The origins and development of media education in Scotland

This study combines analytical and narrative modes of historical enquiry with educational policy sociology to construct a history of media in education in Scotland. It uses the development trajectory of a single case, media education in Scotland's statutory education sector, to deconstruct and reconstruct a history of the institutional relationship between the Scottish Film Council (SFC) and the Scottish Education Department (SED) that stretches back to the 1930s. Existing literature describes media education in Scotland as a phenomenon located in the 1970s and 1980s. This study disaggregates media education discourse and dissolves chronological boundaries to make connections with earlier attempts to introduce media into Scottish education in the context of Scotland's constitutional relations within the UK. It employs historical and socio-cultural methods to analyse the intersections between actors and events taking place over six decades. The analysis and interpretation of the data is located in three time periods. Chapter 3 covers the period from 1929 until 1974 when, on the cusp of the emergence of the new texts and technologies of film, the SFC was established to promote and protect Scottish film culture and audio-visual technologies. During this time, the interdependence of teachers, the film trade and the educational policy-making community led to the production, distribution and exhibition of new and popular forms of text to national and international acclaim. By juxtaposing public and private documents circulating on the margins of statutory education, this chapter generates a new understanding of the importance of film and its technologies in Scotland in the pursuit of a more culturally relevant and contemporary model of education. It also describes how constraints upon Scotland’s cultural production infrastructure limited its capacity to effect significant educational change. In the 1970s, cultural, political and educational ferment in pre-devolution Scotland, created a discursive shift that gave rise first to media education and then to Media Studies. Articulating documents with wider discourses of educational and cultural change and interviews with key players, Chapter 4 describes a counter-narrative gaining momentum. The constraints of the practices of traditional subjects and pedagogies combined with the constraints on Scottish cultural production gave shape and form to the media education movement. Significantly for this study, the movement included influential members of Scottish education’s leadership class. Between 1983 to 1986, the innovative Media Education Development Project (MEDP) aimed to place media education at the centre of teaching and learning in Scottish education. This was fully funded by the SED, managed by the Scottish Council for Educational Technology (SCET) and the SFC and implemented by the Association for Media Education in Scotland (AMES). The MEDP overlapped briefly with another initiative in SCET, the Scottish Microelectronics Development Project (SMDP). During this period, Media Studies enjoyed rapid success as a popular non-advanced qualification in the upper secondary and further education sectors. Media education, however, did not. Chapter 5 explores the links between the MEDP and the SMDP through the agency of three central actors: SCET, the SFC and AMES in the context of a second term of Margaret Thatcher’s Conservative government. This study concludes that between 1934 and 1964, the SFC was a key educational bureaucracy in Scottish education. The SFC’s role as an agent of change represented the recognition of a link between relevant and contemporary Scottish cultural production and the transformation of statutory education. Between 1929 and 1982 three iterations for media and education in Scotland can be discerned. In 1983, the MEDP began a fourth but its progress faltered. The study suggests that if a new iteration for media and education in Scotland in the twenty-first century is to emerge, an institutional link between media culture, technology and educational transformation requires to be restored.

La mutation de la mise en état des affaires pénales à l'épreuve des droits européens / The metamorphosis of the pre-trial phase of the criminal proceedings facing European rights

Au-delà de l’instabilité qui la caractérise, la mise en état des affaires pénales s’illustre par sa métamorphose. A mesure de la multiplication des modes de traitement de la délinquance et de l’enrichissement des possibilités d’investigation en enquête de police, celle qui ne devait être qu’un préalable à l’ouverture d’une information judiciaire s’impose comme le cadre ordinaire dans un système qui n’avait pas été pensé pour elle. En résultent un recul des droits de la défense et du juge auxquels ni une vision d’ensemble de la procédure, ni les dernières réformes, pour une large partie inspirées des droits européens, n’ont pleinement pallié. Mettre les implications de la montée en puissance de l’enquête de police à l’épreuve des droits européens fait ressortir différents motifs d’inquiétude sur la pleine compatibilité du système actuel avec les standards supranationaux. Ils viennent ainsi au soutien d’aménagements promus tant par la doctrine que par des praticiens pour remédier au déséquilibre constaté. Si la mise en conformité du droit interne doit servir de guide aux ajustements préconisés, ces derniers doivent néanmoins être examinés à la lumière de leur simplications sur le système vu dans son ensemble. Le souci de cohérence encouragerait à promouvoir des solutions plus mesurées, combinant à un renforcement relatif des droits durant l’enquête de police, une articulation des cadres procéduraux d’investigation centrée sur le renforcement du contrôle du juge. La perspective de l’intégration d’un Parquet européen, dont la création a été formellement actée le 12 octobre 2017, et qui se caractérise par sa perméabilité avec les ordres juridiques nationaux, rend ces propositions précaires. Les ajustements que son intégration supposera soulèveront à court ou moyen terme, la question d’une recomposition de la mise en état des affaires pénales, favorable à la restauration de son équilibre et de sa cohérence. / Beyond the inconstancy which defines the pre-trial phase of proceedings, it is characterised by its metamorphosis. Because of the multiplication of ways of dealing with delinquency and the increasing possibilities of police inquiry, the pre-trial phase of proceedings, which should have been just a precondition to the preliminary judicial investigation, turns out to be the common framework, in a system not built for it. It leads to the decline of the rights of defence and of the judge. Neither a global perspective of the procedure nor the last reforms, for the most part inspired by European laws, fully overcame it. Confronting the consequences of police inquiry increasing with European rights, highlights several concerns on the full compatibility of the current system with the supranational standards. They support accommodations, encouraged by the searchers as well as the professionals, to solve observed imbalances. If the compliance of French law must guide the recommended adjustments, they should be reviewed in the light of their impacts on the global system, where inquiry and information still coexist. The will of consistency may encourage to promote more measured solutions, combining a moderate strengthening of the rights during police inquiries to an articulation of the investigation proceedings frameworks, focused on a reinforced control of the judge. The perspective of the integration of an European Public Prosecutor’s Office, which creation was formally acknowledged October 12th 2017, characterised by its openness to other national legal systems, makes these propositions uncertain. At short or medium term, adjustments ensued by its integration will lead to rethink the pre-trial phase of proceedings, to ensure its balance and consistency.

Dissertation / This study explores the role of the principal in the management of parent involvement in secondary schools in Northern Province. A literature study investigated existing theories and models of parent involvement; parent involvement in the South African context and the provision of education in South Africa in historical perspective. It also investigated the managerial role of the principal in parent involvement. A qualitative investigation in three secondary schools in Northern Province was done. Data were gathered by means of participant observation in-depth interviews with principals and focus-group interviews with teachers and three parents on the school governing bodies. Analysed data revealed the following findings: principals lack knowledge on parent involvement and schools lack policies and organisational structures dealing with parent involvement as well as home-school relations. As a result of these findings, there is a need to equip principals with ways in which they can involve parents in their schools. / Educational Leadership and Management / M. Ed. Appelés à s’appliquer concurremment pour traiter les difficultés d’une société, il est classiquement considéré que les relations entre le droit des sociétés et le droit des entreprises en difficulté se résument à des conflits pouvant être résolus en faisant prévaloir le « droit spécial » des procédures collectives sur le « droit commun » des sociétés. Cette analyse a perdu de sa pertinence en raison de la mutation du droit des faillites en droit des entreprises en difficulté dont la finalité, le contenu, et le domaine d’application ont profondément changé, ainsi qu’en raison de la contractualisation des deux matières. Ces évolutions ont induit une appréhension nouvelle de celles-ci. Sont en effet recherchées, tant par les sociétés en difficulté que par leurs créanciers, les potentialités de l’association du droit des sociétés et du droit des entreprises en difficulté pour organiser le rebond d’une société défaillante. Leurs relations en droit positif s’avèrent ainsi plus subtiles et plus complexes. Une synergie existe entre elles lors du règlement à l’amiable des difficultés, tandis qu’une véritable soumission du droit des sociétés au droit des entreprises en difficulté peut être constatée lors du règlement judiciaire des difficultés. Malgré des origines distinctes, des finalités propres, et des fonctions radicalement opposées, une logique anime les relations des deux matières révélant un corpus légal et jurisprudentiel utilisé pour le règlement des difficultés qui témoigne de l’existence d’un droit des sociétés en difficulté. / It is commonly understood that, when considering ailing companies, the conflicts that arise between concurrently applicable corporate law and insolvency law can be solved with “special law” that prevails over “ordinary law”. This understanding has lost some relevance through the transformation of “bankruptcy law” into “distressed business law”. The trend towards the use of explicit contracts in these fields is bringing about a change in their finality, content and scope. This evolution of corporate law and insolvency law is creating new apprehension on the part of both the distressed company and the creditors, with the result that both parties are looking for means to combine these subjects when organising the recovery of an ailing firm. Their coexistence in substantive law turns out to be even more subtle and complex. In the case of an amicable settlement of a dispute, a synergy exists between corporate law and insolvency law whereas when a settlement is imposed under court supervision, the prevalence of insolvency law over corporate law is notable. Despite distinct origins, differing finality and radically opposing functions, a common logic motivates the relation between corporate law and insolvency law revealing a legal corpus and case law as a testament to the existence of an “ailing company law”.

Communicative strategies used by witnesses of the Leon and Phumaphi Commissions of Enquiry in Lesotho

Text in English with summaries in English, South Sotho and Xhosa / Bibliography: leaves 196-215 / This study explored the communicative strategies which were used by participants who were called in as witnesses before the Leon Commission and the Phumaphi Commission of Enquiry in Lesotho in 1998 and 2015 respectively. The study specifically looked into the types of communicative strategies employed, their linguistic realisations and their conversational effectiveness in providing required information to the commissions. It further compared the use of strategies by participants in both commissions. Data for this study was obtained from twenty-six audio recordings of twenty-six witnesses. The study established that participants used twelve types of communicative strategies which are classified under the following groups based on their functional characteristics: conversational category which includes strategies such as code-switching, fillers, vague language and circumlocution; a grammatical category that comprises personal pronouns, direct speech, passive voice and questioning; a sociocultural category that covers strategies such as figurative language, indirect communication, direct refusal and indirect criticism. The study established that communicative strategies such as code-switching, fillers, personal pronouns, and direct quoting were conversationally effective as participants strategically employed them to succinctly express themselves. However, strategies with concealing attributes such as those found under a sociocultural category and those under the grammatical category (passive voice and questioning) were considered conversationally ineffective as they withheld required information from the commissioners.
