Resumé The European Arrest Warrant The aim of my diploma thesis is to analyze the Framework Decision of 13 of June on the European Arrest Warrant and the surrender procedures between Member States (2002/584/JHA), next as "FWD", and how it has contributed to the creation of new simplified and more effective system of extradition of criminals among the Member States of the European Union. The historical development of international judicial cooperation in criminal matters and the extradition procedure will be discussed first in order to understand the need for a new solution for handling with the new forms of organised cross boarder crime in the European Union that were brought by the introduction of the principle of free movement of persons and the abolition of boarder checks after the Schengen Agreement. This will lead us to the critical analysis of fundamental principles on which the European Arrest warrant is based, its practical application by the judicial authorities in different Member States and core problematic issues that the daily practise of surrender procedure is nowadays facing. The possible solutions for such questions will be presented, not only on the state but also on the Union level. Studium závislostí středoevropských kapitálových trhů pomocí vysokofrekvenčních dat / Comovements of Central European Stock Markets: What Does the High Frequency Data Tell Us?

In this thesis, we inquire interdependencies and comovements between CEE capital markets within each other. German market is also included in the analysis as a benchmark to CEE capital markets. We have chosen German capital market as it represents more developed market from the same geographical region. We study a unique high-frequency dataset of 5 minutes, 30 minutes and 1 hour data frequencies covering the the crisis period and post-crisis "tranquil" period. Daily data frequency is also involved in the analysis. Using different econometric techniques, we found no steady long-term relationships among stock market indices. The only strong relationship was detected between the DAX and WIG20 indices during both crisis and "tranquil" periods. The frequency of interactions changed across periods. The strongest interdependencies were recognized in 5 minute data frequency which indicates fast reactions between markets. Information inefficiency was revealed between markets according to cointegration tests in most cases.

The thesis is denoted to two principal issues of European insolvency law - COMI notion interpretation and forum shopping. On the background of historic development, it interprets the current wording of European Insolvency Regulation in the light of case law issued by the Court of Justice of the European Union. It also analyses benefits and drawbacks of proposed legislative changes to COMI motion in the connection with the contemplated amendment of the European Insolvency Regulation. It proposes that COMI of companies is determined using irrebuttable presumption of COMI in the place of their registered seat. Further, it distinguishes between positive and negative forum shopping. Also, it provides an overview of risks and advantages related to forum shopping. The thesis evaluates the efficiency of current and potential tools for forum shopping elimination. It also deals with the relation of forum shopping to EU principal freedoms.

The thesis is focused on description and evaluation of current support of business activities, as well as on presentation of the most important fields of business activities, such as a support of small-scale and middle-scale enterprises, support of business activities environment, support of research, development and innovations, support of export -- both from European and national funds. Considerable attention was paid to a support of research, development and innovations, as these are the most important elements to strengthen the competitiveness of European economics on a world-wide scale, comparing it with its largest world competitors, such as Japan and USA. Next part is focused on direct and indirect support of business activities within the scope of particular operational programmes, comparing OPEI (Operational Programme Enterprise and Innovations) and OPIE (Operational Programme Industry and Enterprise). The closing part is about the support of business activities within the period of world financial crises and measurements adopted in relation with such a situation.

The diploma work is dealing with Corporate Governance system in selected countries in the European union. The goal of the work is to compare three companies in three countries and make a conclusion, which company is in the best compliance with the OECD Principles of Corporate Governance and act according to recommendations for Corporate Governance. The work is divided into two parts. In the first part we are analyzing the environment of Corporate Governance in the countries as a whole, specificly in Czech Republic, France and Great Britain. In the second part we are comparing Corporate Governance in these countries on selected examples of three companies, i. e. Telefónica O2 Czech Republic, a.s., Alcatel Lucent (limited liability company, France) and British Telecommunications plc (Great Britain). The analysis is based on the criterias formulated according to the OECD Principles and it was made from the investor's point of view and his opportunity to get the necessary information about the company.

Conflicts of Legitimacies within the European Union - abstract In the beginning of first part, the thesis focuses on the very concept of legitimacy. The point of reference is rather a sociological conception of legitimacy. Then, the critical overview of theoretical contributions to the topic of EU's legitimacy deficit is provided. On this analytical background it is held that the democratic legitimacy is indispensable for the Union and that there is a necessity of its creating even on union-wide (transnational) level. Subsequently, in the second part dealing with particular modalities of legitimacy within the EU, the thesis makes use of the conteporary democratic theory focusing on the concept and functioning of democratic representation. The framework for the second part is a spatio-mechanical metaphor of four modalities ("vectors") of legitimacy (legitimation) formulated previously in the literature. It consists of indirect legitimacy, parliamentary legitimacy, technocratic legitimacy and procedural legitimacy. Changes in their balance after the Lisbon Treaty are discussed. The chapter on indirect legitimacy focuses on theoretical questions and then looks into the institutional and legislative development. Data protection in the EU - Biometric data The main aim of this thesis is to deal with the data protection in connection with the biometric data. In the first chapter, the author of this work deals with the historical context. The right to privacy even nowadays represents the solid ground of the data protection. Therefore, its de- limitation and subsequent connection with the data privacy is of an upmost importance for a proper understanding of this problematics. The author also deals with the data protection not only in the european context, but also with the disunited legislation in the US, where a legisla- tion in the context of general data protection regulation is absent. The second chapter mainly dealt with stating the general legal principles and their rel- evance to the legal order as well as with the special principles laid down in the regulation, which are mandatory to be upheld. The third chapter dealt with the term of personal data. Moreover, it was also important to define the other terms, which goes hand in hand with the personal data term. This thesis analyses in depth the seminal cases of the Court of Justice, namely C-341/05 Laval, C-438/05 Viking Line and C-346/06 Ruffert. The analysis starts with description of the decisions. Those are laid out both from the perspectives of the Advocates General and of the Court of Justice (chapter 2). Central aspects of the decisions are analysed in chapter 3. First, it is the decision to apply Community law (now EU law) to national social policy. This is not new in itself, but it is taken to unusual depth. Second, the Court of Justice decided to apply Community law to trade unions. This horizontal application of Community law has crucial implications on the human rights discourse of the Court. Third, we analyse how the Court viewed the issue whether the strike action violated the Treaty, and the issues of justification and proportionality. Chapter 4 focuses on human rights aspect of the decisions. The very use of human rights in Community law is briefly sketched. In more detail the implications of the likely accession of the European Union to the European Convention on Human rights are considered.
