Ambos os romances desenvolvem narrativas durante o período pós-independência e pretende-se observar o processo de formação da identidade neste contexto. Para isso focaremos como as personagens Félix Ventura d‟O vendedor de passados e Silvestre Vitalício, d‟Antes de nascer o mundo, intentam criar novas identidades através do apagamento/ esquecimento da memória. A estratégia adota pelas personagens refletem o momento atual que estes países enfrentam de total descaso com a memória histórica, optando pelo esquecimento ao invés de enfrentar os traumas do passado, revelando, dessa maneira, a crítica presente nas obras. No entanto, esta tentativa de recomeçar uma vida livre do passado torna-se impossível, visto que as memórias sempre retornam. Além disso, percebe-se que o passado histórico faz parte da construção da identidade, desta forma os autores utilizam a metaficcionalização da história como recurso para recontar a história de seus países, possibilitando que estas não sejam esquecidas. Observa-se, também, como o lugar, o home contribui na formação da identidade e do sentimento de pertencimento ao espaço que as personagens ocupam, não apenas no aspecto físico, mas, sobretudo, emocionalmente. Este trabalho tenta mostrar como a literatura produzida por Angola e Moçambique, nesse contexto pós-colonial, exerce o papel de ferramenta na construção da nação e como os autores se propõem neste processo de construção de uma nação soberana. / The aim of this study is to investigate the literary text of two African contemporary authors: the novel O Vendedor de passados (2004), of the Angolan writer José Eduardo Agualusa and Antes de nascer o mundo (2009), of the Mozambican writer Mia Couto. Both novels develop narratives during the post-independence period and intent to observe the process of identity formation in this context. Therefore, we will concentrate how the characters Félix Ventura, of O Vendedor de passados and Silvestre Vitalício, of Antes de nascer o mundo, attempt to create a new identity through the memory extinguishment/oblivion. The strategy adopts for the characters they reflect the current moment what these countries face of total disregard with the historical memory, opting for the oblivion instead of confronting the traumas of the past, revealing, in this way, the present criticism in the works. However, this attempt of recommencing a life without past makes impossible, seeing that the memories always bring back.Besides, it is realized that the historical past makes part of the construction of the identity, in this way the authors use the history metafictionalization like resource to recount the history of his countries, making possible that these are not forgotten. Also, observe how the place, the home contributes in the formation of the identity and of the feeling of belonging to the space that the characters occupy, not only, in the physical aspect, but, especially, emotionally. This work tries to show how the literature produced by Angola and Mozambique, in this post-colonial context, plays the part of tool in the construction of the nation and since the authors intend in this process of construction of a sovereign nation.

Le règlement préventif dans l'espace OHADA / The preventive rule in OHADA framework

L'espace OHADA bénéficie depuis 13 ans d'un Acte Uniforme portant organisation des procédures collectives, qui détermine le régime juridique d'une nouvelle procédure collective appelée le règlement préventif. Le règlement préventif est une procédure destinée à éviter la cessation des paiements. Il permet l'apurement du passif de l'entreprise au moyen d'un concordat préventif. Il est inspiré de la procédure de suspension des poursuites instituée par la loi française du 23 septembre 1967 que certains Etats africains avaient repris dans leurs législations sans modification et le règlement amiable de la loi française du 1er mars 1984. La présence de cette procédure quoique salutaire n'a malheureusement pas résolu le problème des difficultés des entreprises. La demande est souvent effectuée lorsque l'entreprise a dépassé le "seuil clinique" d'ouverture de la procédure. Les dispositions de l'article8 de l'AUPOCPAP en permettant la suspension immédiate des poursuites, favorise l'utilisation du règlement préventif à titre dilatoire. Raison pour laquelle, il devient urgent d'analyser son déroulement et son dénouement. L'étude fait ressortir que les conditions d'ouverture de cette procédure doivent être étendues afin de permettre aux agriculteurs, artisans, professionnels indépendants et secteur informel d'en bénéficier. / For 13 years, the OHADA legal framework has taken advantage of a "Acte Uniforme" ruling their common procedures. The latter sets up and determines the legal system of a new cammon procedure called the Preventive Rule. It aims at avoiding the suspension of payments. In addition, it allows the discharge thanks to a preventive composition. The new common system is inspired by the french law of the 23rd of september 1967 on the suspension of legal proceedings that some African countries had copied and put in their legislations,without changing anything. And it is also inspired by the French law of the 1st of march 1984 on the amical settlement. However, the preventive rule, althougt beneficial,has not resolved the enterprises issues, hence the necessity to analyse its unfoldind and its outcome. At the end, the conditions to open and to use the new procedure have to lie down to farmers, craftsmen, professionnal persons and to those of the informal sectors in order to allow them to also take advantage of it.

La stipulation des clauses de force majeure dans les contrats internes et internationaux de longue durée procède de la liberté contractuelle et doit sa raison d'être dans la répulsivité des normes supplétives d'allocation des risques. La reconnaissance de leur licéité reste incertaine en raison des difficultés d'identification de leur technique et de leur nature juridique que la doctrine assimile à la quadrature du cercle en géométrie.Compte tenu de l'impact de l'aléa sur l'existence de l'objet et la valeur de l'obligation de garantie qui constitue l'essence des clauses de force majeure, une summa divisio peut être fondamentalement esquissée entre les clauses d'appréciation et d'attribution des risques de force majeure. Les unes sont assujetties à un aléa juridique et relèvent du régime des actes juridiques aléatoires. Les autres sont affectées par un aléa économique et procèdent du régime des actes juridiques commutatifs même si la jurisprudence les rattache indûment au régime des clauses de responsabilité.De lege ferenda, la rationalisation du régime des clauses de force majeure nécessite la codification du raisonnable en tant que principe directeur du droit interne des contrats afin d'entreprendre leur summa divisio en soumettant distributivement les clauses d'appréciation des risques au test qualitatif du raisonnable de conformité et les clauses d'attribution des risques au test quantitatif du raisonnable de modulation / The statement of force majeure provisions in long-term internal and international contracts is based on the ground of the freedom of contract and promoted by the inefficiency of suppletive risk allocation norms in modern legal systems. The recognition of their enforceability still subject to uncertainty due to the misunderstanding of their drafting and their judicial construction that is commonly said to amount to squaring the circle. Base on the influence of the uncertainty conditioning the subject-matter and the value of the obligation to guarantee underlying force majeure clauses, a fundamental summa divisio is drawn up between risk assessment and risk attribution agreements. The first clauses are subject to the uncertainty of a legal nature and should follow the random legal acts framework. The second are affected by the uncertainty of economic nature and should depend to the commutative legal acts framework even though force majeure clauses are unduly treated in case law as exclusion clauses. De lege ferenda, the force majeure clauses regime is expected to be rationalized with the integration of the reasonable reasoning as a fundamental guiding principal of French contract law so that to implement the summa divisio of force majeure agreements by adjusting distributively the risk assessment clauses unreason through the reasonable compliance test and the risk attribution clauses abuses through the reasonable modulation test
