O trabalho trata da abordagem da delinqüência frente à sociedade informática e dos riscos trazidos pelas tecnologias, estimuladoras da prática do delito por conta de suas características especiais. Tal análise concluirá que as condutas praticadas na nova realidade apontam para a necessidade de adaptação do Direito Penal pela criação de novos valores e, então, novo bem jurídico a ser protegido. Em seguida, frente aos principais delitos tipificados nos ordenamentos jurídicos, será apresentada a vitimodogmática que servirá de instrumento para uma interpretação das figuras penais sob a ótica de sua gênese e a contribuição que a vítima tem em tal processo. / This study is about the delinquency considering the informatic society and the risks posed by technology, stimulating crime occurence due to its special characteristics. This analysis concludes that the conduct charged in new environment points to the need of reorganizing criminal law through the creation of new values and new rights to be protected. Therefore, facing the main crime concerns in legal systems, the victimodogmatic will be presented as an instrument for the interpretation of criminal figures from the perspective of its genesis and the contribution that the victim has in this process.

Polsk poesi under mellankrigstiden: ett paradigmskifte : Exempel marialyriken / Polish Interwar Poetry: A Paradigm Shift : The Case of Marian Lyrics

The dissertation examines how medieval poetic tradition was reactivated in the production of poetry from the period between the two world wars—the Polish interwar period, defined here as one of literary transition. The positioning in regard to certain literary conventions and the quest for a new normativity that is so prevalent in interwar poetry is also reflected in the era’s poetry on the theme of Mary. Marian lyrics, owing to their strong position in Polish literature (but also by dint of their role in Polish piety and national identity), serve as an indicator in identifying and defining certain poetic processes. Central to this are the respective relationships of Marian themes to tradition and to the poetic norms of the era: is a given poem located along the traditional axis (if so, which), does it run counter to it, or is it an innovation? The poems analysed—Julian Przyboś’ Heavenly Blue, Jerzy Liebert’s Litany to the Virgin Mary, Tytus Czyżewski’s De profundis, Maria Pawlikowska-Jasnorzewska’s The Black Portrait, Józef Czechowicz’ pious rhymes—represent disparate poetic models: the Krakow Avant-garde, Catholic literature, formism/futurism, the circle of Skamander, the Poetics of the Third Sphere in the Second Avant-garde. Reflected here is the broad spectrum of the period’s poetic trends, tendencies, and constellations—as are the historical and literary events of the era. Despite important differences in the poetic/aesthetic models, in these poems it is possible to identify shared characteristics relevant to this study, that is, elements of medieval poetry. The identifying criterion for these elements here is the concept of dogmatic formal language. In the poems medieval poetics are transformed into their own modern form and integrated into the respective poetic models. No other literary epoch offers what the poets are seeking better than poetic formal language modelled on medieval liturgical language. The five poets all participate in what has been called the interwar paradigm shift in Polish poetry—a parameter that only indirectly relates to modernism. The term high modernism (in the sense of the culmination of Polish poetic modernism) can serve to summarize the historical and literary delimitations and definitions in the study. As interwar poetry is indeed part of the definitive emergence and full expansion of modernism in Polish literature, serving as a link between tradition and innovation, such a study of the influence of high modernism and Marian lyrics on each other aspires to reflect general processes in the poetry of the time.

Orientador: Lúcio Lourenço Prado / Banca: Ubirajara Rancan de Azevedo Marques / Banca: Paulo Roberto Licht dos Santos / Resumo: A pesquisa pretende abordar os escritos da década de 1760, da filosofia kantiana, com o intuito de apontar quais os elementos de cunho crítico presentes nesses escritos, que desembocam na obra Sonhos de um visionário explicados por sonhos da metafísica (1766). No ano de 1763, com o Único argumento possível para uma demonstração da prova da existência de Deus e com o Ensaio para introduzir a noção de grandezas negativas em filosofia, Kant aponta para o papel da experiência na existência do simples possível e para o papel da oposição real para os acontecimentos da ordem fenomenal. Tem-se, por parte de Kant, uma preocupação com o estatuto da metafísica tradicional que se apoia em provas não concretas e busca, por meio de inferência e pelo princípio de contradição, mostrar a ordem do mundo e a existência do real. Nesse sentido, Kant começa a engendrar uma crítica ao racionalismo de cunho dogmático, em especial à escola Leibniz-wolffiana, tendo como influências as inovações da ciência newtoniana e o ceticismo de David Hume. Assim, é possível encontrar nos Sonhos de um visionário pistas que conduzem à interpretação da obra como um fechamento da filosofia pré-crítica de Kant, abrindo as portas para o criticismo presente na Dissertação de 1770, segundo o próprio autor (Carta a Tieftrunk em 1797). Tendo em vista a década de sessenta como um suposto período que configura o criticismo kantiano, a investigação busca, ainda, apontar os elementos que desembocam nos Sonhos e, a partir desse escrito, mostrar as consequências desses elementos para o contexto da própria Dissertação de 1770 e da Crítica da razão pura (1781). Ao final, esboçaremos uma reflexão acerca da existência ou não de um marco que separa a filosofia kantiana em período précrítico e crítico, tentando, ao menos, interpretar os escritos anteriores à Crítica da razão pura como escritos pré-Crítica e não mais como escritos / Abstract: This research intends to approach some Kantian philosophy written from 1760's decade, with the aim of pointing out what are the critical nature elements present on them, which culminate in the work Dreams of a Spirit-Seer elucidated by dreams of metaphysics (1766). In 1763, with The only possible argument in support of a demonstration of the existence of god (Beweisgrund) and with the Attempt to introduce the concept of negative magnitudes into philosophy, Kant points the role of experience in existence of the simple possibile and to the role of the truth opposition to the happenings in a phenomenical order. It has, from Kant position, a worry about the metaphysical traditional constitution that supports itself on not concrete proofs and seeks, throughout inferences and by contradiction principle, to show the order of the world and the existence of the real. In this sense, Kant begins to engender a criticism to dogmatic rationalism, in special to Wolffian-Leibniz school, supporting your ideas on innovation of Newtonian science and Humean skepticism. In so far, it is possible find out, at Dreams of a Spirit-Seer, "clues" that leads to its interpretation as a closure of the Kantian pre-critic philosophy and opening the doors to the criticism present in the Dissertation of 1770, according own author (Letter to Tieftrunk in 1797). In the end, we will sketch a reasoning on the existence, or not, of a landmark that separates Kantian philosophy in pre-critical period and a critical one, trying to, at least, understand the previous written to Critic of Pure Reason as pre-critical written and not as a critical ones / Mestre

Ainda que as diretrizes e normativas educacionais acerca do ensino da filosofia aventassem para sua potência em romper com os dispositivos de transmissão e aquisição mecânica de conteúdos, o modelo institucionalizado deste ensino permanece, ainda hoje, refém de uma dimensão reprodutivista de caráter explicador. Este paradigma pouco contestado, a saber, a lógica da explicação, é responsável por instaurar no ensino um dualismo cego, a partir do qual as modulações do aprendizado do estudante devem necessariamente estar sujeitas à manifestação das explicações e representações de um professor. Desse modo, a função do ensino deixou de se projetar em direção à promoção de uma experiência filosófica, assumindo a tarefa de conformar o pensamento a uma ortodoxia filosófica, restringindo a potência do filosofar a uma imagem distorcida do próprio pensar. Portanto, ainda que propuséssemos uma perspectiva do aprender como emprego livre e pessoal da razão, conforme aventou Kant, esta não seria capaz de prescindir da submissão do pensamento aos estados da representação, afinal, na gênese deste procedimento da razão consiste também a marca indelével de uma imagem dogmática do pensar que subsidia as diversas dimensões de sua manifestação. A partir desta imagem dogmática, que se erigiu segundo ideias gerais do senso comum e do bom senso, o pensar fora entendido pelo viés recognição, como processo que engendra a constituição de modelos e conformações, segundo a ordem da representação, sem jamais diferenciar-se na experimentação do devir. À vista disso, objetivamos investigar nesta dissertação em que medida nos é possível, ainda, promover, no contexto de um ensino representacional, uma aprendizagem filosófica que se abra à experimentação do pensar, como criação de novos sentidos. Para tanto, buscaremos elucidar em que consiste esta experiência do pensar, à luz do uso disjuntivo das faculdades, para, em seguida, compreender em que sentido esta experiência se faz possível com vistas ao aprender a filosofar. A hipótese que atravessa este trabalho articula-se em torno da obra deleuziana Proust e o Signos, a partir da qual defendemos a possibilidade de encontrar, na relação do aprendiz com o signo, uma nova perspectiva sobre a aprendizagem filosófica como lugar de emergência do pensar. / The treatment granted to Philosophy as an official subject of Brazilian school curriculum has always been characterized by ambivalences and inconsistencies that have forged a controversial horizon to its teaching. Although the guidelines and educational regulations for the Philosophy teaching have suggested its potential to break the transmission and mechanical acquisition of contents, its institutionalized model still remains trapped in a reproductivist dimension of an explainer character. This paradigm, very little contested and known as logic of explanation, is responsible for establishing a noxious dualism in teaching, from which the student’s learning must necessarily be subject to the manifestation of the teacher’s explanations and representations. Thus, the role of teaching has stopped projecting itself towards the promotion of a philosophical experience. It assumed the task of shaping the student’s thought to a philosophical orthodoxy, restricting the potential of philosophizing to a distorted image of thinking itself. Therefore, even though we proposed a perspective of learning as a free and personal use of reason, as Kant has suggested, it would not be able to waive the submission of thought to the states of representation. After all, the indelible mark of a dogmatic image of thought that supports the various dimensions of its manifestation consists in the genesis of this procedure of reason. From this dogmatic image, which has been consolidated based on general ideas, common sense and good sense, the thinking has been understood by the recognition process, which engenders the establishment of models and conformations, according to an order of representation, without ever differing itself in an experimentation of becoming. Considering this, we aim to investigate in this thesis to what extent it is still possible to promote, in the context of a representational teaching, a philosophical learning that is open to the experimentation of thinking as creating new senses. In order to do that, we will seek to elucidate in what consists the experience of thinking from the disjunctive use of faculties, to then understand how this experience is possible aiming at learning how to philosophize. The hypothesis that permeates this research study is built around Deleuze’s work, Proust and Signs, from which we defend the possibility of finding, in the learner's relationship with the sign, a new perspective on the philosophical learning as a place of emergence of thinking.

Migration in general and the assessment of the need of protection concerning people from Afghanistan in particular, has in recent years risen on the migration agenda, especially after the Taliban regime's expanded control in the country. This thesis aims to investigate what guidelines that are in place for assessing female Afghan asylum seekers who applies for asylum in Sweden based on gender related persecution. Through a legal dogmatic analysis, three determinations from the Swedish Migration Agency and three determinations from three of Sweden's migration courts have been examined. The purpose has been to examine the guidelines of the determinations, analyze the values applied by the Swedish Migration Agency and the Migration Courts in the determinations, and whether the current application of the law is legally secure based on Frändberg and Von Essen's definition of legal security. The results show that there are shortcomings in the Swedish Migration Agency's as well as the Migration Courts' assessments, which is consistent with previous research. The results as well as previous research shows knowledge gaps about what requirements that should be expected from the applicants in terms of reliability, credibility, and evidence.

Les deux œuvres spirituelles majeures de Cabasilas : L’Explication de la divine Liturgie et ses Sept Discours au sujet de la vie en Christ, dont les conceptions théologiques ecclésiastiques fondamentales et principales constituent le terreau fertile de la présente thèse sur les mystères du Baptême, de la Chrismation et de la divine Eucharistie, s’appuyant sur l’idée principale du théologien que le salut humain se trouve dans la maison de Dieu. Nicolas Cabasilas fonde précisément sur les saints mystères toute sa théologie ecclésiastique du Nouveau Testament, le monde entier, qui se transforme, s’organise et vit en tant que Corps du Christ. Le Saint Esprit « par la main et la bouche des prêtre accomplit » les mystères de l’Église qui apportent des fruits spirituels et la vie morale et spirituelle en Christ. Ainsi la vie des membres du corps de l’Église, dont le Christ est la tête, est la vie dans le Saint Esprit. Cabasilas place ainsi avec justesse et profondeur, les sacrements principaux (baptême, chrismation et eucharistie) au cœur de ce chemin de vie et d'union au Christ. Toutefois, un rappel important de Cabasilas, concernant le principe de coopération, ne doit pas nous échapper. En effet, la vie nouvelle en Christ est le fruit de la coopération de Dieu et du facteur humain. Le salut n’est pas donné de force lors des mystères, mais avec la coopération et la bonne volonté de l’individu, sa participation active. Enfin, comme notre thèse le démontre, la pensée théologique de Cabasilas, concernant le caractère eschatologique des mystères, en particulier du baptême et de la divine Eucharistie, préserve et dispense la doctrine de l’Apôtre Paul et de la théologie chrétienne primitive qualifiant avec Saint Paul les mystères comme « forces du siècle à venir». / The two major spiritual works of Nicholas Cabasilas : The Explanation of the Divine Liturgy and his seven speeches on the life of Christ, whose basic theological and ecclesiastical designs are the fertile soil of our thesis on the mysteries of Baptism, Chrismation and Holy Eucharist, are based on the main idea that human salvation should be found in the church, the house of God. Nicholas Cabasilas bases precisely on the holy mysteries his entire theology of the New Testament, in which the whole world is organized and lives as the Body of Christ. The Holy Spirit by the hand and the mouth of the priest performs the mysteries of the Church and provides the spiritual and moral fruits, the spiritual life in Christ. Thus the life of the members of the body of the Church, of which Christ is the head, is the life in the Holy Spirit. Cabasilas places with reason the major sacraments (Baptism, Chrismation and Eucharist) at the heart of this life and union with Christ. However, the important reminder of Cabasilas on the principle of cooperation should not escape us. Indeed, the new life in Christ is the fruit of cooperation between God and the human factor. The salvation is not given by force with the mysteries, but with the cooperation and good will of the individual, his active participation. Finally, as our case demonstrates, the theological thought of Cabasilas concerning the eschatological character of the mysteries, especially baptism and the Holy Eucharist, preserves and provides the doctrine of the Apostle Paul and the early Christian theology qualifying the holly mysteries as "forces of the age to come."
