related to inventory and asset sharing applicable to any kind of asset division, the regulation of the penalty for property concealing which cannot be left out from the category that most cries out for protection and the defect of legal acts in property division / O presente trabalho aborda algumas espécies de fraudes patrimoniais cometidas quando da dissolução do matrimônio, os instrumentos legais existentes para reverter ou minimizar os prejuízos sofridos e, por fim, a viabilidade de aplicação da pena de sonegados nas partilhas decorrentes do divórcio, como medida punitiva, e principalmente, preventiva de combate ao malicioso esvaziamento patrimonial. Antes disso, contudo, expõe uma breve análise da evolução da família, o conceito de patrimônio e os princípios vinculados ao direito patrimonial das relações familiares, para melhor compreensão acerca das regras de conduta esquecidas, na maioria das vezes, pelos partícipes destas relações, bem como para ressalvar a necessidade de maior proteção da dignidade dos cônjuges no momento do rompimento dos relacionamentos amorosos. Aponta as espécies de regimes de bens e o regulamento dado a cada um pelo ordenamento jurídico, bem como o procedimento de inventário e partilha, aplicáveis para qualquer espécie de divisão patrimonial, o regramento do instituto dos sonegados, o qual não há razão de ser afastado da categoria que mais clama por proteção, e os defeitos do negócio jurídico recorrentes nas partilhas de bens

Adolescents' and young adults' lived experience of living with IBD and an ostomy

According to the Crohn’s and Colitis Foundation of Canada, there is approximately 1 in every 200 individuals who is living with inflammatory bowel disease (IBD). Many of those living with IBD also need to have an ostomy. The literature on the effects IBD and an ostomy has on adolescents and young adults lacks consensus. Therefore, the purpose of this phenomenological study was to try to understand the lived experiences of adolescents and young adults (N=6) living with IBD and an ostomy. Sociodemographic information was collected, and the participants were interviewed in person using a semi-structured interview guide. The work of van Manen (1990) was used as a guide for data collection, analysis and interpretation of this study. Analysis revealed the essence of the adolescents’ and young adults’ lived experience as being “Concealing and Revealing the Self”. Three themes communicate the essence of their lived experience: (a) Uneasy feelings, (b) “It’s hard…”, and (c) A renewed sense of self. The needs of the adolescents and young adults, along with their recommendations to health care providers, are addressed. The study findings inform nurses in the areas of practice, education and research. Practice recommendations include being cognizant that these individuals need holistic care that addresses their psychological, psychosocial and physical needs. This study forms the basis for future research to explore some of the themes in greater detail, as well as a recommendation for a longitudinal study. / February 2008

Revealing and Concealing Hitler's Visual Discourse: Considering "Forbidden" Images with Rhetorics of Display

Typically, when considering Adolf Hitler, we see him in one of two ways: A parodied figure or a monolithic figure of power. I argue that instead of only viewing images of Hitler he wanted us to see, we should expand our view and overall consideration of images he did not want his audiences to bear witness. By examining a collection of photographs that Hitler censored from his audiences, I question what remains hidden about Hitler’s image when we are constantly shown widely circulated images of Hitler. To satisfy this inquiry, I utilize rhetorics of display to argue that when we analyze and include these hidden images into the Hitlerian visual discourse, we further complicate and disrupt the Hitler Myth. This study aims to contribute to recent scholarship that aims to learn more about the “hidden” Hitler as well as to rhetorical studies of display.

<p>Careers education was first established in Sweden at the beginning of the 1940s. At that time it was mainly the concern of the Swedish Labour Market Board. The Labour Market Board started to develop a model, partly influenced by the activities of other countries in the field, that over the years grew into something exceptional with for instance a lot of activities in schools.</p><p>In the early stages the aim was the development and production of informational texts. The person behind most of the ideas was Einar Neymark. In 1971, responsibility for careers education was handed over to the school authorities except for the part concerning the production of occupational information texts.</p><p>The aim of this study is to improve our understanding of careers education as it is represented in occupational information texts produced by the Swedish Labour Market Board, in the period from 1940 - 1970.</p><p>The empirical research focuses on careers education and gaining an understanding through the texts within (not about) careers education. The research has a philosophical-hermeneutic orientation and falls into two parts. Starting from an assumption that the intentions behind careers education are met, three “careers education realities” are constructed for the sake of argument. These realities are then analysed using a theoretical framework grounded in educational sociology, or more precisely the thinking of Durkheim and Bernstein. The result shows that careers education plays an important role in making invisible the connection between school and society hierarchies and also in creating a collective conscience in a Durkheimian sense.</p><p>The first constructed “reality” shows that a careers education based on labour market considerations is both normative and deterministic. In this careers education the labour market consists of a variety of working lives depending on who you are and where you come from. For that reason careers education is both limiting and subordinating according to sex and class background.</p><p>A consciousness-raising careers education is moralizing and limiting. A “perfect” working life is presented to which individuals can relate their personal qualities. For that reason careers education also subordinates.</p><p>A study-motivating careers education is principally motivating for those who have already had good experiences of schooling. It limits and subordinates primarely in terms of sex. Possible relations between education and working life are mostly discussed in general terms. For example, education will be a good thing to have in a future working life as an insurance against unemployment.</p><p>The extended analysis, where the above mentioned results are put together, shows that careers education can be described as unjust, limiting and concealing. It is unfair in that it creates images about different and non-questionable working lives for young people to fit into, in that it perpetuates sex and class subordination, and in that it uses present individually related competencies as the grounds for future education and employment. It is limiting through being normative, moralizing and subordinating. It is concealing in that it is being selective concerning the information given in the texts prepared for pupils.</p><p>Careers education is also adjustable. It fits easily into different situations by being pragmatic and flexible, as is shown by the impact of other scientific areas. This adjustability makes it possible to use careers education regardless of the conception you may have of career choices or wherever careers education is carried out. Being adjustable is not something to be avoided in careers education, on the contrary it is a condition for its existence.</p>

The Challenges Of Young-typed Jobs And How Older Workers Adapt

This study sought to explore the challenges faced by older workers who do not fit the age-type of their jobs and how older workers adapt to overcome those challenges. Specifically, I surveyed a national sample of 227 workers 50 years of age and older, in a wide variety of jobs, on measures of perceived age discrimination and adaptation behaviors. I found that fit, as determined by career timetables theory, but not prototype matching theory, successfully predicted perceived age discrimination. Specifically, more age discrimination was perceived when fewer older workers occupied a job. Additionally, multiple regression analysis showed that career timetables theory, prototype matching theory, and measures of perceived discrimination interacted to predict adaptation behaviors. That is, older workers made more efforts appear younger at work when they perceived age discrimination in jobs occupied by fewer older workers and older women expressed greater desires to appear younger at work when they perceived age discrimination in jobs viewed as more appropriate for younger workers. Although older workers made a wide variety of efforts to appear younger at work, from changing the way they dressed to undergoing surgical procedures, the adaptation efforts believed to be the most effective against age discrimination were more oriented toward enhancing job performance than one’s appearance. It is especially troubling that greater perceived age discrimination was found in young-typed jobs (than in old-typed jobs) given that the number of older workers occupying young-typed jobs is expected to rapidly grow in the near future and perceived discrimination is associated with mental and physical consequences for older adults. Understanding effective adaptations to age discrimination is a valuable first step in helping older workers overcome the iv disadvantages they may face in the workplace, especially when they occupy young-typed jobs. Implications for theory and research are discussed
