The European Accounting Directives : Status of the Fourth and Seventh Company Directives after implementation of Directive 2009/49/EC

Rehn, Patrik January 2010 (has links)
This thesis examines the effects from Directive 2009/49/EC. This directive amend the Fourth and Seventh Company Directives, the Accounting Directives, regarding the information that Small and Medium-sized Enterprises (SME) have to present in notes connected to both the annual reports and notes to the consolidated accounts, in situations with subsidiaries when its necessary to draw up consolidated accounts. The Accounting Directives does not affect all companies, almost only private limited liability companies, is this type of companies the only one discussed. Directive 2009/49/EC is not affecting all sizes of private limited liability companies within the European Union, since the most important reason for implementing it is to give SMEs less administrative burden by lower requirements regarding the information presented in notes attached to the reports. The implementation of Directive 2009/49EC is a positive change since it is in line with the idea of an Internal Market with equal rights and obligations to all sized of limited liability companies, private or public. The lower obligations in the annual reports in the Fourth Directive are for SMEs to the better because of the less administrative burden and the loss of information for interested is not more important, but of course, for some it is crucial. Amending the Seventh Directive may have larger effect to some companies, most likely medium-sized SMEs, since the obligation to draw consolidated accounts will for some companies not be necessary.

Advance directives or living wills- some reflections from general practitioners and frail care coordinators in a small town in KwaZulu Natal

Bull, A. P. A. 23 July 2015 (has links)
Background: - Living wills have long been associated with end-of- life care. This study explored the promotion and use of living wills amongst general practitioners and frail care nursing coordinators directly involved in the care of the elderly in Howick, Kwa-Zulu Natal. The study also explored their views regarding the proforma living will disseminated by the Living Will Society. Participants: - Seven general practitioners and three frail care nursing coordinators, making ten in total. Design: - Qualitative in-depth interviews and analysis, using the Framework method. Results:- Both doctors and nursing staff understood the concept of living wills and acknowledged their varied benefits to patient, family and staff. They were concerned about the lack of legal status. They felt that the proforma document from the Living Will Society was simple and clear. Despite identifying the low level of use of living wills, they felt that third party organisations and individuals should promote living wills Conclusion: - GPs and frail care nurse coordinators were knowledgeable of living wills in general and the Living Will Society proforma document in particular. They valued the contribution that living wills can make in the care of the elderly, benefitting patients, their families, health care workers and even the health system. They also valued the proforma living will document from the Living Will Society for its clarity and simplicity. However, both GPs and frail care nursing coordinators viewed the living will process as patient- driven and their main role was as custodians and not advocates of the living will.

Performing directives in Spanish: The case of advice by Nicaraguan and Panamanian women

January 2012 (has links)
abstract: Although pragmatic analyses based on empirical data have been conducted throughout most of the Spanish-speaking world, Central America remains the most underrepresented region. This study examines the pragmatic strategies used by female Spanish speakers of Nicaragua and Panama in an advice-giving context. The data consists of eighteen role-plays recorded in Masaya, Nicaragua and Panama City, Panama in June and July of 2011. In the role-play situation, the interlocutor (fixed-role) requests advice from the participant, her best friend, regarding a serious issue in her marriage. The participant's advice-giving strategies are classified according to a categorization adapted from Blum-Kulka's request strategy taxonomy. This allows for a statistical analysis of how these strategies correspond to the three elements of Spencer Oatey's rapport management approach: behavioral expectations, face sensitivities and interactional wants. The results indicate strong similarities between participants from Nicaragua and Panama, both electing to respect all components of the association principle and to violate the equity principle, especially its autonomy control component. These results suggest that, at least in this advice-giving context between intimates, both Nicaraguan and Panamanian Spanish speakers prefer to impose their opinions and suggestions rather than respect the person's right to be treated fairly (i.e. equity principle) as well as to maintain a rapport-enhancing orientation rather than preserve their right to associate with others (i.e. association principle). The results of the pragmatic analysis show similarities with other research on directives in the Spanish-speaking world, including empirical studies in the Dominican Republic, Cuba, Venezuela and Spain. Specifically, these cultures are all associated with direct strategies and less mitigation, positive politeness, conventional indirectness and high involvement. / Dissertation/Thesis / M.A. Spanish 2012

Les normes internationales qui prescrivent l'existence ou l'inexistence d'une règle interne / The international norms which prescribe the validity or the invalidity of an internal rule

Meunier, Hugo 10 December 2012 (has links)
This thesis establishes a general theory of international norms which prescribe the validity or the invalidity of an internal rule. This research, the first of its sort to be undertaken in international legal doctrine, follows two principal lines of enquiry. Firstly, it demonstrates that the concept of international norms which prescribe the validity or the invalidity of an internal rule provide a basis on which to describe a fundamental part of positive international law, usually presented by mean of well-know others concepts as the principle of primacy or superiority of the international law, and the conflict or contradiction between international law and internal law. Secondly, this thesis draws on more than 250 legal instruments and 750 judgments, relating principally to business law, environmental law, human-rights law, criminal law, labour law and European Union law, to illustrate the existence of a coherent regime governing all international norms prescribing the validity or the invalidity of an internal rule.
