Contemporary collegiate debate demonstrates a crisis in pedagogy as seen in a history of "fractionation through structural fortification". This lack of a sustainable pedagogical community has proven to critically strain the resources and curricula of academic debate. Conflict Navigation (CN) represents a behavior-based approach to conflict with an emphasis on ethical rhetoric. Intento, desse modo, investigar, em situação de formalidade, as estratégias argumentativointeracionais utilizadas pelo Promotor de Justiça e pelo Advogado de Defesa para apresentar e defender seus pontos de vista. Valho-me, para interpretar os dados deste trabalho, da Sociolinguística Interacional, da Análise do Discurso e da Pragmática. Sirvo-me, como recurso metodológico nesta pesquisa qualitativa, das orientações da Etnografia da Comunicação e da técnicas da Análise da Conversação. Analiso a argumentação do Promotor de Justiça e do Advogado de Defesa sob o enfoque da argumentação discursiva, englobando a tríade aristotélica ethos, pathos e logos. Como resultados de pesquisa, identifiquei cinco parâmetros que caracterizam a formalidade no Tribunal do Júri – elaboração do código, turnos conversacionais, cinésica, negociação de identidade e contexto situacional. Além disso, detectei seis estratégias argumentativo-interacionais utilizadas pelos atores sociais no contexto investigado. Três delas referem-se à tríade aristotélica. São elas: ethos: a negociação de identidades; pathos: o sentimento; logos: a legitimação. Partindo dessas noções, discuti outras três estratégias: facilitador/complicador na inquirição de testemunhas; os questionamentos informativos; e a inquirição acelerada. Espero que, com esta Dissertação, os interagentes possam melhor compreender suas interações, utilizando-se de forma satisfatória dos recursos de que dispõem. A pesquisa pode contribuir, ainda, para o entendimento de como se constitui a formalidade e como se dá a organização da argumentação do Promotor de Justiça e do Advogado de Defesa no Tribunal do Júri. _______________________________________________________________________________________ ABSTRACT / The jury´s trial presents several peculiarities, including the use of any legal aspect that can lead to convincing the jurymen. So, I intend to investigate, in formality form the interrational argumentative strategies used by the Prosecutor and by the defense Lawyer to present and support their views. To interpret the data from this work, I relied on the Interrational Sociolinguistic, on the Analysis of the Speech and on the Pragmatic Theory. As a methodological source, I used in this qualitative research the perspective of the Ethnography of Communication and of the Conversation Analysis. I analyze the prosecutor´s and the defense lawyer´s argumentation focusing on the discursive reasoning, in wich it aboards the Aristotelian triad ethos, pathos and logos. In order to establish the parameters to characterize the formal speech. I identify six argumenative-interrational strategies used by the subjects of this research, three of them refer to the Aristotelian triad. They are: ethos the negotiation of identities; pathos the feeling and logos the legimitation. From these notions, I have discussed other three strategies: facilitator/complicator in the inquisition of witnesses; the informative questioning and the speeded inquisitions. From this essay, I expect a better comprehension on the interactions, utilizing the satisfactory form of the resources available.

Comprenant que l'action argumentative est le résultat d'un travail d'interaction entre les interlocuteurs, les mécanismes paraphrastiques, comme on l'a dit, n' accomplissent pas seulement la fonction de fixer le senso Dans ce mouvement, des sens s'ouvrent, permettant au texte d' avancer dans une direction donnée, determineé par l' orientation argumentative. A partir d'une telle compréhension, on soutient que le processus de formulation textuel ne découle pas de la simple juxtaposition d'énoncés. Ce sont les projets des interlocuteurs défendant leur thêse qui déterminent les choix de formulation et reformulation. C'est parce que le locuteur atlend une réplique de l'autre, comme le soutient Bakhtine, qu'il décide de reformuler des énoncés d'une maniêre et non d' une autre, orientant l' interlocuteur vers les conclusions désirées. C' est ainsi que l' organisation textuelle n' est pas gratuite, mais motivée par un vouloir-dire, au sens bakhtinien du terme. Celui qui parle a un but à atleindre, et son discours est planifié dans l'interlocution, de maniêre à ce que les ressources expressives s'organisent avec cohérence en direction de ce but Ainsi, nons soutenons que la paraphraseest une activité argumentative / Resumo: O presente trabalho, ocupando-se de textos orais produzidos no interior da universidade, estabelece como objeto de estudo os mecanismos parafrásticos, considerados como atividades de reformulação textual que atuam decisivamente como estratégias argumentativas no fazer textual. Compreendendo que a ação argumentativa é resultado de um trabalho da interação entre os interlocutores, defende-se a posição de que os mecanismos parafrásticos, ao retomarem um jádito, não cumprem apenas a função de fixar sentidos. Nesse movimento, abrem-se sentidos, permitindo que o texto avance para uma dada direção, movido pela orientação argumentativa. Por essa via de compreensão, prevalece a defesa de que o processo de formulação textual não decorre da simples justaposição de enunciados. Os propósitos que movem os interlocutores é que determinam as escolhas de formulação e reformulação. É porque o locutor espera uma contrapalavra do outro, como defende Bakhtin, que ele decide reformular enunciados de um jeito e não de outro, orientando o interlocutor para as conclusões desejadas. Assim sendo, a organização textual não é gratuita, mas motivada por um querer-dizer, na visão bakhtiniana do termo. O falante tem um propósito a atingir, e seu discurso é planejado na interlocução, de maneira que os recursos expressivos se organizam coesivamente em direção a esse propósito. Discursive strategies for political survival : a critical discourse analysis of Thai no confidence debates

This thesis argues that the aggressive and informal style of discourse used in Thai parliamentary debates is a product of the Thai political sphere, serving clear functions In its context. Adopting the approach of Critical Discourse Analysis, the thesis presents discourse as socially constituted as well as socially constitutive. The research employs a two level analysis to explore this hypothesis. At the macro level, Critical Discourse Analysis and the Sociocognitive Approach are operationalised to investigate the socio-political conditions that prompt this 'unparliamentary' mode of parliamentary discourse. At the micro level, politeness theory and pragmatics are employed to investigate the potential functions that small linguistic features may serve under such social conditions. Five sample accusatory speeches and two sample respondent speeches from recent debates are selected for close textual analysis using this approach. It is argued that the unparliamentary style of the debates' discourse is the result of discursive strategies used in politicians' speeches. These strategies are textual evidence of sociocultural practice and discourse practice. They reflect the speakers' attempts to subvert three competing conjunctures in the Thai political domain: the debate's formal and actual purposes, its Code of Behaviour, and its multiple audiences. Debaters need to balance three contending purposes: the desire of highly partisan participants to cause maximum damage to the opposing side, their attempts to seek public support (including the maintenance of face), and their need to stay within the parliamentary Code of Behaviour. This thesis identifies a number of strategies that potentially serve these conflicting purposes, for example, intertextuality, enthymeme and prolepsis/disclaimer. These findings lead to the conclusion that an unparliamentary debating style, constituted of small, seemingly insignificant linguistic features, carries larger social implications. Despite being a reflection of social conditions, this debating style has the potential to redefine these conditions. Thai no-confidence debates offer an accomplished parliamentary speaker the opportunity to achieve apparently contradictory political and linguistic ends, within the same tightly-crafted speech.
