Réseaux Évidentiels pour la fusion de données multimodales hétérogènes : application à la détection de chutes / Evidential Networks-based heterogeneous multimodal data fusion : application for fall detection

Ces travaux de recherche se sont déroulés dans le cadre du développement d’une application de télévigilance médicale ayant pour but de détecter des situations de détresse à travers l’utilisation de plusieurs types de capteurs. La fusion multi-capteurs peut fournir des informations plus précises et fiables par rapport aux informations provenant de chaque capteur prises séparément. Par ailleurs les données issues de ces capteurs hétérogènes possèdent différents degrés d’imperfection et de confiance. Parmi les techniques de fusion multi-capteurs, les méthodes crédibilistes fondées sur la théorie de Dempster-Shafer sont actuellement considérées comme les plus adaptées à la représentation et au traitement des informations imparfaites, de ce fait permettant une modélisation plus réaliste du problème. En nous appuyant sur une représentation graphique de la théorie de Dempster-Shafer appelée Réseaux Évidentiels, nous proposons une structure de fusion de données hétérogènes issues de plusieurs capteurs pour la détection de chutes afin de maximiser les performances de détection chutes et ainsi de rendre le système plus fiable. La non-stationnarité des signaux recueillis sur les capteurs du système considéré peut conduire à une dégradation des conditions expérimentales, pouvant rendre les Réseaux Évidentiels incohérents dans leurs décisions. Afin de compenser les effets résultant de la non-stationnarité des signaux provenant des capteurs, les Réseaux Évidentiels sont rendus évolutifs dans le temps, ce qui nous a conduit à introduire les Réseaux Evidentiels Dynamiques dans nos traitements et à les évaluer sur des scénarios de chute simulés correspondant à des cas d’usage variés / This work took place in the development of a remote home healthcare monitoring application designed to detect distress situations through several types of sensors. The multi-sensor fusion can provide more accurate and reliable information compared to information provided by each sensor separately. Furthermore, data from multiple heterogeneous sensors present in the remote home healthcare monitoring systems have different degrees of imperfection and trust. Among the multi-sensor fusion techniques, belief methods based on Dempster-Shafer Theory are currently considered as the most appropriate for the representation and processing of imperfect information, thus allowing a more realistic modeling of the problem. Based on a graphical representation of the Dempster-Shafer called Evidential Networks, a structure of heterogeneous data fusion from multiple sensors for fall detection has been proposed in order to maximize the performance of automatic fall detection and thus make the system more reliable. Sensors’ non-stationary signals of the considered system may lead to degradation of the experimental conditions and make Evidential Networks inconsistent in their decisions. In order to compensate the sensors signals non-stationarity effects, the time evolution is taken into account by introducing the Dynamic Evidential Networks which was evaluated by the simulated fall scenarios corresponding to various use cases

A busca de soluções capazes de imprimir maior eficiência e efetividade ao processo tem norteado as diversas reformas processuais nas últimas décadas. Com esse escopo, aumentaram os poderes do juiz, para justificar essa ampliação no caráter público do processo. Consequência desse aumento de poderes, verificou-se uma alteração no comportamento dos sujeitos envolvidos em um processo, outrora fundamentado nas premissas do princípio dispositivo, fato esse justificado pelos escopos sociais e políticos do processo na busca por uma decisão mais justa. Além disso, a busca por maior efetividade fez com que a duração razoável do processo ganhasse status de Direito Constitucional expressamente reconhecido, de modo a exigir do juiz uma conduta mais ativa na busca de melhor prestação jurisdicional. Como consequência, relegou-se a um plano secundário a participação das partes no processo, que se restringiu, praticamente, à instauração da demanda, de modo que a instrução probatória, cuja premissa maior era a igualdade formal balizada pelos limites do princípio dispositivo, passou, então, a ser influenciada pela iniciativa do juiz. O presente trabalho busca, seguindo os influxos das novas tendências e tendo em vista ser da essência da própria jurisdição a equidistância do magistrado dos interesses em conflito e, como o princípio dispositivo resulta da autonomia da vontade que reina no âmbito de grande parte dos Direitos atuados pelo processo civil, estimular a reflexão sobre o fato de a revalorização deste princípio, que, embora mitigado, ainda orienta o processo civil brasileiro, para confiar às partes, integralmente, tarefas que hoje incumbem aos magistrados no âmbito da instrução probatória, constituiria uma alternativa capaz de solucionar o problema da morosidade que afeta o Judiciário e compromete a efetividade processual. Dentro dessa perspectiva, o presente estudo se desenvolverá em três partes e enfatizará as questões ligadas ao tema proposto. Na primeira parte, será feito um estudo do princípio dispositivo para avaliar os impactos da sua mitigação no processo civil brasileiro contemporâneo, bem como a importância de sua subsistência como limite à atuação do juiz na busca de maior efetividade processual. Na segunda parte, o estudo será dirigido aos poderes do juiz, para refletir se a sua postura proativa realiza, de fato, os escopos da jurisdição, visto que, em geral, no âmbito do processo, se cuida de direitos disponíveis. Na terceira parte, buscar-se-á traçar um panorama atual da instrução probatória no processo civil brasileiro e, ao compará-la a outros ordenamentos estrangeiros, estimular a reflexão, sob a perspectiva da instrumentalidade, quanto ao fato de a maior valorização do princípio dispositivo constituir uma forma de evitar dilações temporais desnecessárias no curso do processo, visto que, não obstante o fortalecimento dos poderes do juiz, a realidade demonstra que o interesse das partes é sempre a mais eficiente mola propulsora da vida dos direitos e da sua efetividade. / The seek for solutions capable of bringing more efficiency to the due process of law has guided the variety of procedural law reforms in the last decades. Aiming to deliver more effectiveness to procedural mechanisms, these reforms enhanced the judges power, using the public aspect of procedure to justify such increase. As a consequence of this increase of powers, there was a change into the parties behavior. Erstwhile this behavior was based on the premises of the dispositive principle, justified by the social and political goals and their seek for a fair solution. Furthermore, the seek for more effectiveness make the question regarding the length of a action receive a clearly recognized Constitutional law status, requiring a better management from the judge during the jurisdictional duty. Thus, the parties participation in the process assumed a marginal role. The parties practically were segregated only to the introduction of the claim. The evidence production, which previously had as a major concept the formal equality, became influenced by the judge proactivity. Once the new tendencies are the essence of jurisdiction and the freedom of choice is an fundamental principle of the rights defended by the civil procedure, this dissertation aims to stimulate the reflection regarding the reanalysis of this principle that, even mitigated, are the main guide to the Brazilian civil procedure law. Inserted in this perspective, the present study will be divided into three parts and will emphasize the issues concerning the theme. The first part will be done a study regarding the dispositive principle. The objective is to evaluate the impact of its mitigation in the current Brazilian procedural law, as well as the importance of its existence as a boundary of the judges power in the quest for greater procedural effectiveness. The second part will be dedicated to the judges discretionary powers. It will bring a reflection if the proactive posture brings, in fact, the main jurisdictional goals, since it generally deals with available entitlement under the procedural law. In the third part, the dissertation will attempt to draw an actual outlook regarding evidence statement on the Brazilian civil procedure law. This work will compare the Brazilian system with foreign jurisdictions and stimulate a debate if the instrumentality perspective is a way to avoid unnecessary time delays in the procedures or not, considering that despite the strengthening of the powers of judge, reality shows that the parties\' interests is always the most efficient \"driving force\" of rights life and its effectiveness.

Model Based Learning and Reasoning from Partially Observed Data

Management of data imprecision has become increasingly important, especially with the advance of technology enabling applications to collect and store huge amount data from multiple sources. Data collected in such applications involve a large number of variables and various types of data imperfections. These data, when used in knowledge discovery applications, require the following: 1) computationally efficient algorithms that works faster with limited resources, 2) an effective methodology for modeling data imperfections and 3) procedures for enabling knowledge discovery and quantifying and propagating partial or incomplete knowledge throughout the decision-making process. Bayesian Networks (BNs) provide a convenient framework for modeling these applications probabilistically enabling a compact representation of the joint probability distribution involving large numbers of variables. BNs also form the foundation for a number of computationally efficient algorithms for making inferences. The underlying probabilistic approach however is not sufficiently capable of handling the wider range of data imperfections that may appear in many new applications (e.g., medical data). Dempster-Shafer theory on the other hand provides a strong framework for modeling a broader range of data imperfections. However, it must overcome the challenge of a potentially enormous computational burden. In this dissertation, we introduce the joint Dirichlet BoE, a certain mass assignment in the DS theoretic framework, that simplifies the computational complexity while enabling one to model many common types of data imperfections. We first use this Dirichlet BoE model to enhance the performance of the EM algorithm used in learning BN parameters from data with missing values. To form a framework of reasoning with the Dirichlet BoE, the DS theoretic notions of conditionals, independence and conditional independence are revisited. These notions are then used to develop the DS-BN, a BN-like graphical model in the DS theoretic framework, that enables a compact representation of the joint Dirichlet BoE. We also show how one may use the DS-BN in different types of reasoning tasks. A local message passing scheme is developed for efficient propagation of evidence in the DS-BN. We also extend the use of the joint Dirichlet BoE to Markov models and hidden Markov models to address the uncertainty arising due to inadequate training data. Finally, we present the results of various experiments carried out on synthetically generated data sets as well as data sets from medical applications.

Knowledge in Action

It is widely acknowledged that an agent is doing A intentionally only if she knows she is doing A. It has proved difficult, however, to reconcile two natural thoughts about this knowledge. On the one hand, the agent seems to know what she is doing immediately, simply by doing it. Her knowledge seems to rely upon no evidence, and indeed to rest upon no specifiable epistemic basis at all. On the other hand, the agent can be wrong about what she is doing; she is fallible. The difficulty is to see how an agent can be wrong about her action if her knowledge of it is immediate. My dissertation provides an account of the agent’s knowledge of her own actions that reconciles these natural, but apparently conflicting thoughts. In the face of this difficulty, many philosophers distinguish two objects of knowledge in action: the object of immediate knowledge, which is supposed to be something interior, and what the agent actually does, which is known only mediately. I argue that this two-factor framework is unacceptable, since it cannot account for the insight which motivated the study of intentional action via the agent’s knowledge of these actions: that it is in virtue of this specific way of knowing that the agent is the agent of her intentional actions. Instead, I defend a view on which acting intentionally itself, with no need for further epistemic work, is a way of knowing what actually happens. This account of knowledge in action also allows me to clarify how this knowledge is necessarily related to our capacity for agency. I argue that the rational capacities that are drawn on in figuring out what to do here and now are the very source of both the action’s taking place, and the agent’s knowledge of her actions without evidence. Since the agent’s knowledge is the result of the very same reasoning that brings about the action, it is practical, and the agent’s having it is the mark of her practical rationality at work and her being the knowingly efficacious author of the action. / Philosophy

Semantic Decision Support for Information Fusion Applications

This thesis is part of the knowledge representation domain and modeling of uncertainty in a context of information fusion. The main idea is to use semantic tools and more specifically ontologies, not only to represent the general domain knowledge and observations, but also to represent the uncertainty that sources may introduce in their own observations. We propose to represent these uncertainties and semantic imprecision trough a metaontology (called DS-Ontology) based on the theory of belief functions. The contribution of this work focuses first on the definition of semantic inclusion and intersection operators for ontologies and on which relies the implementation of the theory of belief functions, and secondly on the development of a tool called FusionLab for merging semantic information within ontologies from the previous theorical development. These works have been applied within a European maritime surveillance project.

Contribution to evidential models for perception grids : application to intelligent vehicle navigation / Contribution aux modèles évidentiels pour les grilles de perception : application à la navigation des véhicules intelligents

Pour les véhicules intelligents, un système de perception est un élément clé pour caractériser en temps réel un modèle de l’environnement de conduite autour du véhicule. Lors de la modélisation de l’environnement, les informations relatives aux obstacles doivent être gérées prioritairement car les collisions peuvent être mortelles pour les autres usagers de la route ou pour les passagers à bord du véhicule considéré. La caractérisation de l’espace occupé est donc cruciale mais pas suffisante pour les véhicules autonomes puisque le système de contrôle a besoin de trouver l’espace navigable pour assurer une planification sure de trajectoire. En effet, afin de naviguer sur les routes publiques avec d’autres utilisateurs, le véhicule doit aussi suivre les règles de circulation qui sont décrites, par exemple, par des marquages au sol peints sur la chaussée. Dans ce travail, nous nous concentrons sur une approche fondée sur des grilles égocentrées pour modéliser l’environnement. L’objectif est d’obtenir un modèle unifié contenant les informations d’obstacle avec des règles sémantiques de la route. Pour modéliser les informations d’obstacle, l’occupation est assurée par l’interprétation des informations des différents capteurs comme les valeurs des cellules. Pour modéliser la sémantique de l’espace navigable, nous proposons d’introduire la notion de grille de voies qui consiste à intégrer l’information sémantique de voie dans les cellules de la grille. La combinaison de ces deux niveaux d’information donne ainsi un modèle d’environnement plus raffiné. Lors de l’interprétation des données des capteurs en information d’obstacle, il faut manipuler des incertitudes dues à de l’ignorance ou des erreurs. L’ignorance est liée à la perception des nouveaux espaces dans la zone de perception et les erreurs proviennent de mesures bruitées et d’estimations imprécises de la pose. Dans cette recherche, la théorie de la fonction de croyance est adoptée pour faire face aux incertitudes et nous proposons des modèles évidentiels pour différents types de capteurs comme des lidars et des caméras. Les grilles de voie contiennent des informations sémantiques sur les voies provenant des marquages au sol, par exemple. À cette fin, nous proposons d’utiliser une carte a priori qui contient des informations détaillées sur la route comme l’orientation de la route et les marquages des voies. Ces informations sont extraites de la carte en utilisant une estimation de pose fournie par un système de localisation. Dans le modèle proposé, nous intégrons dans les grilles les informations de voie en tenant compte de l’incertitude de la pose estimée. Les algorithmes proposés ont été implémentés et testés sur des données réelles obtenues sur des routes publiques. Nous avons développé des algorithmes Matlab et C ++ avec le logiciel PACPUS développé au laboratoire. / For intelligent vehicle applications, a perception system is a key component to characterize in real-time a model of the driving environment at the surrounding of the vehicle. When modeling the environment, obstacle information is the first feature that has to be managed since collisions can be fatal for the other road users or for the passengers on-board the considered vehicle. Characterization of occupation space is therefore crucial but not sufficient for autonomous vehicles since the control system needs to find the navigable space for safe trajectory planning. Indeed, in order to run on public roads with other users, the vehicle needs to follow the traffic rules which are, for instance, described by markings painted on the carriageway. In this work, we focus on an ego-centered grid-based approach to model the environment. The objective is to include in a unified world model obstacle information with semantic road rules. To model obstacle information, occupancy is handled by interpreting the information of different sensors into the values of the cells. To model the semantic of the navigable space, we propose to introduce the notion of lane grids which consist in integrating semantic lane information into the cells of the grid. The combination of these two levels of information gives a refined environment model. When interpreting sensor data into obstacle information, uncertainty inevitably arises from ignorance and errors. Ignorance is due to the perception of new areas and errors come from noisy measurements and imprecise pose estimation. In this research, the belief function theory is adopted to deal with uncertainties and we propose evidential models for different kind of sensors like lidars and cameras. Lane grids contain semantic lane information coming from lane marking information for instance. To this end, we propose to use a prior map which contains detailed road information including road orientation and lane markings. This information is extracted from the map by using a pose estimate provided by a localization system. In the proposed model, we integrate lane information into the grids by taking into account the uncertainty of the estimated pose. The proposed algorithms have been implemented and tested on real data acquired on public roads. We have developed algorithms in Matlab and C++ using the PACPUS software framework developed at the laboratory.

The study is longitudinal nature, characterized by analysis accounts developed in a long period of time. It was analyzed written productions of two children, already stored in a database during the period of 3 years. The theoretical framework was guided by the historical-cultural perspective, focusing authors like Vygotsky and Luria. Methodological assumptions were used as the evidential paradigm, to allow qualitative analysis. This paradigm was developed within the humanities and used to make assumptions about the development of graphic language of children, since the moment they begin to draw until to write. From the clues left in the productions collected, in search of understand the process of writing appropriation for these children. For this to be asked: What mark writing children 4 to 7 years leave in their graphic activities that indicate the process appropriation of writing? In order to answer this question was raised as a general objective describe and analyze the appropriation process of writing as the object of analysis marks leave on the graphic activities for children from 4 years until they the symbolic writing. It is worth noting there are few studies in the area of literacy with this character, and thus an important contribution into the topic, especially for studies of the historical-cultural theory. . It was possible to see in research throughout the course of written language acquisition, that the relationship between drawing and writing was linked to the need for children to express themselves when exposed to situations they might experience and show "some way" - drawing or writing - the useful and function of language. Autonomy in children's writing was when what they wanted to "say" couldn‟t be expressed only by his drawings. As they were appropriating this new language, writing, this became the main form of representation in their productions. The research may also contribute to the training area of literacy teachers, since their product can provide new ways for action towards the students. / O foco desta pesquisa é compreender como ocorre o processo de apropriação da escrita, enquanto representação simbólica, em crianças na faixa etária dos 4 aos 7 anos de idade. O estudo é de cunho longitudinal, caracterizando-se por desenvolver análises referentes a um longo período de tempo. Para tanto, foram analisadas produções escritas de duas crianças, já armazenadas em um banco de dados, durante o período de 3 anos. O referencial teórico foi pautado na perspectiva histórico-cultural, focando autores como Vygotsky e Luria. Como pressupostos metodológicos foi utilizado o paradigma indiciário, por permitir análise qualitativa. Tal paradigma foi desenvolvido no âmbito das ciências humanas e assim empregado para efetuar hipóteses sobre o percurso do desenvolvimento da linguagem gráfica das crianças, do momento em que começam a desenhar figurativamente até a escrita. A partir de pistas, indícios deixados nas produções coletadas, buscou-se compreender o processo de apropriação da escrita por essas crianças. Para isso indagou-se: Quais marcas de escrita crianças de 4 a 7 anos deixam em suas atividades gráficas que indiciam o processo de apropriação da escrita? A fim de responder a tal questionamento, foi colocado como objetivo geral, descrever e analisar o processo de apropriação da escrita tendo como objeto de análise marcas deixadas nas atividades gráficas de crianças dos 4 anos de idade até atingirem a escrita simbólica. Cabe destacar que há poucos estudos na área de alfabetização com esse caráter, sendo dessa forma uma contribuição relevante dentro da temática, em especial para os estudos da teoria histórico-cultural. Foi possível constatar na investigação, ao longo de todo o percurso da apropriação da linguagem escrita, que a relação entre desenho e escrita esteve atrelada à necessidade de as crianças se expressarem, quando submetidas a situações em que puderam vivenciar e mostrar de alguma maneira desenhando ou escrevendo a utilidade e a função da linguagem. A autonomia da escrita nas crianças se deu quando aquilo que elas pretendiam dizer já não podia mais ser dito apenas por seus desenhos. À medida que foram se apropriando dessa nova linguagem, a escrita, esta passou a ser a principal forma de representação em suas produções. A pesquisa pode contribuir ainda com a área de formação de professoras/es da educação infantil e alfabetizadoras/es, uma vez que seu produto pode trazer novos caminhos para a atuação junto às crianças.

It is possible, through this investigation, to contribute to problematize the ways of success in these domains. This millennium, age of information and challenges driven by continuous technological, economic and cultural transformations, demands a society able to find creative solutions to the literacy problems of young people and adults which, acutely, is part of the planetary history and therefore, Brazilian history. Thus, the main focus of this work is to identify and Annalise the expressions of intelligence, in the use of Métis (a practical intelligence) of illiterate or little literate young people and adults, main subjects of this investigation, residents of the cities Pedras de Fogo in the State of Paraiba and Itambé, in Pernambuco. The basic theoretical and methodological bases is presented by authors such as Ginzburg (1989), Détienne e Vernant (2008), Freire (1992; 2011; 2013) and Gonçalves (2013). That present us guiding perspectives to an attentive, crafty and meticulous know-how, before a promising scenario to be mentally anticipated by the researcher educator in his or her search to make prosper the dialog of knowledge on what is genuine for the student in learning situations. This study shows that in order to go foward with success in the litteracy of young people and adults it is important that the educators have lucidity of what their students think and feel, about what they bring historically with themselves, how their genuine repertory of acquiring knowledge, considered valid by them in front of the difficulties of their lives experiences. It is to the educator, therefore, a smart educative practice, adjusted to the domains of a practical inteligence of the students, in a way that they walk with success in direction to the school knowledge, expanding their expectations as to the results to be achieved. / Este estudo tem como foco os processos de manifestação dos recursos da inteligência popular, com o intuito de entendê-los como orientação para o ensinar e o aprender, notadamente na alfabetização de jovens e adultos. É possível, por meio desta investigação, contribuir para problematizar os caminhos do êxito da aprendizagem e do ensino nesses domínios. Este milênio, era da informação e dos desafios impulsionados pelas contínuas transformações tecnológicas, econômicas e culturais, exige uma sociedade que possa encontrar soluções criativas à problemática da alfabetização de jovens e adultos que, de forma aguda, faz parte da história planetária e, por conseguinte, brasileira. Assim, o enfoque maior deste trabalho é o de identificar e analisar as expressões da inteligência, no uso da métis (uma inteligência prática), dos jovens e adultos não ou pouco alfabetizados, principais sujeitos desta investigação, residentes nas cidades de Pedras de Fogo-PB e Itambé-PE. A fundamentação teórico-prática e metodológica é construída em diálogo com autores como Ginzburg (1989), Détienne e Vernant (2008), Freire (1992; 2011; 2013) e Gonçalves (2013). O estudo evidencia que para avançar com êxito na alfabetização de jovens e adultos importa que o(a) educador(a) tenha clareza do que pensam e sentem seus alfabetizandos e alfabetizandas, sobre o que trazem historicamente consigo, como seu repertório genuíno de aquisição de saberes, por eles considerado válido diante das dificuldades de suas experiências de vida. A busca de soluções capazes de imprimir maior eficiência e efetividade ao processo tem norteado as diversas reformas processuais nas últimas décadas. Com esse escopo, aumentaram os poderes do juiz, para justificar essa ampliação no caráter público do processo. Consequência desse aumento de poderes, verificou-se uma alteração no comportamento dos sujeitos envolvidos em um processo, outrora fundamentado nas premissas do princípio dispositivo, fato esse justificado pelos escopos sociais e políticos do processo na busca por uma decisão mais justa. Além disso, a busca por maior efetividade fez com que a duração razoável do processo ganhasse status de Direito Constitucional expressamente reconhecido, de modo a exigir do juiz uma conduta mais ativa na busca de melhor prestação jurisdicional. Como consequência, relegou-se a um plano secundário a participação das partes no processo, que se restringiu, praticamente, à instauração da demanda, de modo que a instrução probatória, cuja premissa maior era a igualdade formal balizada pelos limites do princípio dispositivo, passou, então, a ser influenciada pela iniciativa do juiz. O presente trabalho busca, seguindo os influxos das novas tendências e tendo em vista ser da essência da própria jurisdição a equidistância do magistrado dos interesses em conflito e, como o princípio dispositivo resulta da autonomia da vontade que reina no âmbito de grande parte dos Direitos atuados pelo processo civil, estimular a reflexão sobre o fato de a revalorização deste princípio, que, embora mitigado, ainda orienta o processo civil brasileiro, para confiar às partes, integralmente, tarefas que hoje incumbem aos magistrados no âmbito da instrução probatória, constituiria uma alternativa capaz de solucionar o problema da morosidade que afeta o Judiciário e compromete a efetividade processual. Dentro dessa perspectiva, o presente estudo se desenvolverá em três partes e enfatizará as questões ligadas ao tema proposto. Na primeira parte, será feito um estudo do princípio dispositivo para avaliar os impactos da sua mitigação no processo civil brasileiro contemporâneo, bem como a importância de sua subsistência como limite à atuação do juiz na busca de maior efetividade processual. Na segunda parte, o estudo será dirigido aos poderes do juiz, para refletir se a sua postura proativa realiza, de fato, os escopos da jurisdição, visto que, em geral, no âmbito do processo, se cuida de direitos disponíveis. Na terceira parte, buscar-se-á traçar um panorama atual da instrução probatória no processo civil brasileiro e, ao compará-la a outros ordenamentos estrangeiros, estimular a reflexão, sob a perspectiva da instrumentalidade, quanto ao fato de a maior valorização do princípio dispositivo constituir uma forma de evitar dilações temporais desnecessárias no curso do processo, visto que, não obstante o fortalecimento dos poderes do juiz, a realidade demonstra que o interesse das partes é sempre a mais eficiente mola propulsora da vida dos direitos e da sua efetividade. / The seek for solutions capable of bringing more efficiency to the due process of law has guided the variety of procedural law reforms in the last decades. Aiming to deliver more effectiveness to procedural mechanisms, these reforms enhanced the judges power, using the public aspect of procedure to justify such increase. As a consequence of this increase of powers, there was a change into the parties behavior. Erstwhile this behavior was based on the premises of the dispositive principle, justified by the social and political goals and their seek for a fair solution. Furthermore, the seek for more effectiveness make the question regarding the length of a action receive a clearly recognized Constitutional law status, requiring a better management from the judge during the jurisdictional duty. Thus, the parties participation in the process assumed a marginal role. The parties practically were segregated only to the introduction of the claim. The evidence production, which previously had as a major concept the formal equality, became influenced by the judge proactivity. Once the new tendencies are the essence of jurisdiction and the freedom of choice is an fundamental principle of the rights defended by the civil procedure, this dissertation aims to stimulate the reflection regarding the reanalysis of this principle that, even mitigated, are the main guide to the Brazilian civil procedure law. Inserted in this perspective, the present study will be divided into three parts and will emphasize the issues concerning the theme. The first part will be done a study regarding the dispositive principle. The objective is to evaluate the impact of its mitigation in the current Brazilian procedural law, as well as the importance of its existence as a boundary of the judges power in the quest for greater procedural effectiveness. The second part will be dedicated to the judges discretionary powers. It will bring a reflection if the proactive posture brings, in fact, the main jurisdictional goals, since it generally deals with available entitlement under the procedural law. In the third part, the dissertation will attempt to draw an actual outlook regarding evidence statement on the Brazilian civil procedure law. This work will compare the Brazilian system with foreign jurisdictions and stimulate a debate if the instrumentality perspective is a way to avoid unnecessary time delays in the procedures or not, considering that despite the strengthening of the powers of judge, reality shows that the parties\' interests is always the most efficient \"driving force\" of rights life and its effectiveness.

Como referencial teórico-metodológico seguimos a tradição de pesquisa da Análise da Conversa Etnometodológica e da Sociolingüística Interacional. Procuramos mostrar, nas três audiências analisadas – Saudeplan, Banco Sul e Banco Green – a forma através da qual reclamantes, reclamados e mediadores recorrem a estratégias interacionais para a atribuição de credibilidade e confiabilidade às suas falas, bem como a aceitação das evidências produzidas nas interações. Ao fim dessa análise, identificamos como principais estratégias evidenciais o uso do raciocínio lógico, através da construção se a, então b e do entimema; o uso de analogia; a prova documental, representada pelo contrato; o conhecimento de senso comum; o relatado ou dito; a identidade de expert e a lei. A análise evidenciou que, das sessenta e oito ocorrências de utilização de estratégias evidenciais, o raciocínio por silogismo foi a mais utilizada pelos participantes das audiências, num total de vinte e quatro vezes. As demais estratégias evidenciais mantiveram uma média entre nove a sete ocorrências. O estudo destaca, ainda, que as estratégias evidenciais foram utilizadas mais por reclamantes e reclamados do que pelos mediadores. / This study is aimed at identifying, characterizing and analyzing the strategies of construction and negotiation of evidentiality used by participants in conciliation hearings at Procon and at Juizado Especial Cível from Juiz de Fora. As a theoretic and methodological reference, we have followed the orientation of Ethnometodological Conversation Analysis and Interactional Sociolinguistics. We attempted to show in the three conciliation hearings analyzed – Saudeplan, Banco Sul e Banco Green – the way by which complainers, complainees and mediators employ interactional strategies in order to attribute credibility to their talk, as well as the accepting/rejection of the evidences produced during the interaction by the other participant. As results, we identified as main evidential strategies the use of logical thinking, by the construction if a, then b and the entimema; the use of analogy; the document as a proof, represented by the contract; the common sense knowledge; the constructed dialogue; the identity of expert and the law. The analysis showed that, from the sixty-eight occurrences of evidential strategies, the logical thinking was the most used, totalizing twenty four uses. The other strategies maintained na average of nine to seven occurrences. This study still shows that the evidential strategies were more used by complainers and complainees than by mediators.
