Policy impact on stakeholder benefits and resource use and conservation in Mozambique : the case study of Moflor Forest Concession Area and Pindanganga Community Area

Thesis (PhD)--Stellenbosch University, 2005. / Some digitised pages may appear illegible due to the condition of the hard copy. / ENGLISH ABSTRACT: A case study in miombo woodlands was carried out in Pindanganga and MOFLOR forest concession, Gondola and Dondo Districts respectively, in the centre of Mozambique, to analyse the impact of alternative forest management regimes and sectoral and extra sectoral policies on the well being of stakeholders and conservation of the woodlands. A system dynamics model, MIOMBOSIM, based on game theory and implemented in POWERSIM was developed. The analysis is based on a simulation model of the fluctuation over time of the human population, forest dynamics, harvesting costs of the private sector, household consumption, commercial outputs and prices (timber, charcoal, non timber forest products and domestic animals), using data from field surveys and the literature. It also simulated the effects over time of changes in charcoal production efficiency, sales amount and marketing prices of NTFPs, agricultural output prices, off-miombo greater employment availability and a combination between the changes (simultaneous increase in marketing prices ofNTFPs and agricultural output prices, simultaneous increase in charcoal production efficiency and agricultural output prices, and simultaneous increase in off-miombo greater employment availability and agricultural output prices). The modelling approach chosen allows to evaluate management regimes taking into account the different stakeholder interests, which are often conflicting. This study shows that improvement in the well being of stakeholders and resource conservation can be achieved with sound forest management practices. There is no management regime capable of fully satisfying the goals of the stakeholders. The cooperative management option is potentially beneficial to local communities if properly implemented and can improve the rural livelihoods and the woodland resources condition. It also shows that regulated forest management regimes incorporating social concerns or incorporating social and environmental concerns are potentially more beneficial to the household sector than the open access regime. Results found in the study show that an increase by 10% and 30% on charcoal production efficiency can lead to an increase in the per capita benefits of the household sector by 3.0 to more than 100%, but can not reach the poverty line (one dollar per day per person). An increase by 100% in the sales amount or 100% increase in market selling prices of NTFPs can lead to an increase in the per capita benefits of the household sector. An increase in agricultural output selling prices by 25% without any other incentive leads to agricultural expansion. An increase by 100% in off-miembo employment opportunities in the study areas has an insignificant impact on resource use and conservation for the local communities due to the very low employment opportunities currently in place (0.008% in Pindanganga and 0.005% in MOFLOR area). A combination of these two policies instruments under ceteris paribus condition can improve the well being of the rural communities depending on the management regime option, but can not reach the poverty line (one dollar per day per person). The ranking of the management regime can change depending on the policy instrument applied. / AFRIKAANSE OPSOMMING: 'n Gevalle-studie is in Miombo boomveld in Pindanganga en MOFLOR, onderskeidelik in die Gondola en Dondo Distrikte in die sentrale deel van Mosambiek, uitgevoer om die impak van alternatiewe bosbestuursisteme en sektorale en ekstra-sektorale beleide op die welstand van belanghebbendes (stakeholders) en bewaring van die boomveld te ontleed. 'n Sisteem-dinamika model, MIOMBOSIM, gebaseer op spel teorie (game theory) en ge-implementeer in POWERSIM, was ontwikkel. Die analise is gebaseer op 'n simulasie-model van die fluktuasie oor tyd van die plaaslike bevolking, bosdinamika, oestingskostes van die private sektor, huishoudelike verbruik, kommersiële uitsette en pryse (hout, houtskool, nie-hout produkte en huishoudelike diere), deur data van veldopnames en uit die literatuur te gebruik. Judicial Enforcers? Exploring Lower Federal Court Compliance in Regulating the Obscene

Although federal circuit and district court judges are placed within a federal hierarchy, and receive legal and judicial training that emphasizes the importance of the judicial framework and its structure, such judges are also subjected to other pressures such as the types of litigants within the courtrooms as well as their local political environment. Furthermore, such judges are apt to form their own views about politics and legal policy and are often appointed by presidents who approve of their ideological leanings. Thus, federal courts are caught between competing goals such as their willingness to maximize their preferred legal policy, and their place within the judicial hierarchy. This dissertation applies hierarchy and impact theory to assess the importance of the judicial framework and its socialization, by analyzing both the judicial opinions and votes of federal circuit and district court judges in obscenity cases during a four-decade period (1957-1998). The research presented here finds the influence of higher court precedent to correspond in part with the conception of a judicial hierarchy. An analysis of citations of Supreme Court precedent (Roth v. United States (1957) and Miller v. California (1973)) in lower court majority opinions suggests low levels of compliance: lower courts at the circuit and district court level do not signal to the Supreme Court their acceptance of High Court doctrine; thus, except for 'factual' cases, most circuit and district court decisions do not comply formally with higher court precedent. An analysis of judicial votes, however, suggests that a Supreme Court doctrinal shift (to Miller v. California) influences lower court decisions only at the circuit court level. Further investigation suggests that Supreme Court precedent has a greater influence in circuit courts than in district courts: not only is the magnitude greater for circuit (versus district) court decisions, such results occur when controlling for such factors as the appointing president, regional variations, various constitutional claims and types of litigants. Thus, it appears that the influence of Supreme Court doctrine is much stronger in the circuit courts (only one step removed from the Supreme Court) than in district courts yet the hierarchy is influential nonetheless.

Le district de Litsa est une région de la Péninsule de Kola particulièrement prometteuse pour la métallogénie de l'uranium. Présentant toutes les caractéristiques d'une province métallifère, ce district a enregistré une histoire géologique complexe avec des enrichissements successifs en uranium. Trente anomalies uranifères y sont observées, estimées à 102 000 tonnes (IAEA nomenclature), pour une teneur moyenne de 0,01%. Elles sont encaissées dans différentes formations de niveau structural et d'âge différents, depuis l'Archéen jusqu'au Calédonien. La minéralisation présentant les teneurs en uranium les plus économiques sont des veines de pechblende observées autour du complexe granitique de Litsa-Araguba, où sont présents des protolites, des structures et des phénomènes épigénétiques favorables / The Litsa district is one of the most interesting areas of the Kola Peninsula with respect to uranium metallogenesis. Presenting all the features of uraniferous province, it endured a protracted geological history with several successive uranium enrichments. There are over 30 uranium occurrences and manifestations, totally estimated at 102,000 tons in Speculative Resources (IAEA nomenclature), with an average grade of Uranium 0.01%. They occur at different stratigraphic levels of the geological succession in the district: Archean, Paleoproterozoic, Mesoproterozoic and Paleozoic. Uranium content in the geological formations gradually increases during the geological evolution of the Litsa district from Archean to Paleozoic. The most abundant and probably prospective for the economic-grade uranium mineralization is Paleozoic pitchblende vein type, located around the Litsa-Araguba granitoid complex, where favorable protoliths, structures and epigenetic processes are encountered

This qualitative research method will be supported by both primary and secondary methods in terms of data collection. The study will make people aware of the reflection of the value, importance and meaning attached to place names since it shows how people name their different places, which are in most instances body of history and meaningful. In other words, the study will endeavour to contribute to existing body of knowledge and understanding of the naming practices of some place names in Mhala sub-district of Bohlabela district in Mpumalanga Province.

Professional quality of life among nurses in psychiatric observation units in the metropole district health services

Magister Curationis - MCur / Background: Psychiatric observation units are the units where 72-hour psychiatric observations are conducted in the district and in some of the regional hospitals. These hospitals were selected under the Mental Health Care Act No. 17 of 2002 (MHCA 2002) to admit patients suspected to be mentally ill, ascertain the cause of symptoms, exclude medical illness as a cause of the symptoms, treat and rehabilitate these patients; and at times transfer the patients to tertiary psychiatric hospitals. These units are often overcrowded as only about 30% of patients are transferred to the tertiary psychiatric hospitals. These units are fraught with challenges such as shortage of crucial facilities like seclusion rooms, specialised staff, resources and minimal budget is allocated to these units. Nursing staff in these units are faced with a number of challenges such as shortage of staff, patient overflow, prolonged patient stay, psychologically disturbed patients who can be agitated and violent, and are working long hours. Therefore, Compassion Satisfaction may be affected and these nurses are prone to Compassion Fatigue, which can lead to low Professional Quality of Life. Aim & objectives: The aim was to investigate Professional Quality of Life among nurses working in psychiatric observation units in Metropole District Health Services in the Western Cape Metropole. The objectives were to measure Compassion Satisfaction, to measure levels of Burnout and determine levels of Secondary Traumatic Stress among nurses working in psychiatric observation units in the Metropole District Health Services. Method: A quantitative research approach using a descriptive design was used to determine the Professional Quality of Life of nurses working in psychiatric observation units in the Metropole District Health Services. A self-administered survey using a structured questionnaire, the Professional Quality of Life version 5 (ProQoL 5) was used to collect data from an all-inclusive sample of 175 nurses, yielding a response rate of 93% (n=163). Data was analysed using the Statistical Package of Social Services (SPSS) version 24. Findings: The findings of this study showed that respondents experienced moderate Compassion Satisfaction, moderate Burnout and high Secondary Traumatic Stress. Advanced psychiatric nurse practitioners and registered nurses reported lower Compassion Satisfaction, higher Burnout and higher Secondary Traumatic Stress than enrolled nurses and enrolled nursing assistants. Recommendations: Qualitative research studies need to be conducted on nurses working in psychiatric observation units in order to understand experiences and factors affecting Professional Quality of Life among nurses. Qualitative research studies need to be conducted in order to understand factors affecting Professional Quality of Life of advanced psychiatric nurse practitioners and general registered nurses in psychiatric observations units.

Structural geology and gold mineralisation of the Ora Banda and Zuleika districts, Eastern Goldfields, Western Australia.

Late-Archaean deformation at Ora Banda 69km northwest of Kalgoorlie, Western Australia, resulted in upright folds (D2), ductile shear zones (D3), and a regional-scale brittle-ductile fault network (D4). Early low-angle faults (D', D1), documented in the surrounding Coolgardie, Kambalda and Boorara Domains are not developed in the Ora Banda Domain, and the fabrics reflect only the latest ENE-WSW shortening event. The western limb of the regional-scale ESE- plunging Kurrawang syncline (D2), is truncated by the Zuleika Shear Zone (D3), a within- greenstone ductile shear zone located 10km southeast of Ora Banda. The shear zone has a much greater strike length (250km) than depth extent, as seismic imagery reveals a sharp truncation against a mid-crustal decollement at a depth of 6km-depth below surface. The Zuleika Shear Zone is a NW-SE trending band of anastomosing S-C mylonite zones formed in conjugate sets of NW- SE trending sinistral and N-S trending dextral shear zones. Widely distributed flattening strains and more restricted zones of non-coaxial shear in the Zuleika Shear Zone, suggest deformation-path partitioning typical of a transpressional tectonic environment. Latetectonic brittle-ductile faults (D4) cross-cut the Zuleika Shear Zone and surrounding greenstones, and hence are not Riedel structures or other lower order faults genetically related to the ductile shearing. Gold mineralisation of the Zuleika Shear Zone began during the ductile deformation (D3), continued through peak metamorphism that postdates the shearing, and finally ceased after the brittle-ductile faulting event (D4). Gold deposits are primarily located where brittle-ductile faults intersect the Zuleika Shear Zone. / Brittle-ductile faults (D4), are developed in three principal structural orientations: N-S (dextral), NE-SW (dextral) and E-W (sinistral). These faults display mutual cross-cutting relationships and were formed synchronously during a single regional shortening event. The brittle-ductile fault network is developed unevenly over the region, being localised in packets of high fracture-density referred to as structural zones. The Ora Banda structural zone is an area of high density faulting in the vicinity of Ora Banda, composed of a network of interlinked faults in which alternating ductile and brittle conditions produced cataclasite, breccia and quartz vein systems overprinting mylonite and schistosity. Other areas of high fracture-density (eg. Grants Patch and Mount Pleasant structural zones), are located within the NW-SE trending Ora Banda mafic sequence and spaced at 10km intervals to the southeast of Ora Banda. This spatial periodicity of high fracturedensity within the mafic sequence may have developed as a result of layer-parallel extension during ENE- WSW regional shortening. Gold deposits are concentrated in the Ora Banda, Grants Patch and Mount Pleasant structural zones. Gold distribution within the Ora Banda structural zone traces out the distribution of brittle-ductile faults, indicating that the fault network was the major pathway for fluid flow during mineralisation. Hydrothermal minerals are integral components of fault fabrics within the structural zone, and textures indicate that the faults were formed under conditions of high fluid pressure and, for much of the deformation, may have been fluid-generated. / At Ora Banda the Enterprise gold deposit (40 tonnes Au) highlights the control of mesoscopic- scale fractures on gold distribution. On aeromagnetic imagery, the Enterprise fault zone appears as a narrow fault structure, but at a mesoscopic-scale, it is a broad zone of interlinked brittle-ductile faults and quartz veins. Fabrics developed in the layered, differentiated dolerite host rocks of the Enterprise fault zone, range from cataclasite to banded mylonite with a major component of net- veined breccia (mesofracturing). Kinematic analyses of fault slip lineations reveal an 055 directed (ENE-WSW) maximum shortening axis during brittle-ductile faulting. Microfabrics of the faults show extensive recrystallisation with significant post-deformation recovery that may be related to late to post - tectonic intrusion of the adjacent Lone Hand Monzogranite. Deformation mechanisms indicate that the D4 event occurred at a low-to-moderate temperature, in a low strain-rate enviromnent typical of mid to upper-greenschist facies crustal conditions. Gold mineralisation in the Enterprise deposit is controlled by faults with high-grade shoot development at the intersection of faults and host rock contacts that may represent gradients in tensile rock-strength. Although gold distribution indicates that faults are a major control on mineralisation, at a microscopic-scale, the control is by a linked network of microfractures that pervades the host rocks. / Fry analysis of gold deposits within the Ora Banda mafic sequence shows clustering into groups with about 10km spacing. Coincidence of high fracture-density zones and gold deposits in 1Okm spaced-corridors reveals the regional-scale nature of gold mineralisation within the brittle-ductile fault network. Fluid-pressure gradients generated by pressure release during high-density fracturing, may have effectively increased fluid-rock ratios by focussing of metamorphic fluids through these areas. The largest gold deposits in the Ora Banda mafic sequence are hosted by 060-090 trending brittle-ductile faults with dilational textures (hydraulic breccia), and minor evidence of slip with negligible offsets. The orientation of these structures is sub-parallel to the regional axis of maximum shortening, hence an environment of fluid overpressuring in the presence of a far-field stress system produced conditions where fluid pressure is greater than or equal to the combined minimum compressive stress and the tensile rock strength. Such conditions are conducive to multiple failure episodes with fluid-pressure cycling and transient permeability as a consequence of fault reactivation. Formation of the brittle-ductile fault network occurred as a result of a delicate balance between deviatoric stress and fluid pressure, hence incremental fault development contributed to, and was a consequence of, the gold mineralisation event. / The geometric relations of shear zones, brittle-ductile faults and gold mineralised zones are similar across all scales of observation from regional to microscopic and are therefore fractal. Fractal geometry indicates that deformation and gold mineralisation are temporally and genetically associated, and this combined with the textural relationships of the gold ores indicates that the sites of gold deposition were not structurally prepared prior to mineralisation. Development of early ductile to later brittle-ductile structures indicates changing conditions of deformation typical of decreasing crustal depth, or a variation of strain rate with time. The lack of a significant change in orientation of the maximum shortening direction and continuance of gold mineralisation throughout ductile and brittle deformation events, implies that deformation was progressive during a bulk shortening that accompanied uplift of the crust.

A Study on the Legal System of Administrative Division in Local Districts¡ÐThe Case of Kaohsiung City

Abstract Administrative division contains a string of complex questions. It does not only contain the simple concept of the division of regions, but the formation of the ideology of residence towards regions and the fairness of national resource distributions. However, followed by administrative division, the original administrative district still may not develop well as expected due to the change of time and space. By the analysis of the 5 major frameworks of administrative law, I found out that since the merger of Kaohsiung city and county in 2010, the transition of the environment has diluted and allocated the resources inappropriately. It leads to an unbalanced regional development because the people can not be satisfied with inadequate resources. However, the problem is that the current administrative division can not tackle the problems. It¡¦s a great loss that a reasonable and appropriate plan has not even been conducted for the administrative division of Kaohsiung. Moreover, the scale that administrative division covers in local districts is so comprehensive that it de facto influences the right and obligations of people. Therefore, the legal system of administrative division should be improved and adjusted. By this study I found out that Kaohsiung City should consider the overall development and related factors to assess the whole situation with a profounder perspective. By the expansion that brought by the merger of administrative districts, the resources will be more adequate so as to meet the need of people. With the local features of each administrative district, transport communication can be extended, as well as the space greening and beautification. As a goal-oriented activist, the district governors should dedicated to increasing the service quality and efficiency of district offices for people. Followed by the balanced development, local features and the enhancement of overall development, Kaohsiung City can become the leading city in Taiwan with easy access to administration, balanced resources and limitless development.
