Diploma thesis named Steam turbine in the combi cycle deals with design of low pressure part of three-body turbine and it’s lateral outlet throat to the air condenser. Before the design itself, the thermal schema of entire turbine is calculated. Than follows the detail draft, the strength calculations are included as well. Turbine has any technological consumption of steam or any regenerativ consumption. Turbine will be suplly to Panama. The thesis includes following drawings: cut of flowing part, design of outlet throat and fixing of inner body in outer body of low pressure part. The diploma thesis is created for Doosan Škoda Power company.

This diploma work discusses frame safety and structural requirements and also requirements on mounting of engine, single axles, rear-axle differential, engine intake and exhaust system, fuel tank, control elements, and so on. In the final parts of this diploma work analysis of maximum state of stress in material of on-load frame is made and total frame torsional rigidity is calculated. Total frame torsional rigidity is compared with those of Formula Ford and with other variants of Formula Student.

L’association symbiotique entre les légumineuses et les rhizobia aboutit à la formation de la nodosité fixatrice d’azote. Cet organe symbiotique généré de-novo permet l’hébergement intracellulaire des rhizobia qui, grâce à leurs activités nitrogénase,réduisent l’azote atmosphérique en ammonium, une forme de l’azote directement assimilable par la plante hôte.Les mécanismes moléculaires sous-jacents à la reconnaissance entre les deux partenaires symbiotiques, au processus d’infection et à l’organogénèse de la nodosité sont bien décrits, cependantl’établissement et la maintenance de l’identité de cet unique organe souterrain restent incompris.Les gènes NODULE-ROOT de Medicago truncatula, BLADEON-PETIOLE d’Arabidopsis thaliana et COCHLEATA de Pisumsativum sont membres du clade spécifique très conservé NOOTBOP-COCH-LIKE1 (NBCL1) qui fait partie de la famille des gènesNON-EXPRESSOR OF PATHOGENESIS RELATED PROTEIN1-LIKE. Chez les légumineuses, les membres de ce clade NBCL1 sont connus comme étant des régulateurs clés de l’identité de l’organe symbiotique.Mon travail de thèse a eu pour but d’améliorer la compréhension des rôles des gènes NBCL1, à la fois chez des espèces formant des nodosités indéterminées et déterminées, ainsi que de découvrir de nouveaux acteurs moléculaires impliqués dans l’identité de la nodosité dont la régulation est dépendante des gènesNBCL1, essentiellement par l’utilisation de mutants TILLING, Tnt1et LORE1 originaux chez trois espèces de légumineuses: la luzerne tronquée, le petit pois et le lotier.Ce travail rapporte essentiellement l’identification et la caractérisation de nouveaux mutants affectés dans des gènes qui font partie d’un second sous-clade NBCL2 spécifique des légumineuses.Nous avons révélé que les membres de ce sous-clade spécifique des légumineuses NBCL2 jouent d’importants rôles dans le développement de la nodosité, dans l’établissement et la maintenance de l’identité de la nodosité et par conséquence dans le succès et l’efficacité de l’association symbiotique.Ce travail suggère aussi qu’au cours de l’évolution, le programme de développement de la nodosité a recruté des mécanismes de régulations préexistants afin de réguler le développement de la nodosité et son identité, tel que le module de régulation impliquant des interactions entre des protéines NBCL et des facteurs de transcriptions basic leucine zipper de type TGACG. Nous avons identifié le facteur de transcription MtPERIANTHIA-LIKE, comme un premier partenaire protéique interagissant avec des protéines NBLC dans un contexte de nodosité symbiotique. Les gènes NBCL sont aussi impliqués dans les réseaux de régulations qui contrôlent le développement et le déterminisme de nombreux organes végétatifs et reproductifs aériens et sont également impliqués dans la capacité d’abscission de ces organes.Finalement, ce travail thèse a eu pour objectif d’explorer les rôles de ces gènes NBCL très conservés, dans le développement de la graminée non-domestiquée, Brachypodium distachyon. / The symbiotic interaction between legumes andrhizobia results in the formation of a symbiotic nitrogen fixingnodule.This de-novo generated symbiotic organ allows the intracellularaccommodation of the rhizobia which reduces through theirnitrogenase activity the atmospheric nitrogen in ammonium, anitrogen form usable by the host plant.The molecular mechanisms underlying the symbiotic partnersrecognition, the infection process and the nodule organogenesis arewell described, however the identity establishment and maintenanceof this unique underground organ remain mis-understood.The Medicago truncatula NODULE-ROOT, the Arabidopsisthaliana BLADE-ON-PETIOLE and the Pisum sativumCOCHLEATA genes are members of a highly conserved NOOTBOP-COCH-LIKE1 (NBCL1) specific clade that belongs to theNON-EXPRESSOR OF PATHOGENESIS RELATED PROTEIN1-LIKE gene family. In legumes, the members of this NBCL1 cladeare known as key regulators of the symbiotic nodule identity.The present thesis work aims to better understand the roles of theNBCL1 genes, in both indeterminate and determinate nodule formingspecies and to discover new molecular actors involved in theNBCL1-dependent regulation of the nodule identity essentially usingnovel TILLING, Tnt1 and LORE1 insertional mutants in three legumespecies, Medicago, Pisum and Lotus.This thesis work has allowed the identification and thecharacterization of new mutants for genes belonging to a secondarylegume-specific NBCL2 sub-clade. We revealed that the members ofthis legume-specific NBCL2 sub-clade play important roles in noduledevelopment, identity establishment and maintenance, andconsequently in the success and in the efficiency of the symbioticassociation.This thesis work also shows that during evolution, the noduledevelopmental program has recruited pre-existing regulatorymechanisms for the nodule development and identity, such as theregulatory module involving interactions between NBCL proteins andTGACG type basic leucine zipper transcription factors. We identifiedthe transcription factor, MtPERIANTHIA-LIKE, as a first interactingpartner of NBCL proteins in a context of root nodule symbiosis.NBCL genes are also involved in the regulatory networks thatcontrol the development and the determinacy of many abovegroundvegetative and reproductive organs and were also shown as involvedin their abscission ability.In this thesis we also explored the roles of these highly conservedNBCL genes in the development of the non-domesticated grass,Brachypodium distachyon.

Use of plant growth promoting endophytic bacteria to alleviate the effects of individual and combined abiotic stresses on plants as an innovative approach to discover new delivery strategies for bacterial bio-stimulants

Bacterial endophytes are the organisms that live inside the plant for a full or a part of their life cycle. Endophytic bacteria have captured the interest of agriculture industry due to their plant beneficial properties, such as synthesis of phytohormones, solubilization of soil nutrients, and alleviation of biotic and abiotic stresses. Several studies have reported that stress tolerant endophytic bacteria can work with a similar performance as non-stressed conditions when inoculated to the plants under stressed conditions. Combination of abiotic stresses such as salinity, drought and low nitrogen stress can have additive or agonistic effects on bacterial and plant growth, and their interactions. However, very few studies have reported the impact of combined stress on endophytic bacterial assisted plant growth promotion. Therefore, understanding the underlying mechanisms of endophytic bacterial assisted plant’s tolerance abiotic stresses may provide the means of better exploiting the beneficial abilities of endophytic bacteria in agricultural production. Thus, the aim of this thesis was to study the stress tolerance mechanisms, beneficial characteristics, and plant growth promotion characteristics of endophytic bacteria under individual and combined abiotic stresses. Transcriptome analysis of endophytic bacteria revealed that tolerance mechanisms to deal with one kind of stress is different than concurrent stresses. Salinity and drought stress largely modulated the genes involved in flagellar assembly and membrane transport, showing reduced motility under stress conditions to preserve the energy. Additionally, bacterial endophyte that can fix nitrogen was studied with maize plant growth promotion under drought and low nitrogen stress conditions. The results suggested that diazotrophic bacterial endophyte can promote plant growth under moderate individual and combined stress conditions. Plant growth promoting endophytic bacteria can be utilized as an efficient tool to increase crop production under individual and concurrent abiotic stresses.

A construção civil é o maior consumidor de recursos naturais do planeta, apropriando-se atualmente de mais da metade da massa total dos materiais extraídos. Neste contexto, o desenvolvimento de sistemas construtivos que proporcionem uma redução do consumo de materiais, conhecida como o princípio da desmaterialização dos edifícios, pode ser uma estratégia para a redução do impacto que a construção civil exerce sobre o ambiente, e um passo em direção a uma economia mais sustentável. A utilização de placas cimentícias para a produção de vedações vem crescendo em várias partes do mundo, seja para a produção de vedações verticais externas, seja como revestimento não aderido sobre vedos existentes, destinados tanto a melhoria estética quanto o desempenho destas fachadas. Uma vedação com placas cimentícias possui em torno de 25% da massa de uma alvenaria tradicional constituída por blocos de concreto para a execução de uma mesma área de vedação vertical, o que pode contribuir ainda para uma redução dos materiais empregados nas estruturas e fundações de um edifício. Apesar da utilização destas placas cimentícias estar coerente com a estratégia da desmaterialização, algumas experiências de vedações executadas com estes componentes manifestaram problemas de manutenção de suas características ao longo do tempo, apresentando fissuras geralmente nas juntas entre placas. Verificando-se as propriedades dos materiais que constituem esta placa cimentícia, principalmente a variação dimensional em relação à temperatura e umidade, constatou-se uma incompatibilidade entre a amplitude das variações dimensionais resultantes e os sistemas de fixação e juntas empregados para a sustentação das mesmas. A avaliação experimental de choque térmico comprovou a influência destas variações para a deterioração das juntas entre as placas. Com base nesta constatação, e em análises dos processos de fixação de placas cimentícias adotados por fornecedores em diversas partes do mundo, foi desenvolvido neste trabalho um novo sistema de fixação para placas cimentícias e de juntas entre estas com capacidade de atender a esta variação dimensional. Realizaram-se protótipos destes componentes os quais foram submetidos a uma avaliação experimental de choque térmico, resultando em nenhuma alteração visível nas juntas e nas superfícies destas placas. Como resultado concluiu-se que a criação de mecanismos que possibilitem acomodação às variações dimensionais, tanto nos dispositivos de fixação destas à estrutura, quanto nos acabamentos das juntas, podem contribuir significativamente para a durabilidade do sistema de vedações constituída por placas cimentícias. / The construction industry is the largest consumer of natural resources in the planet, currently appropriating more than half of mass of the total material extracted. In this context, the development of building systems that provide their dematerialization can be considered as a strategy to reduce the environmental construction impact, and a step toward a more sustainable economy. The use of fiber cement boards for the building production is growing in many parts of the world, to produce external vertical building enclosure or building envelopes, to improving the aesthetics and performance of these facades. A fiber cement board walls weigh around 25% of the traditional masonry mass made of concrete blocks for the same area of vertical building enclosure which can further contribute to a reduction of the materials used in building structures and foundations. Although the use of fiber cement boards complies with the dematerialization strategy, some experiments carried out with these cladding showed maintenance problems over time, usually cracks in the joints between panels. Checking the properties of materials constituting fiber cement boards, especially the dimensional variation due to changing temperature and humidity, there was an incompatibility between these dimensional variations amplitude and fixing systems and joints used to support them. The thermal shock experimental evaluation proved the influence of these variations on joints deterioration. Based on this observation, and on analyzes of the fiber cement suppliers recommendations over the world, a new system for fixing fiber cement board and joints between them was developed in this work with capacity to adapt to this dimensional variation. Prototypes of these components were made and submitted the thermal shock evaluation, resulting in no visible changes in the joints and on the surfaces of these panels. As a result, it was concluded that the creation of mechanisms that allow accommodating the dimensional variations, both in fixing these panels to the structure, and in the joints finishing can significantly contribute to the vertical building enclosure system durability.

Embora os direitos de Propriedade Intelectual (PI) sejam supostamente instituídos de forma a fomentar a inovação e o bem-estar em longo prazo, seu uso pode ensejar comportamentos oportunistas e abusivos como os Artigos 8.2 e 40 do TRIPS expressamente admitem. Sempre que tal tipo de comportamento afetar a concorrência em determinado mercado excluindo concorrentes, impondo barreiras à entrada, prejudicando consumidores por meio de aumento de preços ou redução da oferta o Direito de Concorrência será chamado a intervir. Considerando tais questões, o objetivo desse trabalho é identificar um quadro de trabalho brasileiro para tratar de questões envolvendo questões de Direito de Concorrência relacionadas à Propriedade Intelectual. O autor buscou delinear os conceitos de uso abusivo de direitos de Propriedade Intelectual, Dominação de Mercado por meio de uso da Propriedade Intelectual e de abuso de posição dominante, considerando o novo quadro regulatório introduzido pela Lei 12.259/2001. / While intellectual property (IP) rights are usually claimed to be designed to foster innovation and welfare in the long run, their use may give rise to opportunistic, abusive behavior - as Articles 8.2 and 40 of TRIPS openly admit. Whenever such sort of behavior affects competition in a given market - whether by dislodging competitors, imposing barriers to entry, harming costumers, raising prices or reducing output - competition law is called to intervene. Considering these issues, the purpose of this paper is to identify a Brazilian legal framework for dealing with IP related competition issues. The author sought to draw the legal concepts of abusive of IP rights, market domination and abuse of dominant position considering the new regulatory framework introduced by Law 12.259/2011.

專利聯盟(patent pools)可以創造龐大的促進競爭效益,但是同時也可能產生妨礙競爭與創新之疑慮,若法律完全不對專利聯盟之運作進行規範,專利權人將得以利用專利聯盟制度作為提昇自己市場獨占力量,抑制市場競爭,甚至是濫用專利排他權的工具。為了畫下專利權人正當行使權利之界限,維護專利制度的政策目的,以規範專利聯盟所產生之專利權濫用問題,美國的法制上遂逐漸發展出以專利權濫用原則(patent misuse doctrine)與競爭法(即美國之反托拉斯法),對專利聯盟進行管制的結構。美國法上之專利權濫用原則創設之初係為了限制輔助侵權理論之適用,此理論最初與競爭法制並無交集,判斷的重點在於專利權人是否逾越其權限,之後隨著1988年美國專利法之修正,以及學理實務的改變,現今專利權濫用原則的認定已牽涉競爭法「合理原則」之判斷,然而,許多爭議也逐漸浮現,例如應如何判斷專利權人在專利聯盟中所為之限制競爭行為是否成立濫用,專利權濫用原則與競爭法之間之關係為何,甚至專利權濫用原則本身是否仍有必要存在,這些問題都尚待解決,因此現今正是對專利權濫用理論進行全面檢討之時機。 本文以下將針對專利聯盟所涉及之專利權濫用問題進行研究,對於實務上專利權人利用專利聯盟所進行之搭售、包裹授權、聯合訂價、競業禁止條款等行為進行觀察,並對其所涉及之專利權濫用問題進行初步分析。基於此一研究所獲得之基礎,本文將嘗試指出專利權濫用理論值得檢討之處,並指出專利權濫用理論兼具專利制度和競爭法制之特質,也反映了兩者間之衝突,其亦具有能夠與時俱進,以及反映專利制度政策公益之特質,因此仍有繼續存在價值。尤其係在專利聯盟成員利用彼此間競業禁止協議抑制新生替代性技術發展之情形,法院在適用競爭法合理原則時,往往因為專利聯盟所創造的促進競爭效益,以及新生技術未來發展的不確定性,而傾向認定此種契約條款為合法,忽略其所產生之抑制創新問題,此時即有適用專利權濫用原則之空間。此外,更可以考慮以我國民法第148條所規範之誠信原則與權利濫用原則作為將專利權濫用理論引入我國法之基礎,而在尚未引入以前,對於專利聯盟所涉及之專利權濫用問題,我國實務可以將美國法專利權濫用原則之理論基礎作為操作民法第148條、專利法第60條、公平交易法第18條及第19條以及其他相關規定時之指導原則。本文之意旨並非在完全以專利權濫用原則取代競爭法規範的角色,而係期待實務上應當設法對專利權濫用原則之價值進行重新評估,以賦予專利權濫用原則嶄新之生命,讓專利權濫用原則與競爭法共同形成一個完善、合理的專利權行使規範體系。 / Patent pool licensing can both create enormous pro-competitive and anti-competitive effects. Without legal intervention, the patentee would be able to manipulate the patent pool system as a mean to increase his own monopoly power, suppress competition in the market, and even misuse his patent exclusive power. In order to prevent the misuse of patent rights, protect patent policy and regulate patent misuse issues in patent pools, the U.S law system employs the “patent misuse doctrine” and competition law (antitrust law) to deal with the above issues. The patent misuse doctrine was initially designed to limit the overexpansion of the contributory infringement theory and has no relationship with competition law. The essential factor to constitute patent misuse is that the patentee extends the patent monopoly over the statutory scope of his patent right. Nevertheless, in pace with the Patent Misuse Reform Act of 1988 and the conversion of the legal practice, the patent misuse doctrine has begun to intertwine with competition law’s “rule of reason” analysis. Gradually, many disputes have emerged, such as how to determine whether the patentee’s conduct constitutes patent misuse in patent pools, what is the relationship between the patent misuse doctrine and competition law, and whether the patent misuse doctrine itself is necessary to exist. Therefore, it is high time to conduct a comprehensive review of the patent misuse theory. This article will provide insights to patent misuse issues in patent pool licensing, such as tie-in arrangement, package licensing, price fixing, non-competition agreements, etc, and review the theoretical basis of the patent misuse doctrine. This article will also submit that the patent misuse doctrine is a doctrine which has both the characteristics of patent law and competition law and can compromise the interests of these two areas of regulations. It can also reflect patent policy and grow and change with time. Therefore, it is a doctrine which should continue to exist. Particularly, in the situation which patent pool members use non-competition agreements to suppress the development of nascent substitute technologies, courts would often consider this kind of agreement to be legal because of the enormous pro-competitive effects created by the patent pool and the uncertainty of the future development of the nascent technology. At this moment, it is necessary to apply the patent misuse doctrine to deal with the problem. In addition, the principle of good faith which is encoded in article 148 of the civil code may be an appropriate medium to introduce the patent misuse doctrine into our legal system. Even if it is not yet introduced into our system, the patent misuse doctrine could be the guiding principle for our legal practitioners to apply article 148 of the civil code, article 60 of the patent act, article 18 and article 19 of the Fair Trade Act in order to deal with patent misuse issues in patent pool licensing. This article supports that the patent misuse doctrine should be refined and cooperate with competition law in order to form a complete regulation of patent misuse conducts, but it does not submit that current competition law should be entirely replaced by the patent misuse doctrine.

Embora os direitos de Propriedade Intelectual (PI) sejam supostamente instituídos de forma a fomentar a inovação e o bem-estar em longo prazo, seu uso pode ensejar comportamentos oportunistas e abusivos como os Artigos 8.2 e 40 do TRIPS expressamente admitem. Sempre que tal tipo de comportamento afetar a concorrência em determinado mercado excluindo concorrentes, impondo barreiras à entrada, prejudicando consumidores por meio de aumento de preços ou redução da oferta o Direito de Concorrência será chamado a intervir. Considerando tais questões, o objetivo desse trabalho é identificar um quadro de trabalho brasileiro para tratar de questões envolvendo questões de Direito de Concorrência relacionadas à Propriedade Intelectual. O autor buscou delinear os conceitos de uso abusivo de direitos de Propriedade Intelectual, Dominação de Mercado por meio de uso da Propriedade Intelectual e de abuso de posição dominante, considerando o novo quadro regulatório introduzido pela Lei 12.259/2001. / While intellectual property (IP) rights are usually claimed to be designed to foster innovation and welfare in the long run, their use may give rise to opportunistic, abusive behavior - as Articles 8.2 and 40 of TRIPS openly admit. Whenever such sort of behavior affects competition in a given market - whether by dislodging competitors, imposing barriers to entry, harming costumers, raising prices or reducing output - competition law is called to intervene. Considering these issues, the purpose of this paper is to identify a Brazilian legal framework for dealing with IP related competition issues. The author sought to draw the legal concepts of abusive of IP rights, market domination and abuse of dominant position considering the new regulatory framework introduced by Law 12.259/2011.

The effects of fertilization with bio-digester slurry and the inclusion of carbohydrate additives at ensiling on the nutritive value of Napier grass (pennisetum purpureum) silage

MSCAGR (Animal Science) / Department of Animal Science / The objective of the study was to determine the effects of fertilisation with bio-digester slurry and the inclusion of carbohydrate additives at ensiling on the fermentation characteristics, chemical composition, ruminal degradability, and in vitro digestibility of Napier grass silage. Napier grass planted at the School of Agriculture Experimental Farm, University of Venda in 5 m x 4 m plots replicated three times in a completely randomised design and was irrigated with either biodigester slurry or no bio-digester slurry (tap water) for a period of 12 weeks. After 12 weeks, the Napier was freshly cut and ensiled for 90 days in 1 litre glass jars in a 2 (Control - tap water and slurry irrigation) x 4 (No additive, molasses, maize meal and brown sugar) factorial arrangement. Fermentation quality and nutritive composition were determined using standard protocols. The dry matter (DM) and crude protein (CP) ruminal degradability was determined in sacco by incubating feed samples in nylon bags (external dimension: 6 × 12 cm, pore size of 46 μm) in the rumen in three Bonsmara steers fitted with rumen cannulae for 0, 6, 12, 24, 48, 72, 96 and 120 hours (h). Parameters to describe the dynamics of ruminal degradability of DM and CP were obtained by fitting the data on the exponential equation P = a + b (1 - e-ct) using the NEWAY computer program, where “a” is the rapidly degradable fraction, “b” is the slowly degradable fraction and “c” is the outflow rate. The in vitro DM and CP degradability of rumen undegradable residue collected after 12, 24 and 48 h incubation was determined by sequential digestion in pepsin (abomasal) and pancreatin (small intestine) solutions. Fertilisation with bio-digester slurry increased (P <0.05) CP content of fresh cut Napier grass pre-ensilage. Bio-digester slurry fertilisation with molasses inclusion improved (P <0.05) the silage DM content which improved (P >0.05) fermentation characteristics with pH of 4.2 and lowest NH3-N of 13.3 g/kg. Other chemical compositions and fermentation characteristics were not affected (P >0.05) due to fertilisation x additives treatment combinations. No bio-digester slurry fertilisation with maize meal inclusion increased (P <0.01) DM degradability at 0 h incubation. As time progressed to 24 h, no biodigester slurry fertilisation with no additive included reduced (P <0.01) DM degradability with no difference (P >0.05) on other treatments. Potential DM degradability (a + b) of no bio-digester slurry fertilisation with no additive inclusion silage was reduced (P <0.01). The reduction was associated with low levels (P <0.01) of slowly degradable fraction “b”. In vitro DM and CP digestibility were not affected (P >0.05) due to fertilisation x additives treatment combinations. In conclusion, bio-digester slurry application improved the quality of fresh cut Napier grass, with the combination of bio-digester slurry fertilisation and molasses addition yielding the best silage quality.
